Please enjoy, and we will be back next week with more insights from the Corruption, Crime, and Compliance podcast. How can companies build trust and drive growth in a region as politically and economically volatile as Latin America? In this episode, Nicolas Garcia - Vice President, Legal, Regional and Compliance Manager for LATAM and Orica - joins Michael Volkov to discuss the complexities of navigating compliance and leadership in LATAM. The conversation highlights how regional dynamics, such as the crisis in Venezuela, influence business operations and how cultural shifts are changing the role of compliance officers. Nicolas provides valuable insights on the evolving compliance landscape, emphasizing the importance of trust, leadership, and a strong compliance culture in driving business success in challenging environments.Listen in as Nicolas and Mike discuss:The ongoing political and economic crisis in Venezuela has led to massive immigration into neighboring countries like Colombia, Chile, and Brazil, creating both economic challenges and opportunities in the region.Guyana is experiencing rapid growth due to foreign investment, particularly in the oil and gas sectors, standing in stark contrast to Venezuela's decline.Nicholas emphasizes the shift from compliance officers being seen as enforcers to becoming strategic business partners. This transition helps companies not only meet regulatory requirements but also drive success.Establishing a trust-based relationship between compliance officers and leadership is essential. When compliance is integrated into the business strategy, it becomes a tool for enabling growth rather than a barrier.Trust in reporting systems is growing in Latin America, though fear of retaliation remains a concern. Innovative approaches for the detection of apple scab disease

The UK Agri-Tech Centre conducted a feasibility study with Kent fruit growers, Rumwood Green, and crop protection advisers, Landseer Ltd., on the project - 'Apple Orchard Health: Evaluating Hyperspectral Imagery for Disease Detection and Biostimulant Efficacy' - with funding from the Department for Environment, Food and Rural Affairs (DEFRA) and UKRI Transforming Food Production Challenge. UK fruit growers are facing a major challenge, exacerbated by the diminishing availability of plant protection products (PPPs) controlling crop disease. The phasing out of traditional PPPs, driven by environmental concerns, has added complexity to this issue. Despite the utilisation of PPPs, UK apple growers experience an annual crop loss of approximately 10-12% due to apple scab, a fungal disease. Without PPPs, this figure would skyrocket to 70-80%. However, there is a promising solution on the horizon by using biostimulants. These are natural substances or micro-organisms that can enhance the natural defences and overall health of the plants when applied to them. One significant challenge of biostimulants is assessing their effectiveness as they operate distinctively from conventional PPPs. Biostimulants serve as preventative measures rather than curative, necessitating timely application before visible disease symptoms emerge. Accurately timing their use is difficult, as the critical phase of scab infection remains invisible to the naked eye. The project aim was to address the challenge of evaluating the effectiveness of biostimulants and timing their usage, by utilising advanced technologies such as hyperspectral cameras and drones. Hyperspectral sensors can capture and analyse a wide range of frequencies of light very finely, which is like being able to accurately identify and measure hundreds of colours outside of what the human eye can see. This provides a detailed and precise characterisation of objects or materials based on the unique way they reflect light, as a spectral fingerprint. By identifying these unique spectral fingerprints for crop diseases, like apple scab, and also determining which can indicate the efficacy of biostimulants, in future, we can develop an affordable camera for growers to be able to detect these fingerprints. This camera will serve as an early warning system, helping prevent disease spread, enhancing crop yield and operational efficiency, and reducing reliance on traditional PPPs. Eliot Dixon, Head of Robotics and AI at the UK Agri-Tech Centre, said, "This was a fast-paced proof of concept project designed to provide evidence for both the efficacy of biostimulant in apple scab control, but also in spectral imaging as a method for detecting apple scab. "For the UK Agri-Tech Centre, this project highlights how our spectral imaging capabilities can be used in product development for both remote sensing and plant protection products. We are very pleased to have successfully shown how lab-based spectral imaging can be successfully transferred to a commercial farm." Michael Parker, Coldstore and Compliance Manager at Rumwood Green Farm Ltd said, "This trial has been very challenging to reproduce results in the field similar to previous in-lab testing of detecting early signs of scab using specific wavelengths. "Despite the challenges, we are a step closer towards early scab detection using the hyperspectral camera. The positive results shown of the biostimulant used will hopefully encourage more growers to use biostimulants as part of their scab control, not only relying on conventional pesticide programs." Stephen Tully, Director at Landseer, said, "With disease control becoming increasingly challenging due to changes in plant protection regulations and unpredictable weather, this project aimed to validate the efficacy of biostimulants to support their routine use and investigate the feasibility of an affordable early detection system for apple scab. "This feasibility study has delivered encouraging results...

