In this special episode of Justice Visions, we shift our typical focus on innovations in transitional justice to a broader debate about international law, its shortcomings, and how to rethink it in ways that benefit victim-survivors of gross human rights violations. We do so on the occasion of the inaugural Lecture of the Amnesty International Chair at Ghent University, which this year was given by Palestinian-American human rights attorney, legal scholar, and activist Noura Erakat. The Chair is awarded to an individual who has made outstanding contributions to the field of human rights.In an interview which took place just before the lecture, Brigitte Herremans talks with Noura about the limits and possibilities of international law amid unfolding atrocities in Gaza. Drawing on Third World Approaches to International Law, Noura argues that, though not neutral and biased against those most in need of protection, can still be repurposed by those mobilizing it to resist injustices. While Noura's work and activism focus on Gaza, her arguments about the possibilities and challenges of International Law are relevant to a broad range of  TJ practitioners and scholars who are working in contexts of ongoing conflicts and entrenched accountability crises. It offers critical insights about how legal tools can be reclaimed in transnational struggles, rethinking justice beyond formal mechanisms. Touching on survivor-led agency, Noura challenges the framing of Palestinians as passive victim-survivors. Instead, she insists on recognizing their active role in resisting domination and their capacity to demonstrate the full spectrum of their potential as humans, despite the genocide and complicity of states in the Global North. For Noura, part of the Palestinian victory lies not only in the struggle for liberation, but in living that liberation, through joy, care, and collective action. As she states: "We are not defined by what Israel does to us. We are defined by who we are. We are defined by what we do, what we produce, what we write, how we love one another…. We are defined by who we are, despite that harm, and how we respond to it.”Throughout the conversation, Noura emphasizes the importance of counter-hegemonic knowledge production and the need to resist dominant legal and media frameworks as these continue to erase Palestinian experiences and perspectives. She calls for a decolonial and feminist understanding of justice, and resistance that connects Palestine to global struggles. She also reminds us of the responsibility that comes with activism. “If Palestinians who have been placed in a cage and basically shot at with the most advanced weapons technology is a form of experimentation and without mercy have not given up. What right do I have to give up?”

On March 8th, federal immigration agents arrested Mahmoud Khalil, a former Palestinian student activist at Columbia University, in his New York home and moved him to a detention facility in Louisiana. Khalil, a recent graduate from Columbia's public affairs masters program and a prominent leader in the school's movement to pressure the university to divest from companies complicit in Israel's genocide, is a legal permanent resident, and is not accused of any crime. The Trump administration has pointed to his political activism as the reason for why he should be deported, invoking a rarely-used Cold War-era law to argue that Khalil's presence in the US is contrary to US foreign policy interests. Jewish American organizations are split over the administration's reactions: The Anti-Defamation League has praised it, other mainstream groups have remained silent, and liberal Zionist and anti-Zionist Jewish organizations have sharply condemned it.On this episode of On the Nose, editor-in-chief Arielle Angel, associate editor Mari Cohen, and senior reporter Alex Kane discuss the Jewish political reaction to the arrest and detention of Khalil. After the 2022 Russian invasion of Ukraine, the term international rules-based order would be repeated by Washington officials almost daily to describe Moscow's action. Then a curious thing happened when Israel invaded Gaza in 2023. The term virtually disappeared as the U.S. sought to protect its close ally Israel. But the U.S. itself has a long record of violating the international rules-based order with its invasions, occupations, coups, assassinations, sanctions and UN vetoes. Compliant corporate media consistently fail to point out this brazen hypocrisy. Since the leader of the so-called free world and its allies are not held to account the rules-based order is in total disorder. From Washington's perspective, the rules are for thee but not for me. On this edition of Parallax Views, Rutgers University's Director of the Center for Security, Race, and Rights, Sahar Aziz, returns to the program to discuss the recent House Committee on Education and the Workforce hearings on antisemitism and why they resemble something more akin to the McCarthyite witch hunts of the House on American Activities during the Cold War than an honest effort to combat antisemitism. These hearings, she argues, are more about shutting down political criticism of Israel than fighting antisemitism. We'll also delve into some of the key points covered in Sahar's book The Racial Muslim: When Racism Quashes Religious Freedom and discuss the Islamophobia-industrial complex that's especially been prevalent in America since 9/11 and the Global War on Terror. Moreover, Prof. Aziz will offer her thoughts on the Anti-Defamation League, which has received harsh criticism in recent years with Jonathan Greenblatt at its head, and its activities against pro-Palestinian and Arab American political activists. Most importantly, however we focus on how the House Commitee on Education and the Workforce investigations into antisemitism, which involves figures like Rep. Elise Stefanik and Rep. Virginia Fox, have attacked the Center for Security, Race, and Right as well as academics like Noura Erakat and Juan Cole. Sahar will address some of the allegations made by the House Commitee against CSRR and delve into how this is connected to broader Republican Party efforts to tamper down academic freedom and discourse (ie: how it connects to GOP attacks on DEI and CRT, right-wing promotion of book-banning, etc.).

