Welcome back for another episode of Nick's Non-fiction with your host Nick Muniz Described by Murray Rothbard as "the greatest case for anarchist political philosophy ever written", Spooner's lengthy essay is still referenced by philosophers today. In it, he argues that the American Civil War violated the US Constitution, thus rendering it null and void. An indispensable read for political historians both amateur and professional alike. They had no more natural right or power to make political contracts, binding upon succeeding generations, than they had to make marriage or business contracts binding upon them. - No Treason by Lysander Spooner   If every person has the right to defend — even by force — his person, his liberty, and his property, then it follows that a group of men have the right to organize and support a common force to protect these rights constantly...Since an individual cannot lawfully use force against the person, liberty, or property of another individual, then the common force — for the same reason — cannot lawfully be used to destroy the person, liberty, or property of individuals or groups. - The Law by Frederic Bastiat

In this episode:Mike and Ed discuss Bruce Banner being charged with, and then absolved of, treason. Only 30 people have ever been charged with treason in America, so what exactly did Banner do? And why were the charges dropped so quickly? The last time treason charges were dropped was in 1947, and the process took four years. If Banner should not have been charged, someone should lose their job. If he SHOULD have been charged, then why were the charges dropped? Is America part of some secret war, and with Banner aiding the enemy. Has he been set free “they” don't want the public to know about the war? And who are “they” anyway?Behind the issue:In the issue, Banner was charged with treason, but the charges are made to go away as a result of the direct involvement of the President (who was informed by Rick Jones). If this had happened in real life, it would have been an impeachable offence by the President. But in real life, it is pretty unlikely that Banner would have ever been charged. In real life, for crimes committed post-WWII, only one person has been charged with treason in the USA. This is largely because the bar to prove treason is so high that most prosecutors will charge the suspect on a different offence. (Note: people were charged with treason after WWII, although all of these charges related to crimes committed during that war - it was not until 2006 that someone was charged with treason, for aiding and abiding Al Qaeda). In this issue:Bruce Banner its in a military prison, charged with treason for trying to sabotage his own invention. He had not tried to do that - he was trying to protect his nuclear invention from being captured by the villainous Leader's Humanoid - but he really cannot explain himself without revealing that he is really the Hulk. Meanwhile, the Leader plots to study his fellow gamma-irradiated human, the Leader. We return to Washington, D.C., where Banner refuses to tell his lawyer why he is innocent (i.e. that he is the Hulk, etc.) His teenage friend Rick Jones shows up and, after flashing his top-priority Avengers I.D. card, visits with the President of the U.S.A. to tell him why Banner is innocent, i.e. that he is the Hulk. The President agrees that it would not be in the public interest for Banner to share his secret, and at the same time, he does not want to lose one of the U.S.'s greatest scientists to a lifetime in prison. Faced with this conflict, the President pulls strings to have Banner cleared of all charges, and Banner goes free. Well, free to head to an island in the ocean to test his new atomic device. While there, Banner turns into the Hulk, and the Leader, who is also interested in Banner's invention, sends his Humanoids to attack the Hulk. The battle rages and rages, with the Hulk growing more savage and more wild. How will this end? Assumed before the next episode:People are wondering what the heck is happening with Bruce Banner being charged with treason, and the charges then being dropped. This episode takes place:After Bruce Banner is cleared of treason. This week, Scott and Karl read Lysander Spooner's 1870 essay No Treason No. 6: "The Constitution of No Authority."  Spooner was an American anarchist, abolitionist, and legal theorist of the nineteenth century. He is known for competing with the U.S. Post Office with his American Letter Mail Company, later forced out of business by the United States government. Scott says, "The violent revolutionary approach to political change doesn't necessarily go hand in hand with anarchism. Anarchism, in the Spooner form, doesn't mean a free-for-all. It means organic laws and no overarching ruler."  In this essay, Spooner examines the potential validity and lasting authority of the U.S. Constitution as a binding contract between men. Karl asks the listeners, "Have you given consent to the Constitution? In what way did you give that consent? Is it because you haven't moved away?" Tune in for Part One of the duo's discussion. Brought to you by onlinegreatbooks.com.

