We begin this episode with a series of updates on how the ongoing debates on the inclusion of trans athletes in sports are being reflected in legislature across different states. From there, Nancy speaks about how the work she is doing to fight for trans inclusion forms a part of her activism for gender equity in college sports. We talk about the policies Nancy is helping to build so that sports can be the solution for trans inclusion, and how they are fitting trans people into different sports in different ways based on their sex-linked advantage. Wrapping up, we talk to Nancy about the work she is doing to fight for the rights of Olympic athletes through the position in the Olympic Commission which she was recently promoted to.

On June 23, 2022, we will be celebrating the 50th anniversary of Title IX, the landmark federal civil rights legislation which prohibits sex-based discrimination in any school or other education program that receives funding from the federal government. We'll talk about the progress female athletes have made since Title IX's passage but also the hurdles that remain before we arrive at true equal opportunity for both genders in sports in the United States. We then move into a provocative discussion about the controversy surrounding transgender female swimmer Lia Thomas. Thomas has made the transition from biological male to transgender female and is a member of the University of Pennsylvania's women's swimming team. Since making her transition, Thomas has dominated women's swimming events. Some of her teammates have complained that she has unfair physical advantages -- derived from going through male puberty -- and that she's taking a roster spot for Ivy League and NCAA swim meets that should go to a biological female. The issue has spurred passionate debate on both sides. We talk with Nancy about the need for everyone involved to act in good will in order to find a "middle way" solution that is both fair and inclusive.

Today we are joined by Nancy Hogshead-Makar for the first in a two-part discussion on the work she is doing to fight for the inclusion of women and trans athletes in college sports. Nancy is a lifelong advocate for access and equality in athletics. She is a scholar and author who is internationally recognized as a legal expert on sports issues. Legal issues that she addresses include sexual harassment, sexual abuse and assault, employment, pregnancy, and legal enforcement under Title IX. While the list of Nancy's accomplishments is almost endless, it is also worth mentioning that she was a world-class swimmer who represented The US in the 1984 Olympics where she won three gold medals and one silver medal. In part one of my conversation with Nancy, she shares her experience at Duke University as an undergrad athlete. Please note that this episode carries a trigger warning as Nancy shares her experience of surviving rape during her time as a student. Nancy also breaks down gender equity in athletics, from the importance of the Title IX coordinator's involvement with compliance to the three-part test for measuring equal opportunities for women in sports at colleges. Professor Nancy Hogshead-Makar, is a 1980 and 1984 Olympian. At the 1984 Summer Olympics in Los Angeles, she won three gold medals and one silver medal, becoming the most decorated swimmer at the Games. She competed in the first event of the Games, the women's 100m freestyle, where she won in a tie-finish, with American teammate Carrie Steinseifer. They were both awarded gold medals. She also won golds in the 4x100m freestyle and the 4x100m medley teams, and a silver medal in the women's 200m individual medley. Nancy Hogshead-Makar is a civil rights lawyer, and CEO of Champion Women, a non-profit providing legal advocacy for girls and women in sports. She teaches at Rutgers University inside the Global Sports Business masters program, and focuses on important topics in the industry such as: equal play, traditional Title IX compliance, sexual harassment, abuse and assault, as well as employment, pregnancy and LGBT+ discrimination within sport. This week, we continue our previous discussions of Title IX and advocating for our kids throughout their academic years from kindergarten through college with attorney, Nancy Hogshead-Makar. Nancy is an Olympic champion, a civil rights lawyer, and the founder and CEO of Champion Women, a non-profit providing legal advocacy for girls and women in sports. Focus areas include equal play, such as traditional Title IX compliance in athletic departments, sexual harassment, abuse and assault, as well as employment, pregnancy and LGBT discrimination within sport. Hogshead-Makar is leading an effort turn the Olympic Movement back into a service-oriented, athlete-centric non-profit, one who’s corporate structure protects athletes from