In this episode, Seth Leibsohn welcomes Andrew C. McCarthy, a respected legal educator and former federal prosecutor, to discuss the case of Mahmud Khalil, a former Columbia student facing deportation for alleged terrorist activity. McCarthy argues that Khalil's actions, such as mediating between protesters and the university, go beyond protected free speech and may constitute extortion or material support for terrorism, providing legal grounds for deportation despite claims of First Amendment protections.
Andrew C. McCarthy, senior fellow at National Review Institute, an NR contributing editor, and best-selling author, joins the show by phone to discuss his opinion piece "Does the Constitution really protect Columbia agitator Mahmoud Khalil from deportation?" and the case for deporting the Palestinian activist. The Rich Zeoli Show- Hour 4: 6:05pm- Last week, in a post to X, Secretary of State Marco Rubio wrote: “Those who support designated terrorist organizations, including Hamas, threaten our national security. The United States has zero tolerance for foreign visitors who support terrorists. Violators of U.S. law—including international students—face visa denial or revocation, and deportation.” On Sunday, U.S. Immigration and Customs Enforcement (ICE) arrested Mahmoud Khalil—a former Columbia University graduate student and a lawful permanent resident alien—who has been outspoken about his support for the terrorist organization Hamas. The Trump Administration intends to deport Khalil, who was born in Syria. But does this infringe upon free speech rights? In National Review, legal expert Andrew C. McCarthy notes that Khalil's association with, and vocal support for, Hamas are debatable grounds for deportation—however, Khalil likely engaged in unlawful activities, citing the numerous arrests that occurred as a result of destructive, unauthorized on-campus protests. This makes the case against Khalil more compelling. The New York Post reported that Khalil was also being investigated as a possible national security threat. 6:20pm- While appearing on Fox News with Laura Ingraham, Sec. And the Mets? 1 - Promoting an upcoming event. The National FOP has endorsed President Trump. Left-wing outlets are questioning why. In a spate of end-of-term decisions, the Supreme Court released its decision on the question of presidential immunity, ruling that the president has broad protections from criminal prosecution for “official acts,” a presumption of immunity for likely official acts, and zero immunity for private acts. Does this now mean that the U.S. now has a “king” as head of state, someone above the law, as many have implied? Can the president really release Seal Team 6 to kill political rivals without consequence? The answer is simple: No. Rather, the Court continued the job of rebalancing our Republic in favor of three branches, with Congress as the clear venue for trying any president for high crimes and misdemeanors. What does the ruling mean for Trump's pending trials? And how is criticism of the Court eroding it as an American institution? Andrew C. McCarthy is a senior fellow at the National Review Institute, an NR contributing editor, and the author of Ball of Collusion: The Plot to Rig an Election and Destroy a Presidency. Previously, he served as an assistant U.S. attorney for the Southern District of New York.Read the transcript here.

It certainly seems like it. The Rich Zeoli Show- Full Episode (06/20/2024): 3:05pm- During a CNN panel discussion, host Dana Bash suggested she is hesitant to play videos of Joe Biden for fear that snippets of the content will be used to portray the president as old and feeble. Earlier this week, White House Press Secretary Karine Jean Pierre baselessly claimed that Republicans were using “cheap fakes” to make President Biden look bad. But, as Rich notes, the videos are not fake, and no one is making them look any worse than they otherwise would be—Biden is making himself look bad all on his own. 3:30pm- During last week's G7 meeting in Italy, a video went viral when Italian Prime Minister Georgia Meloni appeared to corral President Joe Biden who—at that moment—was staring into the woods. Biden's campaign team has argued that the video is a “cheap fake,” and that the zoomed in version of the original video fails to display a paratrooper Biden was speaking with. However, as Matt explains, the original version of the video may be even more damning than the “cheap fake!” 3:40pm- Speaking with Anderson Cooper on CNN, New York Times journalist Maggie Haberman revealed that Donald Trump is taking next week's presidential debate very seriously, working tirelessly to prepare for it. 3:45pm- While appearing on MSNBC, former Meet the Press host Chuck Todd told Katy Tur that Donald Trump appears to be getting his 2016 “swagger” back—which could be bad news for Joe Biden in the 2024 election. 