In this episode, the Matts continue to make their way through Michael Malice's "The Anarchist Handbook". They covered Lysander Spooner's essay, "No Treason", and discussed whether the US Constitution has any authority, how politicians are able to properly represent their voters, and individualist anarchism. There was a lot of disagreement over the content of this essay, what intuitions it plays into, and if the arguments Spooner make have any utility. As always we hope you find some instruction and entertainment in this conversation.

Last year the CAF put through a policy that changed military writing in that we were not allowed to use He/Him, She/Her in military writing and Personnel Evaluation Reports. Last month email signature formats were changed and pronouns were added if you felt comfortable adding them.  I didn't and I refuse to add them until they make it mandatory and if they do I plan on putting in something very obscure. The pandemic response has been pretty strict in my unit.  We wear masks at all times in all buildings and are supposed to wear the masks outside while on base.  We were told to wear them in military vehicles even if we are the only ones in the vehicles, which is absolutely stupid. There has been an entire operation across the CAF called Op Vector.  On of the stated missions of Op Vector is to reduce vaccine hesitancy.  They also claim to be informing soldiers so they can give informed consent, but they parrot Pharmaceutical companies talking points, which I pointed out and reminded the group about the Mefloquine incident.  There are a few people that I know of who said they didn't want the vaccine that were coerced into saying they would get it.  Comments by officers like, "You tell the three people who don't want it to read the medical brief."  and "The one person who doesn't want the vaccine can come see me in my office in the morning."  That was enough to get most people to take it.  We have been told that if we don't take the vaccine we will lose allowances because we are not deployable and can't go out in the field.  There is a major lack of scientific understanding while claiming to follow the science.  They claim unvaccinated individuals will put missions at risk and can't be allowed to go overseas but if everyone but one person has the vaccine then it's only the one person at risk but seeing how most are vaccinated herd immunity would hold. I've taken enough of your time.  My second reason was to recommend a couple of books for the book club. The Law by Frederic Bastiat and No Treason by Lysander Spooner.  I've included booth ebooks with this email. Have a great day and keep up the great work.   Subject ResulFrom DalHi guys, I heard about the resul march on your show and after looking at the sign up form I noticed there is a section for team, so I was wondering if I can join your team. I believe I saw the owne Oshkos Island retreat in the list so I figured that was you guys.  A little bit about me, I'm in the air force and in 2018 did the full work up training for the Nijmegen march, unfortunately I didn't end up making the final team since there were quite a few people doing the training and only a small team was going. I did however complete two months of work up, finishing with two back to back 40km+ days of marching which I was quite proud to have competed. The work up training was a great experience and really got me in shape.  These kind of events are great since they create a goal to work towards. I haven't decided how many km I'm going to do yet, I don't think I'll attempt the 160 this year but I think I'll try at least 50+ in total. Maybe 160 next year with more work up. Anyway thanks for letting me know about this march and putting the challenge out there. Some things can transcend time and relate to our very present moment. No Treason, by Lysander Spooner, is an essay that was written in 1867 which has transcended the generations with a message: the government and the constitution is invalid. Because Lysander wrote this piece with the lawyer mindstate and was so much closer to the time of the constitution being written, he had a more clear view of what the American government was becoming and was very outspoken about his observations. You can read the piece here: https://oll.libertyfund.org/titles/spooner-no-treason-no-vi-the-constitution-of-no-authority-1870 It is actually a fairly easy read as he wrote it for the laymen of his time. Thanks for joining us this week on the Sounds Like Liberty Podcast. We have a fabulous show for you today beginning right here with our lyrical analysis of The Way it is by Bruce Hornsby http://bit.ly/2Igy6vJ This mellow pop song released in 1986 is thought to be making reference to the Civil Rights era of the 1960’s. Why then is the song ‘the way it is’ not ‘the way it was?’ We talk about it and score it on out scale from Bob Dylan to Eric July. Here we are again at the music discovery portion of our show. Today we are going west and then across the water. Nicky’s pick is a bit of alright from pop punk band Bracket.  The album is called Too Old To Die Young. Nicky’s comments: Here they are, doing exactly what we want and expect from Bracket. Super tight block harmonies and pop structures. Can I consider feeling over the hill myself as a reason to love an album called Too Old To Die Young. Seriously this came out the day after my 35th birthday. I love these guys in general because for a band that is all about the vocals I don’t care at all what the lyrics are. Just gimme more harmonies! http://bracket.bandcamp.com/album/too-old-to-die-young I was jonesing again for something downtempo so I’ve selected the Set Me Free EP from New Zealand band Deep Water Creek.  This recording has all the down home sensibility I expect from bands like my Morning Jacket  and The Mountain Goats proving that it’s not an exclusively american thing. The instrumentation is solid a and the vocals are soulful. I really enjoyed the rainy day feel of this, perhaps you will too. https://deepwatercreek.bandcamp.com/album/set-me-free-ep Also don’t forget to also check out friend of the show and previous guest Dan Smotz’ new EP of midlife crisis infused pop-punk oozing notes of New Found Glory and Four Year Strong at shexclamationpoint.com. Spooner was an American individualist anarchist with radical opinions on everything. His true calling was writing pamphlets and books on issues of the day. His private postal service was forced out of business by the government. He again lost everything and lived out his years as an urban recluse. His most famous work was The Unconstitutionality of Slavery. No Treason is his most famous political tract (1867). "Although Spooner’s argument on the unconstitutionality of slavery had no legal basis, his concept of natural law contained the germs of anarchistic theory of government".

