5/28 Psalm 150 - Cultivating Praise

Key Chapters in the Bible

We know we're supposed to worship God, but sometimes it's a challenge. Today we look at Psalm 150 and talk about several key principles to worshiping our Lord in spirit and truth. Join us! DISCUSSION AND STUDY QUESTIONS: 1.    The podcast began by citing John 4:23 & 24 where Jesus said, “But an hour is coming, and now is, when the true worshipers will worship the Father in spirit and truth; for such people the Father seeks to be His worshipers. God is spirit, and those who worship Him must worship in spirit and truth.” What does it mean to worship God in our spirit according to Hid truth? Since this is what God seeks, would you say that a worshipful attitude characterizes you and your life? 2.    The podcast mentioned that the word “praise” has a wide range of meaning that can be boiled down to admiration and speaking well of someone. This word “praise” occurs in every verse for a total of 13 times in 6 verses. What does this tell you about the importance of you personally speaking well of God to Him? How is this principle reflected in your private worship? How about your worship with your church community? 3.    Keeping with the idea of “praise” meaning to speak well of the Lord, how is that principle demonstrated in verse 2? What are we to speak well about with God in this verse? How about taking a moment to reflect on “mighty deeds” that God has done (either in your life, the Bible, etc)? How is God “excellently great”? 4.    The podcast mentioned that it's important that we praise God in truth about things that are true about Him. Why is truth so important? How would a person's praise be limited by not knowing truth about God or for praising Him for things that are not true about Him? 5.    Verses 3 – 5 talk about praising God with various instruments. Do you know how to play any of these (or their modern equivalents)? Are you using that skill to worship God? How does putting praise to music deepen our connection with what we're celebrating about God? 6.    Have you ever arrived at church, or some other setting where God's people were worshiping Him, and you didn't arrive with a heart of praise? Does verse 6 give wiggle room for that kind of thinking? How might a person, who's having an off day, bring their spirit around to worshipping God? 7.    Finally, the last couple of key chapter episodes have focused on worship. Why is this instruction necessary? Is praise and worship automatic? Why or why not? 8.    In light of the priority of worship in God's Word, how might you increase the priority of praise and worship in your own life? The Hid"a (Rav Haim Yosef David Azulai, 1724-1806), in his work Abodat Ha'kodesh (listen to audio recording for precise citation), writes that one must make a special effort on Shabuot morning, after staying awake through the night, to pray properly. Many people tend to doze during the prayer service on Shabuot morning, such that they do not recite the words properly, skip sections of the service, and certainly do not concentrate on the meaning of the words. The Hid"a writes that "Yasa Secharam Be'hefsedam" – these people lose their reward for learning throughout the night by failing to pray properly in the morning. After staying awake studying Torah throughout the night, one must make an effort to remain fully awake and alert during the prayer service on Shabuot morning so he can pray properly. It should be noted that the Ben Ish Hai (Rav Yosef Haim of Baghdad, 1833-1909) viewed the period of Sefirat Ha'omer as an extended Tikkun ("repair" of spiritual imperfections in the upper worlds) that begins on the second night of Pesah and reaches its culmination in the Musaf prayer on the first day of Shabuot. Accordingly, the Shaharit and Musaf prayers on Shabuot morning are laden with spiritual significance, and it is critical for one to recite these prayers properly. One who sleeps through these prayers, or does not recite them as he should, runs the risk of forfeiting the spiritual achievements of the entire Omer period. Therefore, it is critical after staying awake on Shabuot morning to muster all one's strength to pray properly on Shabuot morning. One who suspects that he will be unable to remain awake and alert through the end of the Musaf prayer should recite Shema and then take a nap. It is preferable to complete the prayer service later, after sleeping and rejuvenating oneself, than to risk dozing during the Tefila. When is the earliest time for reciting Shaharit on Shabuot morning? Generally speaking, one should not recite the Amida prayer of Shaharit before sunrise (Netz Ha'hama). On Shabuot morning, however, some authorities permit congregations to begin the Amida before sunrise. Since it is very difficult for people to pray properly after remaining awake throughout the night, there were some who held that the prayer may be recited earlier to help ensure that everyone will be able to properly pray the entire service. This is the ruling of the Peri Megadim (492) and the Mishna Berura (89:1, and in Sha'ar Ha'siyun 5). There are many congregations that nevertheless ensure to wait until sunrise before beginning the Amida on Shabuot morning, and though this is certainly an admirable custom, those who pray the Amida before sunrise certainly have authorities on whom to rely. Indeed, the practice of Hacham Baruch Ben Haim was to pray the Amida before sunrise on Shabuot morning, and, as mentioned, this practice is perfectly acceptable. This is the ruling of Rabbi Karp in his work Hilchot Hag Be'hag (p. 132; listen to audio recording for precise citation). It should be noted that congregations that recite the Amida before sunrise on Shabuot morning must ensure not to recite Shema before the earliest time for Shema, which occurs approximately 10-15 minutes after dawn. (Generally, however, by the time these congregations reach the Shema prayer, that time has already passed.) Summary: One must make a special effort to remain awake and alert throughout the prayer service on Shabuot morning after remaining awake through the night. If one suspects that he will be unable to remain awake and pray properly throughout the service, it is preferable to recite Shema, take a nap, and then complete the prayer service properly. Although the Amida of Shaharit generally should not be recited before sunrise, some congregations have the custom of reciting the Amida on Shabuot morning before sunrise in consideration of the difficulty entailed in remaining awake and alert throughout the prayer service. This is certainly an acceptable practice.

