Trump instructing the Department of Justice to halt enforcement of the decades old, much-dreaded Foreign Corrupt Practices Act (FCPA) pending a one-year review. In our initial “Regulatory Ramblings Spotlight” segment, we speak with Philip Rohlik, an American attorney in mainland China with the law firm Debevoise & Plimpton to get a sense of what the president's decision means for Hong Kong and the broader Asia-Pacific. Following that, we have a lengthier chat on the global implications of President's Trump's move with Tom Fox, a veteran compliance and anti-corruption lawyer, noted FCPA specialist and podcaster, as well as Malcolm Nance, a former US naval intelligence officer, counterterrorism specialist and author. About the guests. Philip Rohlik is a counsel in the Shanghai office of Debevoise & Plimpton LLP. Happy Holidays from the Great Women in Compliance podcast. For the last episode of 2024, we wanted to share insights and some holiday cheer. We all share some of our thoughts about the trends and developments in 2024, and of course, there is a focus on AI. Sarah brings some news about CCI and their next phase, and Ellen reiterates her ongoing commitment to organizational justice. We also shared some thoughts about 2025, and Lisa raised the challenges that global organizations will face with the various – and sometimes contradictory – regulations and laws from different countries. The group shares some of our favorite GWIC moments of the year. We also answered some pressing questions for the holiday season, including when to start playing holiday music and decorating; spoiler alert, there needed to be more consistency. Over the past few months, the Department of Justice put forth the Whistleblower Pilot Program, and the update to the Evaluation of Corporate Compliance Programs. It was the perfect time to focus on how these impact whistleblower laws. Jane Norberg, who is a partner at Arnold & Porter and the former Chief of the Office of the Whistleblower and Mary Inman, who is a founding partner of Whistleblower Partners. Mary is also an advocate for the power of whistleblowers and is known for representing Facebook Files whistleblower Frances Haugen and Theranos whistleblower Tyler Shultz. They provide insight into what makes a credible and legitimate whistleblower, how the SEC reviews tips from whistleblowers and what we as compliance professionals can do to build effective programs. All focused on the review of all concerns that are raised, regardless of the source. They provide some thoughts about how to handle different situations before, during, and after an investigation, providing practical advice. The group discusses the new DOJ Whistleblower Pilot program and where it follows the past programs like the SEC program and where it is filling new gaps. One part of the program includes the 120-day requirement for reporting an issue, and they focused on what that would mean for organizations. Mary and Jane share their views on the requirements and the best practices and reference how most compliance professionals are using the DOJ Evaluation of Corporate Compliance to develop their programs, which means that an issue is investigated. In practical terms, following the ECCP requirement to investigate, and the pilot program has a “race to report,” is a challenge, and this is discussed in depth. Mary and Jane both provided “one thing you should know” to conclude the discussion. Today, she is the Director of Ethics and Compliance at Conagra and was recognized as an Emerging Leader in this year's Diversity MBA Top 100 Under 50. Providing a safe environment for people to raise concerns is a priority for any Ethics & Compliance officer, but what happens when that person learns first-hand that the safe space does not exist? Like many of us, she raised concerns about an individual's expenses. However, her experience was one where she was stonewalled, told to stop investigating, and then suffered from retaliation. During all this, she stood up for what she believed was right, and the lessons she learned made her better understand what a whistleblower goes through. She talks about how she brings that insight and empathy into all her investigations. Lizette hopes that her willingness to “speak out about speaking out” will inspire others to feel comfortable doing the same, and Lizette and Lisa (as well as Hemma, Sarah, and Ellen) all want to support anyone who has or is going through this and to connect you all. Welcome to the Great Women in Compliance Podcast, hosted by Mary Shirley and Lisa Fine. In today's episode, Lisa speaks with Tracy Saale, who is Conduct Risk Management, Managing Director and Corporate Responsibility Officer at Charles Schwab. This is her second career, and while we often hear from attorneys who have gone in-house, or were assigned to compliance, Tracy started out as a prosecutor and then at the U.S. Federal Bureau of Investigations (FBI), where she worked all over the globe, and advised in ethics and compliance during her career there. She discusses the importance of advising law enforcement officials on what is - or is not - permissible, particularly when they are dealing with criminal behavior and security issues. When she started at the FBI, they had approximately 14% women agents, and while that has increased into the 20% range, there is a way to go, so she recounts her experiences. While Tracy was a bit guarded given her experiences with corporate malfeasance, she also was impressed with Charles Schwab, and joined them in part for that. In her in-house career, she is now seeing what so many of us see - that the majority of people are trying to do the right things - a more positive side of corporate life. If CEOs have Larry Fink's Annual Letter to CEOs, then Lisa has Ellen Hunt's "Hunt Report." Ellen is Principal Consultant Advisor at Spark Compliance and is well known as a mentor and advocate to many in the E&C community. Axiom is a company that outsources legal and compliance professionals to client companies to help them with temporary cover – essentially a placements of secondments. Kerry works with Axiom and Mary, who has always been curious about Axiom, took the opportunity to find out what this working arrangement is like. They journey to earlier on in Kerry's career before Compliance as an employment law professional and how that background and skillset lends well to Compliance. Kerry's wheelhouse now is life sciences and she shares particular risks for Compliance Officers working in that industry.
