This Day in Legal History: The Nineteenth Amendment Is RatifiedOn August 18, 1920, Tennessee became the thirty-sixth state to ratify the Nineteenth Amendment—the final state needed to reach the three-quarters threshold—and with that vote, the constitutional guarantee that the right to vote could not be denied on account of sex became part of American law. It enfranchised, at a stroke, roughly half the adult population of the United States.The story of how it happened is almost unbelievably close. Tennessee's state senate had ratified comfortably, but the house was deadlocked, tied 48 to 48. The decisive vote belonged to a 24-year-old representative named Harry Burn, who had a red rose on his lapel signaling opposition to the amendment—and a letter in his pocket from his mother, Phoebe, urging him to “be a good boy” and vote for suffrage. He did. His single vote broke the tie, Tennessee ratified, and the amendment was certified into the Constitution days later. A generational struggle turned, in the end, on a young man listening to his mother.The significance of August 18, 1920 is best understood as the payoff to a story we told on this show back in July. When we covered the Seneca Falls Convention and its 1848 Declaration of Sentiments—the founding document of the American women's rights movement, which dared to demand the vote—I noted that it would take seventy-two years to win the ballot. The proposal in question is Representative Greg Casar's AI Tax and Work Protection Act. Its premise is sound: if firms are capturing the gains from replacing human workers with AI while pushing the costs—unemployment, lost tax revenue—onto workers and society, those costs look like an externality, the same way pollution does. And we tax externalities all the time: cigarettes, gasoline, carbon. So taxing AI to fund worker protections is a reasonable idea in principle.My problem is with the particulars. Casar's bill doesn't actually tax worker displacement—it taxes AI “tokens,” the technical units of AI computation, with the rate keyed to the unemployment rate. That creates an appealing feedback loop on paper: as AI drives up unemployment, the tax rises and generates more money to put people back to work. But it asks the Treasury to do two things it's genuinely bad at. First, it has to figure out, in real time and on a political calendar, how much of any given rise in unemployment is actually caused by AI, as opposed to a recession, a pandemic, or a war. That's a causal judgment the tax code has no machinery for. Second, and worse, it has to put a stable dollar value on a “token”—an unstable, non-standardized unit that spans text, code, images, audio, and video, and isn't sold in any clean arm's-length market. You're trying to tax the meter, and the meter doesn't have a reliable price.So here's the alternative I argue for: instead of taxing AI use, give the public an equity stake in the companies that capture AI's gains—let the government own a piece of the franchise rather than tax the meter. This isn't as exotic as it sounds; scholars like Jeremy Bearer-Friend and Sarah Polcz have proposed having AI firms pay tax in kind, transferring equity rather than cash, and Senator Sanders has floated a far more aggressive version—a 50% stake funding a sovereign wealth fund. My point is that you don't have to go to 50% to adopt the underlying architecture. Equity is a better proxy than token usage: it scales with the actual size of the economic reallocation AI produces, and it only asks the government to value a company once, rather than to price billions of individual computations or adjudicate whether a particular prompt cost a particular job. If AI merely augments workers and produces modest gains, the public's share stays modest; if it produces extraordinary gains, the public shares in the upside. A smaller equity assessment on the largest firms, held through an independently managed vehicle, would let the public participate in AI's wealth without handing a shrunken Treasury an impossible measurement problem. The instinct to make sure the public benefits from AI is exactly right—we should just own a piece of the thing, not tax the ticker. Today's Headlines: Karoline Leavitt is leaving her job as White House Press Secretary at the end of August, officially to spend more time with her family, though the timing — coming weeks after her boss used the press corps as an Iran assassination decoy — raises some questions. On the never-ending reflecting pool drama, Jeanine Pirro convened a rare special grand jury to investigate the reflecting pool vandalism case, even after admitting there's no case against the former Olympian they arrested. Meanwhile, cyberattacks have hit water systems in 12 states over the past few years, with 30 Minnesota systems targeted last month alone, and what remains of US cyber intelligence confirmed Iran did it — but Trump is blaming Tim Walz, because of course he is. In other news, multiple US Navy sailors aboard the USS