Chief advisor of the new interim government Muhammad Yunus who is expected to meet two minority groups today urged Bangladeshi Hindus to treat themselves as human beings and children of the soil. “You simply say that you are human, a citizen of Bangladesh, and this is your constitutional right that must be ensured. On 31st of January, the district court allowed prayers in the southern cellar of the Gyanvapi mosque complex. The district court order was challenged by the mosque committee in the Supreme Court which asked the committee to approach the Allahabad High Court.The Calcutta High Court on Monday clarified that there is no stay on the arrest of absconding Trinamool Congress leader Sheikh Shajahan, who has been accused of sexual harassment and landgrab in Sandeshkhali. The court directed that Shajahan, the Enforcement Directorate, the CBI, the state home secretary be impleaded as parties in the suo motu matter initiated on the allegations of sexual atrocities and land grab reported from the area in West Bengal's North 24 Parganas district.The Assam assembly witnessed stormy scenes today, with the Speaker rejecting the Opposition's bid to discuss the Cabinet's decision to repeal the Assam Muslim Marriage and Divorce Registration Act 1935. While still frowned upon in most parts of the country, live-in relationships are becoming increasingly common. Couples can choose not to get married for a number of reasons and still stay together, share a household and possibly children. So how legal are these relationships in India? In a recent judgement, the Allahabad High Court refused to grant protection to an inter-faith couple in a live-in relationship and even stressed upon the need to create awareness about the emotional and societal pressures and legal hassles that may be created through such relationships. The Supreme Court however, over the years, has recognised the personal liberty of individuals involved, and, in a number of judgements conferred certain rights – for instance, live-in relationships can be covered under the protection from domestic violence law. But what happens in the case of separations, alimony and children? Are these protections available to same sex and queer couples? With the increasing harassment faced by inter-caste and inter-religious couples in the country, where even getting married has become challenging, do live-in relationships require more legal security?

Can a cartoon stir unrest and bring down an elected government. Police in Maharashtra thought so when they had arrested Aseem Trivedi ten years ago for sedition. Then 24, Trivedi had tried to highlight corruption through his cartoons. The sedition case went on for several years before being struck down by Bombay High Court in 2015. The case was gone, but the stigma stayed. And Trivedi, a Kanpur lad, quit the profession forever. On Thursday, when the Supreme Court put the sedition law in abeyance, Trivedi heaved a sigh of relief. Not only because he was a victim of the IPC's section 124 (A), but also because he was one of the petitioners seeking scrapping of the law. From cartoonists to stand-up comedians and satirists to small political activists and opposition leaders, sedition law has been invoked by police in various states at what experts call a very low threshold. While arguing their case, experts point out the difference between treason and sedition. The first one is an act done against the state while the latter is against the government of the day. And criticising the government, they say, should not be penalised. Some even say that even a court decision should be under the purview of criticism. In 2016, the Allahabad High Court had held that criticism of the judiciary or a court ruling is not sedition. Former BJP leader and Union minister Arun Jaitley was the petitioner in the case. Section 124A of the Indian Penal Code, which is the law against sedition, was introduced in 1870 by the British government. And it was Thomas Macaulay who had introduced the law while drafting the penal codes. Its purpose was to stop Indian colonial subjects from expressing dissent against Britain's rule. At