Send a textAccessing best-practice gender-affirming care for transgender youth is becoming increasingly challenging: 27 states have passed laws banning or restricting care, the U.S. Supreme Court has upheld these bans in the Skrmetti v. L.W. case, and the current Administration has pursued a relentless campaign attacking access. As a result, thousands of transgender youth and their families are being forced to try to find new healthcare providers, travel extreme distances, and take on significant expenses just to get the care they need. Today In the Den, we'll talk with Amanda Keller from The Trans Youth Emergency Project (TYEP), a program that was created to help families navigate this complex and exhausting maze, offering logistical and financial support. Special Guest: Amanda KellerAmanda Keller is a Southern LGBTQIA movement leader working at the intersection of strategy, equity, and liberation. As Manager of Strategic Partnerships at the Campaign for Southern Equality, she is helping lead efforts to Meet the Moment, mobilizing resources, forging powerful cross-sector partnerships, and advancing equity across race, gender, and class in a region where the stakes for LGBTQIA  people could not be higher. With more than 16 years of nonprofit leadership, Amanda has built institutions and movements that center those most often pushed to the margins. As the Founding Director of the Magic City Acceptance Center in Birmingham, Alabama, she grew a grassroots vision into a statewide hub serving thousands of LGBTQIA youth, families, and community members, expanding access to affirming services, leadership development, and community power across Alabama. Her work spans youth development, HIV advocacy, public policy engagement, and cultural organizing, grounded in a clear belief: the South is not a lost cause — it is a place of courage, resilience, and possibility. Since the start of 2026, a string of hospital networks in blue states that legally mandate gender affirming care for trans youth have abruptly ended these programs, leaving thousands of kids and their families in the lurch. What's worse, more proposed rules from the Department of Health & Human Services could spell the end of gender-affirming care for all trans people, including adults. Alberta Premier Danielle Smith has introduced Bill 9 - a piece of legislation that aims to infringe on the rights of trans people. Smith has used the notwithstanding clause four times in the last three weeks. This time to shield three anti-transgender bills from legal challenges and to bypass Charter protected rights. In response, queer activists are scaling up the campaign to defend these rights and protect queer and trans people. We speak with Fae Johnstone, executive director of Queer Momentum.

This Day in Legal History: Sewing Machine PatentOn this day in legal history, September 10, 1846, Elias Howe was granted U.S. Patent No. 3640 for his invention of the lockstitch sewing machine. Though not the first to envision mechanical sewing, Howe's design was the first to successfully automate stitching in a way that was both efficient and commercially viable. His machine used a needle with the eye at the point and a shuttle beneath the cloth to form a lockstitch—features that would become industry standards. Despite the innovation, Howe initially struggled to find financial backers and spent time in England attempting to sell his invention, with little success.When he returned to the United States, Howe discovered that other manufacturers had begun producing similar machines. Chief among them was Isaac Singer, who had developed and begun marketing a sewing machine that closely mirrored Howe's patented design. In 1854, Howe sued Singer for patent infringement, launching one of the first high-profile intellectual property battles in American history. This Day in Legal History: East German Border SealedOn August 13, 1961, the East German government abruptly sealed the border between East and West Berlin, cutting off one of the last open crossings between the Eastern Bloc and the West. Overnight, streets were blocked, barbed wire unrolled, and armed guards posted, turning neighbors into strangers by force. For years after World War II, Berlin had been a divided city within a divided Germany, but its open border allowed thousands of East Germans to flee to the West. By 1961, East Germany's leadership, with Soviet backing, viewed the steady exodus as both an economic drain and a political embarrassment. The border closure was quickly followed by the construction of the Berlin Wall — initially a rudimentary barricade, later reinforced into a heavily guarded concrete barrier. Families were split, jobs lost, and daily life in the city transformed, as movement between the two halves became nearly impossible. West Berlin became an isolated enclave of democracy surrounded by a communist state, symbolizing Cold War tensions. The Wall also became a stage for daring escape attempts, some successful, others tragically fatal. Its legal underpinning rested on East Germany's assertion of sovereignty and border control, which the West rejected as illegitimate. International condemnation followed, but geopolitical realities left the Wall in place for nearly three decades. The border closure and Wall construction intensified the East–West standoff, influencing Cold War diplomacy, military posturing, and propaganda. The Wall finally fell on November 9, 1989, marking the beginning of German reunification. The events of August 13, 1961, remain a stark reminder of how governments can physically enforce political divisions.The American Bar Association has voted to eliminate its longstanding rule that reserved five