Shmuel is a 2L at Chicago-Kent College of Law and works as an Intern at the Illinois Office of the State Attorney's Appellate Prosecutor. Shmuel's journey to the Law is just starting, but it's been nothing short of living the dream thus far! Shmuel and I start before he arrives at Law School. It was High School and Shmuel Applied and gained an internship at the Los Angeles County District Attorney. Being so young as an intern, he would become a sponge to all that he was learning, watching trials, and learning from his bosses, keeping a close eye on everything that went on. From that experience, he knew going forward, going to Law School was his dream. He would return to the same District Attorney's office for 2 out of the 3 next summers, before heading off to Touro College Los Angeles. During his time there, he would hold an additional file clerkship as well as work as a teacher's assistant at the same school he attended, for the same teacher he had. For Shmuel, this experience delivered on building those all-important soft skills, communication skills, and especially with 4th graders, having a ton of patience. We then moved to his entry into Chicago-Kent College of Law, where he would be shocked by the fact that he made it to Law School, describing it as living the dream! He would love the first year as well, having interesting material to work with, and the chance to focus solely on school. As we step into 2025, the legal landscape for former President Donald Trump remains as complex and contentious as ever. Just a few days ago, on the cusp of the New Year, constitutional law expert Harold Krent, a professor at the Chicago-Kent College of Law, delved into the upcoming cases at the Supreme Court, including those involving Trump[3].One of the most recent and intriguing developments is Trump's intervention in the TikTok case. Trump, now President-elect, has asked the Supreme Court to stay the law requiring TikTok to divest from its Chinese parent company, ByteDance, by January 19th. This move is unprecedented, as it raises a presidential power issue under Article 2 that has never been discussed in court before. Trump's lawyer argues that his prerogatives as a future President should be preserved, suggesting that his deal-making expertise and electoral mandate could negotiate a resolution to save the platform while addressing national security concerns[3].This case is particularly interesting because it opens a new can of worms regarding the powers of a President-elect. The Supreme Court's decision on whether to stay the case or not will have a significant impact on Trump's presidency and could set a new precedent.Meanwhile, Trump's legal calendar is filled with other critical dates. In the DC Election Interference case, Trump has been battling various motions and deadlines. For instance, on October 3, 2024, Trump was due to submit a supplement to his motion to dismiss based on statutory grounds, and on October 10, 2024, he had to file objections to the proposed redactions in the government's motion for "Immunity Determinations"[1].In Georgia, Mark Meadows, Trump's former chief of staff, has petitioned the U.S. Supreme Court for a writ of certiorari following the 11th Circuit's decision to dismiss his bid to move his state criminal case to federal court. This case is part of a broader legal battle involving Trump and his associates[1].In New York, Trump faces civil and criminal cases, including the election interference case where Justice Merchan is set to issue a decision on Trump's motion to set aside the jury's guilty verdicts based on the U.S. Supreme Court's Presidential Immunity decision[1][3].As these cases unfold, the legal community is watching closely, anticipating how these decisions will shape the future of presidential immunity and the powers of a President-elect. It took almost a week to select the jurors and alternates for the Manhattan trial of former President Donald Trump. This hour is all about juries. A former U.S. president has been indicted on charges of mishandling classified documents, including the willful retention of classified information and obstruction. The 49-page indictment of Mr. Donald Trump can be accessed via the following journals: NYTimes & WSJ. Did you know that the definition of classified information is largely dependent on presidential executive orders? And did you know that President Richard Nixon's executive order on classified information, is the model that many look to for clear examples of what type of disclosures may cause damage to our national security and, hence, should be protected as classified information? In this episode, Professor Heidi Kitrosser speaks to us about the willful retention of national defense information, and the legal implications of such conduct under the Espionage Act. She will also directly address Mr. Trump's retention of classified documents in Mar-a-Lago. In addition, she'll tell us about the history of classified information, e.g., what constitutes classified information? Who can designate information as classified? Who has access to them? And how all of this plays out in our system of separation of powers? With regards to this last point, Prof. Kitrosser points out something interesting - that U.S. courts and Congress may be intentionally skirting the responsibility of defining and categorizing classified information. She explains why this may be to their political benefit. Ms. Kitrosser is a professor at Northwestern University Pritzker School of Law. She is an expert on the constitutional law of federal government secrecy, and on separation of powers and free speech law more broadly. She is the author of the following book: Reclaiming Accountability: Transparency, Executive Power, and the U.S. Constitution, which was awarded the 2014 Chicago-Kent College of Law / Roy C. Palmer Civil Liberties Prize. She is on the steering committee of a new initiative – the Free Expression Legal Network (FELN) spearheaded by Yale's Media Freedom and Information Access Clinic and the Reporter's Committee for Freedom of the Press.