Daily Halacha Podcast - Daily Halacha By Rabbi Eli J. Mansour

The Hid"a (Rav Haim Yosef David Azulai, 1724-1807), in his work Moreh Be'esba (2:41), discusses the unique significance of studying Mishna (listen to audio recording for precise citation). He notes that the word "Mishna" has the same letters as "Neshama" ("soul"), indicating that studying Mishna has the capacity to cleanse and rectify the soul. Citing from the students of the Arizal, the Hid"a writes that when one learns Mishnayot from Seder Zera'im, the first section of the Mishna, which begins with Masechet Berachot, he should have in mind that he seeks to correct sins involving forbidden foods and Berachot recited in vain. The soul then receives a "Tikkun" (rectification) for these sins through the learning. When learning Seder Mo'ed, which discusses the laws of Shabbat and holidays, one should have in mind to correct sins involving the desecration of Shabbat and Yom Tob. When learning Seder Nashim, one should have in mind to correct sins relating to immorality, and sins involving vows (as Seder Nashim includes the laws of vows). When learning Seder Nezikin, one should have in mind damage that he may have caused to other people. When learning Seder Kodashim, one should have in mind to atone for having profaned his sacred soul, and for laxity in the Halachot involving preparing meat for consumption (slaughtering and inspecting the animal), as these Halachot are discussed in Seder Kodashim. Finally, when learning Sefer Taharot, one should have in mind sins involving family purity, bodily emissions, and laxity in the obligation of Netilat Yadayim. (Incidentally, the fact that laxity in Netilat Yadayim requires a special Tikkun reminds us of the importance of this Misva, and how careful we must be to fulfill the obligation of Netilat Yadayim properly.) The Hid"a adds that there is nothing as valuable as the study of Mishnayot in a loud, clear voice. Furthermore, he writes, Asher, Yaakob's son, stands by the entrance of Gehinam, and rescues anyone who has studied Mishna. This is the meaning of the verse, "Me'Asher Shemena Lahmo" ("From Asher – his bread is hearty" – Bereshit 49:20). The word "Shemena" has the same letters as "Mishna," suggesting that Asher benefits people who study Mishna. This is especially appropriate and worthwhile to bear in mind as we begin a new cycle of Daf Yomi, as the study of Mishna and Talmud offers us the special opportunity to rectify our souls and reach greater heights of holiness and spirituality.

Sefirat Ha'omer – If One Remembers After Sundown That He Had Not Counted the Omer

**Today's Halacha is dedicated f or the refuah and haslacha of Ronnie, Sharon, Eli and all the children of CARE** If a person forgot to count the Omer at night, and also forgot during the following day, but remembered shortly after sundown, may he still count the Omer? Let us take the example of a person who forgot to count the 26th night of the Omer, and forgot also the following day, until a few minutes after sunset. It is obvious that he cannot count with a Beracha, since one does not recite the Beracha if he forgot to count at night and counts the following day. The question, however, is whether he can count the 26th day without a Beracha and then count the 27th day that night, after dark, with a Beracha, just as one would if he counted during the day before sundown. The 13.5-minute period immediately after sunset, which is called "Ben Ha'shemashot," is a time of "Safek" (uncertainty), which means that it is uncertain whether it is regarded as daytime or nighttime. The question thus becomes whether counting the Omer during this period fulfills the previous day's counting, or whether we must consider the possibility that the subsequent day has already begun, such that it is too late to count the previous day's counting. This issue is subject to a debate among the Halachic authorities. The Hid"a (Rav Haim Yosef David Azulai, 1724-1806), in his Birkeh Yosef, writes that in such a case one cannot continue counting with a Beracha. Hacham Ovadia Yosef, however, in his Hazon Ovadia – Hilchot Yom Tov (p. 238), disagrees, and claims that counting the Omer during "Ben Ha'shemashot" suffices to allow one to continue counting with a Beracha. He adds, however, that a person in this case must ensure throughout the remaining nights of the Omer to count after "Ben Ha'shemashot." Since he has established that he considers this period daytime, he can no longer do the nighttime counting during "Ben Ha'shemashot," as he would then be acting in a self-contradictory manner. Rav Yaakob Haim Sofer (Baghdad-Israel, 1870-1939), in his Kaf Ha'haim (#83), writes that a person in this case should ensure henceforth to hear the Beracha recited from somebody else, rather than actually recite the Beracha, in order to satisfy all views. One who wishes to follow this stringency may certainly do so, but according to the strict Halacha, an individual in this case may continue counting with a Beracha, provided that he ensures to count after "Ben Ha'shemashot," as discussed. Summary: If one forgot to count the Omer at night and also during the next day, but he counted during the 13.5-minute period after sundown, he may continue counting on subsequent nights with a Beracha. He must, however, ensure from that point on to count after this 13.5-minute period, since he has established that he treats this period as daytime. One who wishes to be stringent and satisfy all views should try to hear the Beracha from somebody else for the rest of the Omer period, rather than recite the Beracha himself.