that time, sedition was also an offence under Britain's own penal code. While Macaulay's own country expunged the law in 2016, it stays in India. In the first two hearings, the central government tried to defend the law. But on the third one, on Wednesday, it told the apex court that it was reviewing it. The next hearing will take place in July now, while one of three judges listening to the case, CJI NV Ramanna, retires in August. So what does the law say? Under British rule, the punishment prescribed was transportation “beyond the seas for the term of his or her natural life”. This was amended to life imprisonment in 1955. It is still a harsh law and entails a maximum punishment of life imprisonment for anyone who, “by words spoken or written, or by visible representation… brings into hatred or contempt, or excites or attempts to excite disaffection towards the government established by law.” And, how did the British use it? During the Independence movement, this law was used extensively to try and crush political dissent. In fact, some of the prominent pre-independence cases where Section 124A was involved were against freedom fighters like Bal Gangadhar Tilak

Ukraine और Russia का युद्ध थमने का नाम नहीं ले रहा। यहाँ वहां चोरी-डकैती हुई है, कोरोना अभी भी गया नहीं है, Supreme Court के पास आज पचहत्तर cases pending हैं और मंदिर की जगह मस्जिद और मस्जिद की जगह मंदिर बनाने वाली याचिकाएं ताबड़तोड़ चल रही हैं। उन्हीं ताबड़तोड़ याचिकाओं में से ये केस बना है काशी यानी कि वाराणसी में कशी विश्वनाथ मंदिर के बगल बनी ज्ञानवापी मस्जिद का। Gyanvapi Masjid case और क्यों इस पर हो रहा है बवाल, आईये जानते हैं। Body: Time: 0.48 - 9.12 पहला सवाल, कहाँ है ज्ञानवापी मस्जिद? वाराणसी में काशी विश्वनाथ मंदिर के बगल से सटी है ज्ञानवापी मस्जिद। क्यों है मस्जिद पर विवाद? हिन्दू संस्थानों का मानना है कि 17वीं सदी में काशी विश्वनाथ मंदिर को एक तरफ से औरंगज़ेब द्वारा तोड़ा गया था और फिर वहां मस्जिद तामील की गई थी। अब याचिकाएं डाली जा रही हैं ये बोलते हुए कि मस्जिद का सर्वे हो, जांच-पड़ताल हो, कि क्या सही में 17वीं सदि में ऐसा कुछ हुआ था। वाराणसी की एक अदालत ने Archaeological Survey of India (ASI) को इसके सर्वे और जांच का काम सौंप दिया मगर फिर Uttar Pradesh Sunni Central Waqf Board और Anjuman Intezamia Masjid Committee ने इसका विरोध किया और याचिका का सामना किया। अब इलाहाबाद हाई कोर्ट ने गुरुवार को वाराणसी की अदालत के ऑर्डर पर स्टे लगा दिया। मगर और भी कई याचिकाएं हैं जिन्हें सुप्रीम कोर्ट को देखना पड़ेगा। क्या है पूरा मामला? This is an old case, originally1991 का मामला है ये। वाराणसी की एक अदालत में 1991 में कुछ याचिकाएं दायर की गई थीं। याचिकाकरता ज़्यादातर स्थानीय पुजारी थे जिनकी मांग थी कि ज्ञानवापी मस्जिद में उन्हें पूजा-अर्चना करने दी जाए। उन याचिकाकर्ताओं का ही यही मनना था कि मुग़ल शासन के वक़्त औरंगज़ेब ने उस मंदिर को तुड़वा कर वहां मस्जिद बनवाई थी। तो अब ये मुद्दा क्यों उठाया जा रहा है? वाराणसी में रह रहे वकील विजय शंकर रस्तोगी ने वाराणसी के lower court में काशी विश्वनाथ मंदिर के पीठासीन देवता के ‘next friend' बन कर ये याचिका दायर की। ‘Next Friend' उन्हें कहा जाता है जो किसी और की ओर से याचिका दायर करते हैं जो अपने लिए खड़ा नहीं हो सकता। मामला निष्क्रिय रहा और इलाहाबाद High Court ने सुनवाई भी टाल दी। लेकिन अयोध्या के बाबरी मस्जिद-राम जन्मभूमि विवाद में सुप्रीम कोर्ट के फैसले के एक महीने बाद दिसंबर 2019 में ज्ञानवापी मामले को दोबारा खरोंचा जाने लगा। याचिकाकर्ता रस्तोगी ने Swayambhu Jyotirling Bhagwan Vishweshwar के प्रतिनिधि के रूप में ज्ञानवापी मस्जिद के पुरातात्विक सर्वेक्षण यानी कि archaeological survey की मांग की। उनका दावा था कि ज्ञानवापी मस्जिद अवैध रूप से बनाई गई है। रस्तोगी की याचिका पर नए सिरे से सुनवाई हुई और उस के बाद वाराणसी की अदालत ने इस साल अप्रैल में ज्ञानवापी मस्जिद के ढांचे के सर्वे का आदेश दिया था। वाराणसी की अदालत ने ASI को सर्वेक्षण करने और अपनी रिपोर्ट सौंपने के लिए experts की पांच सदस्यीय समिति बैठाने करने का निर्देश दिया। उत्तर प्रदेश सुन्नी सेंट्रल वक्फ बोर्ड और ज्ञानवापी मस्जिद चलाने वाली अंजुमन इंतजामिया मस्जिद कमेटी ने रस्तोगी की याचिका का विरोध किया। उन्होंने ज्ञानवापी मस्जिद के सर्वेक्षण के वाराणसी अदालत के आदेश का भी विरोध किया। फिर बीच में आना पड़ा Allahabad High Court को मामला इलाहाबाद हाईकोर्ट तक पहुंचा। High Court ने दोनों पक्षों को सुनते हुए गुरुवार को ASI को