Jen Psaki reflects on the eye-popping revelations from the House Ethics Committee about Matt Gaetz, and how it shows that Trump's GOP clearly lives by a different standard -- a lower one. Jen is joined by Rep. Jasmine Crockett and MSNBC host Katie Phang to react to the committee's findings, including whether Gaetz could still be held accountable. Next, Jen is joined by political analyst Brendan Buck and reporter Annie Karni to preview the upcoming fight for Speaker of the House in the wake of the Gaetz bombshell. Then, Jen shares some thoughts on the precarious relationship between president-elect Trump and Elon Musk and how difficult their inevitable breakup may be. Later, Jen is joined by Rep. Jim Himes to discuss whether Musk is using his proximity to the presidency to benefit himself financially and concerns about Musk handling sensitive information. Finally, Jen is joined by Former White House Counsel Bob Bauer and Former Assistant Attorney General Jack Goldsmith to discuss Trump's plans to dismantle government and push the limits of presidential power in a second term.Check out our social pages below:https://twitter.com/InsideWithPsakihttps://www.instagram.com/InsideWithPsaki/https://www.tiktok.com/@insidewithpsakihttps://www.msnbc.com/jen-psaki

Political chaos meets holiday chaos this week. We will have Christmas Eve, then Christmas, and Hanukkah, then Boxing Day with David Waldman battling contender Jake or maybe Ron Paul, then Friday… and that's almost the weekend! So who knows what could happen? Our transcendent question this week: Which Superman is the greatest? It is, of course, Kirk Alyn, obviously. However, it seems that 30 million nerd-ragers beg to differ. Nothing drives engagement better than an argument, therefore it was inevitable that the solution and cause of all of our future problems, Artificial Intelligence, would soon be dispatched in the form of “argue-bots”. Now all we need are infinite AI “defend-my-argument-bots” launched against those, and social media should be sucked up its own singularity. Human argue-bot Trump would start a fight with a pile of rocks if he could. If we hadn't elected him F'n President he would have filled his day with Gunn vs. Snyder arguments. Now he's content with threatening to annex Canada, Greenland, and Panama. (It seems that Poland and Crimea have been taken.) President Joe Biden commuted 37 death sentences that Donald had looked forward to… Oh well, plenty more where they came from. The faster Trump can be Stalin, the happier Curtis Yarvin and his many followers in the upcoming administration will be. The House Ethics report on Matt Gaetz is out, and other than the statutory rape, payments to prostitutes and illegal drug use Matt seems like a smart choice for Attorney General. Expect Matt to issue a rebuttal on Cameo soon. Justice Clarence Thomas did fail to disclose a lot of stuff, and will fail to disclose much more, but has been recently caught on a few new ones. Honsan? Hissan? Nissanonda? Nissan and Honda are a couple now. Our lone point of stability, Greg Dworkin did show up, at least for today, with news of the DNC Chair election, which promises to be the beginning of our refuge from chaos.

This Day in Legal History: Max Headroom IncidentOn November 22, 1987, a bizarre and illegal hijacking of television signals in Chicago made history as the "Max Headroom incident." During an evening broadcast of the news on WGN-TV, the signal was interrupted by a person wearing a rubber Max Headroom mask—a character from a popular British-American sci-fi show. The intruder, who spoke in distorted audio while a buzzing background noise played, reappeared later during a broadcast of "Doctor Who" on PBS affiliate WTTW. In the second interruption, the masked figure performed erratic gestures, spouted nonsensical phrases, and referenced TV culture, all culminating in a crude act involving a flyswatter and exposed buttocks. The Federal Communications Commission (FCC), tasked with regulating airwaves, launched an immediate investigation, as signal hijacking violates federal laws prohibiting unauthorized use of broadcast frequencies. Despite efforts by the FCC and law enforcement, the perpetrators were never identified, adding an air of mystery to the event. The technical feat required to override broadcast signals in 1987 suggested that the culprits had considerable expertise and access to specialized equipment. This incident was one of the most notorious cases of broadcast signal intrusion, highlighting vulnerabilities in television networks at the time. It also sparked debates about cybersecurity, freedom of expression, and the emerging role of "hacktivism" in digital media. No further incidents of this type occurred on such a scale in the United States, likely due to improvements in broadcast security and stricter regulatory oversight. President-elect Donald Trump announced his nomination of former Florida Attorney General Pam Bondi as Attorney General following Matt Gaetz's withdrawal. Bondi, a longstanding Trump ally, has been a vocal supporter