Bản án 2 năm tù vì tội trốn thuế được tuyên ngày 17/06 đối với bà Ngụy Thị Khanh, giám đốc tổ chức GreenID, bị nhiều tổ chức bảo vệ nhân quyền cho “là một phần trong một nỗ lực rộng hơn nhằm bịt miệng các nhà hoạt động môi trường hàng đầu ở Việt Nam”. Bà Ngụy Thị Khanh bị cáo buộc “vi phạm quy định pháp luật về quản lý thuế” đối với khoản tiền thưởng 2 triệu đô la cho 3 năm sau khi bà và tổ chức GreenID được trao giải Đột phá về Môi trường (Climate Breakthrough Award) năm 2019. Ba nhà hoạt động môi trường khác là Mai Phan Lợi, Bạch Hùng Dương và Đặng Đình Bách cũng bị bắt hoặc bị kết án vì “trốn thuế”, tội danh phổ biến tại Việt Nam khi chính quyền muốn “sờ” đến ai. Theo tổ chức Quan Sát Nhân Quyền (Human Rights Watch), nhà báo Mai Phan Lợi và luật sư Đặng Đình Bách là thành viên của VNGO-EVFTA, một nhóm tư vấn trong nước gồm 7 tổ chức được cả Liên Hiệp Châu Âu và Việt Nam đồng ý thành lập để khối xã hội dân sự độc lập có thể giám sát việc thực thi Hiệp định Thương mại Tự Do EU-Việt Nam (EVFTA). Trả lời RFI Tiếng Việt ngày 05/07/2022, luật sư Claudio Francavilla, chuyên gia vận động Liên Hiệp Châu Âu của tổ chức Quan Sát Nhân Quyền đánh giá bản án gần đây đối với bà Ngụy Thị Khanh là “bất công” và cho biết tổ chức này tiếp tục vận động để Liên Hiệp Châu Âu gia tăng sức ép đối với Hà Nội trong lĩnh vực nhân quyền và bảo vệ các nhà hoạt động chống biến đổi khí hậu ở Việt Nam. ******* RFI : HRW cũng như nhiều tổ chức bảo vệ nhân quyền khác kêu gọi trả tự do ngay lập tức cho bà Ngụy Thị Khanh và các nhà bảo vệ môi trường khác. Chính phủ Việt Nam đã loại được một phần lớn những tiếng nói bất đồng và bây giờ dường như chiến dịch chuyển sang đàn áp các tổ chức phi chính phủ khác, bao gồm cả các tổ chức phi chính phủ về môi trường. RFI : Liệu có phải là nghịch lý khi Việt Nam liên tục đưa ra những cam kết mạnh mẽ về cải thiện môi trường, chống biến đổi khí hậu, hợp tác với nhiều chính phủ và tổ chức nước ngoài để thực hiện những kế hoạch trên, nhưng lại bắt giam hay “bịt miệng” những nhà hoạt động môi trường nổi tiếng, đã có những dự án hỗ trợ cho chính phủ, hoặc được hỗ trợ từ các tổ chức về khí hậu ở nước ngoài ? LS Claudio Francavilla : Việc này chắc chắn làm suy giảm mức độ tin cậy vào những cam kết của chính phủ Việt Nam, bao gồm cả về mặt môi trường. Nhưng tôi không nghĩ điều đó là nghịch lý. Tôi đã đọc trong các thông cáo rằng Liên Hiệp Châu Âu và Hoa Kỳ đã rất ngạc nhiên về thông tin trên. Nhưng tôi nghĩ không ai nên ngạc nhiên nữa. Thời gian để ngạc nhiên đã qua từ lâu khi nói đến Việt Nam. Việc mà chính phủ làm với bà Ngụy Thị Khanh, cũng như đối với những người khác, hoàn toàn phù hợp với những gì chính quyền Việt Nam làm từ nhiều năm, thậm chí là từ nhiều thập niên qua, mà gần như không hề bị trừng phạt. Chính việc không bị trừng phạt là vấn đề mấu chốt ở đây. Chừng nào còn chưa có hệ quả từ những vụ lạm dụng như vậy, thì chính phủ sẽ không có động cơ hoặc ý định xem xét lại vấn đề lạm dụng. RFI : Trong một thông cáo ngày 04/04, ông chỉ trích là “cuộc đối thoại nhân quyền EU-Vietnam sắp tới không nên chỉ là việc đánh dấu tích cho có nữa”. Liệu Liên