Erakat's research interests include human rights law, humanitarian law, refugee law, national security law, social justice, critical race theory, and the Palestinian-Israel conflict. Jeffrey Sachs serves as the Director of the Center for Sustainable Development at Columbia University, where he holds the rank of University Professor. From 2001-18, Sachs served as Special Advisor to UN Secretaries-General Kofi Annan (2001-7), Ban Ki-moon (2008-16), and António Guterres (2017-18). Sachs has authored and edited numerous books, including The End of Poverty (2005), Common Wealth: Economics for a Crowded Planet (2008), and The Price of Civilization (2011). From 2001-18, Sachs served as Special Advisor to UN Secretaries-General Kofi Annan (2001-7), Ban Ki-moon (2008-16), and António Guterres (2017-18). Sachs has authored and edited numerous books, including The End of Poverty (2005), Common Wealth: Economics for a Crowded Planet (2008), and The Price of Civilization (2011). Sachs has received 42 honorary doctorates, and his recent awards include the 2022 Tang Prize in Sustainable Development, the Legion of Honor by decree of the President of the Republic of France, and the Order of the Cross from the President of Estonia. Prior to joining Columbia, Sachs spent over twenty years as a professor at Harvard University, most recently as the Galen L. Stone Professor of International Trade.

As we recorded that program, Gaza had been under Israeli bombardment from the air, land, and sea for 70 days.   At that time, 18,000 Palestinians in Gaza were known to have been killed by the Israeli military. Today, that number is over 28,000. More than 68,000 Palestinians in Gaza have been wounded. The Israeli military continues to invade Palestinian cities and villages in the West Bank. Violent attacks on Palestinians by Israeli settlers also continue.   Noura joined Frank to discuss the collective trauma of Israel's genocidal assault on Gaza and where the global movement for Palestinian freedom goes from here.   Noura is a human rights attorney and an Associate Professor at Rutgers University in the Department of Africana Studies and the Program in Criminal Justice. On January 26th, the International Court of Justice (ICJ) issued an interim ruling on South Africa's charge that Israel is committing genocide in Gaza. The ICJ found South Africa's argument to be “plausible”—meaning it will allow the case to go forward and will fully examine the merits of South Africa's case. Finally, we talk about what global civil society can and must do to effect change where international law cannot.​​Noura Erakat is a human rights attorney and an Associate Professor at Rutgers University, New Brunswick.  She is a Co-Editor of Jadaliyya. Her book, Justice for Some: Law and the Question of Palestine (Stanford University Press, 2019)  narrates the Palestinian struggle for freedom as told through the relationship between international law and politics during five critical junctures between 1917-2017 to better understand the emancipatory potential of law and to consider possible horizons for the future. Erakat's research interests include human rights law, humanitarian law, refugee law, national security law, social justice, critical race theory, and  the Palestinian-Israel conflict. Until his retirement in December 2022, Michael Lynk taught labor law, constitutional law and international and Canadian human rights law at the Faculty of Law, Western University in London, Ontario for more than 20 years.From 2016 to 2022, he served as the United Nations Special Rapporteur for the situation of human rights in the Palestinian territory occupied since 1967. He has authored and edited several books, including most recently Protecting Human Rights in Occupied Palestine: Working Through the United Nations (Clarity Press, 2022), co-authored with Richard Falk and John Dugard, and International Law and the Middle East Conflict (Routledge, 2011), co-edited with Susan Akram, Michael Dumper and Iain Scobbie.Maung Zarni is a research fellow at the (Genocide) Documentation Center - Cambodia, co-founder of FORSEA.com, a progressive activist and intellectual platform for Southeast Asian activists, and Burmese coordinator of the Free Rohingya Coalition. He has 30-years of engagement in activism, scholarship, politics, and media.  