Chapter 2: General Principles of Criminal Liability Actus Reus (The Criminal Act) Actus reus, or the "guilty act," is a fundamental component of criminal liability. It refers to the physical act or unlawful omission that constitutes a crime. The actus reus can take various forms, including voluntary bodily movements, omissions to act when there is a legal duty to do so, and possession of illegal substances or items. Voluntary Acts: For an action to be considered actus reus, it must be a voluntary act. This means the act must be a conscious and willful bodily movement. Involuntary actions, such as those occurring during a seizure or under duress, do not typically constitute actus reus. Omissions: In some cases, failing to act can fulfill the actus reus requirement if there is a legal duty to act. Legal duties to act can arise from statutes, contracts, relationships, voluntary assumption of care, or creation of peril. For example, parents have a legal duty to provide care for their children, and failing to do so can result in criminal liability. Possession: Possession of illegal items (such as drugs or unregistered firearms) can constitute actus reus. Possession can be actual (physical control) or constructive (having control or the ability to control an item even if it is not in one's direct physical possession). Mens Rea (The Criminal Intent) Mens rea, or the "guilty mind," refers to the mental state or intent required to commit a crime. Different crimes require different levels of mens rea, ranging from specific intent to strict liability, where no intent is required. Specific Intent: Some crimes require that the defendant have a specific intent or purpose to bring about a particular result. Examples include premeditated murder and burglary. General Intent: General intent crimes require that the defendant intended to perform the act that constitutes the crime, but do not require intent to achieve a specific result. Examples include battery and rape. Recklessness: Recklessness involves consciously disregarding a substantial and unjustifiable risk that a certain result will occur from one's actions. This level of mens rea is often seen in crimes like manslaughter. Negligence: Criminal negligence occurs when a person fails to be aware of a substantial and unjustifiable risk that their conduct will cause a particular result, and this failure constitutes a significant deviation from the standard of care a reasonable person would observe. Strict Liability: Strict liability crimes do not require any mens rea. The mere commission of the act is sufficient for criminal liability. Examples include statutory rape and many regulatory offenses, such as selling alcohol to minors. Concurrence of Actus Reus and Mens Rea For a defendant to be found guilty of a crime, there must be a concurrence between the actus reus and the mens rea. This means that the defendant's criminal intent must coincide with the criminal act. For example, if a person plans to commit theft and then carries out the act, the intent and the action are concurrent. Causation and Harm Causation is a critical element in establishing criminal liability. It links the defendant's actions to the resulting harm. There are two types of causation: factual causation and legal causation. Factual Causation: Also known as "but-for" causation, it means that the harm would not have occurred but for the defendant's actions. For instance, if a person shoots another, and the victim dies as a result, the shooter is factually responsible for the death. Legal Causation: Also known as proximate causation, it considers whether the harm was a foreseeable result of the defendant's actions and whether it is fair to hold the defendant legally responsible. 1. Principal Actors: Principals and Accomplices. In criminal law, parties to a crime are classified based on their level of involvement in the commission of the crime. This classification is important because it determines the extent of each party's criminal liability. Principals. Definition and Role: A principal is the primary actor in the commission of a crime, the person who actually performs the act constituting the offense. Principals are often the most directly involved and are usually present at the scene of the crime. Types of Principals: Traditionally, principals are categorized into first and second degree. The first degree includes those who actually perform the criminal act, while the second degree encompasses those who aid, command, or encourage the principal and are present during the crime. Liability of Principals: Principals are fully liable for the crimes they commit. Their intent and actions are directly scrutinized in determining their guilt. Accomplices. Definition and Role: Accomplices are individuals who assist in the commission of a crime but are not the primary actors. They might provide help, encouragement, or support to the principal. Liability of Accomplices: Accomplices are usually liable to the same extent as the principal. This means they face the same charges and penalties as the person who actually commits the crime, as long as it can be proven that they had the intent to assist and did indeed assist in the crime. Mens Rea of Accomplices: An accomplice must have the requisite mens rea, or guilty mind, to be criminally liable. They must intentionally aid or encourage the principal in the commission of the crime. Actus Reus of Accomplices: The actus reus, or guilty act, for an accomplice, is their action in aiding, abetting, or facilitating the crime. This could include providing tools, planning the crime, or helping to hide evidence. 