Hiệp Châu Âu thờ ơ với tình hình nhân quyền Việt Nam, trong khi đây là một trong những điều kiện để ký EVFTA ? Phải chăng vì Liên Hiệp Châu Âu không lên tiếng mạnh mẽ nên chính quyền Việt Nam tiếp tục hành động như vậy? LS Claudio Francavilla : Tôi không nói là Liên Hiệp Châu Âu thờ ơ với những lo ngại này, nhưng chắc chắn là ít hơn nhiều so với mức có thể. Trên thực tế, trái với tư vấn của chúng tôi, cũng như những tổ chức phi chính phủ khác, họ liên tục nói rằng Hiệp định Thương mại Tự do EU - Việt Nam (EVFTA) là một công cụ để đưa Việt Nam đến gần với phương Tây và thúc đẩy tự do cởi mở cho truyền thông trong nước. Nhưng chúng tôi đã nhiều lần nhắc với các nhà lãnh đạo Liên Hiệp Châu Âu rằng việc đó sẽ không ngăn được sự trấn áp ở Việt Nam, cũng như chỉ cổ vũ thêm cho các phe phái cứng rắn nhất trong chính phủ. Chúng ta đang chứng kiến chính xác những gì đang diễn ra cho đến nay. Ngoài ra, cần nhớ rằng nội bộ Liên Hiệp Châu Âu cũng không thống nhất, một số nước thành viên sẵn sàng thúc đẩy vấn đề nhân quyền hơn những nước khác. Nhưng bây giờ, rất tiếc là đòn bẩy phê chuẩn EVFTA đã không còn và rất khó để nói đến những hệ quả đối với Hiệp định EVFTA ở thời điểm này. Vì vậy, câu hỏi đặt ra là thực sự có thể làm gì bây giờ ? Trước tiên, cần nhận ra rằng chiến lược này không hiệu quả. Các cuộc đối thoại, cũng như Hiệp định EVFTA, hay sự tự tin về cách tiếp cận ngoại giao cho đến giờ đã chứng minh rằng không thể tạo nên kết quả. Vì vậy, thực sự, chiến lược này không có tác dụng. Hiện giờ, chính phủ Việt Nam rất hay tính toán thiệt hơn, nên rất nhạy cảm với danh tiếng của họ trên trường quốc tế trong lúc Hà Nội đang cố gắng thu hút các nguồn đầu tư mới. Từ điểm đó, Liên Hiệp Châu Âu cần áp dụng một cách tiếp cận vững chắc hơn. Họ phải hành động khi có những người bị bắt hoặc bị kết án. Họ phải lên tiếng, yêu cầu được thăm người bị giam giữ. Họ cũng cần xem xét hành động tại Hội Đồng Nhân Quyền Liên Hiệp Quốc. Liên Hiệp Châu Âu phải cho thấy rõ thái độ giận dữ, rằng những gì đang diễn ra ở Việt Nam hoàn toàn không chấp nhận được và Hà Nội sẽ phải chịu hậu quả. Và để hệ quả có tác dụng hơn, họ cần phối hợp với những đối tác khác có cùng tư tưởng. Bruxelles cũng cần cân nhắc đến việc đình chỉ đối thoại về nhân quyền cho đến khi Việt Nam có thể đưa ra những cam kết rõ ràng để trấn an người dân và cải cách các đạo luật bị cho là lạm dụng và là gốc rễ của vấn đề. Liên Hiệp Châu Âu cũng cần có những công cụ khác mạnh mẽ hơn, như cơ chế trừng phạt quốc tế về nhân quyền, nhưng phải thực tế hơn, trong bối cảnh nhiều nước thành viên thậm chí vẫn chần chừ đồng ý về tuyên bố. Tôi không hình dung ra được họ có thể nhất trí như thế nào để ủng hộ việc thông qua các biện pháp trừng phạt. Việt Nam tham gia Công ước Quốc tế về các Quyền Dân sự và Chính trị (Internatioanl Convenant on Civil and Political Rights, ICCPR). Việt Nam cũng công bố rõ ràng về nhân quyền trong quan hệ song phương cũng như trong nội bộ, nhưng lại ngang nhiên vi phạm cả hai. Chừng nào họ chưa phải trả giá cho việc này, thì tình hình sẽ không thay đổi. RFI : Ngoài thông cáo ra, tổ chức Quan Sát Nhân Quyền