An adviser to the Genocide Watch, Zarni served as a member of the Panel of Judges in the Permanent Peoples Tribunal on Sri Lanka ('s) genocidal crimes against Eelam Tamil (2013) and was the initiator of the Permanent Peoples Tribunal on Myanmar (2017).His most recent monographs are “The Enemy of the State” speaks: Irreverent Essays and Interviews” (2019) and “Essays on Myanmar's Genocide of Rohingyas” (2018). Israel's genocidal bombardment of Gaza has intensified its yet again, though now it's becoming less and less easy for world leaders to support it. The international movement for a Free Palestine is marching in its millions world wide and growing by the day. More than 10,000 people are now reported to have been killed across the Gaza Strip,  and residents of the West Bank are systematically being harrassed and assaulted and murdered by Israeli settlers. On today's program, Accent of Women continues it's coverage and analysis of the situation in Gaza. On Wednesday, 1 November, the Palestine Festival of Literature held an event in New York titled, "But We Must Speak: On Palestine and the Mandates of Conscience."  On that occasion, Noura Erakat delivered a powerful and stunning speech entitled “In This Moment,” in which she spoke on the genocide in Gaza from her perspective as a teacher, a legal expert, a Palestinian, as a mother, and as an activist. We are grateful to Noura Erakat, to PalFest, and to Jadaliyya for permission to feature this speech on Speaking Out of Place.Noura Erakat is a human rights attorney and an Associate Professor at Rutgers University, New Brunswick.  Noura is a Co-Editor of Jadaliyya. Her book, Justice for Some: Law and the Question of Palestine (Stanford University Press, 2019)  narrates the Palestinian struggle for freedom as told through the relationship between international law and politics during five critical junctures between 1917-2017 to better understand the emancipatory potential of law and to consider possible horizons for the future. Her research interests include human rights law, humanitarian law, refugee law, national security law, social justice, critical race theory, and the Palestinian-Israel conflict.

We are announcing the launch of The War on Palestine Podcast, an approximately 20-minute regular program available on video or audio that comprises updates on what is happening on the ground in Palestine as well as some focused analysis on how to make sense of those developments. The podcast features Noura Erakat, Ziad Abu-Rish, and Bassam Haddad. Research for this program was conducted by Mayss al-Alami, Sarah al-Yahya, Anas Alkhatib, Raneem `Ayyad, and Alaa Attiah Mitwali. The update component of the program will address key developments in a combination of the following areas: Gaza and the rest of Palestine. The United Nations and legal advocacy. Regional state's policies and statements The US media landscape Grassroots reverberations and mobilizations We will present the analysis component during the last 5 minutes of the program. It will take stock of the developments presented both for the immediate moment and the broader trajectory of the struggle for Palestinian liberation. This program is meant to be a resource for educators, activists, researchers, and laypersons wanting to follow closely as the catastrophic situation continues to unfold.

In the last two years, Human Rights Watch and Amnesty International have begun using the word “apartheid” to describe Israeli rule over Palestinians, marking a significant shift within the human rights establishment. But Palestinian intellectuals have been critiquing Israeli apartheid for decades—albeit in a different fashion. As scholars of international law Noura Erakat and John Reynolds wrote in an essay published in the summer issue of Jewish Currents, a rich archive of Palestinian writing from the 1960s and '70s frames apartheid as “an inevitable outcome of Israeli settler colonialism,” and a key “vehicle for its continuance.” Erakat and Reynolds argue that if we understand apartheid as a tool of settler colonialism, it appears to “require the same remedies as other manifestations of colonial rule and foreign occupation: collective liberation and land restitution.” By contrast, the human rights organizations have advanced a more legalistic understanding of apartheid, and suggested accordingly that the solution is to institute formal legal equality in Israel/Palestine—in other words, to extend equal rights to all who live in the land.
