Less than a month into Donald Trump's second term, his administration's aggressive restructuring of the government and flirtation with defying court rulings threaten to spark a constitutional crisis. "He could have done all of that lawfully, and instead what he's done is testing the limits of his power in a way we have never seen in this country," says retired federal Judge Nancy Gertner.During a press conference on Tuesday, Trump dismissed concerns about executive overreach and claimed he would respect court decisions. But legal experts warn his broad view of presidential power crosses long held boundaries and is propelling the country into a constitutional crisis. On this week's episode of The Intercept Briefing, Gertner, who is consulting on several cases challenging the administration's actions and is a senior lecturer at Harvard Law School, and The Intercept's senior counsel and correspondent Shawn Musgrave discuss the federal courts' response so far and what it demonstrates about our system of checks and balances.“I hope that they will realize that one of the two checks on an aggressive president doing unlawful things is that the courts are functioning as a check on his power. I fear that the other takeaway is that Congress is not. The concern about Trump wiping out programs that Congress has approved is a concern that should bother every legislator — Republican or Democrat, it shouldn't matter. That is a core, foundational checks-and-balances issue. And the fact that there is not an outcry from Congress is troubling,” says Gertner.Musgrave adds that it is a real test of governmental structure. “We're in a moment that illustrates the fragility of the system of checks and balances that's held for a couple hundred years. The system that was set up in the Constitution isn't guaranteed; it has to be protected. And so far, it looks like it's going to be up to the courts to do that,” he says.Gertner says there is another check that isn't explicitly laid out in the Constitution, but is just as important. “The public will speak in two years in the midterm elections,” she says. “So the public, although it doesn't have a specific role in the next two years before we can vote again on national issues, the public is important here. What can we expect when President-elect Donald Trump begins his second term on Monday? This week on The Intercept Briefing, we ask Intercept reporters what's on their radar as a new president and a Republican-controlled Congress take office. They'll be watching the tentative ceasefire agreement between Israel and Hamas, the brazenness of oligarchs seeking to profit from the new administration, and threats to reproductive healthcare. Trump's biggest policy promise has been immigration, with a campaign built around his pledge to conduct “the largest mass deportation operation” in U.S. history.Now Congress is advancing measures that could help the administration achieve its deportation vision by expanding immigration authority to the states. Provisions in the Laken Riley Act, which passed the House of Representatives last week with support from dozens of Democrats, would mandate detention for unauthorized immigrants accused of shoplifting and theft. It would also grant state attorneys generals the power to sue the federal government over who is detained or released by U.S. immigration and Customs Enforcement and block people from specific countries from obtaining visas. Historically immigration has been the exclusive domain of the federal government — not states. “We've been trying to raise the alarm,” says Juliana Macedo do Nascimento, Deputy Director of Federal Advocacy for United We Dream, a nonprofit immigration advocacy organization.“This would just totally change the way detention and deportation decisions operate,” says Shawn Musgrave, The Intercept's Senior Counsel and Correspondent. “The Laken Riley Act doesn't have any provisions that change the powers of local law enforcement,” says Musgrave. LEXINGTON, Ky. (November 7, 2024) – The interconnectedness of Black arts and cultural institutions is essential to the mission of community impact and affecting change. That's one of the observations made by University of Kentucky Assistant Professor Jaleesa Wells, Ph.D., from the Department of Arts Administration. For 12 months — from June 2023 through May 2024 — Wells explored the relationships between three East Okland, California, arts organizations: Artist as First Responder, Black Cultural Zone and Eastside Arts Alliance. “The crux of my project was interviewing the stakeholders, interviewing their community members, board members, artists and the community that they interacted with,” Wells said. Those groups were cultural institutions, she said, that went beyond the confines of their respective physical spaces. This week on CounterSpin: Dropped by her law firm after being exposed as an advisor on the post-2020 election call where Donald Trump told Georgia officials to “find” him some votes, Cleta Mitchell has leaned in on the brand of “election integrity.” Platformed on right-wing talk radio, she's now saying that Democrats are “literally getting people to lie” to exploit laws that allow overseas citizens to vote, so she's bringing lawsuits. Does she have evidence? No. Is evidence the point? Also no. We speak this week with media law attorney and reporter Shawn Musgrave, who serves as counsel to the Intercept, about how Trump's “Big Lie” attorneys are not so much returning to the field, but actually never left. In 2018, elite media had apparently moved beyond the kneejerk reportorial pairing of documentation of voter suppression with hypothetical claims of voter fraud. But they were still doing faux-naive reporting of those fraud claims as something other than themselves a deliberate suppression campaign. Then, the shiny object was Kansas Secretary of State Kris Kobach trying to change registration laws in the state. Trump's “Big Lie” attorneys are not so much returning to the field, but actually never left.