of his claims that the Justice Department's investigations into him were politically biased. If confirmed, Bondi would oversee major aspects of the DOJ, including defending controversial policies and managing federal grants.Trump praised Bondi for her toughness and alignment with his "America First" agenda. Bondi previously served on Trump's legal defense team during his first impeachment trial and has taken high-profile legal stances, including challenging the Affordable Care Act as Florida's Attorney General. However, her tenure has also been marked by controversies, such as accepting a Trump Foundation donation while considering action against Trump University, though no wrongdoing was found.Bondi's nomination comes as Trump plans significant changes to the Justice Department, including possible leadership shifts, and amid ongoing federal indictments against him. Bondi has publicly supported Trump's claims of voter fraud and pledged to investigate alleged “deep state” actors. Her background includes working on drug policy and opioid abuse commissions during Trump's first term and involvement with the Trump-aligned America First Policy Institute.Matt Gaetz, initially chosen for the role, stepped down citing the distraction caused by controversies, including a closed sex trafficking investigation and a House Ethics probe. Trump's choice of Bondi highlights his intent to reshape the DOJ's focus while surrounding himself with trusted allies.Trump Picks Pam Bondi for Attorney General After Gaetz Exit (1)Trump picks Pam Bondi for US Attorney General after Gaetz withdraws | ReutersPresident-elect Donald Trump has appointed Elon Musk and Vivek Ramaswamy to lead the newly created Department of Government Efficiency (DOGE), tasked with identifying and repealing federal regulations they consider overly burdensome or invalid. The panel plans to focus on rules that they argue were enacted by unaccountable bureaucracies, guided by recent Supreme Court decisions that curtail agency rulemaking powers. DOGE also aims to propose mass layoffs and identify unauthorized federal spending, with a goal of completing its work by July 4, 2026.Repealing federal rules, however, is a complex and lengthy process governed by the Administrative Procedure Act, which requires detailed justifications, public comment periods, and compliance with legal standards. While Trump could issue executive orders halting enforcement of certain rules, agencies must still follow formal procedures for repealing them. Lawsuits are likely to challenge attempts to eliminate regulations, especially by opponents who claim improper justification or procedural violations.Musk and Ramaswamy's efforts will leverage recent Supreme Court rulings limiting agencies' ability to address major economic or societal issues without explicit Congressional authorization. Despite this, many regulations have firm legal backing, making their repeal difficult. Legal experts predict a wave of lawsuits and mixed outcomes, given the partisan makeup of federal courts. DOGE's recommendations signal Trump's broader agenda to significantly curtail the administrative powers of federal agencies. How Trump's Musk-led efficiency panel could slash federal agency rules | ReutersThe European Commission has closed its four-year antitrust investigation into Apple's rules for e-book and audiobook app developers following the withdrawal of the original complaint. The complainant, who remains unnamed, opted to drop the case, prompting regulators to end the probe. The closure does not indicate that Apple's conduct was found to comply with EU competition laws. EU regulators emphasized their ongoing commitment to monitoring tech industry practices, including Apple's, under the Digital Markets Act and broader competition regulations. The case's conclusion reflects the challenges in sustaining antitrust investigations without active complainants, though scrutiny of Apple's business practices in Europe is expected to persist.EU regulators scrap probe into Apple's e-book rules after complaint was withdrawn | ReutersSenate Democrats have agreed to a deal with Republicans to advance votes on President Joe Biden's district court nominees while abandoning four appellate court picks. The agreement allows the Senate to confirm several district court judges quickly, despite GOP stalling tactics aimed at delaying Biden's judicial appointments before Republicans assume control of the White House and Senate in January. Majority Leader Chuck Schumer's spokesperson highlighted that the trade-off prioritized advancing more district court nominees over the blocked circuit picks. The deal derails the nominations of Adeel Mangi, Ryan Park, Karla Campbell, and Julia Lipez for appellate court seats. Mangi, who would have been the first Muslim federal appellate judge, faced opposition from some Democrats over allegations linking him to antisemitic and anti-police groups. Park's nomination was also at risk due to lack of Republican support. Meanwhile, the Senate pushed forward on cloture votes for several