Study Guide Sanhedrin 79 Today's daf is sponsored by Amy Goldstein in loving memory of her grandfather, Ben Goldstein on his yahrzeit. What type of intent is needed in order for one to receive the death penalty for murder? Rabbi Shimon has a unique approach, that one only gets capital punishment if one intends to kill that particular person. The rabbis disagree but also have their own set of criteria. Rabbi Shimon derives his opinion from the verse in Devraim 19:11, "and he ambushes him and stands up against him and kills him." The rabbis derive a different law from that verse - that if one throws a rock into a group of people and kills one of them, the murderer is not held liable. The Gemara tries to establish the exact case that the rabbis derive and conclude that it must be a case where there were nine Jews in the group and one gentile. The law is lenient here as even though the majority are Jews, if they are fixed, then the doubt is considered 50/50 and we are lenient in cases of capital punishment. After questioning Rabbi Shimon from a case in Shmot 21:22 when a pregnant woman is accidentally killed and the murderer is killed, the Gemara concludes that Rabbi Shimon must hold like Rebbi, that the murderer there is not actually killed, but needs to pay money. A third opinion is brought, of Chizkia, who rules that the murderer is not even obligated to pay, as the laws that we hold by the more severe punishment, and exempt from a less severe punishment apply even in cases where the death penalty could have potentially been there, but is not. If a murderer gets mixed up with a group of people and there is no way to identify who the murderer is, what can be done? The Mishna brings a debate between the rabbis and Rabbi Yehuda. Three different interpretations are brought to explain the case that they are debating.

Phantom Echoes In This Nightmare Tale... ---Tales From The Vault Episode 11--- Mr. Izvertzoff, a wealthy Russian landowner, mysteriously disappears while visiting a cavern on his land - the so-called "Cave Of The Echoes". He is presumed to have been murdered and the finger of blame is pointed firmly at his man-servant, Ivan. Many years after the tragedy, an enigmatic Hungarian traveler and a mysterious Tibetan shaman conduct an eerie ceremony within the cave to determine the true identity of the murderer. Mesmerized by the atmosphere of the place and the ghostly echoes which reverberate through the cave, the onlookers are shocked to learn the truth of what happened to Mr Izvertzoff. Helena Petrovna Blavatsky was a Russian philosopher and author who co-founded the Theosophical Society in 1875. While best known for her occult knowledge and the book "The Secret Doctrine", she also wrote a collection of fictional short stories, collected in a volume called "Nightmare Tales", first published in 1907. I thoroughly enjoyed reading and producing this story, and look forward to reading a few more of HPB's Nightmare Tales very soon. I was planning to talk about Conquer Your Clutter and a listener question about purchasing clothing on sale, but then yesterday, Ari Fuld was murdered, and talking about buying things on sale the week of Yom Kippur just didn't seem right. So, this week on the JTO podcast I talk about, tafkid - your mission in life, how even in times of mourning we need to be careful about waste, like when you tear your clothing as a sign of mourning, Jewish Eco Funerals, and I talk about how my friend, Ben Goldstein, inspired me with a pre-funeral video that showed the unity of the Jewish people. I apologize for the sniffling, but I recorded this episode about 5 times before I could even get through the fist few lines with out crying. I hope you are inspired to reach your true potential, fulfill your tafkid, and pledge to make 5779 the year you finally Conquer Your Clutter, because too much stuff distracts us and hinders our potential.
