Many are not happy with Rep. Bacon and Sen. Grassley for their recent Congressional action on President Trump's tariffs. And they're not happy with me for welcoming them to the fight (which is what they better be doing here). We also talk about the Nazi pic from a small Nebraska town, Gov. Pillen's war on taxpayer-purchased pop, the closing of a beloved Ralson landmark, and more.
Simon Conway's interview with Speaker of the Iowa House Pat Grassley during Monday's first hour.
The White House Office of Management and Budget released a pair of memos to provide agencies with guardrails for how they use and purchase artificial intelligence in the government, replacing Biden administration guidance but maintaining some of the same structures. Both memos, which are dated April 3, represent some of the first major policy actions President Donald Trump has taken on the government's use of AI. Trump began his administration by rolling back former President Joe Biden's AI executive order and later issuing one of his own that called for an AI action plan and a review of the previous administration's work on the technology. Specifically, the order included directions to revise the Biden OMB's AI governance and acquisition guidance. The first new memo (M-25-21) provides guardrails for use and replaces Biden's directive on the same topic (M-24-10). That document states agencies are to focus on three priorities when accelerating the federal use of AI — innovation, governance and public trust — which align with an executive order on the technology from the first Trump administration. But that directive also maintains things that were established under the Biden administration, like chief AI officers and their council and a special management process for potentially risky AI uses it now calls “high-impact.” Similarly, the second memo on AI acquisition (M-25-22) replaces the Biden OMB's guidance on government purchasing of the tech (M-24-18). A bipartisan pair of senators is taking another shot at their bill to expand the U.S. Secret Service's investigative powers for financial cybercrime probes. The Combatting Money Laundering in Cyber Crime Act from Sens. Catherine Cortez Masto, D-Nev., and Chuck Grassley, R-Iowa, would update federal law to strengthen the Secret Service's authority, enabling the agency to look into criminal activity tied to digital assets. Cortez Masto said in a statement: “Dangerous criminals are constantly changing their tactics and using new technology to avoid detection. Our law enforcement agencies need to adapt to keep communities safe. I will continue to fight to pass this bipartisan legislation that would help the Secret Service more effectively combat cybercrime.” Under current law, the Secret Service is empowered to investigate cybercrimes that threaten national security, but those that are conducted via unlicensed money transmitting businesses fall outside the agency's purview. The legislation from Cortez Masto and Grassley, both members of the Senate Finance Committee, addresses that gap by allowing Secret Service members to probe digital asset transactions tied to transnational cyber criminal activity. Senator Chuck Grassley discusses his efforts to rein in activist federal judges who issue national injunctions, affecting the entire country rather than just their district. He highlighted the issue of judges taking free junkets, which can influence their decisions. Grassley also addresses the Biden administration's mishandling of unaccompanied minors at the border, noting that 200,000 children were lost track of, and some were sent to families connected to MS-13. He emphasizes the need for bipartisan support to address these issues and praised the new FBI director for addressing unanswered oversight letters. Grassley also advocates for the reinstatement of whistleblowers who lost their jobs for exposing wrongdoing. Additionally, Congressman Marlon Stutzman discusses the impact of President Trump's tariffs on global trade, particularly on American farmers and producers. Stutzman highlights the historical disadvantages faced by American beef farmers due to Mad Cow Disease restrictions, which allowed Australia to build its beef industry. He emphasizes the need for fair trade rather than free trade, noting that the U.S. has been disadvantaged in defending its allies. Stutzman also mentions the positive economic impact of Trump's policies, including tax reforms, energy policies, and deregulation, which have attracted significant investments from companies like Oracle and Nvidia. He believes these policies will sustain economic growth and maintain America's global economic leadership. Finally, West Virginia has banned seven artificial food dyes due to their harmful effects, setting a precedent for other states. Senator Chris Rose talks about the legislation, highlighting the state's reputation as the least healthy and the need to address attention disorders and carcinogens linked to these dyes. Despite industry resistance, Rose notes that healthier alternatives are available and cheaper, citing examples like Aldi. The state is also considering a SNAP program waiver to remove sugary drinks. Governor Morrisey's "Mountaineer Mile" initiative aims to promote health. Rose emphasizes the need for a coalition of states, including Texas and Florida, to push for federal action on food safety.See Privacy Policy at https://art19.com/privacy and California Privacy Notice at https://art19.com/privacy#do-not-sell-my-info.

