Send us Fan MailThis week on the Montana Outdoor Podcast your host Downrigger Dale talks with a panel of experts to go over the latest fish consumption warnings that were issued by the FWP, Montana DEQ and the Department of Health and Humane services. When that press release about the fish consumption warnings came out back in late April Rigger called his buddy Greg Lemon at the FWP. Greg was able to get a date set when three experts from the Department of Health and Human Services, DEQ and the FWP could all get together and come on the podcast. Rigger and the Captain had received lots of emails from folks that were concerned about consuming the fish that they were catching. After all, the headline of the press release said, “DATA INDICATES FISH CAUGHT IN SOME MONTANA WATERBODIES MAY CONTAIN DETECTABLE LEVELS OF THE MAN-MADE POLLUTANTS KNOWN AS PFAS”. PFAS stands for per- and polyfluoroalkyl substances. What are those? The experts on podcast will explain it way better than we can, all we know is that they are not good for you if you eat a lot of them. As Rigger put it after he had heard that one of the fish mentioned was Walleye; “The headline alone was enough to scare the P-FAS out of me that is for sure! Especially since my health has not been the best lately and I love to eat Walleye!”. That is why he wanted to get the facts directly from the experts. And that is exactly what you will get when you watch or listen to this podcast, especially if you are one of the folks that had heard about it like Rigger and got pretty darn concerned. So here is what we recommend. Welcome to The Turf Zone podcast. This episode features a message for VTC members from the Virginia Department of Environmental Quality. Written by Kati McCall, Water Supply Planner, Office of Water Supply, Virginia Department of Environmental Quality We are reaching out on behalf of DEQ's Water Supply Planning and Analysis team regarding the Virginia Water Withdrawal Reporting Regulation (9VAC25-200).1 This regulation requires users withdrawing groundwater or surface water in Virginia to report annual water withdrawals if withdrawals exceed 1 million gallons per month for crop irrigation purposes or 10,000 gallons per day for all other purposes (300,000 gallons per month). Users that fall below these thresholds or are otherwise exempted from the regulation are encouraged to report voluntarily. Water reporting data provided through the annual reporting process allows DEQ to better understand how water use throughout the Commonwealth impacts surface water and groundwater resources, evaluate whether current water sources can meet future needs, and protect beneficial uses. Water reporting data for 2026 is due to DEQ no later than January 31, 2027. In preparation for the 2026 reporting cycle, our team is conducting an initiative to increase registration of agricultural facilities across the Commonwealth through the distribution of targeted outreach materials. Water reporting data is considered in the development of regional water supply plans2 (required by 9VAC25-7803) and in the water withdrawal permitting process, which includes a simulation of total reported water use within the watershed. Increased availability of water reporting data from agricultural facilities may facilitate more accurate long-term planning of water resources by informing regional water demand projections for agriculture. Additionally, agricultural producers may benefit from reporting annual water withdrawals; a few potential benefits are: Increasing efficiency: comparing current withdrawals to reported withdrawals can provide insight into potential issues at the facility by identifying periods of unusual use (e.g., line breaks, leaks, and other water loss) Drought awareness: users who report withdrawals are notified when the Virginia Drought Monitoring Task Force4 establishes or expands drought advisories affecting their region, and as new drought-related tools developed by DEQ become available Documenting use: reporting annual water withdrawals is the best way to document use for the facility (e.g., when applying for a permit) Planning for the future: calculating and reporting annual water withdrawals may help users to predict and plan for future water needs (e.g., when expanding operations) We are hoping to partner with the Virginia Turfgrass Council, given your extensive network of agricultural producers, to increase awareness of the annual reporting process and potential benefits. In 2023, the DEQ listed sections of the Gallatin River as impaired due to recurring algal blooms. The blooms choke out fish and degrade water quality. State scientists are amid a six-year study trying to understand what's causing the harmful blooms. The state says it will use the results to inform local development regulations and a plan to protect the river.

 Stella-Jones, a Canadian wood products company, recently pleaded guilty to exceeding legal limits of pentachlorophenol in water discharged from its plant near Sheridan, Oregon. The chemical is used to protect wood from insects and fungi and poses a number of health concerns, including an increased risk of cancer.    According to a recent investigation from the journalism nonprofit InvestigateWest, regulators have known about Stella-Jones’s history of pollution for years. On Sep. 8, after InvestigateWest reported on this issue, the Oregon Department of Environmental Quality issued a $1 million civil penalty against Stella-Jones for “numerous violations of environmental regulations” at their wood treating facility.  Kaylee Tornay is a reporter for InvestigateWest. Aspen Ford is a reporter and the Roy W. Howard Fellow at the outlet. They join us with more details on their reporting. On November 21, the Oregon Environmental Quality Commission is scheduled to adopt a carbon rationing scheme known as the Climate Protection Program. The regulation will set a statewide cap on the emissions of human-caused carbon dioxide, and then steadily reduce the cap over time. By 2040, most fossil fuels will be outlawed. The effects of this cap will be swift and painful. Based on experience in Washington and California, the DEQ regulation will increase the cost of gasoline sold in Oregon by at least 25 cents/gallon, and possibly as much as 45 cents. None of this will benefit drivers, and it won't even benefit the environment. Carbon rationing will force fuel suppliers to rely on corn-based ethanol and other agricultural commodities, which will vastly increase the amount of land, water and fertilizer needed to produce automotive fuel. The Climate Protection Program was ordered by former Gov. Kate Brown, who is no longer in office. But elected officials who ARE in office should note that the number one message from voters in the recent election was that they can't afford the rising cost of consumer goods. If state legislative leaders are smart, they will tell DEQ to drop the carbon tax. Elections matter, even in Oregon.