Throwing some scraps to the slaves in Taxachusetts (mj leniency), where 70% of voters endorsed the status quo of income expropriation Education is the main component for maintaining the meme of statism; governmental schools are seen as a necessary good "Education is a weapon" said Stalin Government Education Is Broken? It Just Ain't So! by Alan Schaeffer and Marshall Fritz http://www.fee.org/publications/the-freeman/article.asp?aid=8366 Pundits typical "solution" to the problems of "public education": more money! Dropping out as psychologically healthy The Teenage Liberation Handbook: How to Quit School and Get a Real Life and Education http://lowryhousepublishers.com/TeenageLiberationHandbook.htm No school system can be all things to all students, and no coercive school system is good for anyone Even though it's always alleged to help them, kids from poorer families suffer the worse from governmental schooling, as did their parents Governmental employees are the perfect products of governmental schooling; they've inherited the bad memes fully The nerve-touching moral question always looms large: How exactly is this system funded? Statist arguments from emotional convenience--being treated with ridicule and outrage by those who don't want to face their history of statist indoctrination and advocacy Two fallacies: that the government school system is a failure, and that government can fix it! John Dewey's perverse coercive educational goals: to make good people; to make good citizens; to make each person his or her personal best From the horse's mouth: "My Pedagogic Creed" http://www.infed.org/archives/e-texts/e-dew-pc.htm Link (to a link) to Rand's take on Dewey: http://aynrandlexicon.com/lexicon/education.html The true aim of governmental education is, in H.L. Mencken's words, "to reduce as many individuals as possible to the same safe level, to breed and train a standardized citizenry, to put down dissent and originality." John Taylor Gatto - State Controlled Consciousness http://www.youtube.com/watch?v=8ogCc8ObiwQ Stupid in America by John Stossel http://www.youtube.com/watch?v=Bx4pN-aiofw Being shackled as a governmental school employee, or even a State-regulated private school teacher Regimentation, standardization, and segregation are the mainstay of coercive "public" education Maria Montessori's key insight: "The child has a teacher within" http://www.logicallearning.net/libertyeducation.html Bad tendency of adults to interfere with kids' intrinsic motivation Alfie Kohn's insights on intrinsic motivation (versus extrinsic rewards and punishments): Punished by Rewards? A Conversation with Alfie Kohn by Ron Brandt http://www.alfiekohn.org/teaching/pbracwak.htm GRADING: The Issue Is Not How but Why by Alfie Kohn http://www.alfiekohn.org/teaching/grading.htm Understanding our natural gifts as children; being creative, imaginative, innovative, and fearless Keeping the entrepreneurial spirit and society alive with these gifts Kids are incessant question-askers, as opposed to most adults Why is it that most adults--and even libertarians--send their kids to governmental schools... Constitutional arguments against governmental education are invalid, because the Constitution itself is not a valid contract As Lysander Spooner pointed out: No Treason. No. VI, The Constitution of No Authority http://www.lysanderspooner.org/notreason.htm#no6 The false binary "choices" offered to us by the statist system To advocate coercion to provide education is beyond the pale Because "poor people" need to be educated so much, the market will quickly fill this need cheaply and effectively (sans government) The coercive "business" of governmental education, purported as being for "the common good" (which is never very common and thus never achieved) The fallacy of voting (collectivized plunder), in which people supposedly get something for nothing and extort those with supposedly more wealth If you don't want to be a standardize citizen, there's no place for you in a coercive society Obedience to "authority" is pervasive, both in and out of "school" The ending of governmental schools means the beginning of complete liberty Gatto: "Children need to know that the ultimate form of private property is full possession of one’s own mind and volition." The Alliance for the Separation of School & State http://www.schoolandstate.org/home.htm "The Alliance for the Separation of School & State has a two-fold mission: 1. Help parents and others understand the true nature and the dangers of compulsory state schooling. 