Aldar Tissue, Ireland's largest household and commercial tissue paper manufacturer and part of the Zeus Group, has officially opened its new €15 million, purpose-built manufacturing facility in Rathcoole, Dublin. The 100,000 sq ft facility will see the workforce at Aldar Tissue double by 2026, creating 30 new full-time jobs. Both Aldar Tissue and Zeus are committed to achieving Net Zero emissions by 2050, actively reducing carbon footprints by prioritising local manufacturing and sustainable raw materials. Aldar Tissue supplies major customers such as Musgrave, Lidl, Aldi, and Essential Supplies. The state-of-the-art Dublin plant features fully automated, high-speed production lines, robotic packing, and wrapping technologies. These innovations will enable Aldar Tissue to transition from a 24/5 to a 24/7 operation by 2026, further increasing capacity. Aldar Tissue was acquired by Zeus, Europe's leading independent packaging manufacturer and distributor, in 2019. Speaking at the facility's opening, Keith Ockenden, CEO of Zeus, commented: "Our goal is to help our customers reduce their packaging usage and lower their carbon emissions by providing innovative products and services. By processing industrial production rolls into smaller, finished products on-site in Ireland, Aldar Tissue significantly reduces the need for long-distance transportation of raw materials, thereby cutting carbon emissions from shipping bulk materials from mainland Europe. This streamlined approach not only lowers our carbon footprint but also enhances supply chain efficiency, ensuring products are delivered to customers more sustainably and cost-effectively. "Currently, 80% of the Irish tissue market is supplied from the UK and mainland Europe. This new facility increases our production capacity and will enable us to fulfil up to 40% of Ireland's bathroom tissue and kitchen towel needs. This will allow us to meet the evolving demands of local markets while driving sustainability within the industry." He emphasizes the importance of creating space for men to fully experience and process their anger, rather than just trying to down-regulate it. Navigating the landscape of men's mental health support Matt shares his perspective on the challenges of advocating for more funding and resources for men's mental health, noting the complexities of comparing it to support for women. He expresses concerns about approaches that perpetuate rigid gender norms, and emphasizes the importance of creating spaces that allow men to explore masculinity in a more open and authentic way. Gendered approaches in therapy Matt explains that he takes a gender-affirming approach when working with men, drawing on his own experiences and training to better empathize with and support the unique challenges men face. An exploration of the much-derided English suburbs through rap music. There are many different Englands. From the much-romanticized rolling countryside, to the cosmopolitanism of the inner cities (embraced by some as progressive, multicultural enlightenment and derided by others as the playground of a self-righteous metropolitan elite), or the disparagingly named "left behind" communities which, post-Brexit, have so interested political parties and pundits, demographers and statisticians. But there is also an England no one cares about. The England of semi-detached houses and clean driveways for multiple cars devotedly washed on Sundays, of "twitching curtains" and Laura Ashley sofas; of cul-de-sacs to nowhere and exaggerated accents; of late night drives to petrol stations on A roads, fake IDs tested in Harvesters, and faded tracksuits and over-gelled hair in Toby Carverys; of questionable hash from a "mate of a mate" and two-litre bottles of White Lightning from Budgens consumed in a kids playground. Much derided. Unglamorous, ordinary; cultural vacuity and small "c" conservatism. A hodgepodge. An--apparently--middling, middle-of-the-road middle-England of middle-class middle-mindedness. Part poetry anthology, part academic study into placemaking, and part autoethnography, The England No One Cares About (Goldsmith Press, 2024) innovatively brings together academic discussions of the ethnographic potential of lyrics, scholastic representations of suburbia, and thematic analysis to explore how rap music can illuminate the experiences of young men growing up in suburbia. This takes place by exploring the author's own annotated lyrics from his career as a musician known as Context where he was referred to by the BBC as "Middle England's Poet Laureate." George Musgrave studies the psychological experiences and working conditions of creative careers. He collaboratively undertook a major research project entitled Can Music Make You Sick? and cowrote a bestselling book on the subject. He has worked on ethical decision-making by music managers and wellbeing in the gig economy, and his research has been featured on BBC News, Pitchfork, Mixmag, GQ, The Financial Times, BBC Introducing, The Grammys, and Billboard among others.