While we did not get to hear Sharon's perspective as a Core Team member for the M365 Maturity Model community, we did discuss the maturity model and share some of our own thoughts and experiences. This episode focused on “Leveraging the M365 Maturity Model” to enhance governance, risk, and compliance (GRC) practices. As regulatory environments grow more complex, organizations must evolve from reactive compliance efforts to a proactive approach where GRC is integrated into daily operations and strategic decision-making. We explored how the M365 Maturity Model helps organizations assess their current GRC maturity, identify gaps, and build a more resilient framework that supports both compliance and business growth. We discussed how one size does NOT fit all, and that it is important to tailor your governance framework to fit the unique needs of your organization, ensuring that compliance efforts align with your specific industry requirements and business objectives. From there, organizations can strategically use Microsoft 365 tools like Compliance Manager, Information Protection, and eDiscovery, as well as 3rd party governance solutions to streamline their management efforts and enhance operational efficiency. We also discussed how leadership plays a vital role in driving maturity, fostering a culture where governance is seen as a strategic priority and accountability is embedded at all levels. Finally, we emphasized the need for continuous improvement and adaptation in practices. The M365 Maturity Model serves as a living framework that organizations can use to regularly assess and refine their governance efforts, staying ahead of emerging risks and maintaining compliance in an ever-changing regulatory landscape. And as I mentioned last month, I'd like to once again encourage our viewers to share their own governance war stories and engage with the community within the governance community page at https://www.facebook.com/groups/m365governance.

By Adam Turteltaub More and more organizations seem to be adopting compliance ambassadors or champions programs. In a nutshell, these efforts involve having members of the business unit serve as the eyes and ears, and sometimes arms and legs, of the compliance office. Guillem Casoliva Cabana (LinkedIn), Compliance Manager, Training & Education, at Booking.com shares his insights on the topic in this podcast. The company's ambassadors program began over 10 years ago. Recruiting and training ambassadors is a critical part of the process at Booking.com. They are not nominated by their managers. Instead, all are individuals who volunteered to take on the role. At times, it can even be competitive. If more than one person in a given unit volunteers, there is a vote taken in the unit to make the selection. The onboarding process includes seven distinct steps, including a live session with the compliance and ethics team that goes deep into the scenarios that they may face. Experienced ambassadors serve as mentors to newer ones. And, on an ongoing basis, ambassadors are supported through in-person meetings, an online portal, newsletter and quarterly webinars. The program's durability is a reflection of how successful it has been. The ambassadors have helped support the ethical tone of the company, served as examples of the company's values and proven to be a cost-effective means of embedding compliance without adding to headcount. Listen in to learn more about how the program has worked and what you need to do to start a successful ambassadors effort of your own.

