Daily Halacha Podcast - Daily Halacha By Rabbi Eli J. Mansour

The 7th of Adar (which this year will be March 7th 2025) marks the Yartzheit of Moshe Rabbenu, and there is a custom among many to observe a fast on this day. The custom to fast on 7 Adar is mentioned already by Maran in the Shulhan Aruch (Orah Haim 580:2). The rationale behind this custom is the fact that it is customary to fast on the Yartzheit of one's primary Rabbi, as the Mishna Berura (Rabbi Yisrael Meir Kagan, 1839-1933) cites (in 568:46) from the Shela (Rabbi Yeshayahu Horowitz, 1558-1630). The Mishna Berura explains that one is obligated to honor his Rav Mubhak (primary Rabbi) even more so than his parent, and thus just as it is customary to fast on a parent's Yartzheit, it is appropriate to fast on the Yartzheit of one's Rabbi, as well. Moshe Rabbenu is, without question, the Rav Mubhak of the entire Jewish people, and it is therefore appropriate to observe a fast on his Yartzheit, 7 Adar. It goes without saying that merely refraining from food and drink is not as important as praying and studying Torah, which are the primary means of Teshuba. Therefore, it is proper on 7 Adar for communities to assemble for Torah classes in observance of this special day. The Ben Ish Hai (Rav Yosef Haim of Baghdad, 1833-1909), in the introduction to his Tikkun (service) for 7 Adar, writes that it is also customary to light candles in memory of Moshe Rabbenu on this day. There is a special custom for the Hevra Kadisha (benevolent society) of every community to observe 7 Adar together as a Ta'anit Sibur (communal fast day). They recite Selihot, wear Tefillin at Minha, and conduct the standard Ta'anit Sibur prayer service. Then, after the fast, they have a meal together. The Hevra Kadisha members observe this fast as atonement in case they were neglectful in their sacred duty to give proper respect to the deceased. The Yartzheit of Moshe Rabbenu was chosen as the appropriate occasion for this observance because his burial site remains unknown ("Ve'lo Yada Ish Et Keburato" – Debarim 34:6). Although the fast of 7 Adar is mentioned in the Shulhan Aruch, it is nevertheless preferable to declare a formal acceptance of the fast the previous day, just as is done before a voluntary private fast. If one makes a formal acceptance the day before the fast, he can then add the paragraph of "Anenu" in the Amida on the fast day. The acceptance should be declared on the afternoon of the day before the fast, at the end of the Amida of Minha, just before "Oseh Shalom." The Mishna Berura (562:27) writes that this should preferably be done at Minha Ketana – meaning, during Minha recited in the late afternoon, as opposed to early Minha (Minha Gedola). Certainly, the acceptance should not be made before Minha, and if it is made before Minha, it is ineffective. The proper text of the acceptance, as printed in many Siddurim, based upon the Hid"a (Rav Haim Yosef David Azulai, 1724-1807) in his work Moreh Be'esba (3:186), is, "Hareni Mekabel Alai Ta'anit Yahid Me'alot Ha'shahar Ad Set Ha'kochavim" – "I hereby accept upon myself a private fast from daybreak until nightfall." It is important that one accept the fast of 7 Adar as a private fast (Ta'anit Yahid), and not a communal fast (Ta'anit Sibur). The acceptance is valid even if it was made silently, in one's mind (Shulhan Aruch, Orah Haim 562:6). One should not add the words "Beli Neder" or "Beli Kabala," because he indeed intends to formally accept the fast upon himself. However, one may add a stipulation that he accepts the fast only on condition that he has the physical strength to observe the fast, and that if he feels unable to complete the fast, he will recite the chapter of Tehillim "Mizmor Le'David Hashem Ro'i" and will then be allowed to eat. If one did not make the acceptance during Minha, he may still accept the fast until sundown, and even after sundown, during the period of Ben Ha'shemashot. If one knows that observing a fast will adversely affect the quality of his prayers, or hamper his ability to study Torah properly, then it is preferable not to fast so that he could pray and study to the best of his ability. Similarly, it is improper to fast if this would cause one to feel arrogant and superior to other people. Humility and proper study and prayer are for more valuable than fifty fast days. Therefore, if observing this fast will have an adverse effect on these or other areas of Torah observance, it is far preferable not to observe the fast. Certainly, though, 7 Adar is a very significant day that should be commemorated as such in all communities.

