We reframe the “egg crisis” (high prices and low supply of commercial hen's eggs in a bird flu outbreak) as a crisis of mass farming of animals, proposing sustainable alternative food solutions that can replace eggs and reduce the spread of zoonotic diseases, pollution, and the killing and harm of millions of wild and domesticated animals. BREAKING NEWS: Animal Outlook releases shocking, new undercover video of chickens being abused in a California factory farm and is calling for the Fresno County District Attorney's office to file criminal animal cruelty charges against the corporation, which Animal Outlook identifies as Foster Farms, a major supplier to many big supermarkets. The video appears to show multiple instances of forklifts driving over and hitting live chickens, chickens being thrown, chickens being kicked and grabbed by their wings. Foster Farms says all of its chicken farms are American Humane Association Certified, and that the chickens it raises enjoy the 5 freedoms: including, “freedom from discomfort,” and “freedom from injury, pain, or disease.” Animal Outlook says its investigation “reveals a stark contrast, showing anything but humane care and freedom from discomfort, injury and fear.” Foster Farms is invited on any time to respond to Animal Outlook's allegations. As many of you know, LIC is a litigation nonprofit dedicated to making factory-farm cruelty a liability. We focus on chickens because of the huge numbers in which they suffer and the extreme severity of that suffering. Today, we sued one of the country's largest poultry producers and a KFC supplier, Case Farms, for animal cruelty. The complaint comes on the heels of a 2021 undercover investigation by Animal Outlook, revealing abuse at a Morganton, N.C. Case Farms hatchery that processes more than 200,000 chicks daily. Our lawsuit attacks the notion that Big Ag is above the law. We are suing under North Carolina's 19A statute, which lets private parties enjoin animal cruelty. Case Farms was documented knowingly operating faulty equipment, including a machine piston which repeatedly smashes chicks to death and a dangerous metal conveyor belt which traps and kills young birds. Case Farms was also documented crushing chicks' necks between heavy plastic trays. Case Farms supplies its chicken to KFC, Taco Bell, and Boar's Head, among other customers. On this episode of the Animal Law Podcast, I speak with Piper Hoffman of Animal Outlook and, once again, to Jay Shooster, of the Richman Law Group, about Animal Outlook v Cooke Aquaculture, a consumer protection case brought in the Superior Court of the District of Columbia based in allegations of deceptive advertising about the welfare of fish, specifically the salmon in Cooke's aquaculture facilities. You may recall seeing some of the footage of the treatment of these salmon when Animal Outlook first released the results of this undercover investigation. You may also recall having heard about it on Our Hen House, our sister podcast, when we had Erin Wing, the undercover operative who took that footage, on to tell us about it back on Episode 587. Now we are covering the next development, i.e., this consumer protection lawsuit that is using the information gathered in that investigation to bely some of the claims made about how these poor fish are treated. Piper Hoffman brings more than 20 years of legal experience to bear as the Senior Director of Litigation at national farmed animal advocacy group Animal Outlook. Vegetarian since childhood and vegan since the 20th century, she earned her J.D. cum laude from Harvard Law School, where she successfully lobbied the school to offer its first Animal Law class. After a federal clerkship, Piper began her animal law career as a staff attorney at the Animal Legal Defense Fund. She has taught Animal Law at New York City law schools since 2014. This is a HUGE victory for animal rights and the animals themselves! On June 28, 2021, the Supreme Court of the United States rejected the North American Meat Institute's (NAMI) challenge to California's Proposition 12. Proposition 12 is due to go into effect on January 1, 2022. It strengthens existing California law to ban the intensive confinement of egg-laying chickens, mother pigs and calves used in the veal industry. The law also prohibits the sale in California of eggs, pork and veal from facilities that confine animals in cruel cages. Voters adopted Proposition 12 in 2018. When NAMI sued California in an attempt to stop the state from implementing Proposition 12, Animal Outlook voluntarily intervened in the lawsuit on behalf of the State of California to defend Proposition 12 and protect the millions of hens, pigs and calves used to produce meat and eggs sold in California. Animal Outlook was joined by Animal Equality, Animal Legal Defense Fund, Compassion in World Farming, Farm Sanctuary, the Humane League and the Humane Society of the United States. In rejecting NAMI's challenge, the Supreme Court upheld an appellate court's denial of NAMI's claim that Proposition 12 violated the United States Constitution. The Supreme Court's decision affirms the right of states to pass laws protecting animals, public health and safety. While an appeal in a second lawsuit against Proposition 12, brought by the National Pork Producers Council, still looms, the Supreme Court's decision against NAMI is a massive victory for animals. The law also prohibits the sale in California of eggs, pork and veal from facilities that confine animals in cruel cages. Voters adopted Proposition 12 in 2018. When NAMI sued California in an attempt to stop the state from implementing Proposition 12, Animal Outlook voluntarily intervened in the lawsuit on behalf of the State of California to defend Proposition 12 and protect the millions of hens, pigs and calves used to produce meat and eggs sold in California. Animal Outlook was joined by Animal Equality, Animal Legal Defense Fund, Compassion in World Farming, Farm Sanctuary, the Humane League and the Humane Society of the United States. In rejecting NAMI's challenge, the Supreme Court upheld an appellate court's denial of NAMI's claim that Proposition 12 violated the United States Constitution. The Supreme Court's decision affirms the right of states to pass laws protecting animals, public health and safety. While an appeal in a second lawsuit against Proposition 12, brought by the National Pork Producers Council, still looms, the Supreme Court's decision against NAMI is a massive victory for animals.
