May 30, 2024 is a day that will live in infamy! Donald Trump became the first former President of the United States to be brought to court on felony charges and have a jury reach a verdict of guilty. Not to mention that this happened while he is currently running for President again and is the highest polling candidate. The ripple effects of this historical day will be felt indefinitely. The debates will rage over whether or not this was justice or merely political lawfare. In part 5, we cover the instructions from Judge Merchan to the jury for how to deliberate. Most of the instructions were standard fare. However, the section detailing the charges raised serious questions in my mind. The charges were 34 counts of falsifying business records in the first degree to conceal the crime of conspiracy to promote an election by unlawful means. Each juror could determine anonymously if the "unlawful means" was one or more of the following:FECA violation (campaign contributions above the federal limit)falsifying other business recordstax violations (by paying Cohen extra money to cover income taxes)Falsifying business records alone is a misdemeanor.Conspiracy to promote an election by unlawful means is a misdemeanor. The maximum sentence for all 34 charges is 136 years in prison because Trump allegedly paid for an alleged crime in 11 installments. The jury found Trump guilty of all 34 felony counts. A lot has happened since then. Sentencing has moved to September 18th.Sources Cited:Jury instructions from Judge MerchanNY Elec L § 17-152 (2021)Michael R. No One Above Law: Biden's Son Under Scrutiny for Falsifying Gun Info

Real News Now Podcast

In the courtroom, it was firmly declared that 'no individual is exempt from the rule of law,' as allegations were leveled against Hunter Biden, President Joe Biden's son. Hunter is facing accusations for allegedly falsifying information about his drug habit while procuring firearms back in 2018. Asserting the compelling nature of the evidence, Prosecutor Leo Wise emphasized that Hunter Biden was grappling with a serious crack addiction when he made the affirmation on an obligatory firearms-purchase form that he wasn't engaged in illegal drug use or addiction. Prosecutor Leo Wise, in his concluding argument, evoked text messages allegedly illustrating Hunter Biden's attempts to negotiate drug transactions before and after his gun acquisition. These messages formed a significant portion of the evidence presented. The content of these messages was deeply personal and intense, amplifying the case's grim tone but deemed essential by Wise. Despite facing three felony charges arising from his gun procurement in October 2018, a weapon he possessed for merely 11 days, Hunter Biden pleaded innocent. He has firmly positioned these charges as political tactics, with the Biden family accusing the Justice Department of succumbing to former President Donald Trump and his allies' pressure to file this gun case, as well as additional independent tax charges, after their negotiation with prosecutors disintegrated last year. Defense for Hunter Biden engaged three witnesses, including his daughter Naomi, in an attempt to establish that Hunter didn't consider himself an 'addict' when completing the form. This case shines a spotlight on a tumultuous period in Hunter's life following the tragic loss of his brother, Beau, back in 2015. His trials and tribulations with addiction before his recovery over five years ago are well known.  See omnystudio.com/listener for privacy information.

In this episode of Passing Judgment, we delve into the historic conviction of former President Donald Trump on 34 counts of falsifying business records. We also discuss the possible ramifications, including whether Trump can vote or run for president as a convicted felon, potential sentencing outcomes, and the likelihood of appeals. Here are three key takeaways you don't want to miss:1️⃣ Felony Elevation: Falsification of business records is typically a misdemeanor. It becomes a felony if done to commit or conceal another crime. In this case, the prosecution argued it was to unlawfully interfere with the election by committing federal campaign finance violations, tax fraud, or falsification of other business records.2️⃣ Sentencing: Trump's sentencing is set for July 11th. Jessica anticipates probation rather than prison time due to the non-violent nature of the crimes and Trump being a first-time offender.3️⃣ Impact on Presidential Run: The conviction does not bar Trump from running for or serving as President. The Constitution only precludes those convicted of insurrection from holding office.Join us as Jessica unpacks the legal intricacies of this unprecedented case and its implications for the future.Follow Our Host: @LevinsonJessica

Donald Trump became the first U.S. president to be convicted of a crime on Thursday when a New York jury found him guilty of falsifying documents to cover up a payment to silence Stormy Daniels ahead of the 2016 election. After deliberations over two days, the 12-member jury announced it had found Trump guilty on all 34 counts he faced. Unanimity was required for any verdict. Trump watched the jurors dispassionately as they were polled to confirm the guilty verdict. Justice Juan Merchan set sentencing for July 11, three days before the start of the Republican National Convention expected to formally nominate Trump for president. Wildfires are a fact of life in the American west.  They have played a major role in our western ecosystems for millenia.  But as the climate crisis deepens, and more people move into wildfire country, fires loom larger and larger in the public consciousness.  Wildfires are reshaping everything from our landscapes to our politics, and the implications of how we respond to them will play a huge role in shaping our future. In the midst of this, a scientific debate is raging over what the science tells us about how to protect communities and live with fire.  At the heart of that debate is the Forest Service.  As the manager of almost 200 million acres of land, there is a tremendous amount at stake in how the US Forest Service interprets that science and implements management policy. So I'm excited to be joined by one of the authors of a new scientific paper alleging that the forest service has been falsifying the scientific record around wildfires in order to justify more logging on federal lands.Chad Hanson is the director and principal ecologist for the California based John Muir Project, which he co-founded in the 90s. The Rich Zeoli Show- Hour 1: During Donald Trump's Tuesday afternoon arraignment, the former president learned about the charges that have been brought against him. According to numerous reports, Trump pled not guilty to 34 felony counts before State Supreme Court Justice Juan M. Merchan. During the arraignment, Trump's attorneys are expected to request a change of venue—arguing that Trump is unlikely to receive a fair trial in Manhattan, an area that votes overwhelmingly in favor of Democrat party candidates. The New York Times reports: “Mr. Trump's 11-vehicle motorcade arrived just before 1:30 at the district attorney's office, part of the towering Manhattan Criminal Courts Building. While in custody, he was fingerprinted like any felony defendant, but special accommodations were made for the former president: He spent only a short time in custody and he was not expected to be handcuffed or have his mug shot taken.” You can read more here: https://www.nytimes.com/live/2023/04/04/nyregion/trump-arrest-arraignment During her Tuesday press briefing, White House Press Secretary Karine Jean Pierre refused to comment on Manhattan District Attorney Alvin Bragg's indictment of Donald Trump. Fox News journalist Peter Doocy asked if the Biden Administration was concerned that Bragg's indictment of Trump will result in other local D.A. offices across the country targeting political rivals. Michael Gold of The New York Times reports that former President Donald Trump “has been charged with 34 felony counts of falsifying business records in the first degree. The charges against Mr. Trump are all class E felonies, which are the lowest category of felony offense in New York and carry a maximum prison sentence of four years per count. Under New York law, falsifying business records is generally a misdemeanor.” You can read more here: https://www.nytimes.com/live/2023/04/04/nyregion/trump-arrest-arraignment/trump-charges-falsifying-business-records?smid=url-share Following Trump's arraignment, Manhattan District Attorney Alvin Bragg released a statement on Twitter: “Manhattan is home to the country's most significant business market. We cannot allow New York businesses to manipulate their records to cover up criminal conduct. As the Statement of Facts describes, the trail of money and lies exposes a pattern that, the People allege, violates one of New York's basic and fundamental business laws. As this office has done time and time again, we today uphold our solemn responsibility to ensure that everyone stands equal before the law.” You can read the full statement here: https://www.manhattanda.org/district-attorney-bragg-announces-34-count-felony-indictment-of-former-president-donald-j-trump/
