This week on Driving Law, Kyla and Paul tackle a dynamic mix of personal experience, legal news, and constitutional issues making waves across Canada. Kyla opens the episode with a near-death experience on the Alex Fraser Bridge after unsecured plywood flew off a truck—an incident that underscores the real dangers of unsafe loads and distracted transport. The story sets the tone for a discussion on enforcement methods and public safety. They then analyze Ontario's controversial speed camera program in Vaughan, where 32,000 tickets were issued in just three weeks. Despite the staggering volume, the city has temporarily paused fines, replacing them with warnings while reevaluating the system's effectiveness. Kyla and Paul debate the merits and pitfalls of automated enforcement and the due process challenges it presents for drivers. Next, they cover Surrey's new “Project Rogue Racers”—a year-long crackdown on illegal street racing events. With dozens of tickets, vehicle impounds, and bylaw infractions already issued, the project marks a new level of targeted enforcement against stunt driving and high-risk gatherings. Finally, Kyla and Paul dive deep into the Supreme Court of Canada's decision to grant leave in R. v. Cordner, which revives the long-standing Whyte and Powers constitutional issue. The case will test whether compelled statements at accident scenes—required under traffic legislation—can be used to justify criminal investigative demands, or whether such use violates Charter rights. They explore the nuanced conflict between majority and dissenting opinions at the Alberta Court of Appeal, and why the outcome could reshape the way police interact with drivers post-accident. In this thought-provoking conversation, Professor David Whyte examines how our legal and economic systems—particularly the structures of corporate capitalism—shape environmental outcomes and impede meaningful climate action. Drawing from his academic work and recent report The Carbon Cash Machine, he argues that tackling climate change requires confronting the underlying architecture that enables corporations to prioritize profit while externalizing harm.Whyte explores the role of institutional investors, shareholder returns, and regulatory frameworks, revealing how financial incentives continue to drive fossil fuel expansion, arguing that corporate sustainability commitments are ultimately at odds with their core economic logic. He believes that corporate reform within the existing system will fall short, urging a deeper reckoning with the structural forces that entrench shareholder primacy over environmental responsibility. Calling for a fundamental reimagining of ownership, governance, and investment, he considers alternatives such as cooperative enterprises and public control of key industries, envisioning what a truly transformative economic model might look like. This is a important  incisive discussion, from late 2024, that raises urgent questions about accountability, power, and the deeper systemic changes needed to confront the climate crisis. David Whyte is Professor of Climate Justice in the School of Law, Queen Mary University of London. His most recent book is Ecocide: kill the corporation before it kills us (Manchester University Press, 2020). He is the co-author of Corporate Human Rights Violations: Global Prospects for Legal Action' (Routledge, 2018, with Stefanie Khoury) and editor of The Violence of Austerity (Pluto, 2017, with Vickie Cooper).

In this episode, theologian Russell Moore sits down with acclaimed poet and philosopher David Whyte to explore the terrain where faith meets poetry. Beginning with Whyte's new book Consolations II, their conversation traverses the landscapes of language, spirituality, and what it means to be fully present in a fractured world. Whyte, whose work bridges the philosophical traditions of the East and West with the everyday struggles of being human, offers profound insights on why poetry serves as more than mere decoration—it becomes essential language for our deepest experiences. Moore—bringing his biblical, theological perspective—and Whyte dialogue about the “conversational nature of reality” that Whyte proposes and discuss how it resonates with and challenges Christian understandings of communion with God. Their discussion moves through territories both intimate and universal: The ways poetry gives language to experiences that resist explanation The nature of courage as vulnerability rather than bravado Navigating anxiety in a world that demands constant performance Approaching death, as a companion or an enemy The surprising spiritual journey that led Whyte from marine zoology to becoming one of our most vital poetic voices Whether the modern world is “disenchanted” and what difference that makes While coming from different spiritual traditions, Moore and Whyte explore together how human experience requires language that opens rather than closes, invites rather than insists. Their conversation models what genuine dialogue across philosophical differences can look like—curious, generous, and alive to mystery. David Whyte reflects on the transformative nature of poetry

Author, poet, and philosopher David Whyte believes in poetry. Specifically, he believes in its ability to rekindle emotions often buried or denied — from anguish and death, to joy and wonderment. Whyte credits his Irish roots for his love of the written word. Following in the tradition of many a balladeer before him, Whyte not only is a prolific writer, but he's committed many of his own poems and others to memory.   In his latest collections of poems and essays Constellations II: The Solace, Nourishment and Underlying Meaning of Everyday Words, Whyte takes on some familiar themes of the human condition; anguish and death. He says that poetry offers an “invitation back into the world,” to confront the difficult and to help grapple with life both speakable and unspeakable while finding joy in the process.  Whyte encourages us to embrace the ability we all have to draw down below our internal horizons, connect with our inner voice, and pay attention to people and things other than ourselves. That inner voice, Whyte says, “[is] so often so much more compassionate than the defensive voice we have on the periphery. It's also the voice from which poetry is written, it's the voice below the horizon of our understanding inside us.”  Whyte tells us that poetry, “is the art of creating language that's just as movable as the world that it's temporarily describing. It comes from a fiery, movable place and is equal to the fire and movability of the world. If it's static and holding things in place, it's usually not good poetry.”   David Whyte, pictured here, says: “Poetry is a very physical invitation back into the world and I think it's the beauty in poetry that makes you actually want to respond to the invitation.” Photo by Bodi Hallett “Consolations II: The Solace, Nourishment and Underlying Meaning of Everyday Words,”  David Whyte's latest collection of poems and essays.
