Donna Adelson Trial-Defense Opening Statement: ‘Only Theory, No Evidence' -Adelson's Lawyer Fights Back In a powerful counterpunch to the prosecution, Donna Adelson's defense attorney, Jackie Fulford, tells the jury: “You heard a lot about what other people did… but not a single piece of evidence shows Donna planned or intended this. Donna is just a grandmother, not a crime boss. Fulford begins by honoring Dan Markel's legacy—he was “very well respected” and loved by his peers. She asks jurors to remember the human at the center of all the headlines. Then she frames her client: a 64-year-old woman, “kind,” “normal,” and dedicated to keeping her grandchildren connected—even after the family relational rifts. The defense admits the murder was “outrageous in its cruelty,” but draws a red line between motive and proof: motive alone doesn't equal guilt. Fulford pushes back on the “headline‑grabbing” narrative, cautioning that the prosecution's storycast Donna atop a pyramid built on speculation. “Without evidence—only motive and theory—they put her at the top of this pyramid,” Fulford asserts. She brings a poignant, humanizing plea to jurors: “Why would this woman want to take away the father of her grandchildren?” The tone is calm, measured, and rooted in doubt—not emotion. This opening matters because it introduces the trial's central tension: proof vs. portrayal, fact vs. fiction. Whereas the prosecution constructs a drama of conspiracy, Fulford wants to collapse it into questions: Where's the evidence? What ties does Donna actually have to the crime? This segment provides a window into the skepticism the defense expects jurors to bring to the state's case. #DonnaAdelsonTrial #DefenseOpening #ReasonableDoubt #NoEvidence #FamilyMatters #TrueCrimeCourtroom #TrialByJury #LegalDefense #CustodyCase #DonnaIsNotAMastermind Want to comment and watch this podcast as a video? Atop the 9 o'clock hour, we talk to healthy living expert Paul Fulford about "Broken-Heart Syndrome," which actually claims twice as many men as women; Rich and Paul talk about the condition and how to combat it.
Jackie Fulford is one half of Donna Adelson's criminal defense team (along with Miami native Joshua Zellman) defending her against murder charges in the Dan Markel murder-by-hire case. Fulford has quite a few scandals in her past as a former Judge. Fulford seems to suffer from the same sense of entitlement as her accused murderer client. Chad Hughes welcomes Andrew Fulford, Surface Land Manager of Birchcliff Energy, to the show to talk about Birchcliff's unique culture and his thirty-plus-year career. Andrew, who got into the industry by going to Olds College in what was then called the Land Agent Program, got offered his role at Birchcliff twelve years ago, and he reflects on changes in his career and the industry while offering advice to newcomers in the surface land business. Andrew discusses how the always-changing industry offers a lot of opportunity for growth in a career due to the progress and new skill sets required with the shifts. He says it does lead to being a bit of a jack of all trades and includes project management as one of his roles now. One of the things he learned very recently was the role of Indigenous relations when he not only needed to understand the new consultation regulations, but also become immersed in Indigenous history and culture so he could adapt to their way of doing business. Chad and Andrew talk about company culture and what makes Birchcliff so unique and positive. Andrew highlights the relationships frontline people form with communities and the smooth communication they develop. He reflects on how much things have changed in the industry and how the training now would be substantially different than when he first started. His advice to people looking for a career in the industry is to learn about the whole industry, not just land.“... when you first get into the surface land business, if you're passionate about it … I say to people, go to where you will learn the most. Go to those. Look for those places where you will gain the most skills and diverse skills. Don't just focus on one. It may not be the best-paying job that you take off the start, but it's probably the one that's where you're going to learn the most, and it's probably going to take you away from home for longer periods of time. I spent a good part of the first part of my career, you know, behind the wheel of a vehicle and sometimes away from home for 1 to 2 weeks at a time… but I'll tell you what. It paid off in spades towards the latter part of my career. And the skills that I built and the understanding that I had about the business when I did that.” - Andrew FulfordAbout Andrew Fulford:Andrew is the Surface Land Manager for Birchcliff Energy, responsible for surface land access, community and stakeholder engagement, indigenous relations and managing a team of 5 surface professionals. He graduated Olds College in 1986 with a Land Agent diploma and over the next dozen years worked as a consulting landman for several land brokers and a royalty trust company. In the late 90's he moved “in-house” to the role of Senior Surface Landman for PanCanadian Petroleum, a major exploration and production company which later merged with Alberta Energy Corp. to become into EnCana Corporation. Here he managed a one of the surface land teams focused on Coal Bed Methane development in southern Alberta. In 2012 he moved to his present role at Birchcliff Energy Ltd. an intermediate oil and natural gas company based in Calgary with operations focused on the Montney/Doig resources play in north western Alberta. With over 35 years in the land industry, he has been involved with a diverse variety of projects across all 4 western provinces including acquisition of linear right of ways for powerlines, natural gas and telecom, wellsites, gathering systems and gas processing facilities, freehold and crown mineral land projects, stakeholder and indigenous relations and crown surface land disposition acquisitions. He has worked with the Southern Alberta Institute for Technology to help update and develop their Surface Land Management Course which he also taught for a number of years and has also developed and taught short courses for CAPL and CAPLA (now CALEP and LEMAC) over the past 15 years.Additionally, he has volunteered on various industry committee which presently include the CALEP – Field Acquisition Management Committee and the Olds College, Surface Land Management Program - Industry Advisory Committee.---Chad Hughes | CEO, Entrepreneurial Leader, Author: website |linkedinAndrew Fulford |Surface Land Manager, Birchcliff Energy: website | linkedin