Abraham Lincoln have attempted to jump overboard during a record 250-consecutive-day deployment with severe shortages of soap, toothpaste, hot water, food, and toilet paper, and Pete Hegseth — who built himself a personal salon at the Pentagon — called their accounts "fake news." Josh Kushner and Bob Iger are buying the Los Angeles Lakers for a record $12.5 billion, pending NBA board approval, from an insurance billionaire currently under investigation, so something is sus about this one. Last week Fox News attempted to revive long since dead horrors for its audience - the COVID-19 pandemic, outrage over a transgender athlete scandal that did NOT include a transgender athlete and commies, commies and more commies.In late June the Supreme Court ruled that states were allowed to ban transgender athletes from K-12 and colligate sports programs for women and girls. This essentially barred transgender athletes from competing in women and girls' sports in 29 states.The U.S. Olympic and Paralympic committee announced last July that it would ban transgender women from competing. Several other sports leagues followed suit including the International Cycling Union, World Aquatics, World Boxing Organization, World Athletics Council, and the National Athletics Council (NCAA).Although the issue of transgender women and girls competing in women's athletic competitions is not completely settled the SCOTUS case and athletic league bans have greatly reduced the likelihood of transgender women and girls dominating women's sports.Sophie Cunningham, a WNBA player, voiced support for barring transgender girls in an ESPN article in late July. Fox News acted as if Cunningham was the Rosa Parks of women's basketball.After the article was published Cunningham wasn't fired or disciplined. An Adidas shoe she sponsored sold out in nearly 24 hours. She was praised and criticized for her statement with dueling protesters at some of her games.Cunningham is entitled to her opinion of course, but the hysteria seemed displaced as there is no transgender athlete in the WNBA. Even before the SCOTUS ruling and other athletic league bans transgender athletes made up less than less than 0.002% (10/500,000) of US college athletes, and even fewer of recent Olympians (0.001%) identified as trans.The hype and hysteria surrounding the Cunningham story is peak Fox News. The network knows that the bigotry and hatred of transgender people will keep its viewers interested in its programming while it ignores things like the affordability crisis, the war in Iran and the DOJ's many efforts to coverup everything related to Jeffrey Epstein.While the network whipped its audience into a frenzy about an imagined transgender takeover of the WNBA the network revived other cultural issue zombies such as rehashing disinformation about the COVID-19 pandemic and the new red scare.One of the more amusing moments last week happened when Fox News immediately distanced itself from a story involving its former host Jeanine Pirro, U.S. attorney for the District of Columbia.In a 20-page court filing, Pirro's office wrote that the damage to the Lincoln Memorial reflecting pool was the result of a “botched” renovation – “not vandalism”. Her office dropped criminal charges on four people connected to incidents involving the tourist attraction.President Trump was outraged insisting there was ‘tremendous vandalism' at the site. Fox News did absolutely nothing to support its former host. The network did not acknowledge how it supported Trump's false claims with surveillance footage that showed no criminal activity. In Connecticut, voters embraced change and sent warhorse John Larson out to pasture. In Minnesota, the primary upended political assumptions in 6 ways, none of which are as fun as watching Mike Lindell (and Trump) lose. Mike, ever the crowd pleaser, plans to lose the election over and over again for the foreseeable future. In South Carolina, Darline Graham and Trump aren't yet losing but are now failing. In Wisconsin, it wasn't quite a progressive triumph, but almost, with Francesca Hong's last-minute plateauing and normie Dems flooding the polls. David Crowley might not like campaigning, but apparently, he seems to love holidays. Almost no one is as normie or as old as James Carville, yet he supports Abdul El-Sayed. On to the midterms, if we can keep them. Every slimeball is spit balling election subversion, including the Wad in Chief. The problem is that people hate trump, which in turn keeps boosting Democratic numbers. Also, election subversion tends to be illegal… as if hatred or illegality ever bothered Trump before. Election denier Cleta Mitchell granted DHS elections official Heather Honey a lot of money. A special grand jury might not find enough evidence to bring anyone to trial, but it will allow Jeanine Pirro and Trump to be incredibly catty. So far, Donald K. Trump has been able to stuff 5 scandals into his "Air Force One" Scandal, but there's always room for plenty more!