2. Accessory After the Fact. Definition and Role: An accessory after the fact is a person who assists the principal or an accomplice after the crime has been committed. Their assistance usually involves helping the principal or accomplice escape arrest, trial, or conviction. Liability of Accessory After the Fact: The liability of an accessory after the fact is generally less than that of the principal or accomplice. This is because their involvement does not directly contribute to the commission of the crime but rather assists after the fact. Elements of Being an Accessory After the Fact: The essential elements include knowledge that a crime has been committed and some act of assistance or support to the principal or accomplice with the intent to hinder or prevent their arrest, trial, or punishment. 3. Inchoate Offenses: Attempt, Conspiracy, and Solicitation. Inchoate offenses are crimes that involve taking steps toward committing a crime but not completing the crime itself. These are critical in criminal law as they aim to prevent crimes before they occur. Attempt. Definition and Elements: An attempt to commit a crime involves a person taking substantial steps towards committing a crime but failing to complete it. The key elements are intent to commit the crime and taking a direct, ineffectual act towards its completion. Legal Tests for Attempt: Courts use various tests to determine whether an individual's actions constitute an attempt. These include the proximity test (how close the person came to completing the crime), the unequivocality test (whether the person's actions unequivocally demonstrate the intent to commit the crime), and the substantial step test (whether the actions taken are substantial steps towards committing the crime). Conspiracy. Definition and Elements: Conspiracy involves an agreement between two or more persons to commit a crime. The Common Law Approach relies on judicial decisions and precedents to define and interpret criminal laws. Homicide. Overview of homicide as a crime. Murder: Degrees and elements. Case Study: State v Johnson - Applying degrees of murder. Overview of homicide as a crime: Homicide is the unlawful killing of another person and is considered a criminal offense. Murder: Degrees and elements: Murder involves the intentional killing of another person, with degrees (first-degree, second-degree) defining the level of intent and severity of the crime. Assault and Battery. Defining assault and battery. Distinction between assault and battery. Assault with intent vs. simple assault. Case Study: People v Ramirez - Analyzing assault charges. Defining assault and battery: Assault is the threat of physical harm, while battery is the actual physical harm caused to another person. Distinction between assault and battery: Assault involves the threat of harm, whereas battery involves the actual application of force or contact. Assault with intent vs. simple assault: Assault with intent implies an intention to harm, while simple assault lacks specific intent to harm. Theft Crimes. Types of theft crimes. Legal elements of theft crimes. Case Study: State v Smith - Analyzing theft charges Types of theft crimes: Theft crimes encompass various offenses, including larceny, embezzlement, and robbery, involving the unlawful taking of someone else's property. Legal elements of theft crimes: These elements typically include taking, intent to permanently deprive, and the lack of consent. Sexual Offenses. Legal definitions and elements of sexual offenses. Consent and consent laws. Case Study: Commonwealth v Anderson - Analyzing a sexual assault case. Legal definitions and elements of sexual offenses: These offenses involve sexual misconduct and are defined by specific elements that must be proven in court. Consent and consent laws: Consent laws govern the requirement for voluntary and informed consent in sexual activities. Defenses to Criminal Liability. Insanity defense and its rules (M'Naghten, Irresistible Impulse, Durham). Self-defense and its elements. Case Study: State v Thompson - Analyzing self-defense claim. Insanity defense and its rules (M'Naghten, Irresistible Impulse, Durham): The insanity defense is based on a defendant's mental state at the time of the offense and is assessed under various legal standards, including M'Naghten, Irresistible Impulse, and Durham rules. A wooded copse, a policeman with a gun lying in wait for a repeat offender... sounds like a Scandi crime drama, but actually it's a case from Victorian England.   Also; Actus Reus and the overlap into Mens Rea. What are Assizes? What are summary and indictable offences and what exactly is a felony? And in a world exclusive, we examine the question on everyone's lips, what is an Ox Bow Lake and how are they formed? 