có thể làm thêm gì để bảo vệ những nhà hoạt động môi trường bị viện cớ trốn thuế bắt giam nói riêng và các nhà hoạt động nói chung ? LS Claudio Francavilla : Tổ chức Quan Sát Nhân Quyền sẽ tiếp tục theo dõi và lập báo cáo tình hình trong nước, về những trường hợp đúng, hợp pháp và rộng hơn nữa là những vụ lạm dụng đã xảy ra. Chúng tôi có rất nhiều luật sư cho những trường hợp như vậy, ở Bruxelles cũng như ở những văn phòng khác của HRW trên thế giới. Chúng tôi cũng thường xuyên phối hợp với các tổ chức phi chính phủ khác, những người có chung mối quan tâm như chúng tôi. Nhưng sau đó, thực sự còn phụ thuộc vào các chính phủ, vào Liên Hiệp Quốc và định chế khác để hành động chống những lạm dụng này. Và như tôi đã nói ở trên, phải có những hệ quả cho những vụ lạm dụng đó, thì tình hình mới dần cải thiện được. Gần một tháng sau phiên tòa kết án bà Ngụy Thị Khanh, ngày 12/07, Hiệp hội Công Giáo chống Tra tấn và Án tử hình Pháp (ACAT) đã kêu gọi ký kiến nghị gửi đến đại sứ quán Pháp tại Hà Nội để yêu cầu chính quyền Việt Nam trả tự do cho cựu giám đốc GreenID. Trước đó, người phát ngôn bộ Ngoại Giao Việt Nam Lê Thị Thu Hằng khẳng định bị cáo “đã thừa nhận hành vi này” (trốn thuế) và bác bỏ “một số ý kiến suy diễn cho rằng Ngụy Thị Khanh bị xử lý hình sự vì những hoạt động và ý kiến liên quan đến biến đổi khí hậu là không có cơ sở và không đúng với bản chất của vụ việc”. Tuy nhiên, lời giải thích của phía Việt Nam không thuyết phục được các tổ chức bảo vệ nhân quyền, cũng như chính phủ Pháp và Mỹ. Lần lượt trong hai thông cáo ngày 17/06 và 19/06, bộ Ngoại Giao Pháp và bộ Ngoại Giao Mỹ đều bày tỏ “quan ngại sâu sắc” về bản án đối với “một nhân vật nổi tiếng vì cam kết chống biến đổi khí hậu và ủng hộ chuyển đổi năng lượng ở Việt Nam”. Paris và Washington “kêu gọi trả tự do ngay lập tức” cho “một nhân vật ưu tú trong xã hội dân sự” ở Việt Nam và nhấn mạnh đến “vai trò quan trọng của xã hội dân sự trong việc giúp các quốc gia như Việt Nam đáp ứng các mục tiêu về biến đổi khí hậu và bảo vệ môi trường”. Ông Michael Sutton, giám đốc Goldman Environmental Prize, tổ chức trao Giải thưởng Môi trường Goldman 2018 cho người phụ nữ Việt Nam đầu tiên, cho rằng việc bắt giữ bà Khanh “sẽ gây hại cho danh tiếng của Việt Nam ở quốc tế”. Ông cũng kêu gọi “bất cứ hỗ trợ chuyển đổi nào về năng lượng dành cho Việt Nam trong tương lai cũng phải gắn liền với việc trả tự do cho bà Khanh”. Chính phủ Việt Nam đang đàm phán nhiều chương trình tài trợ năng lượng bền vững với các nước Mỹ, Anh, Nhật Bản và tương tự với Liên Hiệp Châu Âu là hiệp định tài chính 142 triệu euro cho Chương trình Chuyển đổi Năng lượng Bền vững Việt Nam-EU. Liệu trường hợp những nhà đấu tranh bảo vệ môi trường bị bắt giam có được đề cập trong các cuộc thảo luận với các đối tác Việt Nam không ?