2. Show parents and others how they can take back their freedom and ensure a bright future for their children and our country." All statist regimes rely on a tax-funded education system to perpetuate themselves, and to devolve into totalitarianism The American governmental school system is the perfect storm of convincing people in droves that tyranny is actually good for them, and that they are "free," relying as it does on the Founding Fathers' liberty-oriented rhetoric An alternative historical view: Voices Of A People's History Of The United States by Howard Zinn and Anthony Arnove (eds) http://tinyurl.com/njfch Most advocates of the governmental system deny and evade the "gun in the room," i.e., the coercive nature of their views Essentially "the system" discourages individuals from challenging "authority," despite the objective need for a mutually respectful ethics No one can make choices for you, fundamentally; objectivity demands that you open your mind A free society entails people making their own choices about education The key is to free your mind from the mythologies from childhood; remember that when you were being taught about government, it was likely by a governmental employee within a governmental school You were told to believe in and take bites out of "invisible apples," as Stefan Molyneux has astutely noted: http://www.freedomainradio.com/Traffic_Jams/how_to_control_a_human_soul.mp3 bumper music "Another Brick in the Wall" by Pink Floyd http://www.pinkfloyd.com/  http://www.youtube.com/watch?v=M_bvT-DGcWw to comment, please go to http://completeliberty.com/magazine/category/91697

Bureaucrats Never Have a Case by Administrator (aka Marc Stevens)    http://www.adventuresinlegalland.com/index.php?/content/view/20/27/ Statism is based on the illogical premise that you don't own your own life A "complaint" shouldn't be confused with a "case" The Stockholm Syndrome, writ large http://en.wikipedia.org/wiki/Stockholm_syndrome IF IT’S NATURAL TO BE FREE, WHAT’S STOPPING US? http://completeliberty.com/chapter9.php "Citizens" and "States" don't really exist; they're unjust legal fictions The words on paper crafted by bureaucrats are necessarily open to vast interpretation, and many of words spell injustice The Constitution’s Problems: Article I Section 8...Sadly, A Template For Disaster http://completeliberty.com/chapter2.php#47 Once you allow taxation, you open society up to unending tyranny, saying in effect that extortion is good and proper and useful The two absolutely essential elements of legal standing: 1) violation of a legal right and 2) personal injury The unjust laws of the Nanny State create "criminals" out of everyone and generating constant "revenue" for the terrocrats The problem with our society today is not strictly the authoritarian sociopaths in the insane institution of government; it's all the people who are either tuned out or tacitly or directly support violent ideologies; mostly slave-on-slave violence keeps us enslaved Why does society need the monstrous contradiction of government, the preeminent violator of individual rights? Such a meme only promotes low self-esteem and perpetual enslavement "Tax cases" are an indication of how truly sick and twisted our culture is--governmental employees are putting people in cages who've violated no one's rights! Statists allege (but never prove) that the "State" has a legal right to "tax revenue" (your money) and governmental employees are "injured" when they don't get their extorted money "No attempt is made to put such allegations in an 'indictment' because it’s impossible to establish factually how an obligation to file a 'tax return' was created. To prove an obligation or legal right was created, there must be a connection between the people asserting the right and the person who allegedly has this obligation. Statists immediately point out the 'constitution.' And that is the point where they lose; and lose big time." Basically, people in government seek to deprive individuals of self-ownership and property rights simply by virtue of their geographical location, essentially claiming that we are born enslaved It's monstrously contradictory to claim the "right" to deprive innocent others of their rights to self and property The Constitution binds or obligates no one and created nothing; no one today has signed or agreed to it as a contract, except perhaps some brainwashed governmental employees, those who really need to unbrainwash themselves by reading the following: No Treason. No. VI, The Constitution of No Authority.  (1870).