physical, emotional, financial and sexual abuse. She is the Co-Chair of the Committee to Restore Integrity to the USOPC and United States Olympians and Paralympians Unbroken, comprised of 545 Olympians, Paralympians and elite athletes, sexual abuse survivors, coaches, sport leaders, child protection and civil rights organizations. Team Integrity and USOPU provided legal memos and white papers to members of Congress, the USOPC staff and Board, and the media on the opaque operations and legal structure of the Olympic Movement. She actively participated in all four major reports of the Nassar debacle. Two federal laws have already resulted from this athlete-activism: the SafeSport Act, signed into law in February, 2018 and the Empowering Olympians, Paralympians and Elite Athletes Act of 2020, signed October, 2020. It is no wonder Sports Illustrated recently listed her as one of “The Unrelenting; the most powerful, most influential and most outstanding women in sports right now – the game-changers who are speaking out, setting the bar and making a difference.” As an internationally recognized legal expert on sports issues, Hogshead-Makar has testified in Congress numerous times on the topic of gender equity in athletics, and written numerous scholarly and lay articles. Her book, co-authored with Andrew Zimbalist, EQUAL PLAY, TITLE IX AND SOCIAL CHANGE, has received acclaim since its release by Temple University Press. She was the lead author of PREGNANT AND PARENTING STUDENT-ATHLETES; RESOURCES AND MODEL POLICIES, published by the NCAA. She serves as an expert witness in Title IX, sexual abuse, violence and harassment cases and writes amicus briefs representing athletic organizations in precedent-setting litigation. Nancy Hogshead was one of my childhood heroes. She was an Olympic swimming star at the age when I was a rising star. She set her first American record at age 14, won 4 Olympic medals and countless titles along the way. She was a full-package powerhouse with brains, beauty and as she says in this interview, "Talent was dripping from my fingers." Today Nancy is a civil rights attorney. Her focus mainly lies in two areas: Equal rights for women in sport and stopping the pervasive sexual abuse that continues to happen in sports today. Her story is incredible. Her experiences all lead her so perfectly to this place in life. That doesn't mean her experiences have all been rosy. Nancy was shunned as a young swimmer which taught her resilience. She had to deal with the frustration and heartbreak of missing the 1980 Olympics due to the USA boycott. And when she was at Duke University, she was brutally raped which led to major PTSD and a long emotional recovery. Despite all of this, she went on to be the most decorated athlete and one of America's sweethearts at the 1984 Olympics with three golds and a silver medal. Nancy is fun, open, honest and shares the greatest stories. I was laughing so hard for much of this conversation. As you listen, you will want to support her efforts for equality. Nancy Hogshead-Makar won 3 golds and a silver at the 1984 LA Olympic Games. She received a law degree from Georgetown and has devoted her life to fighting for gender equity in sports. Three years before her Olympic triumphs, Nancy was brutally raped while attending Duke University. She feared she was too emotionally damaged to swim again, but the support of her coach and community in getting her back in the water after this trauma ultimately saved her life and her sanity. The uncertainty of the recent developments has caused disruption and cancelations in the swimming community and world-wide. We wanted to have a guest who could relate to having a chance to not only swim fast but represent her country, be taken away, through no fault of her own.   Nancy Hogshead-Makar, J.D., is an American swimmer who represented the United States at the 1984 Summer Olympics, where she won three gold medals and one silver medal. She also was a member of the 1980 US Olympic Team that was part of the boycott. She is currently the CEO of Champion Women, an organization leading targeted efforts to advocate for equality and accountability in sport. Focus areas include equal play, such as traditional Title IX compliance in athletic departments, sexual harassment, abuse, and assault, as well as employment, pregnancy, and LGBT discrimination. In 2012 she began working on legislative changes to assure club and Olympic sports athletes were as protected from sexual abuse. Nancy Hogshead-Makar is an American swimmer who won 3 gold and 1 silver medal at the 1984 Olympics. She was a champion in the pool from a very early age, but her impact on sport and particularly for women in sport extends well beyond the pool. With a law degree from Georgetown University, she's been a long-time champion for women on issues