"The House hasn't reorganized committee jurisdictions since the early 70s—before the internet existed." — Maya KornbergAmerica is stuck stuck stuck stuck. Almost exactly a year ago, I interviewed the Atlantic's Yoni Applebaum about Stuck, his influential critique of the housing crisis. Now we have another Stuck—this one by Maya Kornberg, a senior fellow at the Brennan Center for Justice. Only her subtitle is about Congress, not housing: How Money, Media, and Violence Prevent Change in Congress.This is, Kornberg argues, one of the toughest times in modern American history to sit in Congress. Members are forced to spend most of their time making fundraising calls. They face record-high threats against themselves and their families. And the media incentivizes spectacle over policymaking—what she describes as "Kings and Prophets"—where members have the power of the megaphone but not the power to drive legislation.One fact captures Congressional stuckness: The House hasn't reorganized its committee jurisdictions since the early 1970s—before the internet existed. Half the Senate, then, questioned Mark Zuckerberg because no single committee is responsible for tech. Not even mad libertarians like Elon Musk could make that one up.Kornberg recently ran for New York City Council in Park Slope and, as a friend of Israel, discovered firsthand how media latches onto the most salacious angle. From February 22, 2024: As a new report on the intimidation of state and local officeholders from the Brennan Center for Justice points out, “The January 6 insurrection at the Capitol seemed to mark a new peak in extremist intimidation targeting public officials. But it was hardly the only act of political violence to break the period of relative stability that followed the assassinations of the 1960s.” Citing the 2017 shooting of Rep. The history of science is punctuated by moments of technological innovation that produce a paradigm shift and a subsequent flurry of discovery. A recent technological innovation that generated diverse discoveries, ranging from a profound shift in our understanding of the origin of humanity to a seismic change in the criminal justice system, is the polymerase chain reaction, or PCR. With us to discuss the history of PCR is one of its innovators, Henry Erlich. As Director of the Human Genetics Department at Cetus Corporation and later as Director of Human Genetics and Vice President of Exploratory Research at Roche Molecular Systems, Henry led developments in diagnostic applications for infectious and autoimmune diseases, forensic genetics, and organ transplantation. His laboratory performed the first forensic DNA case in the United States in 1986 and the first DNA-based post-conviction exoneration. Henry has published over 450 journal articles and three books, which include PCR Technology: Principles and Applications for DNA Amplification, Silent Witness: Forensic DNA Analysis in Criminal Investigations and Humanitarian Disasters, and Genetic Reconstruction of the Past: DNA Analysis in Forensics and Human Evolution. Henry has received numerous awards, including the Association for Molecular Pathology Award for Excellence (2000) and the Profiles in DNA Courage Award (National Institute of Justice, 2005).

As a new report on the intimidation of state and local officeholders from the Brennan Center for Justice points out, “The January 6 insurrection at the Capitol seemed to mark a new peak in extremist intimidation targeting public officials. But it was hardly the only act of political violence to break the period of relative stability that followed the assassinations of the 1960s.” Citing the 2017 shooting of Rep. Steve Scalise, last year's hammer attack on Paul Pelosi, and many other cases, the report paints a troubling picture of today's climate of political violence in America. To talk through the report and its implications, Lawfare Senior Editor Quinta Jurecic and Lawfare Managing Editor Tyler McBrien sat down with Maya Kornberg, a Research Fellow at the Brennan Center's Elections and Government Program and one of the report's authors. Dr. Kornberg leads the center's work related to information and disinformation in politics, Congress, and money in politics. Maya also is the author of Inside Congressional Committees: Function and Dysfunction in the Legislative Process (Columbia University Press, 2023.) All of that makes her the perfect person to answer the question, “What do congressional committees do?”Kevin Kosar:Welcome to Understanding Congress, a podcast about the first branch of government. Congress is a notoriously complex institution and few Americans think well of it, but Congress is essential to our republic. It's a place where our pluralistic society is supposed to work out its differences and come to agreement about what our laws should be, and that is why we are here to discuss our national legislature and to think about ways to upgrade it so it can better serve our nation. I'm your host, Kevin Kosar, and I'm a resident scholar at the American Enterprise Institute, a think tank in Washington, D.C.Dr. Kornberg, welcome to the podcast.Maya Kornberg:Thank you so much for having me. I'm excited to be here.Kevin Kosar:Since its earliest days—more than two centuries ago—each chamber of Congress has had committees and used them for lawmaking, oversight, etc. Why committees? Maya Kornberg:As you noted, committees have been essential institutions in Congress since its inception. One of the reasons for this is that Congress is a big organization with an enormous number of issues to handle. So committees act as sub-organizations that can help Congress perform specific duties. Congress delegates work through its committees, so they also serve as indicators of how Congress is apportioning responsibility and resources. And in terms of power within the chambers, committees help to decentralize power, and encourage and give space to more legislators from both parties to be active participants in the policymaking process. Kevin Kosar:You note in the book that committees have four core functions: deliberation, education, theater, and personal connection. What do you mean by these terms?Maya Kornberg:These are the core functions that legislative scholars have identified as key roles of committees in legislatures, generally.First and foremost, scholars identify committees as a deliberative forum within Congress. Woodrow Wilson once wrote that “The House both deliberates and legislates in small sections. It delegates its legislative and deliberative functions to stand in committees.” And what does deliberation mean? As you and your co-authors touch on in Congress Overwhelmed, deliberation is really about weighing the different aspects of a question and reasoning through the different causes and consequences. This is a crucial part of any policy formulation, and something that committees handle in Congress.Traditionally, committees are where research is brought in and technical learning takes place, and that's what I mean by education. Congress is a body in which many lawmakers have to legislate on specialized topics that they don't have any training in. Committees give them the space to learn—they are a place where lawmakers gather information and educate themselves about specific policy areas. Committees are also one of the major bipartisan institutions in an increasingly partisan Congress, so they form a space for members of Congress to...