The Shulhan Aruch (Orah Haim 135:7; listen to audio recording for precise citation) addresses a case where a Kohen, after completing the first Aliya, was called for the second Aliya, as the Mesader assumed there was no Levi in the synagogue. Just as the Kohen began, the Mesader was notified that there was, in fact, a Levi in attendance. The Shulhan Aruch rules that if the Kohen had already begun reciting the Beracha, then he continues and finishes the Aliya. If, however, the Mesader realized his mistake before the Kohen began reciting the Beracha, such as if he had only recited, "Rabanan Barechu Et Hashem," then the Levi is called in place of the Kohen.The Shulhan Aruch then writes if there indeed is no Levi in the synagogue, then the Kohen who received the first Aliya is called for the second Aliya, in place of a Levi. The reason for this Halacha, as the Shulhan Aruch explains, is that if a different Kohen is called, people might conclude that the first Kohen is not truly a Kohen. In order to avoid such suspicions, the Kohen who received the first Aliya receives the second Aliya when no Levi is present.Different customs exist regarding the issue of calling Kohanim for Aliyot after the third Aliya. Many Ashkenazim have the practice of never giving Kohanim and Leviyim Aliyot beyond the first two Aliyot. According to this custom, all Aliyot after the first two Aliyot are given to Yisraelim. Others allow calling up Kohanim and Leviyim beyond the third Aliya, but only in the sequence of Kohen, Levi, Yisrael. Sepharadim, however, allow calling up Kohanim and Leviyim for the later Aliyot, provided that two Kohanim or two Leviyim do not receive successive Aliyot. Meaning, if a Kohen receives the fourth Aliya, another Kohen may not receive the fifth. A Yisrael should receive the fifth Aliya, and then a Kohen can be called for the sixth. The same applies to Leviyim.There are, however, situations when Sephardic practice allows two Kohanim or Leviyim to receive successive Aliyot. For instance, two Kohanim can receive the Aliyot of "Mashlim" (the final Aliya before Kaddish) and "Maftir." Since Kaddish is recited in between these Aliyot, they may both be given to Kohanim or to Leviyim. This is a practical solution in situations where two Kohanim in the congregation have a Yartzheit on the same Shabbat – one can receive "Mashlim," and the other "Maftir." Another situation where Kohanim or Leviyim can receive successive Aliyot is when the Aliyot are read from different Sifreh Torah. Even if Kaddish is not recited in between the two Aliyot, they may nevertheless be given to Kohanim or Leviyim. On Simhat Torah, for example, we read from three Sifreh Torah, and thus three Kohanim or three Leviyim may be given the final three Aliyot. This applies as well when Rosh Hodesh Tevet – which is during Hanukah – falls on Shabbat, and thus three Sifreh Torah are read. The congregation may call a Kohen for the final Aliya in the weekly Torah portion, another Kohen for the Rosh Hodesh reading, and another Kohen for the Maftir reading, since all these are read from different Sifreh Torah. Hacham Ovadia Yosef, in Kol Sinai, cites an extension of this Halacha from Rav Haim Palachi (Izmir, Turkey, 1788-1869). Many congregations have the custom of selling the third Aliya during Minha on Yom Kippur, which is the Aliya of Yona and considered a great honor. Hacham Ovadia ruled that a Kohen who purchases this Aliya may be called, even though it is the third Aliya, which ordinarily must be given to a Yisrael. The reason, he explains, is that this Aliya is a "Maftir," and not an ordinary third Aliya. Moreover, the reason why a Kohen ordinarily may not receive the third Aliya is because people might suspect that he is not really a Kohen. In a case where a Kohen pledged a large sum of money to purchase the privilege of receiving the Aliya of Yona, it is clear that he is receiving this Aliya as a privilege, and not because he is not really a Kohen. Since there is no reason for concern that people will doubt the Kohen's status, he may receive this Aliya. For the same reason, this Aliya may be given to a distinguished Torah scholar who is a Kohen, as it is clear that he receives the Aliya due to his stature of distinction, and not because he is a Yisrael.Hacham Ovadia expressed opposition to the practice of some congregations to ask the Kohanim to leave the synagogue when they want to give all three Aliyot (on a weekday, for example) to a Yisrael. Sometimes there are three Yisraelim at a Minyan who need Aliyot, and so the Kohanim are asked to leave in order to make all three Aliyot available for Yisraelim. Hacham Ovadia discouraged this practice, as it infringes upon the honor due to the Kohanim. He notes that this practice was accepted in one particular instance, as documented by the Maharik (Rav Yosef Kolon, 15th century). There was a custom among some communities to sell the first Aliya on Shabbat Parashat Bereshit to the one who pledged to supply all the oil for the synagogue throughout the coming year, which involved a great deal of money. These communities would then ask the Kohanim to leave so that the person who made the pledge could receive the first Aliya. The Kohanim agreed to leave, and this custom was accepted for the sake of honoring the Torah and securing vital funds for the synagogues. Hacham Ovadia maintains that we cannot extend this custom, which was a well-established tradition at one time among certain communities, to allow asking Kohanim to leave whenever a congregation feels it wants to make all three Aliyot available for Yisraelim. Since we have no such established custom, we should not utilize this "solution" when we want to give three Aliyot to Yisraelim.Summary: If no Levi is present in the synagogue, the second Aliya is given to the Kohen who received the first Aliya. If he was mistakenly called for the second Aliya when a Levi was present, the Levi is called in his place, unless the Kohen had already begun reciting the Beracha. Sephardic practice allows giving Kohanim and Leviyim Aliyot after the third Aliya, as long as two Kohanim or two Leviyim do not receive successive Aliyot. Kohanim or Leviyim may receive successive Aliyot only if the Aliyot are separated by a Kaddish or are read from different Sifreh Torah. A Kohen may be called for the third Aliya at Minha on Yom Kippur. It is improper to ask the Kohanim to leave the synagogue to make all three Aliyot available for Yisraelim.