सर्वे करने के निर्देश पर अंतरिम रोक लगाने का आदेश दिया। Allahabad High Court के इस फैसले का बेस था Places of Worship Act, 1991. ये कानून कहता है कि 15 अगस्त, 1947 को जिस पूजा स्थल का धार्मिक चरित्र जैसा है वो वैसा ही रहेगा। अगर कोई मंदिर है तो मंदिर रहेगा, मस्जिद है तो मस्जिद और worship-place पर कोई बदलाव नहीं होगा। ये कानून Narasimha Rao के समय आया था। निचली अदालत और उच्च न्यायालय दोनों में याचिकाकर्ता ने तर्क दिया कि 1991 का ये अधिनियम ज्ञानवापी मस्जिद पर लागू नहीं होता है क्योंकि 17 वीं शताब्दी में मस्जिद बनाने के लिए काशी विश्वनाथ मंदिर का एक हिस्सा ध्वस्त कर दिया गया था। Places of Worship Act, 1980 के दशक के अंत और 1990 के दशक की शुरुआत में अयोध्या में राम मंदिर के निर्माण के अभियान के backdrop में आया था। बाबरी मस्जिद-राम जन्मभूमि मामले में अदालत ने exception दिया। लेकिन हाँ, ये भी कहा गया कि बाकी किसी मामले में ये लागू होगा। मगर ये विवाद समझना ज़रूरी क्यों है? ज्ञानवापी मस्जिद विवाद भारतीय जनता पार्टी (BJP), विश्व हिंदू परिषद (VHP) और राष्ट्रीय स्वयंसेवक संघ (RSS) ने दोबारा खरोंचा था जब अयोध्या में राम मंदिर निर्माण का अभियान चल रहा था। 3 धार्मिक जगहों के नाम थे इस manifesto में। एक तो राम जन्म भूमि दूसरा ज्ञानवापी मस्जिद और तीसरा धार्मिक स्थल मथुरा में शाही ईदगाह मस्जिद। प्रचारकों ने कहा कि शाही ईदगाह मस्जिद का निर्माण भगवान कृष्ण के जन्मस्थान पर एक मंदिर को तोड़कर किया गया था। मथुरा में एक लोकल अदालत के सामने एक अलग मामला है, जो मथुरा में कटरा केशव देव मंदिर परिसर - भगवान कृष्ण की जन्मभूमि - को दोबारा लेने की मांग कर रहा है। मथुरा कोर्ट ने इस साल फरवरी में इन केस के पार्टियों को नोटिस जारी किया था। मगर आख़िर में बात ये है कि क्या क्या धारणाएं हैं ज्ञानवापी मस्जिद के इर्द-गिर्द और इतनी सारी संभावनाओं को याचिकाकर्ता साबित या उसका खंडन कैसे करंगे आमतौर पर यह माना जाता है कि ज्ञानवापी मस्जिद का निर्माण औरंगजेब के आदेश पर काशी विश्वनाथ मंदिर के एक हिस्से को नष्ट करने के बाद किया गया था। हालांकि, कुछ इतिहासकारों ने कहा है कि मस्जिद का निर्माण 14 वीं शताब्दी में जौनपुर (उत्तर प्रदेश) के एक शर्की सुल्तान ने किया था। इतिहासकार कहते हैं कि शर्की सुल्तान ने काशी विश्वनाथ मंदिर को गिराने का आदेश दिया था। कुछ और इतिहासकारों का कहना है कि काशी विश्वनाथ मंदिर वास्तव में मुगल सम्राट अकबर के समय में बनाया गया था या फिर से बनाया गया था। अकबर के मंत्री टोडरमल ने मंदिर का निर्माण करवाया था। कहा जाता है कि टोडरमल ने दक्षिण भारत के एक विशेषज्ञ नारायण भट को काशी विश्वनाथ मंदिर के निर्माण की निगरानी के लिए कहा था। एक और नज़रिया ये है कि काशी विश्वनाथ मंदिर और ज्ञानवापी मस्जिद दोनों का निर्माण अकबर ने अपने एक धार्मिक experiment, दीन-ए-इलाही को आगे बढ़ाने के लिए किया था।आप सभी ने दीन-ए-इलाही के बारे में कैशा 5-6 में पढ़ा तो होगा ही। ज्ञानवापी मस्जिद के प्रभारी अंजुमन इंतेजामिया मस्जिद समिति ने इस स्टैंड को बरकरार रखा है। Conclusion: Time: 9.12 - 10.45 अब इतने दावों के बीच एक बात जो साबित की जा चुकी है दस्तावेज़ों से, वो ये है कि मौजूदा काशी विश्वनाथ मंदिर का निर्माण इंदौर की रानी अहिल्याबाई ने 1735 के आसपास कराया था, औरंगजेब की मरने के लगभग दो दशक बाद अब देखिये इतनी धारणाएं हैं, कहीं कुछ लिखा है कहीं कुछ। अब तो ये अदालत ही फैसला करेगी कि सच क्या है और झूठ जय है। मगर दिक्कत ये है कि लोगों का अदालतों पर से विश्वास भी डगमगा सा गया है। और शायद यही वजह है कि समाज में इतनी बेचैनी देखने को मिलती है। अब इस मसले पर जो भी update आएगा, वो हम आपको ज़रूर बताएंगे। मगर फिलहाल मैं चलती हूँ। मिलूंगी अगले FYI में with a new topic. आप अपना ख्याल रखें और सुनते रहे ABP Live Podcasts की पेशकश FYI Host and Producer: @jhansiserani Sound designer: @lalit1121992

On 12th June 1975, 4 years after the 1971 Indian general elections, incumbent Prime Minister Indira Gandhi was found guilty by the Allahabad High Court of electoral malpractices. The complaint against her was filed by Raj Narain, her opposing candidate in the constituency of Rae Baraeli. The Court convicted her of election fraud, stripped her of her parliamentary seat, unseated her as the Prime Minister, and barred her from holding office for another 6 years. And how did Mrs. Gandhi respond? By locking down the entire country under an “Emergency” for over 2 years. Mrs. Gandhi also followed this up by passing the 39th Amendment to the Constitution, which barred any court in India from challenging the election of any person to Lok Sabha holding the office of