Presidents have long pursued policy prerogatives through the Department of Justice, but traditionally, there's been a clear division between those and the Justice Department's enforcement decisions. On March 5, 2025, the NYU Law Forum and the Reiss Center on Law and Security at NYU School of Law co-hosted an all-star panel of experts who have served in senior positions at the White House and in the Department of Justice to assess the degree to which the division between the President and the Justice Department has now changed. Among the topics they discussed are: What is the origin of and reason for the Justice Department's measure of independence? How has this independence worked given the Justice Department's mix of political and career employees, and how is the current administration observing those lines? Joe Biden has spoken clearly about the reality of systemic racism in America, and he’s said that racial justice would be a defining element of his Presidency. Such a statement would have been unlikely before the movement that followed the death of George Floyd, or before the overt white supremacy that was on display during the 2017 Charlottesville “Unite the Right” rally, which Biden has said convinced him to run in 2020. Vanita Gupta will be one of the key people guiding the Administration’s response. She was confirmed in April as Associate Attorney General, the No. 3 position at the Department of Justice, overseeing the Civil Rights Division. David Remnick spoke with Gupta about how Biden intends to make good on his promises, and whether criminal-justice reform is still possible in bitterly divided Washington.

You don’t want to hear what Donald Trump had to say. (Neither do I) Former US intelligence director James Clapper is pushing for an Australian investigation into Rupert Murdoch to fight “truth decay”.
