Serwer's piece documents the Trump administration's explicitly race-based statements about Haitian immigrants, including claims they all have AIDS, eat household pets, are genetically predisposed to crime, and are poisoning the blood of the country. Samuel Alito's majority opinion declined to repeat any of those statements, substituting his own race-neutral explanations for what they might have meant instead. Justice Elena Kagan's dissent noted that the evidence was plain to see in statements the majority and even Trump's own lawyers could not bring themselves to repeat. The article brings in legal scholars including Guy-Uriel Charles of Harvard Law, who describes the ruling as setting up an impossible burden for plaintiffs, Anderson Francois of Georgetown, who notes that the administration now needs only a plausible pretext to discriminate while Black plaintiffs need proof no amount of evidence will satisfy, and Melissa Murray of NYU, who calls this a colorblind constitution the architects of Jim Crow would love. Serwer also traces Alito's selective application of intent, showing he is perfectly willing to read racial motive into policies when white people could be perceived as the victims, as in his 2009 Ricci v. DeStefano opinion, but refuses to do so here. (The Brief) THE ORIGIN STORY: PANIC AND OPPORTUNISM The Setup: Prohibition ends in 1933. Federal agencies face budget cuts. They need a new war. They choose "The War on Crime." The Hook: DOJ uses the St. Valentine's Day Massacre to sell a "gangster gun" crisis. The Bait & Switch: The NFA was pitched as a tax on "criminal weapons," but the original bill attempted to register all handguns. The NRA (back when they were Fudds) helped kill the handgun portion but let the rest slide. Crucial Detail: SBR/SBS restrictions were only in the bill to prevent people from hiding pistols. When pistols were removed, Congress left the SBR rules in. We are regulating barrel length today because of a 1934 legislative error. THE MECHANISM: A BAN DISGUISED AS A TAX The "Poll Tax": They couldn't ban guns (2A exists), so they used the Taxing Power. The Cost: $200 in 1934. Inflation Adjustment: That is roughly $4,500 today. Intent: It was an economic ban designed to ensure only the wealthy could own modern firepower. The Registry: The true goal was the NFRTR (National Firearms Registration and Transfer Record). Registration is always the prerequisite for confiscation. THE LEGAL COVER-UP: U.S. V. MILLER (1939) The Supreme Court case that upheld the NFA was a setup. The Fix: The defendant, Jack Miller, was dead before the decision was handed down. His court-appointed attorney did not show up to argue the case. The Ruling: The Government argued unopposed that a sawed-off shotgun had no "militia utility." The Court agreed, solely because no one was there to tell them otherwise. THE MODERN IMPACT & REGULATORY CREEP 1986 Hughes Amendment: Proved the danger of registries. Congress used the NFA list to ban all new machine guns for civilians. Note: The Hughes Amendment passed on a fraudulent voice vote where the "Nays" clearly had it, but the Speaker pushed it through. ATF Power Grabs: The NFA definitions are vague. This allows the ATF to write law without Congress (e.g., Pistol Braces, Bump Stocks, Triggers). Culture War: It normalized the "Two-Tier" system. The wealthy buy what they want; the poor get what they are given. CONSTITUTIONAL ANALYSIS (POST-BRUEN) The Vulnerability: Under the Bruen test (Text, History, Tradition), the NFA is on death's door. The History: There is zero historical tradition of the Founding Fathers taxing the ownership of standard arms or creating a federal list of owners. We argue they are only unusual because the government has spent 90 years threatening to put us in prison for owning them. Every year, KCSU gathers local punk and punk-adjacent bands to play on Colorado State University's campus, creating a unique and exciting event for all to enjoy. KCSU's music directors, Mia Templien and Ria Janapati, had the opportunity to sit down with a few of the bands performing for some in-depth interviews.The amalgamation of kids wanting to play in a band but not finding the right people is what created Snow Day. Consisting of Grace Murch, Jack DeStefano, Kenny Barnes, and Bradley Brungardt, Snow Day is a hodgepodge of alternative rock, punk, noise rock, and much more. Murch had never played bass before, DeStefano snagged Barned from Denver, and Brungardt got a call from Snow Day's old drummer, asking him to fill in. So I have the story of Mad Sam DeStefano, who was a Chicago outfit loan shark collector. I'll tell you what, wait till you hear this guy's story. A lot of you may have heard of him. He's pretty well known, been pretty well reported on. But this guy is, he is what we call affectionately a piece of work. So settle back and listen to the story of the life of the most brutal loan shark collector and loan shark that probably ever was that I know about. He liked to torture. This