Oliver Cromwells regim behövde visa att samväldet var en legitim stat, inte en tillfällig revolt. Historikern Edward Turnbull beskriver hur acceptans utomlands blev en del av överlevnadsprogrammet i London – och att Sverige, som protestantisk stormakt, framstod som en nyckelpartner.Samtidigt hade Sverige egna strategiska skäl att lyssna. Östersjön var 1600-talets ekonomiska pulsåder: där fanns hampa, tjära och timmer – material som Europas flottor bokstavligen byggdes av. Ett engelsk-svenskt närmande kunde också balansera rivaler i regionen. I Turnbulls framställning framstår han dessutom som relativt motvillig: uppdraget var prestigefullt men också ett riskfyllt avståndstagande från Londons intriger under Protektoratets första år.Sverige var vid mitten av 1600-talet en stormakt i Östersjöområdet. För England handlade diplomatin inte bara om artighet, utan om strategi: sjöfart, tullar, tillgång till marina råvaror och ett maktbalansspel där allianser snabbt kunde skifta. Whitelockes mission siktade på ett avtal som knöt Sverige närmare England – och samtidigt visade att republiken i London var en aktör att räkna med även vid kungliga hov.Whitelockes dagbok – som publicerades i tryck långt senare – understryker hur själva resan och följet var en del av diplomatins språk. Folgenbeschreibung:In dieser Folge vertiefen wir das Kausalitätsproblem bei Kollegialentscheidungen anhand des Lederspray-Falls. Im Mittelpunkt steht die Frage: Kann die Stimmabgabe eines einzelnen Gremienmitglieds kausal für einen späteren strafrechtlichen Erfolg sein, wenn niemand allein den Beschluss hätte herbeiführen können?Zu unterscheiden sind zwei Konstellationen. Bei einer Einstimmen-Mehrheit lässt sich jede Ja-Stimme nicht hinwegdenken, ohne dass der Beschluss entfiele – kumulative Kausalität aller zustimmenden Mitglieder ist zu bejahen. Problematisch wird es bei einer Mehrheit von zwei oder mehr Stimmen: Die einzelne Stimme kann hinweggedacht werden, ohne dass der Erfolg entfiele – die klassische csqn-Formel versagt.Zur Lösung werden drei Ansätze diskutiert. Die kumulative Kausalität behandelt alle Stimmen als gemeinsame Ursache, stößt aber an Grenzen, da die Einzelstimme bei Mehrheitsbeschlüssen gerade nicht unentbehrlich ist. Die alternative Kausalität (modifizierte Äquivalenztheorie) stellt auf den Gesamtbeschluss ab – einzelne Stimmen können alternativ, aber nicht kumulativ hinweggedacht werden. Die Mittäterschaft (§ 25 Abs. 2 StGB) ermöglicht gegenseitige Zurechnung der Tatbeiträge, löst das Kausalitätsproblem dogmatisch aber nicht wirklich, da sie eigene kausale Beiträge voraussetzt.Der BGH stellte im Lederspray-Fall auf die gemeinsame Beschlussfassung ab und bejahte Mittäterschaft aller Geschäftsführer für die Folgen der Unterlassung.Support the show
