Can you imagine granting personhood to AI entities? Well, some of us couldn't imagine granting personhood to corporations. And yet... look how that panned out.In this episode, Steve talks with Duke law professor James Boyle about his new book, The Line: AI and the Future of Personhood. James explains the development of his interest in the topic; it began with the idea of empathy. (Then) moved to the idea of AI as the analogy to corporate personhood.  And then the final thing – and maybe the most interesting one to me – is how encounters with AI would change our conceptions of ourselves. Human beings have always tried to set ourselves as different from non-human animals, different from the natural universe.     Sentences no longer imply sentience. And since language is one of the reasons we set human beings up as bigger and better and superior to other things, what will that do to our sense of ourselves? And what would happen if instead of being a chatbot, it was actually an entity that more plausibly possessed consciousness. Steve and James discuss the ways in which science fiction affects our thinking about these things, using Blade Runner and Star Trek to look at the ethical dilemmas we might face. As AI becomes increasingly more integrated into our society, we will need to consider the full range of implications.  James Boyle is the William Neil Reynolds Professor of Law at  Duke Law School, founder of the Center for the Study of the Public Domain, and former chair of Creative Commons. He is the author of The Public Domain: Enclosing the Commons of the Mind, and Shamans, Software, and Spleens. He is co-author of two comic books, and the winner of the Electronic Frontier Foundation's Pioneer Award for his work on digital civil liberties.

This week, we are replaying the latest installment in our virtual roundtable series, titled “Understanding the Legal and Commercial Challenges of Disinformation and Deepfakes.” For those who may not be familiar, a deepfake is a type of synthetic media where images, videos, or audio may seem real, but have been manipulated or generated with artificial intelligence. While some synthetic or manipulated media have legitimate applications, the ability of deepfakes to exploit and spread disinformation poses various commercial and legal threats, which organizations must be prepared to address. Our panel included Catherine Porter, Chief Business Officer of Prove; Hon. Paul W. Grimm (Ret.), professor of the practice of law and director of the Bolch Judicial Institute at Duke Law School; and Puya Partow-Navid, partner at Seyfarth. We discussed a variety of topics, including the biggest risks of deepfakes that organizations must tackle for consumers, the impact of deepfakes on courtroom and evidentiary rules, the legal frameworks in place to protect against deepfakes and disinformation, and technological solutions and best practices for businesses.

I don't think we can resolve the impasses without recognizing the difference between sex and gender. I think that we can have trans rights, but not by way of denying sex. In other words, the strategy that requires sex blindness in order to achieve rights for trans people is not going to work for a lot of females. And so, leaving the political right aside that doesn't want to see any gender diversity and working with people who want to be inclusive but also recognize that there are differences between females and trans women, it's going to require that trans advocates take a step back and accept that, in some places, we need to see sex, and we need to be smart about it.What does it mean to be inclusive?49:25: Being inclusive means taking into account relevant differences and ignoring differences that aren't relevant. That's really important to do, and we shouldn't shy away from that.Confronting the provocative shift in our understanding of sex and gender40:31: I think it's just a really provocative challenge to something so fundamental about ourselves and our society. Like, if you grow up understanding how fundamental sex is to you or gender is to you, and then somebody says it shouldn't be, or we're going to throw it out, or we're going to change what it means, or you can't use that word for yourself anymore, which is all the stuff that's happening, right? People are saying that you've got to start calling yourself a cis woman or, I mean, lots of vocabulary policing, all that kind of stuff about things that are so fundamental. I think it's super provocative, and I think it's super interesting. It's intellectual. It's a phenomenal intellectual challenge. It's an extraordinary political challenge.Is sex difference an equality problem?20:27: I think we've made a mistake to put all of sex into equality as an idea. That is the prism through which we view sex. Period, right? That anything you say about sex or do with sex that automatically belongs in the equality bucket, we've automatically got to, like, push it through this increasingly; it's technically intermediate scrutiny, but it's increasingly perceived as strict because that presumes that sex differences are bad. That presumes that any distinctions we would make on the basis of sex are bad. And I think that's wrong. I don't think sex is all bad. I don't think we should presume that most of it is bad. I think a lot of it is great. And so I think that we've made a mistake to see all of sex and sex differences as an equality problem.

