(Bonus) At various times in the more than one hundred years that have elapsed since the song was written, particularly during the John F. Kennedy administration, there have been efforts to give "America the Beautiful" legal status either as a national hymn or as a national anthem equal to, or in place of, "The Star-Spangled Banner", but so far this has not succeeded. Proponents prefer "America the Beautiful" for various reasons, saying it is easier to sing, more melodic, and more adaptable to new orchestrations while still remaining as easily recognizable as "The Star-Spangled Banner". Some prefer "America the Beautiful" over "The Star-Spangled Banner" due to the latter's war-oriented imagery; others prefer "The Star-Spangled Banner" for the same reason. While that national dichotomy has stymied any effort at changing the tradition of the national anthem, "America the Beautiful" continues to be held in high esteem by a large number of Americans, and was even being considered before 1931 as a candidate to become the national anthem of the United States.

All it took was a NY Times op-ed article on the (misunderstood) legacy of Justice John Marshall Harlan’s famous dissent in the 1896 Plessy (“separate but equal”) case to set off a classic “Lucretia” rant: I find the NYT piece more damaging to the cause of equality before the law even than critical race theory. I think [the author] perpetuates that subterfuge that makes it possible for milquetoast lefties to ignore the radicalism of the militant left. . . In other words, Canellos pretending that any of the principled rationale from Harlan’s Plessy dissent actually found its way into the Brown decision—or subsequent civil rights cases—is positively ludicrous. Brown, as well as most everything up to and including the modern DIE industry, is a complete embrace of Plessy’s central rationale—that the only important consideration is the stigma caused by separateness. So naturally we decided to unpack the ambiguity (and that’s being charitable) of the Brown decision’s treatment of the 14th Amendment’s equal protection clause. Even though the Court decided correctly in striking down segregated schools, it did lasting damage to our jurisprudence with its obfuscation of the 14th Amendment. For example, take in the fourth paragraph of Chief Justice Earl Warren’s opinion: Reargument [of the case] was largely devoted to the circumstances surrounding the adoption of the Fourteenth Amendment in 1868. It covered exhaustively consideration of the Amendment in Congress, ratification by the states, then existing practices in racial segregation, and the views of proponents and opponents of the Amendment. This discussion and our own investigation convince us that, although these sources cast some light, it is not enough to resolve the problem with which we are faced. At best, they are inconclusive. The most avid proponents of the post-War Amendments undoubtedly intended them to remove all legal distinctions among “all persons born or naturalized in the United States.” Their opponents, just as certainly, were antagonistic to both the letter and the spirit of the Amendments and wished them to have the most limited effect. What others in Congress and the state legislatures had in mind cannot be determined with any degree of certainty. Translation: We have no idea what the equal protection clause should mean (though that didn’t stop the Court from deploying it recklessly in the 1960s when it suited them), so we’re going to make it up as we go along, and decide the Brown case on a different basis: modern psychology rather than fundamental law. This was made explicit in two short subsequent passages in the opinion: Whatever may have been the extent of psychological knowledge at the time of Plessy v. Ferguson, this finding is amply supported by modern authority. Any language in Plessy v. Ferguson contrary to this finding is rejected. We conclude that in the field of public education the doctrine of “separate but equal” has no place. Separate educational facilities are inherently unequal. [Emphasis added.] Why limit the reach of this opinion just to public education? The real reason is to keep open the possibility of using racial classifications in the law to enable redistribution schemes like racial reparations, etc. Let’s recall, then Harlan’s clear language: But in view of the Constitution, in the eye of the law, there is in this country no superior, dominant, ruling class of citizens. There is no caste here. Our Constitution is color-blind, and neither knows nor tolerates classes among citizens. In respect of civil rights, all citizens are equal before the law. The humblest is the peer of the most powerful. The law regards man as man, and takes no account of his surroundings or of his color when his civil rights as guaranteed by the supreme law of the land are involved. It is therefore to be regretted that this high tribunal, the final expositor of the fundamental law of the land, has reached the conclusion that it is competent for a State to regulate the enjoyment by citizens of their civil rights solely upon the basis of race. In my opinion, the judgment this day rendered will, in time, prove to be quite as pernicious as the decision made by this tribunal in the Dred Scott Case. . . . The destinies of the two races in this country are indissolubly linked together, and the interests of both require that the common government of all shall not permit the seeds of race hate to be planted under the sanction of law. By contrast, the majority opinion in Plessy held: The object of the amendment was undoubtedly to enforce the absolute equality of the two races before the law, but, in the nature of things, it could not have been intended to abolish distinctions based upon color, or to enforce social, as distinguished from political, equality, or a commingling of the two races upon terms unsatisfactory to either. The point is: today’s race-conscious civil rights jurisprudence of the left is identical to Plessy‘s majority opinion that distinctions based upon color are permissible. Almost no one perceives this, and the left has an interest in concealing this. Bonus: At the end, we talk a bit about the current fascination with UFOs, which make more sense than the legal reasoning of the Warren Court.