Prime Minister. This Amendment was struck down later by the Supreme Court for trying to amend the Basic Structure of the Constitution. So Mrs. Gandhi was basically told a resounding “NO” at least twice by Indian courts. Pandit Jawaharlal Nehru was the first Prime Minister of India. He was quite popular among children and they called him Chacha Nehru. He was born on 14th November 1889 in Allahabad. He was the son of Swarup Ran (mother), and Motilal Nehru (father). Both his parents were attached and involved with freedom movements. He studied theosophy in his childhood and got into the Theosophical Society at age thirteen. Nehru's theosophical interests led him to the study of the Buddhist and Hindu scriptures which later culminated in his book “ The Discovery of India”. 1912, Nehru enrolled himself as an advocate of the Allahabad High Court and tried to settle down as a barrister but he was not interested in law. In 1912, Nehru attended an annual session of the Indian National Congress in Patna and joined Indian politics. He took an active part in movements like Home Rule Movement, Non-Cooperation Movement, and many more. In 1919, while he was traveling, he heard General Dyer talking about the Jallianwala Bagh Massacre. Dyer mentioned how satisfied he was after that incident. That's when Nehru decided to get freedom from the Britishers. He was sent to jail almost 9 times and there he wrote many books like his autobiography, “Towards Freedom”, “Letters from a father to his daughter”, “ Discovery of India”, “Glimpses of World History” and more. He was the right hand of Mahatma Gandhi in Indian Independence. They were an active part of the Civil Disobedience Movement, Salt Satyagraha, Quit India Movement. Nehru became the first Prime Minister of Independent India. Later he worked with Sardar Patel to unify India. In 1950 India became Republic. In 1955, he received the Bharat Ratna for his efforts on Indian industrialization. His attire- the jacket with a rose in the pocket and a Nehru cap is his style statement. Amid reports of rampant harassment and arrests of interfaith couples over anti-love jihad legislations, came an important judgment from the Allahabad High Court, which allows interfaith couples to have a safer registration of their marriages under the Special Marriage Act. On 14 January, a single-judge bench of Justice Vivek Chaudhary held that there is no need to mandatorily publish notices for marriages under the Special Marriage Act as is currently required. The court observed that such mandatory notices invade the fundamental rights of liberty and privacy and also affect a couple's freedom to marry a person of their choice, due to interference from state and non-state actors. What this judgment does, is uphold right to privacy and individual autonomy by leaving it up to the couple if they want to request a marriage officer to publish the notice of their union or to not publish it. This, coming at a time when fringe right-wing mobs and even the police have started interfering in unions of interfaith couples in states like Uttar Pradesh, makes it a significant judgment. While this is legal pushback against interference in interfaith marriages under Special Marriage Act, will this be able make a change on the ground as well? And can this judgment in anyway be able to challenge love jihad ordinances? Despite mounting criticism, Yogi Adityanath's government in Uttar Pradesh approved a very controversial ordinance on 24 November – which is seemingly against unlawful religious conversions, but has been repackaged as a way to combat ‘Love Jihad'. This law declares marriages after a conversion without permission to be null and void. As much as love jihad continues to be an unproven conspiracy not just in UP but in India generally, this law provides for up to five years of rigorous imprisonment and Rs 15,000, as penalty. But the punishment is stricter for 'conversions' of minors and women of the SC/ST communities. It comes with up to 10 years of imprisonment and Rs 25,000 as penalty.But this move shockingly comes around the same time when the Allahabad High Court struck down two