Pesah – Drinking After the Afikoman; The Third and Fourth Cups of Wine

**Today's Halacha is dedicated f or the refuah and haslacha of Ronnie, Sharon, Eli and all the children of CARE** The Afikoman must be eaten with Heseba – meaning, while leaning on the left side. The Sages forbade eating after the Afikoman so that the taste of the Afikoman will remain in one's mouth for the duration of the night. Therefore, after one finishes eating the Afikoman, he may not eat anything else, and should immediately recite Birkat Ha'mazon. Furthermore, one may not drink anything after eating the Afikoman besides the final two cups of wine. It is permissible, however, to drink water after the Afikoman, including carbonated water, and the Halachic authorities rule that one may also drink tea or coffee. The Ben Ish Hai (Rav Yosef Haim of Baghdad, 1833-1909), in Od Yosef Hai, writes that if one needs to add some sugar to the tea or coffee in order to be able to drink it, he may do so. Hacham Abraham Antebe (Aleppo, 1765-1858) was likewise lenient in this regard, and this was also the practice among the Jewish communities in Egypt, as documented in the work Nehar Misrayim. This ruling is mentioned by the Hid"a (Rav Haim Yosef David Azulai, 1724-1806), as well, and this is the position of Hacham Ovadia Yosef. Hacham Bension Abba Shaul (Israel, 1923-1998) recommends drinking the tea or coffee without sugar, but he rules that one may add sugar if necessary. (This is also the Halacha regarding drinking before Shaharit in the morning; one may drink tea or coffee, and he may add sugar if he needs.) Other beverages, however, may not be drunk after eating the Afikoman. In the "Ha'rahaman" section of Birkat Ha'mazon, we add the special "Ha'rahaman" for Yom Tob ("Hu Yanhilenu Le'yom She'kulo Tob"). It should be noted that the custom in Halab (Aleppo), as documented in the work Derech Eretz, was not to add special "Ha'rahaman" prayers on Shabbat or Yom Tob, and to recite only the standard prayers that are included in the regular weekday Birkat Ha'mazon. Clearly, however, our community has since adopted the widespread custom to add the special "Ha'rahaman" prayers for Shabbat and Yom Tob. Immediately after Birkat Ha'mazon, one drinks the third cup of wine while leaning on his left side. One who drank without leaning must drink another cup of wine. After drinking the third cup, some have the custom to pour a special cup in honor of Eliyahu Ha'nabi and to leave it on the table throughout the remainder of the Seder. The Rama (Rav Moshe Isserles of Cracow, 1525-1572) cites a custom among Ashkenazim to then open the door as an expression of faith that Hashem will protect us on this special night, in the hope that Mashiah will come in the merit of our faith. As Eliyahu will come to herald our redemption, a special cup is poured in his honor. However, although this is the custom in many communities, the custom among Syrian Jews is to neither pour this cup for Eliyahu nor open the door. The Hallel is then recited, slowly and with festive song. The Shulhan Aruch writes that it is preferable to arrange for a Zimun (three or more men) to be present at the Seder so that the Hallel can be recited responsively, as it was in ancient times, when one person would recite "Hodu L'Hashem Ki Tob," and the others would respond, "Ki Le'olam Hasdo." Nevertheless, if a Zimun is not present, the Hallel may still be recited. The custom among Syrian Jews is to recite the regular full Hallel, followed by the chapter of Tehillim (136) "Hodu' Le'Hashem" ("Hallel Ha'gadol"), "Nishmat," "Yishtabah" (until just before the end), and then the Beracha of "Yehalelucha." The Tur (Rabbenu Yaakob Ben Asher, Germany-Spain, 12269-1343) ruled that "Yehalelucha" should be recited immediately after the standard chapters of Hallel, but our custom follows the view of the Bet Yosef (commentary to the Tur by Maran, author of the Shulhan Aruch) to recite "Yehalelucha" at the very end. After reciting the concluding Beracha of "Melech Mehulal Ba'tishbahot," we drink the fourth cup of wine, without first reciting "Boreh Peri Ha'gefen." One must drink a Rebi'it and then recite the Beracha Aharona. Some people do not drink the fourth cup until the very end of the Seder, after singing the traditional songs, but this is improper; the fourth cup should be drunk upon the conclusion of Hallel. The Shulhan Aruch writes that if one forgot to lean while drinking the fourth cup of wine, and he must therefore drink another cup, he recites a new Beracha of "Boreh Peri Ha'gefen," as this cup was not covered by the Beracha recited earlier. However, Hacham Ovadia Yosef (Hazon Ovadia – Teshubot, Siman 49) clarifies that this applies only if one realized his mistake after drinking the entire cup of wine. If some of the wine was left in the cup, then he adds some wine and drinks a new cup while leaning without first reciting a new Beracha.

