The Constitution is under attack—and not just by Trump and the executive branch. For a long time, the conservative justices on the Supreme Court have been inconsistently interpreting the Constitution. But our guest, Madiba Dennie, says focusing on their decision-making processes is a trap. She says there's a better way for concerned citizens to take action against the backsliding of social progress fueled by the Supreme Court. Madiba K. Dennie is an attorney, columnist, and professor whose work focuses on fostering an equitable multiracial democracy. She is the deputy editor and senior contributor at the critical legal commentary website Balls and Strikes and the author of The Originalism Trap: How Extremists Stole the Constitution and How We the People Can Take It Back. Dennie previously served as counsel at the Brennan Center for Justice, and her legal and political commentary has been featured in The Atlantic, The Washington Post, the BBC, and MSNBC. https://www.penguinrandomhouse.com/books/735353/the-originalism-trap-by-madiba-k-dennie/

"Mind your privilege, give not away your right!" With those words, William Penn urged the jurors in his 1670 religious freedom trial to remember the power and the responsibility of their role in the English judicial system. For this episode, we return to the topic of jury nullification – the power of juries to acquit despite evidence of the defendant's guilt – with a fresh take from the UK. Professor Richard Vogler of the University of Sussex chats with host Becky Annison about the role of jury nullification, going all the way back to William Penn's trial in the 17th century up to its relevance in climate change cases of today. They discuss why legal institutions began viewing juries with more suspicion from the 1970s, and why it's more important than ever to defend the jury's place within our legal system – including its power to nullify convictions. For more on this topic, listen to Janelle Wrigley's conversation with Glenn Reynolds, from the University of Tennessee, about jury nullification in the US (ep.159) – https://pod.fo/e/269d1a.

Imagine you are a juror in a criminal trial. The evidence is overwhelming that the defendant is guilty. But you can't shake the feeling that it would be unjust to convict. Maybe you don't believe what the defendant did should be treated as a crime. Or maybe you simply believe the defendant deserves mercy. Can you vote to acquit, or must you vote according to the evidence? It turns out that, in the US and the UK, jurors do have the power to acquit, even if they believe a defendant committed the charged crime. This is known as jury nullification. In this episode, host Janelle Wrigley chats with Professor Glenn Reynolds from the University of Tennessee College of Law. They discuss the history of jury nullification in the US, the role of the jury, and the debate on whether jurors should be told they have the power to nullify if they believe a conviction would be unjust.

Reichard White, LewRockwell.com Voir Dire is legal tampering with the jury, so the jury is not a random group of your peers, but a filtered group of individuals who are selected because they are most likely to submit to authority, follow the judge's instructions, and return a guilty verdict even when the law is unjust or unlawfully applied. * The Right to Assembly - Judge Andrew Napolitano, RonPaulInstitute.org "Last week, the Supreme Court effectively abolished the right to assembly in three Southern states." * The National-Security Branch Rules the Roost - Jacob G. Hornberger. * Utah's Step-By-Step Strategy in Support of Sound Money - Mike Maharrey, TenthAmendmentCenter.com "Utah laid the groundwork in 2011 with the passage of the Utah Legal Tender Act. The law made gold and silver coins issued by the federal government legal tender in the state. "It also specified that “the exchange of gold and silver coins for another form of legal tender does not create any individual income or sales tax liability.” In effect, it repealed both the state sales and capital gains taxes on gold and silver. The following year, 2012, the Utah Legislature renamed the act the "Specie Legal Tender Act," which expanded the definition of specie legal tender beyond only coins authorized by the feds, to include any gold and silver coins approved by the state. * "The passage of the Utah Legal Tender Act also set a precedent for other states to follow.  Wyoming, Oklahoma, and Arkansas have since made gold and silver legal tender." Earlier this year (2024), the legislature authorized the State Treasurer to hold up to 10% of certain funds in silver, gold, platinum, copper, or palladium. Doing this would be a defensive hedge against the losses of the federal reserve note, which as everyone knows is rapidly declining in value.

