This Day in Legal History: Confederate States ConstitutionOn March 11, 1861, delegates of the newly formed Confederate States adopted the Constitution of the Confederate States of America in Montgomery, Alabama. The document closely resembled the United States Constitution in structure, language, and institutional design, reflecting the Confederacy's claim that it was preserving the original constitutional order rather than rebelling against it. But the similarities masked a fundamental and disturbing difference: the Confederate Constitution explicitly protected and entrenched slavery. Unlike the U.S. Constitution, which used indirect language around the institution, the Confederate document openly required that slavery be recognized and protected in Confederate territories. It also prohibited any law impairing the right of property in enslaved people, making the protection of slavery a central constitutional commitment rather than a political compromise.The constitution also attempted to limit certain federal powers, reflecting long-standing Southern arguments about states' rights and suspicion of centralized authority. For example, it restricted tariffs and internal improvements, policies many Southern leaders believed favored Northern industrial interests. The document also changed the structure of the executive branch by providing for a single six-year presidential term instead of allowing reelection. These provisions were intended to prevent what Confederate leaders viewed as excessive federal power or political manipulation. This Day in Legal History: Bruno Hauptmann IndictedOn October 8, 1934, Bruno Richard Hauptmann was indicted for the murder of 20-month-old Charles Lindbergh Jr., the son of famed aviator Charles Lindbergh. In this episode, you'll hear the Court's opinion in Turkiye Halk Bankasi A-S v United States In this case, the court considered this issue: May the district courts properly exercise subject-matter jurisdiction over the criminal prosecution against Halkbank in this case based on the commercial activity exception to the Foreign Sovereign Immunities Act? The case was decided on Apr 19, 2023. The Supreme Court held that The district court has jurisdiction in this criminal prosecution; the Foreign Sovereign Immunities Act's comprehensive scheme governing claims of immunity in civil actions against foreign states and their instrumentalities does not cover criminal cases. Justice Brett Kavanaugh authored the 7-2 majority opinion of the Court. 18 U.S.C. § 3231 contains a broad jurisdictional grant: it gives district courts original jurisdiction over “all offenses against the laws of the United States.” Absent a textual exclusion of foreign states, the most natural reading of that provision is that it includes them. The Foreign Sovereign Immunities Act covers only civil cases. It grants district courts original jurisdiction over “any nonjury civil action against a foreign state” as to “any claim for relief in personam with respect to which the foreign state is not entitled to immunity” and describes procedures and remedies applicable exclusively in civil, not criminal, cases. FSIA is silent as to criminal prosecutions. Its one provision that a “foreign state shall be immune from the jurisdiction of the courts of the United States and of the States except as provided in sections 1605 to 1607 of this chapter” must be read in conjunction with the rest of the Act, which focuses exclusively on civil matters. However, principles of common-law immunity might preclude this criminal prosecution even if the FSIA does not. Thus, the Court affirmed the appellate court's determination that the district court had jurisdiction, reversed as to its conclusion that FSIA granted immunity from criminal prosecution, and vacated and remanded as to the issue of common-law immunity claims. Justice Neil Gorsuch authored an opinion concurring in part and dissenting in part, joined by Justice Samuel Alito. Justice Gorsuch argued that FSIA alone dictates the answer to the immunity questions in this case and thus agrees with the majority as to all but the judgment to vacate and remand the question of common-law immunity. Türkiye, genel seçim sonrası, Batı'dan kapital girişini sağlamaya dönük bir ekonomi politikası biçimi benimsedi. Böylece hükümet, İsveç'in NATO