Daily Halacha Podcast - Daily Halacha By Rabbi Eli J. Mansour

The 7th of Adar (which this year will be March 7th 2025) marks the Yartzheit of Moshe Rabbenu, and there is a custom among many to observe a fast on this day. The custom to fast on 7 Adar is mentioned already by Maran in the Shulhan Aruch (Orah Haim 580:2). The rationale behind this custom is the fact that it is customary to fast on the Yartzheit of one's primary Rabbi, as the Mishna Berura (Rabbi Yisrael Meir Kagan, 1839-1933) cites (in 568:46) from the Shela (Rabbi Yeshayahu Horowitz, 1558-1630). The Mishna Berura explains that one is obligated to honor his Rav Mubhak (primary Rabbi) even more so than his parent, and thus just as it is customary to fast on a parent's Yartzheit, it is appropriate to fast on the Yartzheit of one's Rabbi, as well. Moshe Rabbenu is, without question, the Rav Mubhak of the entire Jewish people, and it is therefore appropriate to observe a fast on his Yartzheit, 7 Adar. It goes without saying that merely refraining from food and drink is not as important as praying and studying Torah, which are the primary means of Teshuba. Therefore, it is proper on 7 Adar for communities to assemble for Torah classes in observance of this special day. The Ben Ish Hai (Rav Yosef Haim of Baghdad, 1833-1909), in the introduction to his Tikkun (service) for 7 Adar, writes that it is also customary to light candles in memory of Moshe Rabbenu on this day. There is a special custom for the Hevra Kadisha (benevolent society) of every community to observe 7 Adar together as a Ta'anit Sibur (communal fast day). They recite Selihot, wear Tefillin at Minha, and conduct the standard Ta'anit Sibur prayer service. Then, after the fast, they have a meal together. The Hevra Kadisha members observe this fast as atonement in case they were neglectful in their sacred duty to give proper respect to the deceased. The Yartzheit of Moshe Rabbenu was chosen as the appropriate occasion for this observance because his burial site remains unknown ("Ve'lo Yada Ish Et Keburato" – Debarim 34:6). Although the fast of 7 Adar is mentioned in the Shulhan Aruch, it is nevertheless preferable to declare a formal acceptance of the fast the previous day, just as is done before a voluntary private fast. If one makes a formal acceptance the day before the fast, he can then add the paragraph of "Anenu" in the Amida on the fast day. The acceptance should be declared on the afternoon of the day before the fast, at the end of the Amida of Minha, just before "Oseh Shalom." The Mishna Berura (562:27) writes that this should preferably be done at Minha Ketana – meaning, during Minha recited in the late afternoon, as opposed to early Minha (Minha Gedola). Certainly, the acceptance should not be made before Minha, and if it is made before Minha, it is ineffective. The proper text of the acceptance, as printed in many Siddurim, based upon the Hid"a (Rav Haim Yosef David Azulai, 1724-1807) in his work Moreh Be'esba (3:186), is, "Hareni Mekabel Alai Ta'anit Yahid Me'alot Ha'shahar Ad Set Ha'kochavim" – "I hereby accept upon myself a private fast from daybreak until nightfall." It is important that one accept the fast of 7 Adar as a private fast (Ta'anit Yahid), and not a communal fast (Ta'anit Sibur). The acceptance is valid even if it was made silently, in one's mind (Shulhan Aruch, Orah Haim 562:6). One should not add the words "Beli Neder" or "Beli Kabala," because he indeed intends to formally accept the fast upon himself. However, one may add a stipulation that he accepts the fast only on condition that he has the physical strength to observe the fast, and that if he feels unable to complete the fast, he will recite the chapter of Tehillim "Mizmor Le'David Hashem Ro'i" and will then be allowed to eat. If one did not make the acceptance during Minha, he may still accept the fast until sundown, and even after sundown, during the period of Ben Ha'shemashot. If one knows that observing a fast will adversely affect the quality of his prayers, or hamper his ability to study Torah properly, then it is preferable not to fast so that he could pray and study to the best of his ability. Similarly, it is improper to fast if this would cause one to feel arrogant and superior to other people. Humility and proper study and prayer are for more valuable than fifty fast days. Therefore, if observing this fast will have an adverse effect on these or other areas of Torah observance, it is far preferable not to observe the fast. Certainly, though, 7 Adar is a very significant day that should be commemorated as such in all communities.

Birkat Ha'gomel: The Meaning of the Words, and Whether a Child Recites the Beracha

Daily Halacha Podcast - Daily Halacha By Rabbi Eli J. Mansour

Play Episode Listen Later Jan 23, 2025

The Gemara in the ninth chapter of Masechet Berachot establishes the obligation to recite the Beracha of Birkat Ha'gomel upon emerging safely from a dangerous situation, such as illness, captivity, and travel. In the prevalent editions of the Talmud, the text of the Beracha reads, "Baruch Ata…Ha'gomel Hasadim Tovim Le'amo Yisrael" – "Blessed are You…who performs great acts of kindness for His nation Israel." Common practice, however, follows the text codified by the Rif (Rabbi Yishak of Fez, Morocco, 1013-1103) and the Rambam (Rabbi Moshe Maimonides, Spain-Egypt, 1135-1204), which reads, "…Ha'gomel Le'hayavim Tovot She'gemalani Kol Tov" – "…who performs kindness for those who bear guilt, who has performed for me great kindness." In this Beracha one gives praise to God for dealing with him kindly despite his unworthiness. Even though we might not be deserving of escaping the dangerous situations that we confront, God nevertheless intervenes and, in His abundant kindness, delivers us from danger. The individual concludes, "who has performed for me great kindness," acknowledging that he is among those who might have been deserving of punishment but was nevertheless brought into safety through God's infinite compassion. Among the interesting issues addressed by the authorities with regard to this Beracha is the question of whether a child under the age of Bar-Misva should recite this Beracha upon emerging from a threatening situation. The Hid"a (Rav Haim Yosef David Azulai, 1724-1806) claimed that Birkat Ha'gomel is no different in this regard from other Berachot. Just as a child is trained to recite other Berachot, the Hid"a argued, he should likewise be taught to recite Birkat Ha'gomel in cases where an adult would be required to do so. Others, however, held that a minor should not recite Birkat Ha'gomel, because he cannot include himself among the "Hayavim" – those who "bear guilt." Since a minor is not held accountable for his wrongdoing – for which his father bears responsibility until the child's Bar-Misva – he cannot speak of himself as being "guilty" and unworthy of God's assistance. Conceivably, one could claim that when a child recites this Beracha, the word "Hayavim" refers to his father, who bears the guilt for his wrongdoing. However, as these authorities note, it would be very disrespectful to one's father to make explicit reference to the guilt he bears for the child's misconduct. Hence, according to this view, a child before the age of Bar-Misva should not recite Birkat Ha'gomel. The Ben Ish Hai (Rav Yosef Haim of Baghdad, 1833-1909), in Parashat Ekev, records both positions, and rules that every community should follow its custom. Where it is customary for minors to recite Birkat Ha'gomel, they should continue doing so, whereas in communities where minors do not recite this Beracha, this practice should be maintained. It appears that in our community it is not customary for children to recite Birkat Ha'gomel upon emerging from a dangerous situation, and therefore, in accordance with the Ben Ish Hai's ruling, children should not be instructed to recite this Beracha. If a child wishes, he may – in a situation that would require an adult to recite Birkat Ha'gomel – recite the Beracha without the words, "Hashem Elokenu Melech Ha'olam." Additionally, if a father and son traveled together, while the father recites the Beracha he and his son may have in mind for the Beracha to apply to the son, as well. But the child should not recite the Beracha if children do not customarily do so in his community. Summary: The authorities debate the question of whether a minor recites the Beracha of Birkat Ha'gomel upon emerging safely from a threatening situation, and therefore children in each community should follow the customary practice of his community in this regard.

