A couple of weeks ago, I could not have predicted that I would come upon another way of crafting a Southern Songs and Stories podcast in this fashion. Regular or even casual listeners will be familiar with the go-to format of documentary style profiles of and interviews with music artists in this series; those of you who listen a lot will probably be familiar with some of the less traveled paths we have taken here as well, which include a remembrance for a friend and colleague who passed away unexpectedly, a survey of how western NC folks in the music business were coping in the immediate aftermath of Hurricane Helene, as well as an old school, comedic Christmas radio drama, among others. Add to that list this episode, which is a live podcast, at least for part of it. And we are talking about a subject that is incredibly deep and wide, a subject which could easily fill a year's worth of episodes. It is a subject that I will revisit again in more depth in coming months — perhaps not here, but at least in person. More on that in the podcast itself, which I hope you enjoy hearing as much as I did in making it. This episode adds to that original talk with additional commentary, music, and new avenues of exploration for the topic, which is essentially the impact from music born of social movements, especially as it relates to radio. At Queens, I gave an overview of 13 songs associated with four social movements: Labor, Civil Rights, Feminism and Environmentalism. Here, we focus on the portions of my talk on Labor and Civil Rights, with example songs ranging from hillbilly music from a 1930s cotton mill man (“Cotton Mill Colic”) to the most controversial and simultaneously most successful song in Billie Holiday's career (“Strange Fruit”), and more. Florence Reece (1900-1986) was a writer, musician, and poet who wrote about unions, coal miners' rights, and her own lived experiences. Florence was a coal miner's wife and experienced the bloody Harlan County War, which she used as inspiration for her material. The last few years have seen a wave of labor organizing as it becomes more and more clear to workers that their work is not expendable, but actually the heart of every business. From walkouts to unionization, workers at every workplace from Starbucks to Amazon to your local coffee shop have come together to build and exercise their power. In this episode we explore the issues that led organizers to take the initiative to organize their workplaces and the ins and outs and ups and downs of the process, and the backlash. Mackenzie New-Walker is the Executive Director of the West Virginia Mine Wars Museum in Matewan, West Virginia. Having descended from a long line of miners, Mackenzie describes what life was like for the men, women & children in the oppressive coal company towns of the early 1900's: from how they recruiting their immigrant labor force to paying miners in substitute money called scrip; the private company guards aka "gun thugs" known as the Baldwin-Felts agents; to child labor and laundry day. From there we hear of 1921's Battle of Blair Mountain [the largest labor uprising in US history] where the fed up striking miners transformed into the "Redneck Army."  Mackenzie then recounts the story of The Matewan Massacre, an earlier train station skirmish that has left bullets lodged in a brick wall across from the museum. After reflecting on how this all relates to the present & a sense of coal miner pride, we wrap it up with highlights from the museum's collection, including one about "a canary in a coal mine."Check out the West Virginia Mine Wars Museum & help them fundraise to buy the museum building. MATTHEW SALESSES is the author of eight books, including The Sense of Wonder, which comes out in January 2023 from Little, Brown. Most recent are the national bestseller Craft in the Real World (a Best Book of 2021 at NPR, Esquire, Library Journal, Independent Book Review, Chicago Tribune, Electric Literature, and others) and the PEN/Faulkner Finalist and Dublin Literary Award longlisted novel Disappear Doppelgänger Disappear. It's said that the way to a man's heart is through his stomach. The State of California has repurposed this adage lately, finding ways to remake the country in its own progressive image through the food industry. The last time Professor Richard Epstein joined the show, we took up the “pig case” aka NPPC v. Ross. The Supreme Court is now deciding whether California can foist its values on the rest of the country through regulations that would impact pork producers nationwide. Based on oral arguments in October, it looks like it will be a close call. Meanwhile, a new battle has been brewing over fast food restaurants and other franchises in the Golden State. Governor Newsom signed the FAST Recovery Act (AB 257) into law on Labor Day, celebrating the bill's dramatic minimum increase from $15 to $22 for fast food and other franchise workers. Organized labor cheered, but the bill has now been put on hold until voters can weigh in by referendum in 2024. We can hope that voters will see through the bill's lofty promises for workers to the harms of minimum wage increases for workers, employers, and consumers alike. Even the Washington Post called the bill “ham-handed.” Professor Epstein joins me to review the economic case against the minimum wage. However, this is not like normal minimum wage legislation. The FAST Recovery Act also gives sweeping new powers to the state – and “Emperor Newsom” in particular – to regulate every aspect of thousands of businesses in California that qualify as large franchises. Such powers were unthinkable for the Founders, but Epstein points out that the courts have increasingly deferred to state authority since the New Deal Era. The FAST Act takes the administrative overreach that has become common and goes a step fruther – consolidating that power into the governor's hand. Beyond the possibility of overturning the law by citizen vote, Epstein sees a larger opportunity to challenge its constitutionality on equal protection grounds – setting a precedent for similar cases of power grabs by state executives. The battlelines have been drawn. To quote an old Union hymn, Which Side Are You On? Team Liberty or Team Newsom?

Thomas Riggins is a New York university lecturer in philosophy and ancient studies. He is a retired city housing manager and a veteran of the peace and civil rights movements of the 1960s. He holds degrees from Florida State University and the CUNY Graduate Center. Ryan Lee Wong was born and raised in Los Angeles, lived for two years at Ancestral Heart Zen Temple, and currently lives in Brooklyn, where he is the administrative director of Brooklyn Zen Center. Previously, he served as program director for the Asian American Writers' Workshop and managing director of Kundiman. He has organized exhibitions and written extensively on the Asian American movements of the 1970s. He holds an MFA in fiction from Rutgers University-Newark. Which Side Are You On is his first book.