üyeliğini reddetmeyeceğinin işaretini vermişti. Şimdi Meclis'te İsveç'in üyeliğinin onaylaması, ekonomi yönetiminin planına uygun düşmüştür denilebilir. Meclis kararının olumlu olması, ekonomi yönetiminin enflasyonla mücadelede benimsediği, yarısı bizden yarısı konjonktürden stratejisinin ana unsurlarındandı. Aksi takdirde politika adımlarının zararı faydasından çok olacaktı. Türkiye'nin NATO ilişkilerini geliştirmesinin, ekonomi yönetiminin beklediği konjonktür katkısının temel kaldıracı olduğunu söylesem yanlış olmaz. Hatta bu düşüncemi bir veri ile destekleyebilirim; İsveç'in NATO'ya üyeliğinin tam da Merkez Bankası'nın faiz artırım döngüsünde sona gelineceğini daha önce ifade ettiği bir haftaya denk düşmesi sanırım tesadüf değildir. Ekonomi yönetimi, stratejisinin yarısı bizden kısmını tamamladığı bu haftada yarısı konjonktürden kısmı için de gerekli ortayı eş anlı olarak kapitalin merkezine yapmış oldu. Piyasanın içerideki oyuncularının durumu doğru analiz ederek verdiği tepkiyle Borsaİstanbul'da yukarı yönlü trend başladı. Yabancı girişiyle hedef endeks değerlerine kolaylıkla ulaşılması mümkün. Az önce yabancı analistlerin rapor dilinin alışılmışın tam aksi yönde değiştiği görüldü. Goldman Sachs, JP Morgan ve diğerleri Türkiye ekonomisini nasıl öveceklerini şaşırdılar. (“Halkbank”) was indicted by a grand jury in 2019, and charged with involvement in a scheme to launder billions of dollars worth of proceeds from Iranian oil and natural gas, which was in violation of U.S. sanctions against Iran at the time.Halkbank is majority-owned by the government of Turkey and moved to dismiss this indictment, arguing that the court lacked jurisdiction. Halkbank contended that the Foreign Sovereign Immunities Act (FSIA) and the fact that the government of Turkey had a majority of its ownership made it immune to criminal prosecution in U.S. federal court. In relying on FSIA, Halkbank asserted that exceptions in FSIA apply only to civil cases, and that even if such exceptions applied in criminal cases, Halkbank Would still be immune under common law standards.The U.S. District Court rejected the argument put forward by Halkbank, and the Second Circuit affirmed. In 2019, the U.S. government took a step that it had never taken before. It brought criminal charges against a foreign state-owned bank, Turkiye Halk Bankasi, or Halkbank, which is majority-owned by the country of Turkiye (until recently known as Turkey), for evading U.S. sanctions on Iran. Turkiye in turn argued that such a move was not only unprecedented but prohibited by the legal immunities it is entitled to under the Foreign Sovereign Immunities Act, or FSIA. Yesterday, those arguments reached the U.S. Supreme Court where both sides seemed to agree on just one thing—that the court's eventual decision could well have major consequences for the United States and its foreign relations.To talk through oral arguments in Halkbank, Lawfare senior editor Scott R. AKP Genel Başkanı ve Cumhurbaşkanı Recep Tayyip Erdoğan, geçtiğimiz günlerde Sinan Erdem Kapalı Spor Salonu'nda düzenlenen TÜGVA 5. Olağan Genel Kurulu ve 6. Gençlik Buluşması'nda asgari ücrete ilişkin konuştu. Erdoğan, “İnşallah Aralık ayındaki yapılacak olan yeni değerlendirmelerle de asgari ücreti en uygun rakama çıkaracağız. Şu an onun hazırlığı içindeyiz” dedi. Erdoğan, 10 Ekim'de yapılan kabine toplantısının ardından da esnafa yönelik açıklamalarda bulundu. Erdoğan, “Esnafımız için Halkbank vasıtasıyla 60 ay vadeyle ve yüzde 7,5 faiz oranıyla istifade edebilecekleri 100 milyar liralık bir kredi kampanyası başlatıyoruz” diye konuştu. Çelebi'nin AKP'ye geçişi sonrası Radyo Televizyon Üst Kurulu'nda (RTÜK) boşalan bir üyelik İYİ Parti'den yeniden AKP'ye geçti. AKP Genel Başkanı ve Cumhurbaşkanı Recep Tayyip Erdoğan, kabine toplantısının ardından açıklamalarda bulundu. Erdoğan, “Esnafımız için Halkbank vasıtasıyla 60 ay vadeyle ve yüzde 7,5 faiz oranıyla istifade edebilecekleri 100 milyar liralık bir kredi kampanyası başlatıyoruz” dedi. CHP Genel Başkanı Kemal Kılıçdaroğlu ABD'deki temaslarına devam ediyor.  İstanbul-Kadıköy'deki Fikirtepe Mahallesi'nde 9 Ekim akşamı yaşanan patlamaya ilişkin resmi açıklamalar gelmeye başladı. Turkey's ambiguous application of United Nations' sanctions on Russia