In this episode, we feature excerpts from a 2004 interview with late Judge Robinson O. Everett (1928-2009), former Chief Judge of the United States Court of Appeals for Armed Forces. Everett graduated from Harvard University at age 19 and was admitted into the North Carolina Bar Association by age 22. Originally from Durham, North Carolina, Everett was part of Duke Law School's faculty for over 50 years - founding the University's Center on Law Ethics and National Security. In the interview, Everett shares of the importance of mentorship, his family, and the many different facets of law as he traveled from North Carolina to Washington over the course of his more than 50-year career.   "One of the nice things about being a lawyer is that you occasionally have opportunities to do something that will be very far-reaching," Everett said on the podcast. "Where you can hopefully bring about a result that will make things better for everyone." The interview was conducted by Hon. William A. BACKGROUNDRule 53 of the Federal Rules of Civil Procedure authorizes judges to appoint a “master” to assist the court when exceptional conditions prevent the assigned judge from handling all matters associated with a case. Commonly referred to as “special masters,” these judicial adjuncts address pretrial and posttrial matters that “cannot be effectively and timely addressed by an available district judge or magistrate judge.” Frequently they oversee the discovery process and resolve disputes when they arise, supervise settlement discussions, perform accountings, or compute damages. Here is a business story, that is really a humanitarian story, but overall is an incredible story of drive I believe you'll be inspired and equipped by. The story would make a great movie, and since my guest actually roomed with Matt Damon in college, it just might become one. James Rhee's parents migrated to America from Korea. James was driven to excel and please his parents, so he got into Harvard. But he really wanted to teach, so he then taught high school for a couple years. Some of his most rewarding years he says. But then he went back to Harvard and graduated from law school. But he realized he didn't want to be a lawyer so he became an investment banker. He did well, but realized he didn't want to do that either. So he worked in private equity. He did well. Very well. He appreciated helping businesses, but didn't like how disconnected he was from everything. So he quit and didn't know what to do. Then he ends up in an unlikely place - as CEO of Ashley Stewart, a fashion retailer that served plus-size, predominantly middle- and lower-income Black women. And the company was at its end. The death knell had sounded. James came in for what was supposed to be six months because he felt an obligation to help. He ended up there for seven years with a miracle turnaround story that he's now described in a book called Red Helicopter: Lead Change With Kindness. You'll hear a very personal story of James' drive, from healthy to unhealthy. You'll hear about how Ashley Stewart went from death to stardom because it became a place and brand of belonging, not fashion. You'll hear how success came, not from communication, but connection. My guest today is Nita Farahany. Nita is a professor of Law and Philosophy at Duke Law School. She is the founding director of the Duke Science and Society. She is the faculty chair of the Duke MA in Bioethics and Science Policy and Principal Investigator at slap lab. In 2010, she was appointed by President Obama to the Presidential Commission for the Study of Bioethical Issues where she served until 2017. She's an appointed Member of the National Advisory Council for the National Institute for Neurological Disease and Stroke and she is a past president of the International Neuroethics Society. This is only a small slice of her bio.The topic of this conversation is mind reading, and I don't mean trying to guess what's in somebody's head. I mean actual technology that scans your brain and reliably conveys what you are thinking or feeling. Now, this seemed like science fiction to me, but Nita convinced me in this conversation that this technology is already here, and there are a host of ethical questions relating to privacy and other things.Nita and I talk about how EEG scans can give us information about our minds. We talk about the relationship between EEG scans and classical questions in the philosophy of mind, such as consciousness, as well as free will. We talk about the uses of mind-reading technology in criminal investigations, which has already happened. We talk about the current uses of mind-reading tech in Chinese factories. And yes, that is already happening too. We talk about tattoos that can pick up your brain activity. And once again, that already exists. We talk about the combination of artificial intelligence and mind-reading tech and what that promises for the future. We talk about whether excellent liars would be able to pass mind-reading technology. We also talk about how mind-reading tech has even been used to tell whether couples are in love.