guy is Sam, Mad Sam DeStefano. And I'd heard of Mad Sam. Of course, all you guys up in Chicago know about Mad Sam. He was kind of the guy that taught Tony Spilotro all the tricks of the trade on being a gangster. He was one of the first guys that Spilotro was given, was sent to his crew or Spilotro joined his crew. But Mad Sam, we'll tell you a little bit about the history of Mad Sam. Mad Sam was born in 1909. [1:21]And he would go on to become a big-time loan shark and a political fixer and a sociopathic killer for the Chicago outfit. I heard of, there's a guy a lot of you all know, a Chicago, former Chicago-based FBI agent named William F. Romer Jr. He wrote several books on the mob that a lot of people cuss and discuss and argue about whether he was telling the truth or making stuff up. But regardless what you think of Bill Romer, he did know Chicago Outfit better than anybody. And he considered DeStefano to be the worst torture murderer in the history of the United States. He said that this guy was a mentally unstable and sadistic person that was used by the Outfit as an enforcer and a juice loan collector. Sam, Mad Sam, was born in Streeter, Illinois. If you got into real estate 5-6 years ago, you might be forgiven for thinking this business is easy. We didn't have the low inventory, high interest rates and the commission changes we're dealing with now.  For any agent who started back then, the 2024 market might as well be a whole new industry you have to learn. It was a great time to get into the business, but in order to stay in the business now, you have to learn how to generate deals in this current environment. Many people are failing to do that, and that's why we'll continue to see agents throwing in the towel and leaving the industry entirely.  Mastering the basics of running a solid real estate business is the only way to outlast all the shifts and changes. If you came into the business and immediately started taking shortcuts, you just won't be able to hack it in the skills-based market we're in right now.  If you're an agent who invested in coaching, and found a way to go out and get business, you'll never have to complain about any market conditions - even the ones that are taking other people out of the industry.  I recently sat down with an agent who built his business the right way, and developed skills that create success under any circumstance. Sammy DeStefano shares how he went from car sales to real estate, and what's allowed him to do so well.  Why learning the fundamentals matters in this profession The personality type of most real estate agents is high D, so that means we're an industry of people who like to do things their own way. Also, real estate is a second or third career for a lot of people, and most of those people don't like being told to do so they are going to riff and find their own way. That's why learning the basics is so important.   For a long time, Sammy felt more comfortable cold calling strangers than calling his sphere. That's because as a new agent he didn't feel like he had any value, so it felt like he was just asking family and friends to find someone who wants to pay him. Let's face it, we're under-competent in our first deal, we just find someone who agrees to work with us. After working an expired and selling it, and earning the social proof, it was easier for Sammy to feel like he's bringing value, and he could confidently ask his sphere “do you know anyone who wants to use my level of service?” You need a coach You're an idiot if you're not writing a check to a coach every month. That's not to say you wouldn't have figured things out without a coach. But something has to be said for having someone wise who has been there and done that and also has a feel for what other people are doing around the country. It provides a massive amount of value and insight, which makes business easier. It's really easy to get into our own bubble or just talk to people in your own brokerage and limit your possibilities. Getting exposed to what other people are doing is what helps us grow the most both personally and in business.  Guest Info Sammy DeStefano is a Realtor in Arizona. After spending 6 years in car sales working for BMW in Phoenix, Arizona, Sammy got accustomed to not only sales but more importantly rain making and prospecting. Initially he got into real estate because he had reached his ceiling at my BMW dealership as a business development center caller, sales guy, and ultimately a finance director. After leaving the dealership and getting his license, Sammy joined Mike Ferry Premier coaching within 90 days and was off to the races. In his first year, Sammy sold 30 homes (all expired and canceled listings that he cold called). In his second year, he sold 35 homes from January to June with a goal of 60 homes sold for the year. The rest is history...  Sammy is proactive and finds his own business, calling and door knocking, and there are more than enough clients to help out there.