The arrival in a Turkish port of two superyachts belonging to a Russian oligarch is drawing attention to Ankara's policy of refusing to impose sanctions on Russia in response to its invasion of Ukraine. There are concerns that Turkey is becoming a safe haven for those seeking to circumvent sanctions.  The arrival of vessels belonging to millionaire Roman Abramovich is adding to suspicions that Turkey could become a refuge for sanctioned oligarchs and their wealth.  Despite Abramovich being targeted by sanctions by both the European Union and Britain, Turkey has so far refused to penalize Russians. There are reports in the Turkish media that Abramovich plans to use Turkey as a base, or planning to buy a Turkish football team. Abramovich invested heavily in London's Chelsea soccer club before British authorities seized control after the oligarch was placed on a sanctioned list. MPs seize control of Chelsea after British government sanctions owner Abramovich Timothy Ash of Bluejay Asset Management says Turkey will face growing scrutiny from its Western allies.  "There has been some focus on reflagging Russian aircraft as Turkish aircraft. There are strong trading and banking relationships between Russia and Turkey. Some media attention on a lot of Russians trying to set up new bank accounts in Turkey, presumably to try to get around some of the problems they are probably encountering," Ash told RFI.  "There has also been concern that Russian companies and entities trying to export or trade with Russia are repackaging themselves as Turkish entities," Ash continues. "I would imagine western governments, including the US, will be talking with their Turkish counterparts and trying to encourage them not to break sanctions. But there is a recognition of Turkey's relatively weak financial position," he concluded.   Iran case "There is a lot of news, unsubstantiated in my view, that oligarchs are parking their money in Turkey," analyst Atilla Yesilada of Global Source Partners told RFI.  "Turkey has extensive business links, no matter how you define it, with Russia," added Yesilada. "A lot of people hoped that Turkey would become a proxy financial center or intermediary for Russia. I wouldn't put it past the current regime to try to repeat the Reza Zarrab incident - 40 billion dollars of money whitewashed to Iran," he continued.  Reza Zarrab is a Turkish-Iranian businessman who pleaded guilty in 2017 in a New York court to massive charges of violating sanctions against Iran. A senior executive of the Turkish state-owned investment bank Halkbank was convicted and jailed under the same investigation. Halkbank itself is also facing trial on Iranian sanction busting charges.  Ankara insists it is fulfilling its international obligations in enforcing United Nations sanctions. "If you mean whether these oligarchs can do any business in Turkey, then of course, if it is legal and not against international law, I will consider it," said Turkish foreign minister Mevlut Cavusoglu. Peace brokering Turkish President Recep Tayyip Erdogan argues that financial and economic measures against Moscow are counterproductive. Erdogan claims his country's refusal to join sanctions enables it to be an honest broker in efforts to end the Ukraine conflict. The Turkish President has close ties with both his Russian and Ukrainian counterparts, having hosted three days of talks between the warring parties in late March.    The Dutch Prime Minister Paul Rutte recently visited Ankara, becoming the fourth European leader to travel to Turkey since Russia invaded Ukraine in February. Rutte appeared to play down any concerns over Turkey's opposition to Russian sanctions at a joint press conference.  EU nations expel dozens of Russian diplomats suspected of spying  "Yes, of course, we would very much favor for Turkey to implement all the sanctions, but I think we also have to be happy with the fact that Turkey is playing now its diplomatic role and its leadership role in trying to end the conflict," said Rutte. With Erdogan appearing to play a prominent role in peace efforts, analysts say Turkey is likely to get - at least in public - the benefit of the doubt over its stance on sanctions. Some analysts say that means more Russian superyachts and their owners could be heading to Turkish marinas earlier than usual, ahead of the traditional summer season.
