Mandatory ADR in Canada Means More Need for Professional Divorce Coaches

Send Us a Message (include your contact info if you'd like a reply)Today, our Canadian Director Dori Braddell joins Tracy for a fascinating and timely discussion of the recent changes to the family justice system in Canada, including mandatory ADR, and what it means for dispute resolution and divorce coaching.Dori shares that in 2024, some provinces have made it mandatory for divorcing couples to make an ADR attempt first before they can have their matter heard in court. Couples can no longer go directly to a judge to decide their family matters. And in provinces where it's not mandatory (yet), she is seeing judges order couples into an ADR process or require it if either party requests it. This means that divorcing Canadians are more likely to participate in ADR, whether by choice or not, than ever before. And demand for professionals to support them will continue to grow. We know that one on one, individualized dispute resolution support from a Certified Divorce Coach can be the difference between a blown ADR attempt and a settlement agreement. Divorce Coaches are that secret weapon, the special sauce that exponentially improves the odds at succeeding in something you didn't have choice but to do. The next cohort of DCA divorce coach training for Canada begins the week of March 9 and Dori would love to chat with you about the opportunities that this new legislation opens up for properly trained divorce coaches. You can schedule a 1-1 call with her: Dori's Calendar Learn more about DCA® or any of the classes or events mentioned in this episode at the links below:Website: www.divorcecoachesacademy.comInstagram: @divorcecoachesacademyLinkedIn: divorce-coaches-academyEmail: DCA@divorcecoachesacademy.com

There's hopes new legislation helps ease the often rocky path of divorce for abuse victims. A bill passed by Parliament means survivors can end their marriages if they have a protection order against their spouse. The Bill's nicknamed 'Ashley's Law', and is championed by Ashley Jones. Jones told Mike Hosking she didn't expect it to be passed unanimously, and can't believe she was fundamental in changing a law. She said it's a huge reminder that one voice can make a change, and if you fight hard enough you can change things you think are not right. In the early days of her family law practice, Heather Quick noticed a troubling pattern among the women she represented. Women often undervalued what they brought to the marriage and failed to stand up for themselves in the divorce process. So, what can women do to change their mindset around divorce and fight for what they deserve? Heather Quick is Founder and CEO of Florida Women's Law Group, the only divorce and family law firm in Northeast Florida that serves women exclusively. Consistent with her message of women's empowerment, Heather has published several books on divorce and business, including Women's Guide to Divorce in Florida and Women's Guide to Becoming a Successful Entrepreneur. On this episode of Divorce Dialogues, Heather joins Katherine to discuss the unique challenges facing women in divorce, from stay-at-home moms to female breadwinners. Heather explains how women compromise on finances to protect their children and why that's a bad idea, challenging couples to stop using their children as a negotiating tool in divorce. Listen in to understand how entrepreneurship can help women own their financial destiny and learn how FWLG advocates for women before, during and after divorce. November is Family Court Awareness Month. My friend and colleague, Tina Swithin, has dedicated the month of November to educating people about the family court system: how corrupt it can be, how unfair it is, and how uneducated most people in the family law system are about domestic violence. Tina was a guest on my podcast a few years back to share the truths about the family court system. If you fear you may end up in the family court system, you must listen to this episode. It will help you understand what family court is designed to do and enable you to prepare yourself to battle within the court system, which is not designed to protect you.  Listen to hear (or re-hear) this incredible conversation about family court awareness.    Featured topics include: Family Court Awareness Month is an opportunity for survivors to raise awareness at a community level.  The family court system is abusive. How we can come together to increase awareness.  The disconnect between family court and other judicial systems. There is no regulation or checks and balances. Very few states have required trauma-informed or domestic violence training for family court judges.  We examine how judges become appointed family law judges.  What you can expect when advocating for yourself in the family court system.  Learn more about Tina Swithin: Tina Swithin survived a “Category Five Divorce Hurricane” while acting as her own attorney in a high-conflict custody battle that turned her family's life upside down for over a decade.  Known for her internationally recognized blog, “One Mom's Battle” and her book series, “Divorcing a Narcissist,” Tina helps survivors to navigate the family court system against narcissists and other toxic individuals. In 2020, Tina launched two major projects: The High Conflict Divorce Coach Certification Program and a nationwide campaign, Family Court Awareness Month.   The mission at Family Court Awareness Month is to raise awareness and shine a spotlight on one of the most important branches of our judicial system; the family court system. The very system that was established to govern family law cases and make decisions that are “in the best interest” of children, has some undeniable shortcomings that warrant conversations, solutions and ultimately, change.   The mission at Family Court Awareness Month is fueled by the desire for a family court system that is trauma-informed and educated on domestic violence, coercive control and post separation abuse. To truly act in the best interest of children, our family court system needs to incorporate empirical data and research into their decisions and rulings.  Resources & Links: Links and information may also be found at: kateanthony.com/podcast/episode-241-family-court-awareness-month-with-tina-swithin/ Pre-order Kate's book “The D Word” and Grab Your Bonuses!Domestic Violence Training: Bridging the Gap in Divorce Law with Kate Anthony on The Divorce and Beyond Podcast #318 Family Court AwarenessOne Mom's BattleTina on FacebookTina on InstagramTina on LinkedIn TODAY'S EPISODE IS SPONSORED BY: SOBERLINK Proof. Our subject for today's show is divorce. Divorce is far too prevalent in the world of law enforcement, and I have wanted to do a podcast episode about this subject for some time now.I survived a brutal divorce that lasted over two years and wrote a book about it to help others going through a nasty divorce titled, “Divorced Dad: Kids are Forever, Wives are not.” This book is not full of venom or hate, it is a guide to help those, especially dads, who are navigating the sometimes shark-infested waters of divorce. I used the pen name of L.J. Burke because I was still employed as a cop and didn't want to deal with the red tape of getting the book approved through the department. I felt it would be a good idea to bring on someone with a unique perspective on the subject, Kerrie Droban. Kerrie is also a divorce survivor who now helps others get through their parting of the ways with her family law practice and at one time was married to a homicide detective.Kerrie Droban received a Master's degree from The Johns Hopkins University Writing Seminars and a Master of Fine Arts and Juris Doctorate from the University of Arizona. In today's episode we discuss:·      The reasons for the high rate of divorce among first responders.·      The warning signs of an impending divorce and sometimes ignoring them, listen to your gut feelings.·      When should you think about marriage counseling? ·      Best practices when asking your spouse for a divorce and breaking the news to your children.·      When is it time to get a divorce lawyer and is it a good idea to share one?·      Separation and moving out. Dos and don'ts to protect yourself and your kids.·      Tips on how to soften the damage of divorce on children.·      Avoid speaking poorly about your soon-to-be ex or their parents to your kids. ·      When should you reconsider getting a divorce?·      Self-care during a divorce and avoiding destructive behavior during the process.·      Co-parenting best tips and practices·      When should you start dating?