The recent mass shooting in Atlanta remind us of the deep divides that exist in our country. Naturally, given what we know about the case, we have to ask the question: "were the shootings racially motivated." Dr. Frank makes the case for comprehensive immigration reform and holds policy makers on both sides of the aisle to account for our nation's failed immigration policy. The Job Search Narrative is the story or pitch that you have when you are looking for a new position. The interesting part is that you don't have to be actively job searching to have a good job search narrative. This is similar to an elevator pitch, but more intentional. A job search narrative is more about the story you are telling about who you are as a professional and where you are headed in your career. It is the next level of depth past an elevator pitch to inform someone of your professional status. In this episode, I share my own experience of not having a good job search narrative that cost me positions and I share examples of what a good narrative sounds like and what an unprepared narrative sounds like. The Wake Up Experience is composed of two friends and artists, Evan Bane and Ryz. Evan grew up around Hip-Hop and Gospel Music and started rapping at a young age. Ryz is a singer, producer and happens to be certified in Advanced Spiritual Psychology. But, their lives weren't always this way. At one point in his life, Ryz found himself homeless, with a food addiction, and living an overall unhealthy life. At one point, he decided he needed to make a change. Now, years after Ryz and Evan met in college, they create music together as The Wake Up Experience. Throughout their journeys of struggles and accomplishments, both of them found veganism, which shifted some of their creative experiences. The Wake Up Experience has grown to a point where the guys have focused on how to be more loving and compassionate, and how to spread those messages through their music. Jim spent many years working in management for the DuPont corportation, and spent about 2 years in rural India working with the Peace Corps. Now retired, he is an avid outdoorsman, bow hunter, renewable energy enthusiast and loves driving his Tesla Model 3. He brought the car to the station and handed Adam the keys for a drive around town. Adam and Jim also discuss the challenges inherent in bow hunting, and the mission of the Peace Corps as well as Jim's time in India. Welcome Betzy Valdez of @bempowereddreamer to Episode 92 of the @immigrationmicpodcast! Betzy is a DACA recipient from Central Mexico whose family immigrated to Colorado for a better life for their family; her sister was born with bilateral microtia and needed specialized care. Growing up, Betzy hid her good grades and intelligence to fit in, and similarly, she was uncomfortable with immigration conversations because she felt it would bring up her immigration status. 9/11 marked an important moment for her; she felt it became a hopeless situation to find relief for her immigration status or to obtain residency. She talks about her life transitions: getting married at 19, having her first child at 20, and how her three daughters motivate her to push forward. Betzy describes her inner struggles being undocumented in high school, and how after DACA in 2012, she was able to go back to school, and is working towards her associates degree; her way of going after the American Dream. We talk about the 2016 election, and how Betzy was crushed by DACA being ended in 2017 - and how she fought against the negativity during that time, and didn’t let it defeat her. She tells the story of when she unexpectedly first told her story at a networking event, and the fateful moment that she knew she was destined to tell her story to empower herself and others. Pablo Larraín was born when Pinochet was already in power but the military coup that brought Pinochet to power always fascinated him, largely because it wasn’t something that was discussed until after the dictatorship ended in 1990. On top of that, Larraín became fascinated by the little people who got wrapped up in big moments in history. One that piqued his curiosity was a man named Mario who happened to be a coroner’s assistant helping in the room during the autopsy of President Salvador Allende, the former Chilean leader before Pinochet’s rise. Larraín became fascinated by this moment of history told through this character’s eyes. And thus, Post Mortem was born. Join us – Pete Wright and Andy Nelson – as we continue our ‘Pablo Larraín’s Unintentional Trilogy’ series with his 2010 film Post Mortem. We talk about why this film, while not as unenjoyable to watch as Tony Manero, still is difficult to watch, and it’s largely about the dislikeable protagonist Mario played well by Alfredo Castro. We debate what Larraín is doing here and if perhaps he’s aiming for too much symbolism in these stories with such despicable characters. We chat about the political environment in Chile at the time and how fascinated we were by those elements. We talk about the crazy Russian lenses they used to film this movie and how much we ended up liking the hypnotic look, even if it took us a while to get there. We chat about Antonia Zegers and Amparo Noguera and some of the powerful moments the two of them provide in the film. And we look at the last shot of the film and the potential power in it.