Daily Halacha Podcast - Daily Halacha By Rabbi Eli J. Mansour

The Shabbat prohibition of Borer forbids removing undesirable items that are mixed together with desirable items. The question arises as to whether it would be forbidden to remove bones from fish as one eats on Shabbat. The Hid"a (Rav Haim Yosef David Azulai, 1724-1806), in his work Birkeh Yosef, cites a debate among the Aharonim (post-Medieval Halachic authorities) as to whether the Borer prohibition applies to separating Pesolet (undesirable food) from Ochel (desirable food) during the eating process. On the one hand, one might argue that the Borer prohibition applies regardless of when the separation is performed; it is never permissible to separate Pesolet from Ochel on Shabbat. On the other hand, separating during the "hand to mouth" eating process might be considered an integral stage of eating. Since the Torah clearly allows eating on Shabbat, it perhaps allows separating Pesolet from one's food during eating, as this constitutes an important stage of the eating process. The Hid"a cites the Mahari Abulafia as permitting separating Pesolet from one's food as he eats, whereas the Rav Yom Tob Sahalon (1559-1638) rules stringently, and applies the Borer prohibition even to separating during the eating process. Of course, according to all opinions it is forbidden to separate Pesolet while preparing food to be served, even just before serving. The Mishna Berura (Rav Yisrael Meir Kagan of Radin, 1839-1933), in his Be'ur Halacha, notes that this issue was already debated earlier, by the Rishonim (Medieval Halachic scholars). The Ramban (Rabbi Moshe Nahmanides of Spain, 1194-1270) allowed separating during eating, while the Rosh (Rabbenu Asher Ben Yehiel, Germany-Spain, 1250-1327) ruled stringently. As for the final Halacha, the Hid"a writes that since a Torah violation of Shabbat is at stake, we must follow the stringent opinion, and refrain from separating Pesolet from food even as we eat. Rabbi Moshe Halevi (Israel, 1961-2001), in his Menuhat Ahaba, likewise rules stringently, but he adds that the lenient ruling of the Mahari Abulafia may be taken into account in situations where there are other considerations warranting a lenient ruling. With regard to removing bones from fish, Rabbenu Hananel (early 11th century) held that since the meat of the fish is attached to the bone, removing the bone does not violate the prohibition of Borer. Furthermore, some authorities held that since fish is normally eaten by first removing the bones before bringing the meat to the mouth, this would not constitute Borer, and is rather the usual manner of eating. Rabbi Moshe Halevi thus rules that in consideration of these arguments, combined with the ruling of the Mahari Abulafia, who permits separating during the eating process, we may allow removing bones from fish while eating on Shabbat. He adds that adults feeding children may separate the bones before giving the food to the children, since the children are incapable of doing so themselves. Summary: It is permissible to remove bones from fish while eating on Shabbat. One may not, however, separate the bones before serving the fish, except when serving children, who cannot separate the bones themselves.

Succot- Performing Hakafot on Shemini Aseret

Jewish communities in the Diaspora observe the eighth day of Sukkot as Shemini Aseret, and the ninth day as Simhat Torah. This is in contrast to the custom observed in Israel, where Shemini Aseret and Simhat Torah are observed together on the same day, the eighth day of Sukkot. It is customary to perform Hakafot on Simhat Torah, both in the night and during the day. Some Diaspora communities, however, have the custom to perform Hakafot on Shemini Aseret, as well. These Hakafot are generally held on the afternoon of Shemini Aseret, after Minha. The Hid"a (Rav Haim Yosef David Azulai, 1724-1806) disapproved of this practice, and held that it is improper to conduct Hakafot on Shemini Aseret. He wrote that if people perform Hakafot on Shemini Aseret, they will treat the Simhat Torah observance lightly, and not afford it proper respect. People might figure that since they already conducted Hakafot on Shemini Aseret, there is no need to celebrate on Simhat Torah. The Hid"a was therefore opposed to conducting Hakafot on Shemini Aseret, and insisted that Hakafot be held only on Simhat Torah. Others, however, disagreed. The Ben Ish Hai (Rav Yosef Haim of Baghdad, 1833-1909) wrote that nowadays there is, thank God, a good deal of awareness of and respect for Simhat Torah, and we therefore need not be concerned that people will disregard the Simhat Torah celebration. In his view, it is permissible and in fact admirable to conduct Hakafot on Shemini Aseret. This was also the opinion of Rav Yaakob Haim Sofer (1870-1939), in his Kaf Ha'haim (669:33). This is the view accepted by Hacham Ovadia Yosef, who ruled that it is entirely permissible to conduct extra Hakafot on Shemini Aseret, in addition to the regular Hakafot on Simhat Torah. Summary: It is customary to conduct Hakafot on Simhat Torah, both at night and by day. Nevertheless, there are communities that perform Hakafot also on Shemini Aseret, and although some authorities disapproved of this custom, the accepted Halacha is that this is a perfectly legitimate practice.