Reducing the cost of prescription drugs has been a bipartisan priority for years. One recent effort is the Preserve Access to Affordadble Generics and Biosimilars Act (S. 142), sponsored by Sen. Klobuchar with the support of Sen. Grassley and others. This bill would give the FTC new authority to investigate settlements between branded and generic drug companies that delay generic/biosimilar market entry and are deemed anticompetitive. The bill proposes allowing the FTC to make factual findings and liability determinations that the district court applies when computing damages. Our expert panel will discuss whether this bifurcated administrative/judicial arrangement can be squared with SEC v. Jarkesy and more broadly discuss issues around patent settlements in the bio/pharma space. Featuring:Matthew S. Hellman, Partner, Jenner & BlockWilliam M. On the surface, endorsements from top Democrats continue to pile up for Kamala Harris' presumptive nomination to run for president in November. Sen. Schumer and House Minority Leader Jeffries announced their support as well after something of a delay as compared to colleagues. Is the support for Harris real, temporary or just for show for a default choice? Is Kamala Harris a legitimate threat to win the presidency or an albatross on the ticket while the party looks toward 2028? Dr. Jerome Corsi explores these questions on The Truth Central. Also, not much new information about the attempted assassination of Donald Trump has been released for quite a while, aside from some bodycam footage from local law enforcement as requested by Sen. This Day in Legal History: Federal Housing Act PassedOn this day in legal history, July 15, 1949, Congress passed the Federal Housing Act, a pivotal piece of legislation that aimed to address the nation's post-war housing crisis. This Act, also known as the Housing Act of 1949, was a key component of President Harry S. Truman's Fair Deal program. It marked a significant federal commitment to improving living conditions for low-income Americans. The Act provided federal funding for slum clearance, urban renewal projects, and the construction of low-rent public housing. Title I of the Act focused on urban renewal, authorizing the use of federal funds to clear blighted areas in cities. Title II aimed to increase the availability of low-rent public housing by providing subsidies for the construction of new units. The legislation intended not only to address the housing shortage but also to stimulate the economy by creating construction jobs. The passage of the Federal Housing Act of 1949 reflected a growing recognition of the government's role in ensuring decent housing for all citizens. However, its implementation also sparked controversy and criticism, particularly regarding the displacement of communities and the effectiveness of urban renewal efforts. Despite these challenges, the Act laid the groundwork for subsequent federal housing policies and programs, shaping the landscape of American cities and the lives of countless families. This landmark legislation underscored the ongoing struggle to balance development, equity, and community preservation in urban policy.A federal judge in Florida, Aileen Cannon, dismissed the criminal case against Donald Trump concerning his alleged illegal retention of classified documents at his Mar-a-Lago resort. The ruling followed a hearing where Trump's legal team argued for dismissal, citing selective prosecution and political targeting by Democrats as Trump seeks the presidency again. They also referenced a Supreme Court decision granting the president immunity for official acts. In contrast, President Joe Biden and former Vice President Mike Pence faced no criminal charges for their mishandling of classified documents, as both cooperated with investigators. Prosecutors had argued Trump's case was different due to allegations he obstructed the investigation by moving documents and discussing deceit with investigators. The dismissed charges had included 40 counts related to national security issues like nuclear capabilities and military vulnerabilities.Florida judge dismisses criminal classified documents case against TrumpFollowing the Supreme Court's decision to limit federal regulators' powers, the Tennessee Walking Horse National Celebration Association and two show horse owners filed a lawsuit against a new USDA rule aimed at preventing horse soring. The case was strategically filed in Amarillo, Texas, to be heard by US District Judge Matthew Kacsmaryk, known for rulings against Biden administration policies. Plaintiffs argue the USDA rule, which bans devices and practices that can mask evidence of soring, will significantly devalue their horses, leading to a regulatory taking. The rule specifically targets Tennessee Walking Horses and Racking Horses, prohibiting chains, pads, wedges, and lubricants used to enhance their gait. The lawsuit comes in the wake of the Supreme Court's June 28 decision to end Chevron deference, which had required courts to defer to an agency's reasonable interpretation of an ambiguous law. This case exemplifies the swift actions taken by anti-regulation groups to leverage the new regulatory landscape. Despite not explicitly mentioning Chevron or Loper Bright, the lawsuit challenges the USDA's authority under the Horse Protection Act, claiming the banned equipment does not cause soring based on scientific evidence.Legal experts note the potential implications of this case, suggesting it could influence future regulatory policymaking. Critics argue the association is engaging in judge shopping to secure a favorable outcome. The plaintiffs seek to invalidate the rule and claim compensation for the anticipated loss in their horses' value, arguing the rule constitutes a regulatory taking. The outcome of this case could set a significant precedent in the context of administrative law and regulatory challenges. The concept of regulatory taking is central to this case. It refers to a situation where a government regulation limits the use of private property to such an extent that it effectively deprives the owners of its value, warranting compensation. This claim, if accepted by the court, could complicate future regulatory efforts by requiring compensation