previous orders by single judges of the same court that Chief Minister Yogi Adityanath had previously quoted as a basis for the anti-love jihad laws. Those verdicts had held that religious conversion purely for the sake of marriage was illegal, but on 11 November, a division bench of Justices Vivek Agarwal and Pankaj Naqvi held that neither of the two rulings were "good law" as they don't consider the "liberty of two matured individuals in choosing a partner or their right to freedom of choice as to with whom they would like to live with." What kind of a precedent is the Yogi government setting with this law that even in the court's view goes against the fundamental rights of citizens, that too without enough evidence to support the government's claims on love jihad? On April 15, 2008, in Uttar Pradesh's Amroha district, Shabnam and her lover Saleem, killed the former's entire family. The duo was having an affair and wanted to get married. However, the woman's family was opposed to their marriage. Seven members of a family, including a 10-month-old child, were axed to death on the night of horror. The Sessions court sentenced them to death. However, in 2010, they approached Allahabad High Court but it upheld the death sentenced awarded to them by the sessions court. habnam then filed mercy plea in front of then President Pranab Mukherjee. They also filed a review plea in the Supreme Court. On January 23, Supreme Court reserved its judgment on the review petition filed by the convicts for killing seven members of Shabnam's family in 2008. While hearing the plea, the three-judge bench headed by Chief Justice of India SA Bobde raised questions if the conduct of a convict inside jail can be taken as “mitigating” circumstances for the commutation of the death penalty to life imprisonment. The Supreme Court delivered two critical judgments on Thursday. However, the Ayodhya-Babri Masjid verdict took precedence over the adultery law in terms of media coverage. Those championing for the construction of Ram Temple at the disputed site in Ayodhya are elated. The Vishwa Hindu Parishad has declared that the ruling has cleared the blockade and paved the way for a Ram Mandir at the Ram Janmabhoomi.The three-judge Bench of Chief Justice Dipak Misra, Justices Ashok Bhushan and S Abdul Nazeer – in 2:1 majority judgement – declined to refer the Ayodhya-Ram Janmabhoomi title dispute to a larger Bench. It also refused to reconsider the 1994 Ismail Faruqi judgement that stated mosque was not an integral part of Islam. However, the Apex court also maintained that the 1994 verdict would have no bearing on the present title suit. The SC will start the hearing of the title suit from October 29. Newslaundry spoke to Zafarul Islam Khan, chairperson of Delhi Minorities Commission and Islamic scholar, on the issue. Khan said the SC verdict is not a “setback” for the minority community.“The court has said that 1994 verdict will have no bearing on the present case. It is (the SC verdict) is a welcome move,” he said. “The issue here is the title of the land – whether it belongs to this or that party (Hindus or Muslims). The Supreme Court or any other court should decide (the tittle-ship) case in the light of the law of the land and the Constitution,” Khan said. He said that the no court should decide on issues whether a Mosque, Temple or Church is an integral part of any religion or not.Khan had earlier backed Maulana Salman Nadvi’s proposal that both parties – Hindus and Muslims – should look for out of court settlement.Importantly, he said that the title rights of the disputed structure should go to one party – contrary to the Allahabad High Court verdict in which it divided the land rights between both Hindu and Muslim community. “In the Allahabad HC verdict, the Muslim community was on the losing side. If the land of the 500-year-old structure belongs to the Muslims, why should they give two-third land to the other party.” Khan maintained that he is not in favour division of the land.“Even if you give a part of it (the land) to Muslims, do you think the Muslims will be able to construct a Mosque there?
