I have now had a few years of experience doing architectural and interior design for many spaces that people seem to really love (most widely known Lighthaven, but before that we also had the Lightcone Offices, though I've also played a hand in designing some of the most popular areas at Constellation a few years back). Most people (including me a few years back) have surprisingly bad introspective access into why a room makes them feel certain things. Most of the time, people's ability to describe the effect of a space on them is as shallow as "this place feels artificial", or "this place has bad vibes", or "this place feels cozy". And if they try to figure out why that is true, they quickly run into limits of their introspective access. The most common reason why a space feels bad, is because it is lit by low-quality lights. Our eyes evolved to see things illuminated by sunlight. Correspondingly, it appears that the best proxy we have for whether the light in a room "works" is how similar the light in that room is to natural sunlight. President Donald Trump's losses in court are suddenly piling up on many crucial fronts at once. Most of his tariffs were just ruled illegal, prompting him to explode in fury. An appeals court blocked Trump's use of the Alien Enemies Act for deportations. And a judge invalidated Trump's cancellation of grants to Harvard. There's a big through line here that deserves attention: Judges are taking a very hard line on Trump's use of pretexts to justify his illegal actions, on many of the issues where his abuses of power are most flagrant. But what happens when all this collides with the highest court in the land? We talked to Michigan University law professor Leah Litman, author of Lawless: How the Supreme Court Runs on Conservative Grievance, Fringe Theories, and Bad Vibes. She explains why Trump's manufacturing of pretexts is central to his consolidation of authoritarian power, why it's temporarily heartening that he's facing many setbacks in these areas, and what it will look like once it all goes to the high court. During Donald Trump's first term, the Supreme Court made some effort to check his power. But that era is over. The court has ruled that Trump cannot be prosecuted for actions he took as president, including for his role in the January 6 attack on the Capitol, and it just wrapped its latest term by restricting lower courts' power to block his unlawful orders on issues like birthright citizenship, abortion care, and immigrants' basic rights. “What the Supreme Court did is it limited lower courts' ability to use what has been the most effective tool that lower courts have to reign in the Trump administration's lawlessness, which is to block a policy on a nationwide basis,” says Leah Litman, author of the new book, “Lawless: How the Supreme Court Runs on Conservative Grievance, Fringe Theories, and Bad Vibes.” This week on The Intercept Briefing, newsroom counsel and correspondent Shawn Musgrave speaks with professor and attorney Litman and politics reporter Jessica Washington about how the Supreme Court's right-wing supermajority is laying the legal foundation for unchecked executive lawlessness — and signaling to Trump that it won't stand in his way. The Supreme Court is staying busy with decisions. The High Court issued a 6-3 ruling on Wednesday in United States v. Skrmetti, upholding a Tennessee law that banned gender-affirming care for transgender minors.
