Recently-appointed Department of Energy Undersecretary Kyle Haustveit says that when people talk about transitioning on energy sources, they aren't talking about reality. "We've never transitioned from any fuel source in the world in the history of mankind," he said on this episode of Plain Talk, recording with us from the Williston Basin Petroleum Conference in Bismarck. "We consume more wood and dung or biomass today than we ever have before. Same with coal, oil, natural gas, nuclear, wind, solar, geothermal." "The charts are all up and to the right," he added. Going forward, we need to start by asking what we need from our energy? Is it low prices? Low carbon intensity? "What do you have available in your region? How do we prioritize responsible development to maintain affordable, reliable, secure energy for the people that need it most?" he said we should be asking. Also, he says we need to grow to meet new demands for power. "For years, it's been far too easy to stop things and far too hard to start building things," he said, crediting President Donald Trump's administration with changing some of that. Also on this episode, Supreme Court Justice Jerod Tufte and Cass County State's Attorney Kim Hegvik join to celebrate North Dakota's drug courts or, to use the new terminology, treatment courts. These are specialized proceedings in the criminal justice system that still prioritize accountability for crimes, but also focus on helping people solve problems. They were called drug courts because they started out focusing on addiction, though these days there are lots of different types, including some specializing in the specific issues veterans might face. "Right now we run most of these at close to capacity, and so we have a pretty good population of people that have shown that they are high-risk, high need," Justice Tufte said. "So these aren't the lowest level, first-time offenders. These are people that by and large would be incarcerated if they weren't in a drug drug court or a treatment court program." Hegvik and Tufte said the treatment courts save the state money by keeping offenders out of jail, and they also reduce recidivism. Ariston Johnson is Watford City-based attorney who is challenging incumbent Supreme Court Justice Jerod Tufte, who is in the process of wrapping up his first 10-year term on the court. There are actually two Supreme Court races on the ballot this cycle. Justice Douglas Bahr is running to have his appointment by Gov. Doug Burgum to finish former Justice Gerald VandeWalle's term confirmed by voters. Why is Johnson challenging Tufte and not Bahr? He said it's because defeating Tufte would mean a full term on the court. Also, Bahr, a former government attorney, has more of the experience Johnson believes the state's top court needs. "Frankly, if the election ballot offered Ari Johnson or Douglas Bar, I would vote for Douglas Bar because the court needs that. perspective," Johnson said on this episode of Plain Talk. He also addressed the increased politicization of the judiciary. At the national level, U.S. Supreme Court justices are now routinely referred to by their ideologies. In other states, like Wisconsin, judicial elections have become hyper-partisan affairs. So far, that hasn't happened in North Dakota, and Johnson says he doesn't want it to. "I am myself generally apolitical. I don't bring my politics to work and I would not bring them to the Supreme Court," he said. "It is a nonpartisan race and it should be a nonpartisan job." "If the law compels a decision, then the Supreme Court should make that decision. If the law is wrong, the legislature should write a better law," he continued. "Judges shouldn't decide policy and they shouldn't decide law. They should apply the law under our constitutional system with the checks and balances." Also on this episode, me and former Gov. Ed Schafer, who served as a guest co-host, discussed the tragic passing of state Rep. Liz Conmy, the complications existing term limits laws impose on the process of appointing her replacement, and whether Measure 1, which would reform those current term limits laws, is something voters should support. North Dakota doesn't typically see competitive judicial races, particularly for the state Supreme Court. But even when voters do have a choice, the candidates themselves are prohibited by ethical considerations from campaigning the way other candidates do. They can't tell voters how they'd rule on a particular case, or, for incumbents, why they ruled the way they did on previous cases. But judicial candidates can be "reassuring people that that you understand the proper role of the court and that that you will apply the law as it's written and not become somebody that people worry will stray outside into policy aspects," Supreme Court Justice Jerod Tufte said on this episode of Plain Talk. Tufte is concluding a 10-year term he was elected to in 2016, and campaigning for a new one. Tufte is facing a challenge from Watford City attorney Ari Johnson, who will be on a future episode of Plain Talk. Tufte says that a big part of the job is ruling on the law, and not public opinion. "We have to have a thick skin. We have to expect people will criticize our written opinions and find flaws, gaps or areas of disagreement ,and how we express our legal reasoning and how we apply to the the law to a particular case," he said. "But you have to just apply the law in every case regardless of what kind of person is before you, rich or poor or on one political team or the other, or part of one industry or another." "A lot of people focus on results rather than methods," Tufte added, noting that when the courts aren't producing the results the