The Wayne County Prosecutor's Office announced on Tuesday, Dec. 10, that the mother, whose son was 16 years old at the time of the crash, will not be charged in connection to the November 2023 crash. Kiernan Tague, who was 16 at the time of the crash, was charged in March with second-degree murder for the Nov. 13, 2023, crash that claimed the life of this 18-year-old friend, Flynn Mackrell. Police say Tague was driving over 100 miles per hour on a residential street in Grosse Pointe Farms where the speed limit was 25 mph when he lost control and struck a utility pole and tree. Mackrell's mother, Anne Vanker, requested the teen driver's mother be charged, citing the case of convicted Oxford High School shooter Ethan Crumbley and his parents, who were the first parents in United States history to be held responsible for a school shooting committed by their child. But Wayne County Prosecutor Kym Worthy said on Dec. 10 that a panel of assistant prosecutors determined the mother “was not directly or indirectly involved in any way in the offenses for which we have charged her son.” “Parenting is hard in the best of circumstances,” Worthy said in a statement. “Most parents do everything they can to mentor their children and steer them in the right direction. The juvenile respondent's mother was no different. She took consistent, active steps to try to make sure that he stayed on the right path.” "There will be those that say she should have done more, but we have looked at all of the facts and those facts dictate no criminal charges here," Worthy said. "We will not be more specific about her actions because her son will be facing trial in February. (The defendant's mother) was not directly or indirectly involved in any way in the offenses for which we have charged her son. Despite his mother's attempts, it is our firm position that the respondent and the respondent only is directly responsible for the crimes that we have adult designated and charged him with." MacKrell's mother Anne Vanker told The News she thought there was enough evidence to prove the driver's mother knew he was reckless because a Grosse Pointe Farms police report showed the woman had monitored her son's driving habits via the Life 360 app that allows parents to view their kids' driving speed, hard braking and other activity. Mackrell's mother previously told the paper that she believed the teen driver's parents could have done something to prevent the crash that killed her son. MacKrell's parents said he was picked up by a 16-year-old friend who was driving his mother's white 2021 BMW X3. They were going to surprise another friend in Grosse Pointe Farms. Afterward, the driver sped over 100 mph while heading southwest on Ridge Road, officials said. That stretch of the road has a 25 mph speed limit. He lost control of the SUV, struck a utility pole, went airborne, and then hit a tree, witnesses said. They reported that the SUV was moving “at a very high rate of speed.” “The vehicle was traveling at such a high rate of speed that the engine, transmission, front axle, and passenger compartment all separated from each other and scattered all over the roadway,” the police report says. Vanker called the announcement "a weak decision." "The wounds never close, and I'm disappointed," Vanker said. "When your child is skipping school or smoking pot, a parent maybe can't control that. But she knew her son was driving more than 100 mph because of the Life 360 app; that was right in the police report. She didn't try to control his behavior. And she provided him with the murder weapon, which was the car, knowing he was an aggressive driver. "I know Kym Worthy does the best she can, and her office gets a lot of cases," Vanker said. "But this was a missed opportunity. So many kids are killed in car accidents every year, and parents keep giving them the keys to these cars, knowing how crazy they drive. This was a chance to hold parents accountable. Now, my son is dead, and my family is destroyed." Tague is not being charged as an adult but is adult-designated, meaning if convicted, a judge can sentence him as a juvenile or as an adult or blended sentence with the option of imposing an adult sentence if Tague is not rehabilitated. Suspect Luigi Mangione is facing a Second Degree Murder charge in New York in connection with the death of United Healthcare CEO Brian Thompson according to an online court docket. Diddy's attorney defended his client stating that they have full confidence in the fact that he didn't do the things claimed in the lawsuits. His attorney's will most likely claim that Diddy cannot adequately represent himself from the barrage of civil litigation while in custody. Jorge Torres and Sarah Boone were a couple living in central Florida with a tumultuous past. In February 2020 during a night of drinking at Sarah's home, Jorge got into a suitcase that was then zipped shut. The next morning Sarah called 9-1-1 and when police responded, Jorge was dead, and Sarah was charged with second-degree murder after police discovered videos of Sarah taunting Jorge as he begged to be let out of the suitcase. Definition and Elements: First-degree murder is characterized by premeditation and deliberation. It involves planning the murder before it is carried out and is considered the most serious form of homicide. Premeditation and Deliberation: Premeditation means the defendant thought about the murder before it occurred, and deliberation implies the defendant considered the choice to kill and made a decision to do so. These