* http://www.lysanderspooner.org/notreason.htm#no6 "The State" can't be a valid plaintiff; it's at best a fictional third party; "The State" has no standing in any case, not even regarding real crimes such as murder "There is no such thing as a legitimate government, so nothing they do is legitimate regardless of the endless red herrings statists throw up." "Government is men and women providing services on a compulsory basis; pay or get shot. To be legitimate they would have to drop their guns and provide their services on a voluntary basis. However, the moment they do so, they cease to be a government." Either you're for voluntary social interaction (complete liberty) or you're for anti-social human interaction (statism) "...statism and it’s supporting theology are not here to promote freedom or protect 'Life, Liberty, and the Pursuit of Happiness'; it’s mind control to divert our attention away from the actions of anti-social individuals who are so desperate to 'protect' us they are willing to kill us and steal our property." The libertarian movement is crippled by the unwillingness to differentiate those who want a voluntary society and those who do not; any libertarian who promotes "limited" government or any form of statism whatsoever is engaging in this monstrous moral contradiction in society All governmental courts operate outside the bounds of natural and objective law, i.e., a voluntarily funded and provided legal system; statist courts, regardless of their rhetoric (used for public relations), are necessarily invalid Prosecution of alleged rights-violators must involve restitution and reparations; the ingenuity of justice service entrepreneurs will probably entail many elements of the insurance model As we transition to complete liberty, the need for rights-protection services becomes less and less; the threat against our lives and property will be extremely remote in a society of complete liberty, because the biggest violators of rights (governments) will be absent The only way to clarity in these matters is to reassess the nature of one's volitional capacity and one's fears of others, which entails addressing the moral corruption and authoritarianism in family life; "Do this because I said so" is the same as "Obey this law (because we wrote it down)" Are We There Yet, Are We There Yet? Let’s Check Marx and Engels’s List by Robert Higgs http://www.independent.org/newsroom/article.asp?id=2366 The Timeless Allure Of Communism http://completeliberty.com/chapter1.php#15 Government needs to make slaves out of adults (property tax payers) to indoctrinate future tax payers (kids in schools of government) "Remember the government's motto: you've got money, and we want it." "Therefore, in the present distressing circumstances, we may be warranted in asking: is our politico-economic system finally going smash in a frenzy of monetary inflation, bailouts, and government takeovers? We’ll know the answer pretty soon." So, what can we do? Focus on passing moral judgment; point out to others the coercion at the base of society (the gun in the room: http://www.lewrockwell.com/molyneux/molyneux29.html); and, get people out of your life who behave in morally corrupt ways and advocate coercion Ultimately, it's either statism or voluntarism; mutual respect of persons and property is the ideal bumper music "Gimmee_Dada Orwell-REMIX" by Roger Grant and Dada Orwell (aka Dave Ridley) http://www.politicalgraffiti.com/nhfree/music/Gimmee_Dada_Orwell-REMIX.mp3 to comment, please go to http://completeliberty.com/magazine/category/91697

John Stuart Mill, 1806-1873, was the most famous classical liberal, a British philosopher and a political economist whose concept of liberty justified the freedom of the individual in opposition to unlimited state control. His hierarchy of pleasures in Utilitarianism was a notable idea. He felt that individual accomplishment through self-improvement was the source of true freedom.Herbert Spencer, 1820-1903, was a prominent classical liberal political theorist of the Victorian era. As a polymath, he had an enormous range of knowledge. He achieved unparalleled popularity. Spencer was a Utilitarian, feeling that the promotion of human survival would maximize human utility. Spencer is associated with Social Darwinism, perhaps because he supported competition, but he did not embrace Darwinist science.Lysander Spooner, 1808-1887, was an American individualist anarchist and abolitionist. His key contribution was to demolish consent theories. In the No Treason pamphlets he asks for names of those who have actually consented to the Constitution.Lecture 8 of 10 from David Gordon's The History of Politcal Philosophy: From Plato to Rothbard.