4:05pm- Elizabeth Pipko—Spokeswoman for the Republican National Committee—joins The Rich Zeoli Show to discuss Republican presidential candidate Donald Trump's upcoming campaign rally at Temple University's campus in Philadelphia, PA on Saturday, June 22nd. Pipko is a former model, a 2016 Trump campaign staffer, and author of the book, “Finding My Place: Making My Parents' American Dream Come True.” 4:30pm- If you could give former President Donald Trump one piece of advice prior to next week's presidential debate, what would it be? Listeners react—explaining that Trump should focus on the economy and foreign policy (not personal insults). Others say Trump should avoid becoming entangled in claims that the 2020 election was stolen from him. Above all, most listeners agree that Trump must remain positive and optimistic by highlighting his record as president. 5:05pm- Former Florida Attorney General Pam Bondi and Election Attorney Linda Kerns join The Rich Zeoli Show to discuss their tireless efforts to protect the integrity of the 2024 election. The Rich Zeoli Show- Hour 1: 3:05pm- On Thursday, jurors began their second day of deliberation in the Donald Trump “hush money” trial. Trump has been charged with having concealed payments made to adult film star Stormy Daniels. Manhattan District Attorney Alvin Bragg alleges that the payment concealment amounts to falsified business records which ultimately influenced the 2016 election. Will we get a verdict today? What happens if former President Trump is found guilty—and could it impact his election prospects? 3:30pm- Marist National Polling's 2024 Presidential Election poll for the month of May shows that Donald Trump leads Joe Biden 54% to 42% among independent voters. Though the poll shows Biden ahead of Trump nationally (50% to 49%) “among those who say they will definitely vote.” Interestingly, Biden had a 5-point lead with that group in last month's poll. 3:40pm- The Trump campaign released a brand-new advertisement where they insist the only verdict that matters is the verdict at the ballot box in November. 3:50pm- While appearing on Fox News, Andrew C. McCarthy explained the bizarre instructions Judge Juan Merchan gave to the jury prior to deliberation—in order to convict former President Donald Trump, the jury is not required to agree on which crime was committed. And in a piece he wrote for National Review, McCarthy explained, Judge Merchan “effectively concealed what should have been fatal holes in [the prosecution's] case.”

Steinglass said democracy is subverted when voters lack “accurate information about the candidates.” But in that (plausible) hypothetical, their information would be inaccurate in a major way: Trump would have been wrongfully convicted. McCarthy of National Review writes that in Donald Trump “hush money” trial, humiliation is the point: “As porn star Stormy Daniels's testimony unfolds, what has always been obvious becomes even more explicit: The point of this trial is to bruise Donald Trump politically—to humiliate him with a tawdry sexual episode from nearly 20 years ago that is utterly unnecessary to prove the charges in the indictment.” You can read the full article here: https://www.nationalreview.com/corner/stormy-testimony-shows-trumps-humiliation-is-the-point-of-braggs-prosecution/ 5:40pm- After court concluded on Tuesday, former President Donald Trump spoke with the press briefly and declared that the case against him is a “complete disaster.” The trial will resume on Thursday. 5:50pm- Perry Stein and Devlin Barrett of The Washington Post report: “Donald Trump's Florida trial for allegedly mishandling classified documents and obstructing government efforts to retrieve them has been pushed back indefinitely, U.S. District Judge Aileen M. The Rich Zeoli Show- Full Episode (05/07/2024): 3:05pm- Former President Donald Trump's “hush money” trial resumed in New York City on Tuesday. The New York Times writes that Judge Juan Merchan “denied a request from [Trump's] lawyers for a mistrial, after [the Trump defense team] complained that [Stormy] Daniels's testimony was prejudicial.” Reporting from inside the courthouse, Maggie Haberman detailed that at one point adult film star Stormy Daniels was asked about a statement she signed in January of 2018 where she denied having an affair with Trump. Despite the best efforts of his political opponents and a large swath of the media to hold Donald Trump accountable for the utterances of even the most fringe of his supporters—a standard to which no other candidate is ever held.” Rich notes that the violent, antisemitic protesters living in encampments on college campuses are not Trump supporters—they are members of the Democrat party, but the media isn't holding the left accountable. McCarthy of National Review writes of former President Donald Trump's “hush money” trial which began Monday morning: “Manhattan District Attorney Alvin Bragg is an election denier. The bills had cleared a procedural hurdle on Friday with bipartisan support—316 to 94, passing with more Democrat than Republican support. The aid package includes a measure that, if passed in the Senate and signed by President Joe Biden, would force Chinese company ByteDance to sell its popular social media platform TikTok to an American-based company—citing a threat to national security. Refusal to sell TikTok would result in the app being banned in the United States. 