My guest this week is Dr. David Weill, the former director of the Center for Advanced Lung Disease and Lung and Heart-Lung Transplant Program at Stanford University Medical Center. He's currently the principal of the Weill Consulting Group, which focuses on improving the delivery of pulmonary, ICU, and transplant care. He's also the author of the new novel, All That Really Matters, which follows his memoir, Exhale: Hope, Healing, and a Life in Transplant. David talks with me about how he made the shift from surgery into writing, how healthcare workers have historically been encouraged to deny the emotional reality of their work as a defense mechanism, and how that is finally shifting; the harsh and sometimes cruel realities of the transplant world; how fiction allows greater latitude in telling the truth about those realities; why transplant patients often like to go sky diving after their surgeries; and more. Episode breakdown: 00:00 Introduction 01:31 Transplant professional documented experiences, produced two books. 05:19 Hid emotions in career, later embraced vulnerability. 06:53 Health care work strains minds, career change needed. 12:14 Interesting emotional arc, unwise career decision impacts protagonist. 16:51 Medicine's learning curve: years of motivating terror. 18:01 Mentor's patient admiration influenced his demeanor. 22:32 Some should leave jobs earlier, unlike most. 26:47 Healthcare struggles balancing patient care and profitability. 29:34 Moral injury from value misalignment in healthcare. 31:57 Left clinical role; now consulting for solutions. 36:49 Saving young lives is my most memorable work. 40:27 Enjoyed writing fiction; eager to continue exploring. 42:31 Organ allocation ethics and financial incentives examined. 45:40 Talented, flawed protagonist falls and redeems self. 50:55 Next book explores questions of identity. Kevin writes "Lets jump to my first possible encounter. Age 16 roughly 1999, my buddy gets his first vehicle ( a Chevy S10 ). That summer we decided we're going to take our first trip to the boundary waters. Another buddy decided he was going to join us as well. Here we are three 16yr old boys, our gear, and a canoe packed into this tiny truck. We entered the BWCA through the Larch Creek access point on the Gunflint Trail. We spent the next couple days portaging deeper into the wilderness. I don't remember exactly which night of the trip this happened, but it was towards the middle. It was late or early how've good like to think of it and I had to pee. There was a bright moon out, bright enough that I didn't need to bring a flashlight. I didn't stray far from the tent. I found a random rock to pee on and let it fly. This is when I found out my target rock was not a rock at all. It let out a disgusted grunt or breath in not sure which. It went from what I can only imagine was a belly crawl to upright in a blink of and eye and took off running. In the moment I thought I had just peed on a bear cub and that momma was going to be really pissed off. I ran for the tent and got back in. Originally I was closest to the opening of the tent. I got in my sleeping bag and bounced into the middle of my two buddies. Not my proudest moment I'll admit. Well this of course woke them up and after some heated words and a plee on my end, they realized I must have seen something as I was visibly shaken and my eyes were watering from the adrenaline dumping into me and an irrational fear. That night something did come into our camp but without further known incident and nothing further to report. Thinking back on this experience with a clear head, a few things stand out to me. Why did the bear cub come up off the ground and run off like a human or was it the moon light playing tricks? Why the disgust in its tone of exhale an animal wouldn't have that emotion? And why did I panic like I did? I've seen full grown black bear in the wild up close and personal while hunting both in the dark and in the light. I've seen a sow and her cubs and had to talk her down at close range from making a decision that was either going to harm her or myself. There was a irrational fear that came over me. Encounter #2 ( made into a knower not just a believer ) Roughly the summer of 2004 maybe 2005. Like I started in the beginning of my email, I'm an avid outdoorsman. During the summers I live to spend my nights in my boat on the river. Whether alone or with a buddy. This particular night my buddy and I were fishing this barge bay. We run the river full speed at night so I have large HID lights mounted on the front of my boat light truck headlights. We were anchored maybe 15'-20' off shore. One side of the bay was barging equipment, the other old growth Cottonwoods to which the bow of my boat was facing. These old growth trees are huge! So here we are, middle of the night, sitting in my boat in the pitch black. We start hearing movement coming from in the Cottonwoods. I should mention the river banks mainly consist of river silt which dampens sound. The sounds of bipedal walking are getting closer and louder. Again, panic is starting to set in. And again, I do not panic, I'm very calm under pressure. But here I am panicking. Again, it's that irrational fear, eyes watering, chest feels like it's slow motion beating out of my chest. Everything seems to slow down yet speed up at the same time. My buddy is clearly experiencing the same emotions. I flip my headlights on and standing directly in front of us is this gigantic man. You could see the shock in his eyes and on his face when the lights suddenly are turned on and he's caught directly in the beam. He did his best to hide behind a Cottonwood, but he was too large to