Ngoài ra, cần nhớ rằng nội bộ Liên Hiệp Châu Âu cũng không thống nhất, một số nước thành viên sẵn sàng thúc đẩy vấn đề nhân quyền hơn những nước khác. Nhưng bây giờ, rất tiếc là đòn bẩy phê chuẩn EVFTA đã không còn và rất khó để nói đến những hệ quả đối với Hiệp định EVFTA ở thời điểm này. Vì vậy, câu hỏi đặt ra là thực sự có thể làm gì bây giờ ? Trước tiên, cần nhận ra rằng chiến lược này không hiệu quả. Các cuộc đối thoại, cũng như Hiệp định EVFTA, hay sự tự tin về cách tiếp cận ngoại giao cho đến giờ đã chứng minh rằng không thể tạo nên kết quả. Vì vậy, thực sự, chiến lược này không có tác dụng. Hiện giờ, chính phủ Việt Nam rất hay tính toán thiệt hơn, nên rất nhạy cảm với danh tiếng của họ trên trường quốc tế trong lúc Hà Nội đang cố gắng thu hút các nguồn đầu tư mới. Từ điểm đó, Liên Hiệp Châu Âu cần áp dụng một cách tiếp cận vững chắc hơn. Họ phải hành động khi có những người bị bắt hoặc bị kết án. Họ phải lên tiếng, yêu cầu được thăm người bị giam giữ. Họ cũng cần xem xét hành động tại Hội Đồng Nhân Quyền Liên Hiệp Quốc. Liên Hiệp Châu Âu phải cho thấy rõ thái độ giận dữ, rằng những gì đang diễn ra ở Việt Nam hoàn toàn không chấp nhận được và Hà Nội sẽ phải chịu hậu quả. Và để hệ quả có tác dụng hơn, họ cần phối hợp với những đối tác khác có cùng tư tưởng. Bruxelles cũng cần cân nhắc đến việc đình chỉ đối thoại về nhân quyền cho đến khi Việt Nam có thể đưa ra những cam kết rõ ràng để trấn an người dân và cải cách các đạo luật bị cho là lạm dụng và là gốc rễ của vấn đề. Liên Hiệp Châu Âu cũng cần có những công cụ khác mạnh mẽ hơn, như cơ chế trừng phạt quốc tế về nhân quyền, nhưng phải thực tế hơn, trong bối cảnh nhiều nước thành viên thậm chí vẫn chần chừ đồng ý về tuyên bố. Tôi không hình dung ra được họ có thể nhất trí như thế nào để ủng hộ việc thông qua các biện pháp trừng phạt. Việt Nam tham gia Công ước Quốc tế về các Quyền Dân sự và Chính trị (Internatioanl Convenant on Civil and Political Rights, ICCPR). Việt Nam cũng công bố rõ ràng về nhân quyền trong quan hệ song phương cũng như trong nội bộ, nhưng lại ngang nhiên vi phạm cả hai. Chừng nào họ chưa phải trả giá cho việc này, thì tình hình sẽ không thay đổi. LS Claudio Francavilla : Tổ chức Quan Sát Nhân Quyền sẽ tiếp tục theo dõi và lập báo cáo tình hình trong nước, về những trường hợp đúng, hợp pháp và rộng hơn nữa là những vụ lạm dụng đã xảy ra. Trước đó, người phát ngôn bộ Ngoại Giao Việt Nam Lê Thị Thu Hằng khẳng định bị cáo “đã thừa nhận hành vi này” (trốn thuế) và bác bỏ “một số ý kiến suy diễn cho rằng Ngụy Thị Khanh bị xử lý hình sự vì những hoạt động và ý kiến liên quan đến biến đổi khí hậu là không có cơ sở và không đúng với bản chất của vụ việc”. Paris và Washington “kêu gọi trả tự do ngay lập tức” cho “một nhân vật ưu tú trong xã hội dân sự” ở Việt Nam và nhấn mạnh đến “vai trò quan trọng của xã hội dân sự trong việc giúp các quốc gia như Việt Nam đáp ứng các mục tiêu về biến đổi khí hậu và bảo vệ môi trường”. Michael Sutton has over 40 years experience teaching the principles and mechanics of mind/body connection through martial arts, yoga, and meditation. Michael Sutton reprises his Daytime Emmy-nominated role as Stone on ABC Daytime's "General Hospital." Michael Sutton was nominated for a Daytime Emmy in 1996 for his role as Stone on “General Hospital.” Sutton’s portrayal of Stone was part of a groundbreaking storyline in the 1990’s about he and his girlfriend Robin (played by Kimberly