4:10pm- Eric Boehm of Reason writes: “Tech companies and First Amendment groups are calling attention to a provision in a domestic spying bill that they say would significantly expand the federal government's power to snoop on Americans' digital communications—potentially by forcing employees of private businesses to become informants. The Information Technology Industry Council (ITI), a global trade group that represents major tech companies including Google and Microsoft, is calling for last-minute changes to the Reforming Intelligence and Securing America Act (RISAA), which could get a final vote in the Senate on Friday. The bill's primary purpose is to extend Section 702 of the Foreign Intelligence Surveillance Act (FISA), which allows U.S. intelligence agencies to scoop up communications between Americans and individuals abroad. But the bill also includes a provision that ‘vastly expands the U.S. government's warrantless surveillance capabilities, damaging the competitiveness of U.S. technology companies large and small, and arguably imperiling the continued global free flow of data between the U.S. and its allies,' the ITI said in a statement this week.” You can read the full report here: https://reason.com/2024/04/19/how-the-fisa-reauthorization-bill-could-force-maintenance-workers-and-custodians-to-become-government-spies/ 4:30pm- Dave McCormick—Republican Candidate for U.S. Senate in Pennsylvania & former Under Secretary of the Treasury for International Affairs during the George W. The White House later clarified that Biden's uncle had not been eaten by cannibals—however, according to reports, the Prime Minister of Papua New Guinea is not happy about the unsubstantiated claim! 5:00pm- President Donald Trump—the presumptive Republican Presidential Nominee— joins The Rich Zeoli Show to preview Tuesday's Pennsylvania Primary. President Trump weighs-in on numerous topics including the Biden Administration's indifference towards securing the U.S. Southern border, biological males competing in women's sports, Congressional renewal of FISA, and his ongoing fight against politically motivated legal charges which are preventing him from campaigning in key swing states. President Trump jokes of President Joe Biden's numerous policy failures: “Jimmy Carter was brilliant by comparison.” Plus, are we on the precipice of World War III? President Trump notes that prior to Biden taking office “you never heard this kind of language. You never heard this before when it was the Trump Administration—nobody talked about World War III.” He goes on to implore Pennsylvanians to “get out to vote!” 5:30pm- Author Les Leopold joins The Rich Zeoli Show to talk about his new book, “Wall Street's War on Workers: How Mass Layoffs and Greed Are Destroying the Working Class and What to Do About It.” You can find his book here: https://a.co/d/aUfaEoA 6:05pm- Jonah E. Ilhan Omar (D-MN) and a student at Barnard College at Columbia University, was recently suspended for anti-Israel protests and refusing to leave a makeshift encampment on campus. Despite Jewish leadership at Columbia suggesting that Jewish students are no longer safe on campus due to the threat of violence from radical leftist protesters, Teen Vogue decided to write a glowing piece about Hirsi this weekend. The Rich Zeoli Show- Hour 2: 4:05pm- Bruce LeVell—Senior Advisor to President Donald Trump & Former Small Business Advisory Advocate for the White House—joins The Rich Zeoli Show to discuss the 2024 campaign, Trump's New York City trial over “hush money” payments, and President Joe Biden's recent trip to Scranton. 4:25pm- While appearing on CNN, New York Times reporter Maggie Haberman ridiculously accused Donald Trump of glaring at her in court after she reported that Trump may have fallen asleep during legal proceedings. 4:30pm- Andrew C. Trump was indicted for attempting to conceal payments made to adult film actress Stormy Daniels. Manhattan District Attorney Alvin Bragg alleges that the payment concealment amounted to falsified business records which influenced the 2016 election. McCarthy hilariously notes that Bragg's legal argument seems to imply that it's acceptable for a politician to pay-off adult film actresses with campaign funds provided the transactions are properly documented! You can learn more about his book here: https://www.encounterbooks.com/books/ball-of-collusion/. 4:50pm- On Tuesday, the U.S. Supreme Court heard oral argument in Fischer v. United States—a case which will determine whether obstruction laws can be used to charge January 6th defendants. While questioning U.S. Solicitor General Elizabeth Prelogar, Justice Neil Gorsuch asked if “pulling a fire alarm before a [Congressional] vote” would qualify as obstruction, potentially resulting in up to 20-years of federal imprisonment. Notably, Congressman Jamaal Bowman (D-NY) pulled a fire alarm in the Cannon House Office Building just prior to the House holding its vote on a stopgap spending measure—allegedly to delay the vote.
Andrew C. McCarthy joins the podcast today to talk about how the prosecutions of Donald Trump may be violating critical Constitutional and procedural protections for defendants who stand accused of crimes before the bar—and why that matters. Give a listen.
