After the International Court of Justice's finding that Israel's war on Gaza was a "plausible case of genocide," Israel smeared the UN Relief and Works Agency for Palestinian Refugees, claiming that four or five UNRWA employees were affiliated with Hamas. These employees were fired without any proof of wrongdoing, and several countries stopping funding UNRWA, also without seeing any concrete evidence. Many of these countries are signatories of the Genocide Convention, which means they should be doing everything possible to stop Israel's acts of genocide. Today, on Speaking Out of Place, we discuss the recent International Court of Justice ruling on the Gaza genocide case, which found that Israel is plausibly engaging in genocide in Gaza.We discuss the case and its implications, as well as the colonial backdrop of the international law behind it, with former UN Special Rapporteur on Palestine Michael Link, Palestinian human rights attorney, scholar, activist, and teacher Noura Erakat, and Burmese scholar and dissident in exile, Maung Zarni. We also address the recent decision of a number of countries to defund the UN Relief Works Agency for Palestinian Refugees, which was established by the United Nations in 1949. Finally, we talk about what global civil society can and must do to effect change where international law cannot.Noura Erakat is a human rights attorney and an Associate Professor at Rutgers University, New Brunswick. She is a Co-Editor of Jadaliyya. Her book, Justice for Some: Law and the Question of Palestine (Stanford University Press, 2019) narrates the Palestinian struggle for freedom as told through the relationship between international law and politics during five critical junctures between 1917-2017 to better understand the emancipatory potential of law and to consider possible horizons for the future. Erakat's research interests include human rights law, humanitarian law, refugee law, national security law, social justice, critical race theory, and the Palestinian-Israel conflict. Former U.N. Special Rapporteur on Human Rights in the Palestinian Territories Occupied by Israel since 1967, Michael Lynk discusses international law as it applies to the war in Gaza between Israel and Hamas. The Oct. 7 attack on Israeli civilians by Hamas as well as Hamas' ongoing missile strikes on Israel violate international law. So too does Israel's indiscriminate shelling of Palestinian civilians in Gaza and its tightening siege. Lynk addresses the dire humanitarian crisis in Gaza and says the Biden administration's support for Israel's actions is complicity in war crimes.
CW: depictions of violence and death, systematic abuse This episode's guest is Michael Lynk, former UN Special Rapporteur on the human rights situation in the Palestinian Territories (2016-2022). Michael and our guest host discuss one of the longest standing conflicts in the world today, detailing the ways in which Israeli occupation and the systematic oppression of Palestinians has created the conditions that can be described in no other way than as Apartheid. Palestine has been occupied by Israeli military since 1967 despite countless UN resolutions denouncing its violent and racist tactics which have led to the displacement of generations of Palestinians. Palestinians now make up approximately 5.9 million displaced individuals across the Middle East alone. In the episode, Michael discusses how this has been made possible through major international actors turning a blind eye, and via a sophisticated mechanism of state propaganda. Finally, we share insights on some of the ways that institutions and states can support the West's disenfranchisement from Israel's apartheid government, and urges listeners to learn more about the situation in Palestine. Update: In April of this year, Israeli forces carried out violent raids on the Haram Al-Sharif compound and Al-Aqsa Mosque during the holy month of Ramadan for the third year in a row. Richard Falk is an American professor emeritus of international law at Princeton University, and Euro-Mediterranean Human Rights Monitor's Chairman of the Board of Trustees. Falk has published extensively with multiple books written about international law and the United Nations. John Dugard is a South African professor of international law. His main academic specialisations are in Roman-Dutch law, public international law, jurisprudence, human rights, criminal procedure and international criminal law. He has served on the International Law Commission, the primary UN institution for the development of international law, and has been active in reporting on human-rights violations by Israel in the Palestinian territories. Michael Lynk is Associate Professor at the Faculty of Law, Western University, London, Ontario, Canada, and was the United Nations Human Rights Council Special Rapporteur for the human rights situation in the Palestinian Territory occupied since 1967.

In this episode we're excited to share an interview with Michael Lynk, the 7th Special Rapporteur for the human rights situation in the Palestinian Territories, appointed by the United Nations Human Rights Council. On this edition of Parallax Views, outgoing United Nations Special Rapporteur on the situation of human rights in the Palestinian Territories occupied since 1967 S. Michael Lynk joins us to discuss his latest report on the situation of human rights in the Occupied Palestinian Territory. Dr. Lynk, who is also an associate professor at the University of Ottawa, describes how he wrote the report and the difficulties of writing due to roadblocks from both the pandemic and Israeli officials. We then begin to delve into the findings of the report with a focus on the shocking stories of settler violence detailed within, the unequal practice of law and policy in the OPT in regard to its Israeli and Palestinian citizens, housing demolition and the issue of collective punishment, "permanent occupation" as a legal paradox, international law, institutionalized systems of racial oppression and domination, the differences between what took place in apartheid South Africa and what is happening now in the Occupied Territories, and much, much more. Additionally, we do raise the issue of the "A" word, or apartheid, in the OPT. What does it mean? What does it entail? And why does Lynk's report employ the term. This specific UN report raises the issue of apartheid alongside a growing number of others in the past few years including B'tselem, Human Rights Watch, and Amnesty International. What does it all mean and what are Lynk's recommendations going forward? Canadian lawyer Michael Lynk served as the UN's "Special Rapporteur on the situation of Human Rights in the [occupied] Palestinian territories" from 2016 to 2022.. During his mandate Lynk faced intense criticism from pro-Israel voices, and Israel banned him from even visiting occupied Palestine. Nonetheless, he distinguished himself remarkably over his six-year term, and just issued a final report concluding that Israel is practicing apartheid. Michael Lynk is a law professor and the current Special Rapporteur on the situation of Palestinians in the Occupied Territories. For almost six years he has observed the plight of that community, but without visiting the Occupied Territories at all; the government of Israel refuses to allow a representative of the United Nations to enter Israel or the Occupied Territories. Only a few other countries maintain such a rigid control over a community (such as the Rohingya or the Uyghurs). Lynk maintains that the government of Israel will never relent in its oppression of the Palestinians unless the international community intervenes with strong demands, but he reports that almost all countries maintain a willful blindness about the illegality of the Israeli occupation. The crime of apartheid has a clear definition, and although its origin is historically linked to the racist regime in South Africa, it is now an independent legal concept. In 2020, Yesh Din, an Israeli human rights organisation commissioned human rights lawyer Michael Sfard to produce a legal opinion on the prevailing in the occupied Palestinian West Bank. The conclusion of this legal opinion is that the crime against humanity of apartheid is indeed being committed by the Israeli state, and the victims of this crime are the indigenous Palestinians. Professor Michael Lynk describes how the Israeli occupation of West Bank and its total blockade of Gaza has caused terrible conditions for Palestinians in these areas. Israel's occupation does not meet the legal obligations of occupying countries in terms of its decades-long duration, and persistent violation of human rights. Further, Israel's planned eventual annexation of the occupied territories and its de facto annexation of Jerusalem are forbidden under international law. Professor Lynk will be speaking on these issues in Hamilton on January 31 at McMaster University at 12:30pm noon (room TBA) and at Barton Stone/Mount Hope United Church at 21 Stone Church Rd. at 7:00pm.