Donna Adelson, accused of orchestrating the 2014 murder-for-hire of Florida State University law professor Dan Markel, appeared in court with her new defense team after her trial was delayed by conflict-of-interest issues. The appearance marked her first since a September postponement of the high-profile case. Accompanied by her new attorneys, former Circuit Judge Jackie Fulford and Tallahassee lawyer Josh Zelman, Adelson appeared before Leon Circuit Judge Stephen Everett. Both attorneys assured the court there were no conflicts of interest in their representation. Adelson's previous legal team had been disqualified due to conflicts involving her son Charlie Adelson, who is serving a life sentence for organizing the murder. Fulford and Zelman took over the case in October and have begun addressing the substantial legal hurdles that come with such a transition. Fulford, drawing on her experience as a circuit judge and interim state attorney, expressed confidence in their ability to prepare for the trial despite limited access to discovery materials. “The state attorney's office has agreed to provide us with electronic copies of all deposition transcripts,” Zelman noted. Adelson, who appeared in a purple jail jumpsuit and spoke only to her attorneys, faces charges of first-degree murder, conspiracy, and solicitation. Prosecutors allege she hired hitmen through her son Charlie Adelson to kill Dan Markel during a contentious custody dispute involving her grandchildren. During the hearing, Fulford proposed a trial window between June 16 and July 2, noting that all parties involved, including witnesses, could be available during that time. Judge Everett emphasized the importance of setting a firm trial date, citing the logistical complexities of moving prisoners and ensuring the presence of witnesses. “When that trial date is set, it is going to be firm,” he stated. The court set the next case management conference for February 11, when discovery is expected to be completed and deadlines for trial preparation finalized. Local attorney Don Pumphrey commented on the challenges of picking up a case at this stage, likening it to “painting in the blind.” However, he acknowledged the strengths of the new legal team, describing Fulford as a “strategist” and a strong choice for the defense. The case remains one of significant public interest, with Adelson being one of five individuals arrested in connection with Markel's murder. Her son Charlie Adelson and three others are already serving prison sentences, leaving her as the final defendant to face trial. Judge Everett also addressed any potential conflicts arising from Fulford's prior judicial role presiding over Markel probate matters. After reviewing the matter, he found no issues that would interfere with her representation. The court's focus now shifts to ensuring all materials are handed over and preparations are completed in time for the June trial window, bringing the case closer to resolution after a decade of legal battles and public scrutiny. #DonnaAdelson #DanMarkel #Tallahassee #TrueCrime #MurderTrial Want to listen to ALL of our podcasts AD-FREE? Today we're going to take a look at fresh water systems and specifically, how to decontaminate them through biological methods. Some of you may remember an interview I did with Tom Duncan about his floating wetlands and how they can be used to clean up excessive nutrients and pollutants back in season 1. Today I'll be expanding on that technique since it´s gained a lot of traction and floating islands are popping up all over the world to help deal with contaminated rivers, lakes, and ponds. I'll be sure to put a link to that interview in the show note on the website in case you missed it. For this episode I reached out to Galen Fulford, the managing director at Biomatrix Water, a biological technology company working on solutions for waterway and wastewater treatment based in Moray, Scotland. In this interview, Galen explains the science behind waterway contamination evaluation and the calculations they do to determine the restoration approach and techniques that are appropriate for each site. He also breaks down how their floating wetland systems work and how they compare and differ from traditional wetlands in the way they decontaminate water and provide habitat and sanctuaries for wildlife. We also explore the challenges that installing floating wetlands in urban environments can entail as well as some of the novel solutions in engineering that Biomatrix Water have developed to help their installations withstand events like floods and heavy contamination loads. This is a great episode for people who really want to understand the biology and engineering behind some of the most promising natural waterway remediation techniques being pioneered today. Make sure you listen all the way till the end too when Galen explains how these floating wetland systems are being applied to ecological sewage treatment and municipal water purification.

Host Jo Reed and AudioFile's Alan Minskoff discuss an audiobook where the brilliance of the novel is enhanced by the excellence of the performers. Daniel Mason's novel is expansive, employing a wide array of audiobook narrators. A secluded spot in Massachusetts becomes home to many over a four-hundred-year span. With each tale of shifting inhabitants, the listener is treated to a performance by one of several gifted narrators. It's been four years since this episode came out and I wanted to share it again. As a young officer I remember when this shooting happened and was always amazed at how well Jennifer handled herself and won a gunfight with multiple suspects. Lots of great lessons learned for officers and well as anyone who carry a gun for self defense. Jennifer Fulford was a deputy sheriff back in 2004 when she went to a suspicious incident call. A child on the phone was stating strange men were in the house and on arrival she met up with the female homeowner who was acting strange. It turned out three men were inside committing an armed home invasion. Jennifer got into a gunfight with two of the men and despite being shot multiple times, she was able to take out both suspects. The third suspect gave up. Jennifer went on to have a career in law enforcement and now talks to other officers on how to survive critical events.