The Shulhan Aruch (Orah Haim 144) writes that a congregation must ensure before the Sefer Torah is brought from the ark for the reading that it is set to the right place in the Torah. If the Torah must be rolled to the right place after it is taken out of the ark, this inconveniences the congregation, and such a situation must be avoided. If the congregation realizes during the Pesukeh De'zimra section of the prayer service that the Sefer Torah had not been prepared and rolled to the proper place, then somebody must go and roll the Sefer Torah at that point so it is prepared by the time it is taken from the ark. Similarly, the Mishna Berura (Rav Yisrael Meir Kagan of Radin, 1839-1933) comments that if, on a Shabbat when two Sifreh Torah are read, it is discovered that one of the two scrolls is not set to the right place, it should be rolled while the first Torah is being read, in order to not to inconvenience the congregation.On a day when two Sifreh Torah are read, such as Shabbat Rosh Hodesh, a person may not be called for Aliyot to both Sifreh Torah. Meaning, if a person had been called for one of the seven main Aliyot, he may not then be called for the Maftir reading from the second Sefer Torah. The reason is that people might suspect that he was called for a second Aliya because the first Sefer Torah was found to be disqualified. In order that people will not cast aspersions on the first Sefer Torah, a Mesader should not call for Maftir somebody who had already received an Aliya to the first Sefer Torah. This applies also in a case where three Sifreh Torah are read. Meaning, if a person had received an Aliya to the first Sefer Torah, he may not be called to the third Sefer Torah for Maftir, despite the fact that a different Sefer Torah had been read in the interim.Under certain circumstances, the Halachic authorities permit calling a person for two Aliyot to the same Sefer Torah. Namely, if there is only one Kohen or Levi present in the synagogue, and he must therefore receive the first Aliya (in the case of a Kohen) or the second Aliya (in the case of a Levi), he may receive also the Aliya of Maftir for a Yartzheit. Since there is no other Kohen or Levi, he must receive the first or second Aliya, and he may then also receive Maftir for the Yartzheit, provided that the Maftir is read from the same Sefer Torah. Interestingly enough, this Halacha can result in a situation where a person receives three Aliyot on the same Shabbat – if the only Kohen in the synagogue has a Yahrtzeit, and there is no Levi present in the synagogue. When no Levi is present, the Kohen who had received the first Aliya is called again for the second Aliya, in place of a Levi. If he has a Yartzheit that day, he may also receive the Aliya of Maftir, as long as the Maftir is read from the same Sefer Torah as the previous Aliyot.Summary: Congregations must ensure that the Sefer Torah is rolled to the proper place before it is taken out of the ark, so the people will not have to wait for the Torah to be rolled before the reading. As a general rule, a person should not receive two Aliyot during the same reading. If, however, there is only one Kohen (or Levi) in the synagogue, and he must therefore receive the first Aliya (or second, in the case of a Levi), and he has Yahrtzeit that Shabbat, he may receive Maftir for the Yahrtzeit. If, however, a different Sefer Torah is read for the Maftir, such as on Shabbat Rosh Hodesh, then one who received an Aliya to the first Sefer Torah may not receive Maftir under any circumstances.