The Rich Zeoli Show- Full Episode (02/28/2024): 3:05pm- On Wednesday, during a speech from the Senate floor, Senate Minority Leader Mitch McConnell (R-KY) announced that he would be stepping down from his leadership position at the end of the term in November. Though, he does not plan to resign from the Senate. McConnell, now 82-years-old, has served in the U.S. Senate for nearly 40-years and has been the leader of the Senate Republican Conference since 2007. You can read more here: https://thehill.com/homenews/senate/4494536-mcconnell-to-step-down-as-senate-gop-leader/ 3:15pm- According to reports from both The New York Times and The Wall Street Journal, during a White House meeting on Tuesday, Senate Minority Leader Mitch McConnell (R-KY) joined Democrat leadership—President Joe Biden, Vice President Kamala Harris, Senate Majority Leader Chuck Schumer, and House Minority Leader Hakeem Jeffries—in pressing Speaker of the House Mike Johnson (R-LA) to vote on a bill that would send tens-of-billions of dollars of foreign aid to Ukraine. The bill, which passed in the Senate, has stalled in the House of Representatives. 3:40pm- On Tuesday, Michigan held its Republican and Democrat primaries. Donald Trump defeated Nikki Haley 68% to 27%. Meanwhile President Joe Biden won 81% of the vote—though, “uncommitted” received a shocking 101,000 votes, or 13% of the Democrat electorate. According to estimates, “uncommitted” earned enough support to be awarded 2 delegates. Perhaps most alarming for Democrats, “uncommitted”—which beat Biden in Dearborn and Hamtramck, both of which have large Arab American populations—also performed well in East Lansing and Ann Arbor, two college towns. Is Biden struggling to appeal to young voters? And what could that mean for Biden in a general election? 4:05pm- On Wednesday, President Joe Biden had his annual physical at Walter Reed National Military Medical Center—though, he received no cognitive test. During her White House press briefing, Press Secretary Karine Jean-Pierre insisted that Biden “passes a cognitive test everyday” as president. You can read more here: https://www.wsj.com/politics/president-biden-gets-annual-physical-amid-concerns-about-age-76a608c9?mod=hp_lead_pos3 4:15pm- While appearing on CNN with Erin Burnett, former Obama Administration Advisor Van Jones reacted to the idea that Robert Kennedy Jr. might be able to win traditionally Democrat voters in swing states who may be unhappy with President Joe Biden's policies. Jones noted that Kennedy is “on track to be in enough states to cost Joe Biden the presidency.” 4:30pm- David Kappos—Under Secretary of Commerce for Intellectual Property and Director, U.S. Patent and Trademark Office under Barack Obama (2009-2013)—joins The Rich Zeoli Show to discuss a Biden Administration proposal that would reinterpret the Bayh-Dole Act which deals with the development of intellectual property arising from research funded by the federal government—with ownership of the invention/patent being granted to the entity responsible for actually conducting the research. Rather than alter the bill through the legislative process, President Joe Biden may act unilaterally via executive order. And under Biden's proposed alteration to the Bayh-Dole Act's framework, he would weaken patent ownership—hobbling technological, medical, and scientific innovation done at universities, for example, in the process. A letter to Biden, signed by Kappos and other former government officials, states: “We believe the adoption of the Draft Framework would destabilize our nation's entire technology transfer system which is central to U.S. innovation, and we thus implore you to withdraw the framework in its entirety.” 4:50pm- After a seven-hour deposition, Hunter Biden and his attorney Abbe Lowell emerged from an office building on Capitol Hill. How would this new proposed exorbitant tax impact job creation throughout the state? 5:20pm- Jess Bravin of The Wall Street Journal writes: “The Supreme Court agreed to consider whether Donald Trump must stand trial on charges he plotted to overturn the 2020 election, after lower courts rejected his claim that he is entitled to absolute immunity because he was president at the time. The court's move means it will have final say on an issue the judiciary never confronted before Trump. But it also means the former president has bought himself at least another couple of months before any trial, which had been scheduled to start in early March before the immunity battle scuttled those plans.” You find more on this developing story here: https://www.wsj.com/us-news/law/supreme-court-to-say-if-donald-trump-must-stand-trial-in-2020-election-conspiracy-case-1b7f4e3f 5:40pm- Phil Kerpen—President of American Commitment—joins The Rich Zeoli Show to discuss Senate Minority Leader Mitch McConnell's announcement that he will be stepping down at the end of the term in November. Plus, according to reports, Congressional leaders have agreed to a short-term bill to avoid a partial government shutdown which was at risk of occurring at the end of the week. And did Governor Gavin Newsom really exempt Panera Bread from new state minimum wage laws because they contributed to his campaign? The Department of Justice released a report that Joe