How design authority leads to product safety liability

In this episode... Sofeast's CEO Renaud Anjoran is joined by two guests, Clive Greenwood and Andrew Wilson of WWMG associates to discuss the topic of liability for product safety issues. There's commonly a disconnect between Chinese manufacturers and their foreign customers over who is liable for any problems, such as consumer injury, caused by the products that they worked on. It depends on a number of things, such as who has the design authority and who issues the design specifications, etc. If you are importing products you really need to have a handle on liability, as the consequences could be extremely costly and uncomfortable. The panel aim to get to the bottom of it here...   Show Sections 00:00 - Introduction.  01:26 - When an American company, for example, works with a Chinese manufacturer to develop a new product, what do they expect the manufacturer to tell them?  05:00 - Product liability laws in the US & EU.  07:53 - How 'design authority' can be used to attribute liability.   12:09 - Post-DFMEA liability.  15:43 - Why letting your Chinese manufacturer 'help' develop a product could be a big mistake.  21:13 - Compliance for medical devices/products.  24:01 - Action items for companies who're designing a general consumer product to be manufactured in China.  31:58 - Product safety. What do we need to consider?  38:29 - Conclusion.  40:49 - Wrapping up.   Related content... Paul is spent. After the 3 hour epic that was episode 181, Paul is out of material so reluctantly he hands over the reigns to Eli. What happens over the 60 minutes is all on Eli, Paul washes his hands of it completely. So... This week expect the stank of Eli's desires as he throws everything from noodles to sauces into the pot and adds a dash of The Muppets and a sprinkle of Pringles to the mix too. Be Afraid. There are places in the world where the veil is thin.  Where strange things seem to always be happening.  Glastenbury Mountain and the area surrounding it, what has come to be known as Bennington Triangle, may be one of those places.  Unfortunately, the mountain rarely leaves a survivor.  If it does, it doesn't leave them with many logical answers... Team, when I was in Squaw Valley for the Spartan World Championships, I had the honor of meeting Kristen Ulmer who, for 12 consecutive years, was the world's top female big mountain extreme skiier. (My dream job!) From Wikipedia: Ulmer was on the US Ski Team for moguls in 1991. She also starred in over 20 ski movies, and was called by the ski media the best woman big mountain extreme skier in the world from 1990-2001. In 1997 Ulmer was also voted in a Powder Magazine ski industry survey to be the best overall female skier in the world, beating even Olympic gold medalists. She was known for jumping off up to 70-foot cliffs, throwing flips, and for ski mountaineering feats such as the first female ski decent of Wyoming's Grand Teton in 1997. An avid rock and ice climber, paraglider pilot, adventure cyclist, and kiteboarder, Ulmer was also voted by the outdoor industry in a 2000 Women's Sports and Fitness Magazine poll to be the most extreme woman athlete in North America, beating women in all sports disciplines not just skiing. She retired from professional athletics in 2003. Kristen has since written a book, The Art of Fear: Why Conquering Fear Won't Work and What To Do Instead.  So I could not pass up the opportunity to walk with her and ask her to share her story and big mountain wisdom with all of us. On a personal note, I'm really looking forward to staying friends with Kristen.  And I'm definitely looking forward to joining her on the slopes! Every Mogul Matters! He is a contributing editor for The New Republic and a contributor to Time and Slate. He has also written for The Atlantic Monthly, The New Yorker, The New York Times Magazine, and Foreign Policy, as well as the op-ed pages of The New York Times, The Washington Post, and The Financial Times. His books have been translated into more than a dozen languages, and his awards include the National Magazine Award for Essay and Criticism. Mr. Wright writes on a wide range of issues related to technology, religion, and foreign policy, particularly the war on terrorism. His 1994 cover story for The New Republic, "Be Very Afraid," warned about the dangers of weapons of mass destruction falling into the hands of terrorists. In his 2000 book, Nonzero (which was named a New York Times Book Review Notable Book), Wright noted how the evolution of information technology could exacerbate this problem, facilitating the translation of intense hatred into massive lethality. His most recent book, The Evolution of God, touches on a number of contemporary issues, including how to foster interfaith tolerance amid globalization. Mr. Wright is now focusing on the question of how best to shape a foreign policy that reckons with such trends, paying particular attention to issues of global governance.