The Ben Ish Hai (Rav Yosef Haim of Baghdad, 1833-1909) writes (Vayeseh, 21) that within twelve months of a parent's passing, Heaven forbid, the Aliya of Maftir is the most beneficial of all Aliyot for the departed soul. This is especially so, the Ben Ish Hai adds, on Shabbatot that have a special Maftir reading, such as Shabbat Zachor, Shabbat Para, and Shabbat Rosh Hodesh. However, the Hesed La'alafim (Rav Eliezer Papo, 1786-1827) warns that if the person who receives the Aliya of Maftir does not properly pronounce the words of the Berachot or of the Haftara, then instead of bringing benefit for his departed parent's soul, he does just the opposite. Therefore, if one fears that he is unable to pronounce the words properly, he should elevate his parent's soul by giving charity, and allow somebody else to receive Maftir. The Misva is to read the Berachot and the Haftara for the congregation, and thus the words must be pronounced properly.Years ago, the one who received the Aliya of Maftir would read the Haftara for the congregation, just like on Purim one person reads the Megilla for the entire congregation, who listen attentively to the reading. The Ariizal (Rav Yishak Luria of Safed, 1534-1572), however, taught that the proper practice nowadays is for everybody to read the Haftara from the Humashim along with the person who received Maftir. The Kaf Ha'haim (Rav Yaakob Haim Sofer, Baghdad-Israel, 1867-1939) writes that for this reason, the one who recites the Berachot must have in mind that he recites them not only for himself, but also for the congregation, who read the Haftara along with him.The Shulhan Aruch writes that the Beracha over the Haftara should not be recited until the Sefer Torah is closed, as it would be disrespectful to the Sefer Torah to recite the Beracha while it is open.Many people make the mistake of answering "Amen" in the middle of the Beracha recited before the Haftara, after the words, "Ha'ne'emarim Be'emet." There is only one Beracha recited before the Haftara, which ends with the words, "Ha'emet Ve'ha'sedek," and thus one should not answer "Amen" until after these words are recited. Some people also make the mistake of answering "Amen" in the middle of the first Beracha recited after the Haftara, after the words, "Emet Va'sedek," despite the fact that the Beracha continues until "Ha'Kel Ha'ne'eman Be'chol Devarav." It is customary to pause after the words, "Emet Va'sedek," because, as the Aruch Ha'shulhan (Rav Yechiel Michel Epstein of Nevarduk, 1829-1908) explains, congregations in the olden days would sing the next portion of this Beracha – "Ne'eman Ata Hu" – along with the one reciting the Berachot. However, although a pause is made, this point does not signify the end of the Beracha, and thus "Amen" should not be recited at this point.The Shulhan Aruch writes that when Rosh Hodesh falls on Shabbat, the one reciting the Berachot after the Haftara does not mention Rosh Hodesh in the final Beracha. Meaning, when he recites, "Ve'al Yom Ha'Shabbat Ha'zeh," he does not then add "Ve'al Yom Rosh Ha'hodesh Ha'zeh." Since the occasion of Rosh Hodesh does not require the reading of a Haftara, and the Haftara is read only because it is Shabbat, Rosh Hodesh is not mentioned in the Berachot.It is customary to recite a "Mi'she'berach" prayer for each person who receives an Aliya, immediately after the Aliya. Whereas some Ashkenazic communities recite one collective "Mi'she'berach" for everybody after the Haftara, the accepted practice among Sepharadim is to recite a separate "Mi'she'berach" prayer after each Aliya. It is also customary after somebody receives an Aliya for a Yartzheit to recite the "Hashkaba" prayer for the deceased family member. It should be noted that, as the Zohar (cited by the Kaf Ha'haim) comments, we mention the deceased's name and his or her mother's name when reciting the "Hashkaba." The reason, the Zohar explains, is that while praying we must speak in definitive terms, without any uncertainty. Therefore, since the identity of a person's mother is verifiable whereas the identity of the father is only presumed, the mother's name is mentioned when praying for somebody.Those who receive Aliyot must ensure to recite the Berachot aloud, such that everybody in the synagogue can hear them, and to pronounce the words properly. This applies as well to the Berachot before and after the Haftara. The Shulhan Aruch (Orah Haim 284) writes that by listening to these Berachot, we can be considered as having recited them ourselves as part of the requirement to recite one hundred Berachot each day. While on weekdays we recite fifty-seven Berachot just by reciting the three Amida prayers, the four Amida prayers on Shabbat total only twenty-eight Berachot. In order to make up the missing Berachot so we can reach a total of one hundred Berachot over the course of the day, we should listen to the Berachot recited over the Torah reading and the Haftara. Each of the eight Aliyot (including Maftir) includes two Berachot, for a total of sixteen, and then there is one Beracha recited before the Haftara and four after. These Berachot are necessary in order for us to ensure that we recite one hundred Berachot on Shabbat. For this reason, it is important that those who receive Aliyot recite the Berachot loudly and clearly, so they can be counted toward the congregants' recitation of one hundred Berachot.