truly hide behind it. Again, these trees are anywhere between 4'-6' around at the base. Even with having my sidearm on me it never entered my mind that I had it. All I could do was push my buddy out of the way and pull up the anchor and get the hell out of there. We did return a week later. I'm 6'3 220lbs, I'm not small. I stood in the exact spot we saw it and this thing had to be at least a foot maybe foot and a half taller then I and hundreds of pounds heavier. I remember it was dark on color and very hairy. It face was ape like but at the same time humanoid. There was no doubt it was experiencing the same shock, terror, and confusion as we were. And no I'm not projecting human traits into this thing. It was clearly intelligent enough to have those emotions while at the same time knowing to hide and curious enough to pop his head around the tree to watch what we were doing. I do not remember finding any other evidence at that time. Findings May 4th 2015 I decided to go out for a morning hike. The location is very strange for such evidence ( see attached photos ) but again within a few miles of my 2004 or 2005 sighting. I can share actual locations if you'd like to discuss further. While on my hike I was hiking a ridge line away from the paved trail. This is when I came across a tree that was snapped and twisted close to the ground. I'm the photo you can see they are not tiny trees. The amount of force needed to do that damage to a live green tree would be more than any man could ever summon. After finding these trees I was instantly in Investigator mode. This is when I found the print, like I was saying I'm 6'3 220lbs and wear a size 13.5 boot. I oddly enough only found one track but it was roughly 3-4" longer than my boot. I tried to make an impression in the ground but the ground was far too hard as it's still pretty chilly at this time of year in Minnesota.            Encounter #3 ( things get strange ) It's 2018, rifle deer opener. We hunt a very remote area at the end of an old logging road surrounded by Peet bog. One way in one way out. It's not possible to make it through the bogs alive. It's truly one way in or out. We always get up there a couple days prior to opening day. Allows us time to fully set up camp, stands, and do some grouse hunting. It's Thursday night, earlier in the day we had shot a bunch of grouse and cleaned the and through the remains at the end of the woods line in front of our camp. So here we are three of us experienced hunters and skilled outdoorsman sitting around the campfire. It's not super late maybe 2230-2300hrs, but it's plenty dark out. Sun is long gone and there's no light other than the fire glow. I don't remember which of us noticed the lights first, but I'm the protector and was instantly up or off my chair and sidearm was drawn. What we saw was two balls of light far off into the woods. The light color was that of an old lantern. We thought folks were walking towards us with only a lantern. Again, no one should've been able to make it to their location without us noticing. That's when they went out and everything went dead silent. No bugs, owls, birds, coyotes, or wolves. All which we hear on a nightly basis on a normal night. If a gnat would have dated I would've blamed it on one of my buddies it was that quiet. That's when we start hearing walking in front of us in the woods. Same direction as the lights and dead grouse carcasses were discarded. At this point one of my two buddies is out of his chair and moving to my location weapon drawn. So here we stand weapons drawn flashlights pointing in the sound direction. We can still hear the walking but cannot see anything. At the same time the walking stops we hear a voice come from directly behind camp. Very similar to what people describe as the samurai speech. It sounds like someone's trying to speak gibberish but only speaking from the back of their throats. Like a Mongolian throat singer. At this point my other buddy out now or of his chair and weapon drawn setting as the sound seemed to come from only 20' behind him. At the same time myself and my buddy standing next to me spun around to not knowing we were surrounded. This is when the walking that was in front of us took off running, the gibberish continues and then from our now left side a tree cracks and falls. The gibberish stops. And everything seems to grow still again. Needless to say if was a sleepless night. Interesting side note, that impending doom feels did not happen on this experience. In the morning we did find the fallen tree, it was dead but it was the tree we use to site our rifles in on. I should also make mention this year 2024 will mark year 27 that one of the buddies in the story and I have hunted this area. We've been hunting this area with his dad since we were kids. My wife and daughter do not like it up there and get very freaked out. My boys and I have had another incident that I could tell but I'll leave that for another time if you want. I've also had two other experiences with another buddy. Sorry for rambling, it's hard to get a lifetime in 1 email. I recently shifted work gears and I started driving dump truck. I needed a break from leading and directing employees and having the sole responsibilities of a 1.2 million sq ft building on 46 acres for the last 20 years. Driving has allowed a lot of pressure to be lifted off my shoulders, but also has allowed me to listen to your podcast and give me the encouragement to finally tell my experiences. Until now I have never formally told anyone. Yes, my buddies, family have heard most of them but never publicly. Again, sorry for the novel, hopefully I didn't waste too much of your time."

