As we start a new year, here are 5 things employers may want to consider to avoid trouble:1.  COVID-19 Plans - You probably have a plan in place but this is a good time to take stock of how it is working.  Also, employers need to consider what to do about vaccine policies as the vaccines become more widely available.  Finally, the FFCRA leave has expired as of 12/31/20 but employers may continue to offer leave through March 2021 - consider whether this makes sense for your business.2.  Independent Contractors - How is your business using independent contractors?  Are thy properly classified as independent contractors or are they employees?  Traditionally, tests focus on the level of control businesses have over workers.  On January 7, 2021, the U.S. Department of Labor issued a new final rule on this topic - https://tinyurl.com/y4p6x6qy.The new rule provides some clarification for employers but its future is not clear as it does not become effective until March after the new administration takes over.  Regardless, employers should check their independent contractors and stay tuned for more information on the new rule.3.  Exempt Status of Employees - This is a good time for employers to consider whether their employees are properly classified.  There have been a lot of changes over the past year and the bases for employee exemptions may have changed.4.  Pending Employment Litigation - January is traditionally a great month to settle cases.  If you have pending litigation, this is a good time to consider whether you can settle claims and put them behind you.5.  New Laws - Several states have passed new laws that go into effect this year - this is a good time to check if any apply to your business.  Ohio has passed one of the most significant laws, overhauling its employment discrimination law.  Three big changes are eliminating most individual liability for managers and supervisors, requiring litigants to file charges before going to court and shortening the statute of limitations for claims from 6 years to 2 years.The new Ohio law is here: https://tinyurl.com/yy9b83coComments or questions: Contact Mark Chumley at mchumley@kmklaw.com or visit www.kmklaw.comMusic :Jamming with Leon by texasradiofish (c) copyright 2020 Licensed under a Creative Commons Attribution Noncommercial  (3.0) license. http://dig.ccmixter.org/files/texasradiofish/61983 Ft: Scomber

Suzanne and Chase then talk about practical implications of the act, including employee notification, administration, and plan document updates before digging into provisions of the law that apply to individuals, including unemployment benefits and stimulus checks. Suzanne outlines the items in the law relating to small businesses, including extensions of employee retention and FFCRA tax credits and additional amendments to the PPP loan program. The Families First Coronavirus Response Act (FFCRA), which took effect April 1, requires covered employers to provide eligible employees with temporary job-protected paid sick leave and paid expanded family and medical leave due to certain qualifying reasons related to the COVID-19 pandemic. The FFCRA has a sunset date of December 31, 2020. In the absence of a law extending the FFCRA's provisions, employers need to be proactive and prepare for the sunset of the FFCRA. Jonyce Bullock Squire launched a COVID-19 business resource center that kept pace with the many changes and announcements made as the PPP program, FFCRA, and other resources emerged. This includes articles and many free webinars. We worked with clients to get them applied for the PPP to ensure they get the funds they need to stay in business. We continue to watch the situation closely and update accordingly. We also moved all internal and client meetings virtually unless necessary and we set up drop box sites at each location for those who cannot send their files virtually. All employees can work from home outside a very minimal number of essential staff. Although distance has been necessary, we recognize the need for all employees to feel connected to their coworkers. We opened up Microsoft Teams channels for staff to use for "water cooler chats," sent care packages to provide a few comforts, which has made working remotely more enjoyable. A new school year has started, and it is presenting unprecedented challenges for working parents and employers. Many schools are physically open on a reduced schedule or 100% remote. The US Department of Labor recently tried to clear up confusion regarding an employee's eligibility for leave under the Families First Coronavirus Response Act (FFCRA) when a child's school is on a hybrid or remote schedule. On this podcast, Littler employment shareholder Jeff Nowak joins XpertHR Legal Editor David Weisenfeld to discuss a host of back to school leave issues. Nowak is sympathetic to the plight many parents are facing, but said they cannot take leave under the FFCRA for the hours or days that their child's school is open. However, he advises employers to look for creative solutions when possible in noting that they will help them to be an "employer of choice" when the coronavirus pandemic is over.

Millions of US workers are able to receive federally mandated paid leave for the first time under the Families First Coronavirus Response Act (FFCRA). But with few employers unscathed by the COVID-19 crisis, many are wondering what this emergency law means for them. Littler employment attorney Jeff Nowak, a leading authority on leave law issues, joins XpertHR Legal Editor David Weisenfeld to break down the FFCRA. "This new law is fraught with compliance issues," said Nowak. What concerns him the most is how employers will take paid leave into account in conjunction with the Family and Medical Leave Act and state and local leave laws. But Nowak said the availability of immediate tax credits eases the burden on employers somewhat.