Biden willfully retained classified documents – but can't be tried because - long story short - he is non compos mentis. The Dems are outraged. Is it justified? On the other side of the aisle, Trump is facing 14th Amendment charges to keep him off the ballot. Is that legal? And finally, the House is mired in debates ongoing about passing a border bill. What was wrong with the Senate bill? As usual, there is a lot going on this week – but we have the guest to help us understand it all.Andrew C. McCarthy—Senior Fellow at National Review Institute & Author of “Ball of Collusion: The Plot to Rig an Election and Destroy a Presidency”—joins The Rich Zeoli Show to discuss his latest article, “Jockeying Over Hunter Biden House Testimony.” McCarthy writes: “Hunter [Biden]'s legal team has reacted to the [Congressional] subpoena by agreeing that he will show up but demanding that the testimony be held in public…A subpoena is not a suggestion. It is an order enforceable by legal penalties. By agreeing that he will attend, Hunter is putting a brave face on what's no more than an acknowledgement that he will do what he is legally compelled to do. He is demanding that the hearing be public because he knows Republicans will refuse.” You can read the full article here: https://www.nationalreview.com/corner/jockeying-over-hunter-biden-house-testimony/ Senator Rand Paul—United States Senator from Kentucky & Author of “Deception: The Great Covid Cover-Up”—joins The Rich Zeoli Show. Throughout the book Sen. Paul presents evidence that COVID-19 likely originated in a Wuhan, China laboratory and was a by-product of dangerous gain-of-function research. Was the research funded by U.S. taxpayers? And did Dr. Anthony Fauci attempt to cover-up the virus's origin? Sen. Paul says, “if I had it my way, Anthony Fauci would already be wearing pinstripes.” Plus, Sen. Paul reacts to Elon Musk's assessment that, prior to his ownership, Twitter suppressed Republican posts at 10x the rate of Democrats—accusing the social media platform of ostensibly being “a state publication.” Sen. Kennedy Jr. testified before a House Judiciary Subcommittee on censorship. Ironically, Congresswoman Debbie Wasserman-Schultz (D-FL) attempted to end the hearing before it even began—baselessly alleging that Kennedy harbored racist and antisemitic views. Kennedy vehemently denied Wasserman-Schultz' reprehensible claims, exclaiming: "I want to say this while I'm on the record. In my entire life…I have never uttered a phrase that was either racist or antisemitic." 4:15pm- During his opening statement at Thursday's House Judiciary hearing on the weaponization of the federal government, Kennedy noted that free speech is the basis of Democracy and that “the First Amendment was not written for easy speech it was written for speech that nobody likes you for.” 4:30pm- Dr. E.J. Antoni— Economist & Research Fellow in The Heritage Foundation's Grover M. Hermann Center for the Federal Budget—joins The Rich Zeoli Show to recap President Joe Biden's trip to Philadelphia where he touted “Bidenomics.” But is the economy really as strong as the Biden Administration proclaims? Though the memes were tame, the school suspended the student. FIRE notes, “the First Amendment bars public school employees from acting as a 24/7 board of censors, and the lawsuit seeks to cement Supreme Court law that schools cannot punish students for nondisruptive, private, off-campus speech.”

The Rich Zeoli Show- Full Episode (06/02/2023): 3:05pm- Shortly after delivering the commencement address to the U.S. Air Force Academy on Thursday, President Joe Biden took a scary fall—thankfully, after being helped up by several secret service agents he appeared to be ok. An NBC Nightly News report from Stephanie Gosk bemoaned the fact that several companies have begun to be less vociferous in their support/participation in Pride Month—specifically, elements of the LGBTQ+ community that have been outspoken in their support for “gender affirming” procedures on children. Caroline Downey of National Review writes, “[t]he stock was demoted from overweight, which means the broker has a positive outlook on the company's prospects due to its current share price and that the stock is considered a strong buy, to neutral, which means the broker believes the investor should hold the stock as its price may not change.” You can read more here: https://www.nationalreview.com/news/jpmorgan-downgrades-target-stock-amid-backlash-over-lgbt-merchandise/#:~:text=Target%27s%20stock%20was%20downgraded%20on,the%20store%27s%20LGBT%20product%20campaign 3:35pm- During a town hall-style interview with Sean Hannity on Fox News, former President Donald Trump mocked Chris Christie's presumed run for president in 2024—pointing out that the former New Jersey Governor is barely polling at 1%. 3:45pm- State Senator Ed Durr—representing New Jersey's 3rd Legislative District—joins The Rich Zeoli Show to discuss his reelection campaign. McCarthy, “FBI director Chris Wray reached a compromise with committee chairman James Comer (R-KY)” regarding a House Oversight Committee subpoenaed document which is alleged to show members of the Biden family were receiving payments from foreign nationals for policy influence while Joe Biden was Vice President.