elements distinguish first-degree murder from other forms of homicide. Examples and Application: Common scenarios include killings involving lying in wait, poison, or other pre-planned methods. Second-Degree Murder. Definition and Elements: Second-degree murder is typically defined as an intentional killing that is not premeditated or planned, nor committed in a reasonable "heat of passion." Malice Aforethought: This form of murder requires malice aforethought, meaning the defendant had a reckless disregard for human life. It is less severe than first-degree murder but still represents a serious form of homicide. Examples and Application: This might include impulsive killings or situations where the intent to kill forms on the spot. Felony Murder Rule. Definition and Application: The felony murder rule applies when a death occurs during the commission or attempted commission of a felony. The rule allows a defendant to be charged with first-degree murder if a death – even an accidental one – occurs during certain felonies, such as robbery or arson. Rationale and Limitations: The rationale behind the rule is to deter felons from using lethal violence during the commission of a felony. However, some jurisdictions have limitations on the application of this rule, often requiring that the death be a foreseeable result of the felony. 2. Manslaughter: Voluntary and Involuntary. Manslaughter is a less severe form of homicide compared to murder, often categorized based on the defendant's state of mind and circumstances of the act. Voluntary Manslaughter. Criminal Negligence: The defendant's actions must demonstrate a gross deviation from a reasonable standard of care, showing a disregard for human life. Examples and Application: A common example is vehicular homicide, where reckless driving leads to someone's death. 3. Negligent Homicide. Negligent homicide involves causing the death of another through criminal negligence. It's a less serious form of homicide compared to murder and manslaughter. Definition and Elements: This crime occurs when a person's negligence is so grossly negligent that it becomes criminal. This typically involves a failure to be aware of a substantial and unjustifiable risk that constitutes a gross deviation from the standard of conduct that a law-abiding person would observe in the actor's situation. A Pennsylvania man, Derek Louk, has entered a guilty plea for third-degree murder in the killing of his cousin, Tyler Matthai, last year. The incident involved a gruesome cover-up attempt, which included burning the victim's body with the assistance of his estranged girlfriend and another individual. The guilty plea was made in Bedford County Court and was accompanied by an admission of guilt for abuse of a corpse. According to Pennsylvania Attorney General Michelle Henry's press release on Thursday, Derek Louk, not only confessed to fatally shooting Matthai on April 26, 2022, but also revealed his involvement in conspiring with two others to burn the victim's body and conceal the crime. "Beyond pulling the trigger, the defendant orchestrated a scheme to obliterate the evidence - the victim's remains," Henry stated. "This plea signifies an acknowledgment of responsibility for these heartless acts of violence and disregard for human life." Louk's accomplice in the cover-up, Courtney S. Boden, identified as the estranged girlfriend of the victim, received a sentence of 2¼ to 12 years in prison after admitting her involvement in burning the body and attempting to cover up the crime. Another individual, Jordon Robertson, has also pleaded guilty and awaits sentencing. The events unfolded on April 26, 2022, when Louk allegedly used an AR-15 rifle to shoot Matthai twice, claiming self-defense after Matthai entered his residence and forcefully took Boden to a car waiting outside. Louk then allegedly dragged Matthai's lifeless body to a hole in his yard, buried it under tires, doused it in kerosene, and ignited it, maintaining the fire for approximately six hours while he slept. According to Louk, he and Boden had a seven-year friendship since his relocation to Bedford County. The court documents revealed that Matthai and Boden had a history of abusive behavior in their relationship. Louk recounted that Matthai forcefully entered his home, took Boden from the living room, and placed her in the back seat of her car. Louk retrieved his AR-15 rifle and shot Matthai in the arm and, subsequently in the back. He asserted that he verified Matthai's death by checking for a pulse on multiple occasions. Louk then proceeded to bury Matthai's body in a makeshift grave on his property and set it ablaze with kerosene. Louk disclosed that the fire burned for six hours while he slept, and the following morning, he covered the burnt remains with soil. Authorities were alerted to the situation by a relative, who claimed that Boden had mentioned Matthai's drug use and aggressive behavior that night. According to the relative's testimony, Boden informed them that Louk had warned Matthai to stop his violent behavior or face consequences, leading to Louk allegedly shooting him. Boden reportedly told the witness she attempted to stem the bleeding, but Matthai overdosed and died. She confessed to disposing of the body and belongings in an undisclosed manner, obliterating all traces of the victim. She further attempted to cleanse bloodstains from a vehicle and sell the murder weapon. Louk's plea agreement stipulates a prison term of 15 to 30 years. The sentencing is scheduled for September 22.