including equal play, Title IX compliance, sexual harassment, abuse and assault, as well as employment, pregnancy, and LGBT discrimination. She is currently the CEO of Champion Women, an organization leading targeted efforts to change policy and advocate for equality and accountability in sport. Shanna and Kara interview Nancy to discuss all of it. Nancy Hogshead-Makar was off to an elite Olympic swimming career when her life was turned upside down during her time as a student-athlete at Duke University. Out for a routine jog on campus, Nancy was abducted and brutally raped for hours. She tells the details of this horrific experience and how she eventually used swimming to help overcome the devastating trauma. She went on to win three gold medals and one silver medal at the 1984 Los Angeles Olympics where she was the most decorated swimmer at the Games.Her aspirations led her to pursue a law degree and a career dedicated to the advancement of women and to the protection of athletes from sexual abuse & misconduct in sports. Nancy has been in the world of sexual abuse when it comes to the club and Olympic sports for 8 years now. She discusses the issues around sexual abuse in sport, updates us on the new policies taking place since the gymnasts have come forward and what we can do to protect our athletes. * Nancy has been involved in sexual abuse issues when it comes to Club and Olympic athletes for 8 years now. She shares the reasons that it has taken this long for policies to be made to protect these athletes. * The gymnasts that came forward changed the world of sport. Because of them, there is now a statue that gives the USOC, and US Center for Safe Sport a legal duty to take care of athletes.   Nancy updates us on the changes that have occurred since the gymnasts have come forward. * What are the red flags that athletes and parents can be aware of: when a coach is alone with them, that they give them a gift, texting them individually, friending them on social media that can make abuse possible. So you know she’s legit: 1977, at the age of 14, the only American swimmer to be ranked number one in the world in an international event. 1984, won three gold medals and one silver medal at the Los Angeles Olympics. The most decorated swimmer at the Games. In 2000, ranked by Sports Illustrated as Florida’s 13th greatest athlete of the 20th Century. She completed her BA in Political Science and Women's Studies from Duke University and her law degree from Georgetown University. She is one of the foremost exponents of gender equity in education, including sports participation, sexual harassment, employment, pregnancy, legal enforcement, and Title IX of the Education Amendments of 1972. She has testified before Congress numerous times, is a frequent guest on national news programs, serves as an expert witness in Title IX cases, and has written amicus briefs in precedent-setting litigation. She authored Equal Play, Title IX and Social Change (Temple University Press) and Pregnant and Parenting Student-Athletes; Resources and Model Policies (NCAA). Other major awards include the Nathan Malison Award, given to Florida's outstanding athlete, the prestigious Kiphuth Award, given to the best all-around swimmer nationally. Nancy has been inducted into eleven halls of fame, including the International Swimming Hall of Fame and the International Women's Sports Hall of Fame. In 2000, Sports Illustrated ranked her as Florida's 13th greatest athlete of the 20th Century. Nancy is a high profile advocate of gender equity in sports. She is one of the nation's foremost exponents of Title IX of the Education Amendments of 1972, particularly within the context of intercollegiate sports. She is a former President of Women's Sports Foundation (1992-94) and currently serves as its Legal Advisor. She has testified in Congress numerous times on the topic of gender equity in athletics, written numerous scholarly and lay articles, and has been a frequent guest on national news programs on the topic, including 60 Minutes, CNN, Good Morning America, and ESPN. Nancy is a Professor of Law at Florida Coastal School of Law where she teaches Sports Law and Torts courses. In 2004, she was awarded “Favorite Professor” by the first-year students. She earned her law degree from Georgetown University Law Center and is an honors graduate of Duke University.

Smith Reynolds Professor of Public Policy Studies, and author of the new book "Big-Time Sports in American Universities"; Alan Fishel (J.D. '86), lead counsel on Bowl Championship Series issues; Chris Kennedy (Ph.D. '79), Duke's deputy director of athletics; and Nancy Hogshead-Makar ('86), Olympic gold-medal winner and professor at Florida Coastal School of Law. James E. Coleman Jr., the John S. Bradway Professor of Law at Duke Law School, moderated the panel.