Rosh Hashanah – Are Women Required to Hear the Shofar?

The Shulhan Aruch (Orah Haim 589) writes that the obligation of Shofar on Rosh Hashanah falls under the category of "Misvot Aseh She'ha'zman Gerama" – affirmative commands that apply only at specific times – and, as such, women are exempt from this obligation. Strictly speaking, then, women are not required to hear the Shofar on Rosh Hashanah. However, as noted by the Ben Ish Hai (Rav Yosef Haim of Baghdad, 1833-1909), women have taken it upon themselves to hear the sounding of the Shofar, even though they are not strictly obligated to do so. He adds that it was customary in his community in Baghdad that when a woman was unable to attend the synagogue on Rosh Hashanah, somebody would go to her home to sound the Shofar for her, so she could fulfill the Misva. This custom mentioned by the Ben Ish Hai is noteworthy, for two reasons. First, it shows that he followed the ruling of the Shulhan Aruch that one may sound the Shofar on Rosh Hashanah for women. The Peri Hadash (Rav Hizkiya Da Silva, 1659-1698) disagrees with this position, and maintains that it is forbidden to blow the Shofar only for a woman or group of women. Sounding a Shofar is forbidden on Yom Tob, and is permitted on Rosh Hashanah only for the purpose of fulfilling a Misva. The Peri Hadash thus contends that since women are exempt from the Misva, one who has already fulfilled the Misva may not sound the Shofar for a woman. The Ben Ish Hai clearly followed the Shulhan Aruch's lenient position, that since women are, after all, credited with a Misva if they hear the Shofar, this suffices to permit blowing the Shofar for them on Rosh Hashanah. Secondly, the Ben Ish Hai's comments show that in his view, it is permissible to carry a Shofar through a public domain on Rosh Hashanah for the purpose of the blowing the Shofar for a woman. Tosafot (Talmudic commentaries by Medieval French and German scholars), in Masechet Hullin, maintained that carrying in a public domain is permitted on Yom Tob only for a "Sorech" ("need"), and blowing the Shofar for a woman does not qualify as a "Sorech" because they are not obligated to hear the Shofar. The Tur (Rabbenu Yaakob Ben Asher, 1269-1343) cites the Ba'al Ha'ittur (Rav Yishak Ben Abba Mari, 1122-1193) as disagreeing, and claiming that since a woman fulfills a Misva if she hears a Shofar, this qualifies as a "need" for which carrying is allowed on Yom Tob. In truth, all this is immaterial in light of the Shulhan Aruch's ruling (Orah Haim 518), following the position of the Rambam (Rav Moshe Maimonides, Spain-Egypt, 1135-1204), that carrying on Yom Tob is allowed under any circumstances. According to Sephardic practice, then, there is no question at all whether a Shofar may be carried through a public domain on Rosh Hashanah for the sake of blowing it for a woman, since carrying is entirely permissible on Yom Tob (as long as the object is not Mukseh). There is a famous debate among the Rishonim whether a woman who performs a Misva from which she is exempt recites a Beracha over the Misva. Tosafot, Rabbenu Tam (France, 1100-1171), and several other Rishonim maintained that a woman does, in fact, recite a Beracha, since she does, after all, receive reward for performing the Misva. And although the text of the Beracha includes the word "Ve'sivanu" ("and commanded us"), implying that even the woman is included in the command, these Rishonim explain that this refers generically to the command given to the Jewish People, and does not imply that the women are obligated. The Rambam, however, writes that if a woman wears Sisit, she does not recite a Beracha, because it is a "Misvat Aseh She'ha'zman Gerama" from which she is exempt – clearly indicating that a woman who performs a Misva from which she is exempt does not recite a Beracha. The Shulhan Aruch follows the Rambam's position, and thus rules that a woman does not recite a Beracha over the sounding of the Shofar, since she is not obligated in this Misva. Interestingly, the Hid"a (Rav Haim Yosef David Azulai, 1724-1806) concludes that despite the Shulhan Aruch's ruling, women should, in fact, recite a Beracha over Misvot which they voluntarily perform. He notes a responsum by Rav Yaakob of Marvege (France, d. 1243), a Rabbi who would pose Halachic questions before going to sleep, and then receive an answer in a dream during the night. He compiled these responses in a work entitled "Min Ha'shamayim." One of the questions he asked was whether women recite a Beracha when performing a "Misvat Aseh She'ha'zman Gerama," and the response he received was that women indeed do recite a Beracha over such a Misva. The Hid"a asserts that if Maran (author of the Shulhan Aruch) would have been aware of this response, which was shown to Rav Yaakob of Marvege in a quasi-prophetic dream, he would have accepted this ruling. Accordingly, the Hid"a ruled that women generally do recite a Beracha when they perform a "Misvat Aseh She'ha'zman Gerama." He makes an exception, however, with regard to the Misva of Shofar, noting that even in Sephardic communities in which women recited a Beracha over other Misvot, like Lulab, women would not recite a Beracha over Shofar. This is also the ruling of Hacham Bension Abba Shaul (Israel, 1924-1998). Hacham Ovadia Yosef, however, challenges the Hid"a's claim, arguing that we follow the Shulhan Aruch's rulings even if they run in opposition to the positions revealed to Rav Yaakob of Marvege. In any event, it is clear that according to all opinions, if one blows the Shofar only for a woman or group of women, no Beracha is recited. The Ben Ish Hai writes that if a woman normally hears the Shofar on Rosh Hashanah – which is, of course, the commonly accepted practice – and one year she knows she will be unable to, then before Rosh Hashanah she must perform Hatarat Nedarim, annulling her implicit vow to observe this custom. The Sha'areh Teshuba comments that it is preferable for a woman to hear the Shofar sounded by a man, rather than blow it herself or hear a woman blow it. Finally, the custom that women ensure to hear the Shofar is limited to the first 30 Shofar sounds, which are blown in the synagogue before Musaf. A woman is not required – even by force of accepted custom – to hear all 101 sounds that are blown in the synagogue; it suffices to hear just 30 sounds. Summary: Although women are exempt from the obligation of Shofar, it is customary for women to hear the first 30 sounds of the Shofar. If a woman cannot attend the synagogue, it is permissible, and proper, for a man to go to her home and blow the Shofar on her behalf. He may carry the Shofar through the public domain for this purpose. No Beracha is recited if the Shofar is being blown only for a woman or group of women. A woman who knows before Rosh Hashanah that she will be unable to hear the Shofar should perform Hatarat Nedarim.

On the morning of March 20, 1927, nine-year-old Lorraine Snyder was awakened by the sound of gentle knocking at her bedroom door and when she opened it, she found her mother bound and gagged on the floor. According to the girl's mother, Ruth Snyder, someone had broken into the house in the middle of the night, knocked her unconscious and tied her up, then murdered her husband, Albert. Ruth claimed the motive was robbery, but investigators were immediately suspicious of her. Not only was there no sign of forced entry, but Albert's murder had been particularly brutal and appeared personal. A day later, when police found Ruth's supposedly stolen items hidden in the house, her story started to fall apart. The murder of Albert Snyder had everything depression-era Americans were looking for in a media distraction—sex, extramarital affairs, fraud, and murder. From the moment Ruth and her boyfriend, Judd Gray, were arrested for the murder of her husband, they were thrust into the spotlight and would remain fixtures on the front pages of the papers across New York up to and including the final moments of their lives.Thank you to the incredible Dave White of Bring Me the Axe Podcast for research!ReferencesBeckley, Zoe. 1927.