This week the Oregon Department of Environmental Quality (DEQ) is holding its final public hearing on a plan to reduce carbon dioxide emissions by 90% from fossil fuels used in Oregon. Since there is a rough proportionality between fossil fuel combustion and CO2 emissions, that means the DEQ rule is a mandate to reduce the actual use of carbon-based fuels by 90%. This would essentially shut down the Oregon economy.  DEQ's program goes by the Orwellian name of “Climate Protection Program,” but it will have no effects on global climate. Any carbon dioxide reductions occurring in Oregon will be immediately offset by growing emissions elsewhere, which will be true for decades. The primary result of DEQ's rationing scheme will be rising energy prices, and the rapid exodus of people and businesses to other states. DEQ's Climate Protection Program was ordered by former Gov. Kate Brown after she failed to get the program enacted by the state Legislature. It should be repealed by legislators as soon as they convene again in February.

With recent rainfall clearing Virginia's drought-stricken landscape, the Virginia Department of Environmental Quality recently announced that drought advisories have been lifted for 76 counties and cities throughout the commonwealth, including Henrico. Significant drought is now no longer a reality in 8 of the 13 regions that were previously under drought watch or warning, DEQ officials said. However, the drought watch remains in effect for the Shenandoah region. The recent rains have improved streamflow levels across the majority of the state, but groundwater levels remain below normal and require additional rain to recover. For more than 20 years a pair of DEQ hydrologists have been sharing their knowledge of surface water and groundwater with outdoor school students in Eastern Oregon. May is Wildfire Awareness Month, and recent summery weather in Oregon has us thinking about wildfire season. So, Susan and Dylan talk about air monitoring and air quality advisories. They learn what's new with the Air Quality Index (AQI) from Hillarie Sales, who does outreach for the DEQ lab, and talk with KGW Meteorologist Chris McGinness about how the media uses the AQI and advisories.

Last month, the Oregon Department of Environmental Quality announced more than $13 million in grants to help expand electric vehicle charging infrastructure in the state. But these aren't your typical EV chargers for drivers to pull up to, located near major highways or tucked inside parking garages or strip mall parking lots. The charging equipment targeted by these grants are designed to power up fleets of vehicles such as delivery vans, buses and large trucks hauling freight bound for same or next-day delivery. Most heavy and medium-duty vehicles run on diesel and account for nearly a quarter of Oregon's greenhouse gas emissions, according to the DEQ. In 2021, the agency adopted the Advanced Clean Truck Rule which requires manufacturers to sell an increasing percentage of zero-emission medium and heavy duty vehicles in Oregon starting with the 2025 model year. Joining us to talk about the opportunities and challenges of electrifying their trucking fleet are executives from two Portland-based companies. Randy Carpenter is the director of development at Airport Drayage Company, and Keith Wilson is the president and CEO of Titan Freight Systems.

Food waste is the second leading cause of greenhouse gases — a key ingredient of climate change — so prevention is crucial. Katie and Dylan learn about Food Waste Prevention Week, which occurs in early April, and talk with the co-chairs of its planning committee. One chair is from Oregon, and works at DEQ, and the other chair is in Florida. They're working together to spread the event around the country. You'll hear some great, practical tips on how not to waste food, including an interesting trick with an egg.

DEQ generates volumes of public records as a science-based state agency in Oregon. A team of two officials guides record storage and response to public records requests. Jeff Poupart is the section chief of Water Quality Permitting with the North Carolina Department of Environmental Quality (DEQ). In that position he oversees permitting and compliance for the NPDES and Non-Discharge wastewater, sewer collection systems, 401 Certifications, Wetlands and Buffer, transportation permitting and Animal Feeding operations. Poupart has been with DEQ since 1992 and has served in various supervisory positions including industrial pretreatment and emergency response. Oregon's Clean Fuels Program was created to reduce greenhouse gas emissions from fossil fuel suppliers, with a goal for companies to scale back emissions by at least 37% by 2035. These companies can purchase carbon credits, which are awarded to clean fuel providers by the Department of Environmental Quality, to counterbalance their emissions. One Lincoln City man found a way to swindle the system. Merlin Thompson defrauded the DEQ carbon credit system and sold credits he did not earn for nearly $2 million. Alex Baumhardt is a reporter for the Oregon Capital Chronicle and has been following this story.

Lauren and Dylan talk with U.S. Environmental Protection Agency and Oregon Health Authority staff involved in a recent mercury spill in Bend that resulted in damage to the home, cars, furniture and $100,000 in cleanup costs for the homeowners. They help us understand how to respond if mercury does spill in your home to minimize the impact, and then DEQ staff tell us how to safely dispose of any items we own that we know contain mercury.

Last month we asked DEQ staff: how do you ensure facilities follow environmental laws? We learned a lot about how complaints get processed, when DEQ goes out to inspect facilities and how that can lead to enforcement and fines. This month, we're talking about that enforcement process. Lauren and Dylan talk with DEQ enforcement staff, EPA enforcement staff and the Northwest Environmental Defense Center to learn about DEQ enforcement actions. We discuss how DEQ figures out what amount to fine violators, how DEQ and EPA enforcement work together and the ways NEDC advocates for environmental issues through litigation.

People often ask DEQ: how do you ensure facilities follow environmental laws? There are a lot of answers, but key parts are complaints, inspections and enforcement. This is the first of a two-part series that dives into the complaints and inspections process. Lauren talks with the manager of the complaints system, a complaints inspector and two facility inspectors about how they receive complaints, find the source of pollution complaints, keep tabs on facilities that DEQ regulates and what happens when there is a violation.