McCollough), both stricken with HIV. This was one of the first times TV explored this topic and the first time a TV series explored the disease with a heterosexual couple. Stone eventually died, but Robin moved on and has lived a full life ever since, becoming a doctor, wife and mother. The current storyline involves Robin struggling with news that her husband Patrick cheated on her. She hallucinates and sees her first love, Stone, for the first time since his death. "In September 2004, much hype was made of a buffer overflow vulnerability that existed in the Microsoft engine responsible for processing JPEG files. While the resulting vulnerability itself was nothing new, the fact that a vulnerability could be caused by a non-executable file commonly traversing public and private networks was reason for concern. File format vulnerabilities are emerging as more and more frequent attack vector. These attacks take advantage of the fact that an exploit can be carried within non-executable files that were previously considered to be innocuous. As a result, firewalls and border routers rarely prevent the files from entering a network when included as email attachments or downloaded from the Internet. As with most vulnerabilities, discovering file format attacks tends to be more art than science. We will present various techniques that utilize file format fuzzing that range from pure brute force fuzzing to intelligent fuzzing that requires an understanding of the targeted file formats. We will present a methodology for approaching this type of research and address issues such as automating the process. Techniques will be discussed to address challenges such as attacking proprietary file formats, overcoming exception handling and reducing false positives. The presentation will include demonstrations of fuzzing tools designed for both the *nix and Windows platforms that will be released at the conference and the disclosure of vulnerabilities discovered during the course of our research. "Injecting shellcode into a vulnerable program so you can find it reliably can be tricky. With image format vulnerabilities, sometimes the only place you can put your code is in the image itself. If a file attempting to exploit one of these vulnerabilities was rendered using a non-vulnerable application, the ‘strange’ files might raise some suspicion; a file containing a NOP-sled and shellcode does not tend to look like any normal photo. What if shellcode could be injected in this way without significantly altering the appearance of the file? What if the entire file could be transformed into executable code but the original image or sound could still be rendered? In this presentation we will present Punk Ode, which combines concepts from steganography, psychophysics and restricted character-set shellcode encoding to hide shellcode in plain sight. We will discuss how to convert a media file into a stream of valid instructions while leaving the initial images/sounds intact so as not to raise suspicion. We will also release a series of tools designed to automate the generation of such files.
