Can liberals succeed in limiting Trump through the courts or are American courts an inevitably conservative institution? Paul Nolette finds that Democratic Attorneys General have banded together to fight Trump, building on successful action last time. They are able to select the venues and usually win standing, becoming key actors in limiting executive action. But Brian Highsmith finds that over the long run, judicial supremacy tends to advance conservative goals in the American system. Even if Democrats win in the courts now, that may allow the judiciary to develop a longer term constraint on government.

Most recently, federal Judge James Boasberg is trying to stop Trump from deporting Tren de Aragua gang members to El Salvador. As a result, Rep. Brandon Gill (R-Texas) has introduced articles of impeachment against him. And of course, Chief Justice John Roberts of the Supreme Court has rushed to defend the establishment rather than fighting for the will of the people, who overwhelmingly support mass deportation of illegal immigrants. Josh Hammer joins the show to explain why there is no real constitutional basis for what these judges are doing. Also in the news, President Trump had a phone call with Russian President Vladimir Putin in which Putin agreed to a partial ceasefire, which is a huge step toward ending the war between Russia and Ukraine. A federal judge has ordered the Trump administration, Elon Musk, and the Department of Government Efficiency to stop dismantling USAID, arguing that what the DOGE is doing violates the U.S. Constitution. It was a minor decision: The justices rejected an emergency request from the administration to keep frozen some $2 billion in foreign aid payments. Justice Amy Coney Barrett and Chief Justice John Roberts joined the three liberals, raising questions about how the court will handle the waves of litigation crashing against the White House with Trump back in office.