for loss in property value due to regulatory changes.Tennessee Horse Show Picks Texas to Challenge Rule Post ChevronA divided federal appeals court upheld Tennessee's longstanding policy prohibiting changes to the sex listed on birth certificates, rejecting a constitutional challenge by four transgender women. The 6th U.S. Circuit Court of Appeals ruled 2-1 that the U.S. Constitution does not mandate Tennessee to amend birth certificates to reflect gender identity. The court concluded that Tennessee has the discretion to maintain records based on biological sex. The plaintiffs argued that the policy violated their due process and equal protection rights under the 14th Amendment by discriminating based on sex and transgender status. However, Chief U.S. Circuit Judge Jeffrey Sutton, representing the majority, stated that there is no fundamental right to have a birth certificate reflect gender identity over biological sex. Tennessee's Republican attorney general, Jonathan Skrmetti, supported the ruling, emphasizing that any policy change must come from the state's residents. The plaintiffs' lawyer, Omar Gonzalez-Pagan from Lambda Legal, expressed disappointment and indicated potential further actions. He highlighted that the ruling conflicts with a recent decision by the 10th U.S. Circuit Court of Appeals, which revived a similar lawsuit in Oklahoma. Judge Helene White, who dissented, argued that Tennessee's policy relies on outdated generalizations about sex and gender, infringing on the plaintiffs' rights by forcing them to disclose their transgender status in situations requiring birth certificates.Court upholds Tennessee ban on changing sex in birth certificates | ReutersOpenAI whistleblowers have filed a complaint with the U.S. Securities and Exchange Commission (SEC), urging an investigation into the company's non-disclosure agreements (NDAs). These agreements allegedly required employees to waive their federal rights to whistleblower compensation. The whistleblowers, supported by Sen. Chuck Grassley's office, claim that OpenAI's policies suppress employees' rights to report concerns and receive compensation for protected disclosures. The complaint requests the SEC to impose fines on OpenAI for each improper NDA and to inspect all contracts containing such agreements. The whistleblowers also highlight that OpenAI's NDAs lacked exemptions for disclosing securities violations and required prior company consent to disclose information to federal regulators.Sen. Grassley emphasized the importance of whistleblower protections, especially as artificial intelligence continues to advance rapidly. The SEC has not commented on the existence of the whistleblower submission, and OpenAI has not responded to requests for comment. However, she now finds herself under scrutiny, with investigations into her office's management of federal funds. GOP Senators Chuck Grassley from Iowa and Ron Johnson from Wisconsin recently penned a stern letter to Willis, demanding answers about what seems to be a misappropriation of grant money from the federal government. The letter, which has been made accessible to the public via sources including The Beacon, draws attention to a glaring discrepancy. It contrasts the original purpose of the taxpayer-allocated federal awards with the alleged real usage of these funds in Fulton County. The Senators were unequivocal in their condemnation, emphasizing that wastage or misuse of taxpayer money is a breach of public trust. Senator Grassley, in conversation with The Beacon, reinforced the need for accountability, stating unequivocally that Congress has the right to scrutinize the allocation and utilization of federal tax dollars. He pointed out that these monies were meant to aid at-risk youth and bolster essential law enforcement initiatives. Yet, the indications are that the Fulton County DA's office may have utilized these resources for their own discretionary reasons. All misuse of taxpayer funds should be taken seriously and addressed with appropriate actions. However, it isn't just Senators Grassley and Johnson sounding the alarm. The Beacon's independent investigation corroborated the allegations of dubious spending. In particular, it flagged several instances where DA Willis appeared to divert funds from federal grants to pay for her office's expenditures, such as computer equipment and travel expenses.See omnystudio.com/listener for privacy information.
Making a Difference on Capitol HillIn the halls of Capitol Hill, among the throng of suits and ties, one Ohioan stands out - Benjamin Mays, a legislative correspondent for Iowa Senator Chuck Grassley. Hailing from Middletown, Ohio, Benjamin found his calling in the heart of Washington, D.C., but his journey to the nation's capital began with a pivotal visit to Cedarville University. As a high school senior, Benjamin stepped onto Cedarville's campus, where he first learned about the D.C. Semester program. This unique opportunity, offering a blend of classroom learning and real-world experience in politics, sealed his decision to pursue political science at Cedarville. During his semester in D.C., Benjamin interned in the office of Ohio Representative Warren Davidson, gaining firsthand insight into the intersection of national policy and local communities. Serving constituents who were also his neighbors, he witnessed the tangible impact of government on everyday lives. Inspired by Rep. Davidson's Christian values guiding his legislative work, Benjamin recognized the vital role of faith in shaping political decisions. Armed with this perspective, he graduated with a degree in political science and joined Sen. Grassley's office, determined to make a difference. For Benjamin, government service is more than just a career - it's a calling to embody Christian principles in the political arena. With a firm belief that God's presence is needed now more than ever in policy-making, he intends to stay in public service as long as he can, advocating for integrity and compassion in governance. Tune in to the Cedarville Stories podcast to hear Benjamin's inspiring journey, from Cedarville to Capitol Hill, and his unwavering commitment to bringing faith into the heart of politics. https://share.transistor.fm/s/30de62b6