Board of Governors seats specifically for women, racial minorities, LGBTQ+ members, and people with disabilities — what can only be described as a stunning kowtowing to authoritarianism. Instead, those positions will now be open to anyone who can demonstrate a commitment to diversity, equity, and inclusion, regardless of personal demographic background. The change was approved by the ABA's House of Delegates during its annual meeting in Toronto, where members also considered, but rejected, proposals to shrink the size of both the House and the Board. Advocates for the shift argued that broadening eligibility could help the ABA sidestep potential lawsuits, while critics noted it follows years of political pressure from the Trump administration and conservative legal groups. That pressure has included threats to strip the ABA of its law school accreditation role and formal complaints alleging its diversity programs discriminate against non-minorities. The ABA has already paused its law school diversity accreditation requirement until at least 2026. Membership in the association has also sharply declined over the past decade, falling from nearly 400,000 in 2015 to about 227,000 in 2024, with leadership citing the elimination of free and low-cost memberships as one factor. Previously, eligibility for the diversity-designated seats was based strictly on identity, but the new rules rely on factors such as lived experience, involvement in relevant initiatives, and resilience in the face of obstacles. The Supreme Court is staying busy with decisions. The High Court issued a 6-3 ruling on Wednesday in United States v. Skrmetti, upholding a Tennessee law that banned gender-affirming care for transgender minors. Today's disagreement is about transgender health care for young people and the future of the trans rights movement.Gender Affirming Care is a method of treating gender dysphoria by affirming a child's gender identity and tailoring medical and social interventions around this identity. This might begin with a social transition and often leads to a medical protocol that involves puberty blockers and then cross sex hormones.Almost a year ago, we had a conversation with leading national clinicians, Dr. Jack Drescher and Dr. Erica Anderson about the state of gender affirming care for young people in the United States. If you haven't listened to that episode, I highly recommend it as a helpful primer for this conversation. Since then, a lot has changed in the conversation about trans care for young people.In April 2024, the Cass report came out in the UK. It is one of the most thorough reviews of the evidence base for gender-affirming care. It also called into question the limits of what we know and don't know about care for minors. Right now, 27 states have enacted laws to ban or restrict the practice and the supreme court will be ruling on it later this year. And the United States has a new presidential administration who recently issued the executive order: “Protecting Children from Chemical and Surgical Mutilation," which attempts to put forth a national ban on gender affirming care.We ask some important questions around gender affirming care and the trans rights movement. Have trans advocates and medical practitioners overstated the quality of the evidence base for gender-affirming interventions for minors?Brianna Wu is a political commentator and trans rights activist. She is executive director of the progressive Rebellion PAC.Dr. Marci Bowers is a pelvic and gynecological surgeon with more than three decades of experience in healthcare. Dr. Bowers was most recently the president of the World Professional Association for Transgender Health (WPATH). She was the organization's first transgender president.Thank you to Brianna and Marci for coming together to have this critical conversation. It's a difficult topic and as you'll hear, a difficult conversation. But we need more of this. We need more people willing to come together and have hard conversations out in the open, and we really appreciate you both.This conversation is pretty “in the weeds” when it comes to youth gender medicine and the state of the research. If you have the context, that's great – you can skip ahead. If you don't, here is a highly efficient glossary:WPATH is the leading trans health organization in the world. Its “Standards of Care” or SOC - have served as the national guidelines for youth gender medicine in most gender clinics.The Standards of Care have evolved a great deal over time: SOC 6, published in 2001, required multiple psychological assessments and a period of Real Life Experience (RLE), living as the preferred gender, before any medical interventions. The most recent SOC, SOC 8, was published in 2022. It removed many of these requirements which activists have described as “gatekeeping.”The Dutch Protocol, also known as “watchful waiting”, is a more conservative alternative to gender-affirming care. It focuses on providing large amounts of psychological support and monitoring during childhood. If the dysphoria continues to persist, then putting young people on puberty blockers and cross sex hormones in late adolescence.Language around gender identity is constantly evolving. Brianna uses the term FTM (or Female to Male) to describe females who transition. For the same demographic, Marci uses “transmasculine.”We also talk about Hormone Replacement Therapy (HRT) and Facial Feminization Surgery (FFS).Okay, that will hopefully create a solid foundation. Take a deep breath. Open your mind as far as it's willing to go. The ACLU announced legal action against the Trump administration’s executive order which targets gender-affirming care for minors.