people want, they should ask legislators and executive branch officials for change. They welcome a very good, but decimated New Jersey Devils team who is down their superstar Jack Hughes.At this point, we don't think the Avs care who they are facing. They need to get back to Avalanche hockey and start scoring goals again.The team did announce a call-up from the AHL Colorado Eagles. Many were assuming the next player to get the call-up would be Riley Tufte. He's been killing it with the Eagles and in the small sample size with the Avalanche has impressed. But he was not who they called up. That went to Ondrej Pavel.There could be multiple reasons why this call-up went to Pavel and not Tufte. Jared Bednar has stated he wants to get many players involved and get them some time. If the Avs feel like Pavel has a role with the club throughout the season, they want to give him some time now while it's still early in the season.It also has waiver implications. If the Avs were to call up Tufte, they would have to place him on waivers if they eventually send him down, which there is a very good chance he would get claimed, or at least they feel he could. Lisbon transit cartographer and designer Aurélien Boyer-Moraes talks learning to use a computer at 19, creating his first 3x4 ft. transit map of an imagined Brazilian city after reading Jacques Bertin's Semiology of Graphics cover-to-cover, preempting Google Street View in Lyon with his 6x6 Seagull camera, ten years of designing transit maps for French cities with Attoma, and his heavily-annotated collection of 2,100 transit and city maps (which he might let you see someday.) See his maps at https://transit-map.com/Indented below are Aurélien's notes on my notes (he is, as you can imagine, a precise man). Transit maps originally designed by Aurélien Metz, and Aurélien's original design  “The colors were imposed, there was no discussion, the use of these specific colors was mandatory because they were the new colors of the authority overseeing the transport in the agglomeration. They do not convey any specific information, which is against my general ‘credo', but we had to use them in the map.” Toulouse “My map had a strong palette which was consistent with the offer (the headways and the span of service) as you can see in the original from sept 2013, but it was scrapped in-house.” Dijon “A picture of a bus stop with the maps displayed (plan schématique général and the city center) and a pdf of an early version of the paper maps as they were issued in three different configurations: North, SE and SW (SO for sud-ouest), only the geographic map changed accordingly, the plan schématique remained the same, it was the reference. This initial configuration was irrelevant for a city of this size (250,000 inhabitants), then they reversed back to a single issue with, on one side the schéma + the center + information, and overleaf the geographic map.” Lyon, and Aurélien's original design Milan street map, completed in under two weeks Lisbon bus, tram and subway map Marseilles transit as of 1957 Vignelli's 1972 NYC subway map (cropped seven years later without his input, quelle horreur!) “I have a lot of respect for the early version of the map that the MTA committee led by Tauranac (with Michael Hertz as designer) released in 1979 (and was left almost untouched until the 1990s).One of the most relevant features of this map was the introduction of a very well thought out color code system by trunk in Mahanttan, which finally served also Vignelli since it makes his redesign of 2008 even more efficient! I am not a ‘blind pro-Vignelli, all against-1979 map.' It is way more subtle than that.Although the 1979 map evolved in such a wrong way since the mid-1990s, that today it is a spaghetti plate, and the redesign—first with the weekender and then with the opening of the first section of the 2nd subway line (after the demise of Vignelli)—by Cifuentes-Waterhouse in 2017 is more than ever powerfull thanks to the work of the 1979 committee.” Jarret Walker: a transit planning consultancy Sanborn insurance maps of Manhattan Two cartographers Aurélien would like to honor: “A Frenchman (for once) civil engineer from the prestigious École des ponts et chaussées, from the 19th century Charles-Joseph Minard (1781-1870) whose work is stilll pretty obscure to the general public, I learnt about him while reading The Visual Quantitative Display of Quantitative Information by Tufte, and you can easily find information about his impressive charts on the www.” “A Swiss designer (alive) who worked mostly in France, Rudi Meyer, he designed the 1976 splendid RER diagram and the French Railway system map that was on display from the late 1970s until 2011 in the trains. This season has been crazy left and right with changes to the NHL schedule, NHL season plans, and even NHL rosters. But what about the AHL? The American Hockey League is the minor league affiliate to the NHL, and each team has a respective affiliate where their prospects play and can be called up at anytime to make their big break with their NHL club. We are joined by Riley Tufte - a forward for the Texas Stars and 1st Round Draft pick for the Dallas Stars who is now developing in the AHL. Riley chats with us about how he got to the major leagues, from his hockey development, time in college, and the intense training, as well as what the AHL season has been like in COVID-19. The AHL COVID-19 protocol has been similar to the NHL, but the playoffs were greatly effected. The AHL will not be playing for their version of the Stanley Cup, called the Calder Cup, and has changed how they will hold their playoff run. All of this and more as we sit down with Riley Tufte!