In this episode of the Post-Acute POV, originally featured in the McKnight’s Long-Term Care Expo, Jenny Lee, Regulatory Compliance Manager, and Cassie Diner, BSN, RN, CPHIMS, CSPO, SA, Clinical Product Manager, have a conversation on the major changes coming to MDS and how skilled nursing facilities can prepare. Join Jenny and Cassie as they discuss how the new MDS items may affect your assessment process moving forward, what you should do to help your staff prepare for these changes, and what to look for to ensure your technology vendor is working to ease this transition. Listen to their discussion below. Topics discussed during today’s episode: [01:47 – 07:09]: Cassie greets the audience, introduces the topic, and provides background on her expertise in managing regulatory changes. She then offers seven recommendations for providers as they prepare for the MDS changes going into effect, on October 1, 2023. [07:09 – 12:13]: Next, Cassie elaborates on the main changes: Section G or functional status being removed from standard OBRA forms, the potential for new OSA or state forms, 29 new or modified MDS questions bringing more commonality between post-acute care and the OASIS form used in home health, and more. [12:13 – 18:06]: Cassie describes both a complicated and simple reimbursement change that was made at the state level. Wisconsin’s elaborate PDPM transition and Illinois’ much simpler transition to PDPM. She goes on to discuss the state-level uncertainty and nuance with the OSAs. [18:06 – 22:58]: Cassie and Jenny share what the audience can do now to prepare. Review your assessments or observations completed by nursing and other parts of the interdisciplinary team within your EHR system to see where changes need to be made and eliminate questions or change questions prior to the October 1st deadline to capture necessary data. [22:58 – 28:29]: Next, Cassie describes how organizations should work with their technology vendor as we approach these major changes. Attend your vendor’s advisory council meetings and share your status or any new information to stay on the same page with your vendor. Also, consider participating in complimentary training provided by CMS. [28:29 – 33:47]: Cassie describes the three roles that facilities should focus on as CMS begins to release the requisite documentation: caregiver or nursing staff, dedicated educators, and MDS coordinators. She then shares some key insights and feedback she has gathered within the industry. [33:47 – 38:15]: Cassie closes the discussion by sharing how the coming months will be huge for continued success leading to October as the CMS is expected to release final MDS questions and item sets. It will remain a top priority to stay in the loop with your technology vendor. In this Part 5, I visit with Alexander Cotoia, a Regulatory and Compliance Manager at the Volkov Law Group to consider how recent FCPA enforcement actions point towards the use cases for a robust third-party risk management system.  In 2022, the overwhelming majority of FCPA related enforcement actions involved third parties and required organizations to reprioritize third party risk management. In this episode, we consider case studies involving ABB Limited, GOL Airlines and Oracle which all demonstrated the importance of understanding bribery and corruption schemes, making voluntary disclosures, and reassessing third party risk management. Key Highlights ·      How can organizations reprioritize third-party risk management as a core compliance function?  ·      What strategies can organizations use to avoid FCPA violations and maximize cooperation credit?  ·      How can organizations effectively assess the risks posed by potential business partners?  Notable Quotes  1.     "Don't put yourself in a position of being uncooperative with either the SEC or DOJ. Reassess your framework for third party risk management holistically and hone in on the nature and quality of the information that's being collected to objectively evaluate the totality of risks posed by a potential business partner to the organization." 2.     "You really can't afford to be complacent, especially as we have a new emerging consideration suspecting sanctions and export controls that have become core enforcement priorities of the federal government." 3.     "The critical question asked from a functional perspective is, is it adequate to objectively evaluate the totality of risks posed by a potential business partner to the organization?" 4.     "You have to understand that third party risk, especially as it pertains to anti bribery and corruption concerns, is a universal constant."  Resources Alexander Cotoia on LinkedIn Check out Diligent's 3rd party products and services here.

By Adam Turteltaub Auditing and monitoring is a required element for an effective compliance program, but it also carries with it a host of benefits. In this podcast, Jessenia Cornejo (LinkedIn), Chief Compliance Officer for Bridge Diagnostics and Brittani Summers, Compliance Manager for Sprinter Health, outline all you can get from a robust auditing and monitoring program and how to create one. Benefits of a strong auditing and monitoring program include: Measuring the effectiveness of your compliance program Identifying criminal or malicious conduct Highlighting risk areas Accountability Transparency Continuous improvement (which the government is looking for these days) Greater collaboration with other departments In addition to all these benefits, a strong program in this area can be enormous dividends when a regulator of the Department of Justice comes knocking at your door. When launching an auditing and monitoring initiative they recommend putting a work plan in place. It will enable you to manage the implementation to your goals and objectives. Be sure to include scheduling, they advise. It will help you stay on track. Then share the plan with leadership or the compliance committee. That will help ensure buy in, identify constraints and risks, and help you get any additional resources you may need. They also offer one simple, but important, piece of advice: don't try and do everything all at once. Don't wait until everything is in place before beginning. Instead, focus on the top risks as soon as you can. Likewise, don't try and audit everything all at once. It can be better to tackle one item at a time. Listen in and learn more about how to make your auditing and monitoring program a success.