Whether you call it Jury Nullification or Conscientious Acquittal, today's episode is all about the fight to reinvigorate the jury trial and the independence of the jury. Joining Hunter to discuss is Clark Neily, Senior VP for Legal Studies at the CATO Institute. Before America was even a country, the power of a jury to acquit someone of a charge they were legally guilty of because the jury disagree with the law as applied in this case was unquestioned. Over time however, prosecutors and judges pushed for and enabled the gradual erosion of the juries power. Now, more than 250 years after the founding, the jury trial is little more than a relic of the past, and even a whisper of jury independence in a court room can get jurors removed from a case. How did this happen and what can be done to reverse this trend? Being raised in a Christian home, Toby accepted the Lord as his Savior at age five. He has four daughters and one son.    In his book, Toby explains what has become common place today was practically unheard of  decades ago. The State's war against the family via divorce and the child support system where many are unjustly suffering.    Toby shared his personal divorce experience and the permanent scars caused by the government intervening in their lives. His courage to stand against this tyranny is an encouragement to all who are trapped in the grinding machine of family court and child support system.   We discussed Jury Nullification and what that entails. Jury Nullification  happens when a jury comes back with a "Not Guilty," verdict even though jurors believe beyond a reasonable doubt that the defendant has broken a law. Mark Levin- Dems Put Trump Aid in Leg Irons and Handcuffs and Find Clinton Aid Not Guilty by Jury Nullification. America continues to limp toward tyranny as a lawyer presents an open and shut case to a jury that was not objective and comprised of a few donors to the Hillary Clinton campaign and other ties to the judge. What America witnessed, with the Michael Sussman not guilty verdict, was jury nullification. The testimony presented by John Durham was clearly overwhelming, yet the jury felt it didn't meet the standard of guilty beyond a shadow of a doubt. Thanks to Big Media, America is engaged in a conversation on mass shootings, and mental illness with no real facts, or hard data. A word of thanks also goes to Mitch McConnell and the RINO Republicans for discussing pointless gun control measures in Congress, even though there isn't a single bill they could pass that would stop crazy people from hurting innocent people. We must thank President Biden for focusing his attention on 9mm pistols and revealing how senseless their gun-grabbing desires are, right? A year ago, a gallon of gas on average was $3.04, today a gallon of gas on average in California is $6.21 and this program predicts that the national average will surpass $5.00 for a gallon for regular gasoline by next week. The government's boot is still on the throat of America's energy producers. OPEC has agreed to ramp up production, but this does nothing to accelerate U.S energy production. The January 6th Committee is a trojan-horse front for the Department of Justice to cast a wider net than a law enforcement agency is legally permitted to. This is unconstitutional as it violates the individual's Constitutional rights in a criminal proceeding. Earlier, Peter Navarro was held in contempt of Congress by the Congressional January 6th Committee. Navarro was indicted and immediately arrested at the airport and placed in handcuffs and leg irons for his political opposition to the committee's document request. In this episode I review what the first degree charge says about our duty as a citizen, the people rising up all around the world to fight for their freedoms and rights, Boris Johnson was forced to remove all restrictions for the cuties meaning no more masks, no more jab mandates and everything connected to it. Does our first degree charge admonish us to just obey and not question anything our elected officials say or do? The only way we can begin to understand this is to exercise our minds and learn about what Lysander Spooner had to say about Jury Nullification and how we as citizens are empowered not only the facts of any case but the execution of the law being applied. We have the right and duty to judge both the fact and law. I would add that this applies to us as Citizens and Masons alike. The Grand Jury is supposed to refuse to indict people under "bad laws" (a law that is in violation of the Constitution for the United States of America)   The Trial Jury is never supposed to convict someone for violating a "bad law". If you are on a Trial Jury and the defendant is being prosecuted for violating a "bad law", the verdict should always be "not guilty".
