Schlaffer Wins the Bout as Cubs Outpunch Kernels 4–1 This afternoon at Veterans Memorial Stadium felt more like a title fight than a baseball game, as South Bend’s Tyler Schlaffer and Cedar Rapids’ Chase Cheney squared off in a heavyweight pitching duel. Schlaffer came out swinging—delivering haymakers from the mound with 10 strikeouts over 7 innings, allowing just one hit on 100 pitches. A true prizefight performance. Cheney went the distance for the Kernels, tossing 6 1/3 innings and giving up only 4 hits and 2 earned runs, but took the tough-luck loss. The Cubs broke the scoreless tie in the 7th when Ivan Brethowr landed a clean jab—a line-drive single to right—scoring Cameron Sisneros. Miguel Pabon advanced to third and then crossed home plate on a Brian Kalmer sac fly. In the 8th, South Bend kept landing punches. Jefferson Rojas scored on a Sisneros sacrifice fly, and Cristian Hernández stole third—his 28th bag of the year—then scored on a wild throw by catcher Luke Napleton. That made it 4–0 before the Kernels answered with a late-round run in the 9th. South Bend wins the bout by unanimous decision, 4–1. Cubs Celebrate Tiki Night with 4–2 Win Over Captains The South Bend Cubs brought the island vibes to Four Winds Field on Tiki Night and delivered a 4–2 victory over the Lake County Captains. First pitch was delayed slightly due to a brief rain shower, with the game getting underway around 7:30 p.m. Lake County struck first with two runs in the top of the third inning off Cubs starter Tyler Schlaffer, but South Bend quickly answered in the bottom half. Cameron Sisneros doubled sharply to right, scoring Jefferson Rojas to cut the deficit to 2–1. The Cubs erupted for three runs in the fifth. Rojas delivered again, roping an RBI double to left field to score Carter Trice and James Triantos, then advanced to third. Sisneros followed with an RBI single to right, bringing Rojas home and giving the Cubs a 4–2 lead. Despite some shaky defense—South Bend committed three errors, including two by Sisneros at first base—Schlaffer turned in a gem. The right-hander pitched seven strong innings, allowing just two hits and one earned run, while striking out five and walking three. Chase Watkins tossed a clean eighth to earn a hold, and Grayson Moore locked down his second save of the season with a scoreless ninth inning. Sisneros made up for his defensive miscues at the plate, going 3-for-4 with 2 RBIs, including a clutch two-out knock in the third. With the series squared at one, the Cubs and Captains will wrap up the first half at 7:05 PM on Thursday. Ashleigh Sisneros is an Information Technology Specialist and an Air Force Veteran. A ‘Network Administrator' by trade, she has worked in all facets of IT with various government agencies. Having achieved early career success, she has made it her mission to help other Latina women in tech. At 17 she enlisted into the Air Force as a guard member for the State of Louisiana. Having lived through Katrina and other hurricanes, she remembered those in uniform who would hand out water and lifesaving supplies and knew she wanted to be a part of that. She served for 10 years, had 2 deployments, was activated for hurricane and state missions, and served at the nation's capital during the 2020 inauguration. Today Ashleigh is currently working at the Department of Defense Educational Activity in Naples, Italy. She spends her free time traveling and trying to achieve her fun goal, to eat Peruvian food in each new country she visits! Shantiel is a Nutrition Therapist Master and a Mindset Coach. She graduated from NTI in October 2022 and graduated from the Quantum Coaching Academy in November 2022. Before school, she spent her whole adult years practicing as a Massage Therapist and Esthetician. Shantiel has always had the urge to help others, but, with her own health struggles, found the way to true health is about what you put into your body and mind every day. Shantiel has dealt with autoimmunity since 17 years old and, like many others, heard that it was all in her head, she was just depressed, and it is just because of her age. These answers were not good enough, so she started doing research on her own, started seeing a Functional Medicine Doctor, and then found her way to Nutrition Therapy Institute. Once she felt the relief that she had been longing for for years, she decided that she needed to learn how to share this knowledge with others. On the journey, she also quickly learned that it's not just what we feed ourselves but it's how we take care of ourselves and how we speak and think about ourselves. Therefore, she started school at Quantum Coaching Academy to learn more about how to connect with people on a deeper level. The focus of Shantiel's nutrition business is around women's health and autoimmune conditions, and as we well know, autoimmune diseases can also be turned on by how much stress we expose ourselves to on a daily basis. Lynn Bernstein became the first college graduate in her family in 2001 when she earned a B.S. in Aerospace Engineering from the University of Colorado. Her experience integrating and testing complex systems on numerous satellites taught her to think critically about processes, procedures, and accountability.She put her engineering career on hold for several years to focus on raising a family. Five years ago while she was in the process of applying to grad school, someone told her they didn't think NC election systems were adequately tested or secure. Intrigued but skeptical, she took an unbiased look at election systems, laws, and practices in North Carolina. Shocked and concerned by what she discovered, she put grad school on hold and founded Transparent Elections NC, a group devoted to ensuring that elections are worthy of the public's trust: they must be understandable, secure, transparent, robustly audited, and publicly verified. When she's not encouraging those in her community to get involved in election integrity, she loves spending time with her family, friends, and nature – hiking, kayaking, and foodscaping.

Trial is approaching, and you learn a witness you planned to call live now isn't available. You'll need to read or play their deposition testimony instead. That means that you must prove the witness' "unavailability" under the rules. How do you do it? Which rules do you need to analyze? How far in advance of trial do you have to do it? Can you just tell the judge that, last you heard, Peter, Paul, and Mary were leaving on a jet plane, and you don't know when they'll be back again, so you're probably going to read their depositions?
