Pennsylvania's Wrongfully Accused: A Closer Look at the Human Cost of Miscarriages of Justice

Smart Talk

In the realm of criminal justice, Pennsylvania stands as a stage where the specter of wrongful convictions casts a long and haunting shadow. Recent research by the American Civil Liberties Union (ACLU) sheds light on the staggering prevalence of wrongful accusations within the state, illuminating the urgent need for systemic reforms. According to the ACLU's data, Pennsylvania ranks among the highest in the nation for wrongful convictions, with a significant portion of those affected belonging to marginalized communities. The indigent defense fund, a crucial lifeline for those who cannot afford legal representation, has emerged as a beacon of hope amidst this bleak landscape. On The Spark, Senator Vincent Hughes shed light on the pivotal role of indigent defense funding in safeguarding the rights of Pennsylvanians. The recent statewide budget allocated substantial resources to bolster this essential aspect of the justice system. Senator Hughes emphasized that expanding this funding could be instrumental in rectifying the injustices faced by wrongfully accused individuals, particularly those from disadvantaged backgrounds. The human toll of wrongful convictions came to the forefront in a poignant conversation with Ronald Johnson, a man who spent 34 years behind bars for a crime he did not commit. Released just last month, Johnson's harrowing ordeal serves as a stark reminder of the devastating consequences of miscarriages of justice. During the interview, Johnson recounted the anguish of knowing his innocence while languishing in prison, separated from loved ones and robbed of precious moments of freedom. As we dove deeper into the heart-wrenching stories of those wrongfully convicted, attention turned to Chester Hollman III, another victim of a flawed justice system. Reporter Emily Preveti provided insights into Hollman's case, shedding light on the systemic failures that led to his wrongful conviction in Philadelphia. Hollman's exoneration serves as a testament to the resilience of the human spirit in the face of adversity, but it also underscores the pressing need for comprehensive reforms to prevent similar tragedies in the future. The statistics presented by the ACLU paint a sobering picture of the pervasive injustices that plague Pennsylvania's criminal justice system. Among the wrongfully accused, a disproportionate number hail from marginalized communities, highlighting the intersecting dynamics of race, poverty, and systemic bias.Support WITF: https://www.witf.org/support/give-now/See omnystudio.com/listener for privacy information.

What did it take to stage a successful slave uprising? Over the course of the early republic, we see a few violent slave uprisings in the United States. A particularly brutal rebellion took place in Louisiana in January 1811. Another violent rebellion took place in Southampton County, Virginia in August 1831. Neither of these rebellions led to the abolishment of slavery, but they did lead to the death of many enslaved people and their enslavers. Vanessa Holden, an Associate Professor of History at the University of Kentucky and the author of the award-winning book Surviving Southampton, leads us through the events and circumstances of the 1831-Southampton Rebellion, a rebellion we tend to know today as Nat Turner's Rebellion. Watch the video recording: https://youtu.be/vJAe3s1SkPo   Episode Details: Kentucky trial lawyers Ronald Johnson and Jay Vaughn of Hendy Johnson Vaughn Emery explain how they held an asphalt paving company responsible for causing a car crash that killed Amy Skiba. On the morning of January 9, 2019, Amy was driving her 12-year-old twins to school on a two-lane road when a 2013 Chevrolet truck's front tire went off the side of the road. When the truck returned to the roadway, it hit Amy's Honda Accord, and she died on impact. In this episode, learn how Ronald Johnson and Jay Vaughn explained to the jury that Amy's death was not the fault of either driver, instead demonstrating that Eaton Asphalt Paving Co., Inc. was ultimately responsible due to the fact that the company incorrectly re-paved the road two months prior to the accident and created hazardous conditions by removing safety wedges and rumble strips. In spite of Eaton Asphalt Paving Co., Inc.'s attempts to assert they had the permission of the Kentucky Transportation Cabinet to not mill the road and to cast blame on the driver of the Chevrolet truck, the Boone County, Kentucky jury found in favor of the plaintiff. On July 12, 2021, the jury awarded Amy's surviving children $24 million in damages as well as $50 million in punitive damages against the defendant.   Click Here to Read/Download the Complete Trial Documents   Guest Bios: Ronald Johnson Ronald Johnson is a veteran trial lawyer who has spent his career representing families and persons who have been injured or killed by defective drugs and medical devices, chemicals, dangerous conditions on a property, semi-truck collisions, automobile wrecks, medical malpractice, and other product liability claims. Who do we count as family? If a relative was born in a foreign place and one of their parents was of a different race? Would they count as family? Eighteenth-century Britons asked themselves these questions. As we might suspect, their answers varied by time and whether they lived in Great Britain, North America, or the Caribbean. Daniel Livesay, an Associate Professor of History at Claremont McKenna College in California, helps us explore the evolution of British ideas about race with details from his book Children of Uncertain Fortune: Mixed-Race Jamaicans in Britain and the Atlantic Family, 1733-1833. When it comes to the paranormal, people always say they want proof. Well, on Friday, November 2nd, 1971, evidence of what many believe to be "proof" of an Unidentified Flying Object touching down on the Johnson family farm in Delphos, Kansas appeared on the ground and would remain for a very long time. A crusty "ring" in the dirt and damage to the adjacent flora was left behind after the Johnsons described seeing a strange, brightly lit and noisy hovering craft of some kind leaving their property and disappearing into the night sky. This ring and the broken branches apparently in the path of this object would exhibit forensic properties that were not entirely explainable. The incident is still considered one of the best instances of a Close Encounter of the 2nd Kind: "A UFO event in which a physical effect is alleged." Whatever it was that left whatever it left, we can be certain of this — Ron Johnson will always remember this 2nd of November. Tonight's Quote: “Ronald Johnson doesn’t know what it was, but it rumbled, whistled like a jet or the high whine of tires on the freeway and shot into the sky and left a glowing ring behind on the ground.” — Page 2 of the Salina Journal, Friday, the 5th of November, 1971 Show Links: We've found that some sites are not showing these links as clickable unless they are URLs, so until those outlets improve their show notes section, we are providing actual URLs next to the clickable description of each link to make things easier for our listeners! The issues raised by deaths at the hands of police of unarmed men and boys of color in Ferguson, Cleveland, New York City and elsewhere as well as the assassination of two police officers in New York City are complicated and expose many, many shortcomings in our society. This panel will explore a range of questions around policing and police training but also look at the role race, poverty, access to guns and the failure of other public sector institutions and policies play in these tragic events. The panel will focus on identifying policies and strategies that can help bridge the real and perceived divide that persists between too many communities and the police that are supposed to serve and protect them. Cathy Cohen, professor of political science at UChicago and chair of the department; Cap. Ronald Johnson, Missouri State Highway Patrol, appointed by Gov. Jay Nixon to the Lead Protest Security following the fatal police shooting of Michael Brown Jr.; Andrew Papachristos, Associate Professor of Sociology at Yale University; Charlene Carruthers, national coordinator of the Black Youth Project; and writer and activist Jamie Kalven joined the Institute of Politics to discuss these most important and timely issues. The conversation was moderated Steve Edwards, Executive Director of the Institute of Politics. This event was co-sponsored by the University of Chicago Office of Civic Engagement.