Actus reus, sometimes called the external element or the objective element of a crime, is the Latin term for the "guilty act" which, when proved beyond a reasonable doubt in combination with the mens rea, "guilty mind", produces criminal liability in the common law−based criminal law jurisdictions of England, Canada, and the United States of America. In the United States, Some crimes also require proof of attendant circumstances and-or proof of a required result directly caused by the actus reus. Definitions. The terms actus reus and mens rea developed in English law are derived from the principle stated by Edward Coke, namely, actus non facit reum nisi mens sit rea, which means: "an act does not make a person guilty unless (their) mind is also guilty"; hence, the general test of guilt is one that requires proof of fault, culpability or blameworthiness both in thought and action. In order for an actus reus to be committed there has to have been an act. Various common law define act differently but generally, an act is a "bodily movement whether voluntary or involuntary." In Robinson v California (1962), the U.S. Supreme Court ruled that a California law making it illegal to be a drug addict was unconstitutional because the mere status of being a drug addict was not an act and thus not criminal. Commentator Dennis Baker asserts: "Although lawyers find the expression actus reus convenient, it is misleading in one respect. It means not just the criminal act but all the external elements of an offence. Ordinarily, there is a criminal act, which is what makes the term actus reus generally acceptable. But there are crimes without an act, and therefore without an actus reus in the obvious meaning of that term. The expression 'conduct' is more satisfactory, because wider; it covers not only an act but an omission, and (by a stretch) a bodily position. The conduct must sometimes take place in legally relevant circumstances. The relevant circumstances might include consent in the case of rape. The act of human sexual intercourse becomes a wrongful act if it is committed in circumstances where one party does not consent and/or one or more parties concerned are below the age of consent. Other crimes require the act to produce a legally forbidden consequence. Such crimes are called result crimes. ... All that can truly be said, without exception, is that a crime requires some external state of affairs that can be categorized as criminal. What goes on inside a person's head is never enough in itself to constitute a crime, even though it might be proven by a confession that is fully believed to be genuine." Certain names in Metal are uttered in hushed tones of reverence, as if belonging to godlike, super-advanced creatures from other dimensions. Such respect and reverence are deserving of genre defining prodigies and artists who are often light-years ahead of their own time.  In this instance, we’re referring to The Riff Lord Wizard sent to further evolutionize Metal to yet another level of genius rifftactical badassery:   Enter (and HAIL) CHUCK SCHULDINER.   “The Godfather of Death Metal” helped spawn an entirely new genre of metal, blending all of the best elements of progressive and thrash metal while simultaneously intensifying the technicality, musicianship, and profound, thought-provoking lyricism (already inherently part of bolth genres) with beautifully precise craftsmanship and flawlessly executed production.  (And to think, at the time, we just thought it was the next wave of Thrash…Nope.  This was CHUCK SCHULDINER.  This was DEATH.  THIS was the dawn of Death Metal!)   Grab your train-whistle and blow off that morning meeting (really, you’ll be better once you’re fully relaxerized and caffeinated anyway), because after you phone in your order for Ron’s signature Nacho Relaxerole you’re gonna wanna JOIN US as we talk about the multi splendored genius of CHUCK SCHULDINER and DEATH. The terms actus reus and mens rea developed in English Law are derived from the principle stated by Edward Coke, namely, actus non facit reum nisi mens sit rea, which means: "an act does not make a person guilty unless (their) mind is also guilty"; hence, the general test of guilt is one that requires proof of fault, culpability or blameworthiness both in thought and action. In order for an actus reus to be committed there has to have been an act. Various common law jurisdictions define act differently but generally, an act is a "bodily movement whether voluntary or involuntary." In Robinson v. California, 370 U.S. 660 (1962), the U.S. Supreme Court ruled that a California law making it illegal to be a drug addict was unconstitutional because the mere status of being a drug addict was not an act and thus not criminal. Commentator Dennis Baker asserts: "Although lawyers find the expression actus reus convenient, it is misleading in one respect. It means not just the criminal act but all the external elements of an offence. Ordinarily, there is a criminal act, which is what makes the term actus reus generally acceptable. But there are crimes without an act, and therefore without an actus reus in the obvious meaning of that term. The expression “conduct” is more satisfactory, because wider; it covers not only an act but an omission, and (by a stretch) a bodily position. The conduct must sometimes take place in legally relevant circumstances. The relevant circumstances might include consent in the case of rape. The act of human sexual intercourse becomes a wrongful act if it is committed in circumstances where one party does not consent and/or one or more parties concerned are below the age of consent. Other crimes require the act to produce a legally forbidden consequence. Such crimes are called result crimes. ... All that can truly be said, without exception, is that a crime requires some external state of affairs that can be categorized as criminal.