district court nominees, including Spark Sooknanan, Brian Murphy, Anne Hwang, Cynthia Valenzuela Dixon, and Catherine Henry. Votes on their confirmations will occur after Thanksgiving. Other nominees, such as Sharad Desai for Arizona and several others approved by the Judiciary Committee, also advanced. The agreement leaves critical appellate seats open, including those on the Third and First Circuits, aiding President-elect Donald Trump's agenda to influence the federal judiciary. Some judges considering semi-retirement may now delay their decisions, further impacting the judicial landscape.Biden Circuit Picks Derailed by Senate Deal on Trial Judges (2)This week's closing theme is by Johann Sebastian Bach.Johann Sebastian Bach (1685–1750) was a German composer and musician of the Baroque period, widely regarded as one of the greatest composers in Western music history. Born into a family of musicians in Eisenach, he displayed prodigious talent from a young age, mastering the organ, harpsichord, and violin. Throughout his career, Bach held prestigious positions as a court musician, music director, and cantor, most notably serving as the Thomaskantor in Leipzig, where he composed many of his most enduring works. His output includes cantatas, concertos, masses, and instrumental pieces, showcasing an unparalleled command of counterpoint, harmony, and structure. Despite limited recognition during his lifetime, Bach's music profoundly influenced later composers, earning him the title "Father of Music."This week's closing music is Bach's Prelude and Fugue in G minor, BWV 861, from The Well-Tempered Clavier, Book I. This collection of preludes and fugues in all 24 major and minor keys was revolutionary, both as a demonstration of the possibilities of the then-novel well-tempered tuning system and as a masterclass in compositional technique. The G minor prelude opens with a flowing, somber melody that builds in complexity, evoking introspection and elegance. The fugue that follows is a testament to Bach's genius for counterpoint, weaving together a single thematic idea into an intricate tapestry of musical voices. The Prelude and Fugue in G minor exemplifies Bach's ability to transform simple ideas into profound statements, inviting listeners into a world of meticulous craftsmanship and emotional depth. It's a fitting choice to close the week, blending timeless artistry with intellectual rigor.Without further ado, Johann Sebastian Bach's Prelude and Fugue in G minor, enjoy. This is a public episode. Your Guide to the Matt Gaetz ScandalState of Play:Ethics report is unreleased as of now, a hacker has apparently obtained parts of the Department of Justice investigation that did not end in prosecution of GaetzThe iron law of political scandals, as written on the wall of a DC backroom (wash your hands after inspecting): if the public already knows about your dirty deeds and hasn't totally written you off, keep chugging. But every new bit of information that comes out is an exponential risk. The Gaetz story has been publicly aired for years. So it is really only a liability if new information comes to light. So what is already known? That way we know if something new comes along.Well, it comes down to two main questions.* Are Sugar Babies w****s?* Is it illegal to sleep with a minor who misrepresents their age? Can the sex be proven beyond a reasonable doubt?Let's start with question number one. Are Sugar Babies w****s?Which for the pure of heart will begin with a subquestion, what is a Sugar Baby?A sugar baby is typically a younger individual who enters into a relationship with an older, affluent partner—known as a sugar daddy or sugar mommy—in exchange for financial support, gifts, or other benefits. These relationships are often characterized by mutual agreements where the sugar baby provides companionship, and in some cases, intimacy, while receiving monetary assistance, luxury items, or experiences in return. These connections, like much of our modern world, is facilitated by the internet. For example…Seeking.com is an online dating platform that connects successful and attractive individuals seeking mutually beneficial relationships. And so it was on Seeking.com that Joel Greenberg, a then-friend of Gaetz who eventually pled guilty to sex trafficking and informed on the congressman, met women to form such relationships. Here is an ABC report of a back and forth between one of the women…"I have a friend flying in and we are trying to make plans for tonight. What are your plans for later," Greenberg wrote to the woman, whose identity ABC News is withholding for privacy purposes. "And how much of an allowance will you be requiring :)" Greenberg added. The woman responded by telling Greenberg she has "a friend who introduced me to the website that I could bring" and said she "usually" requires "$400 per meet."Greenberg then sent the woman a photo of Gaetz taking a selfie with students at Pea Ridge Elementary from a 2017 visit, and wrote, "My friend," indicating that Gaetz would be the friend joining him."Oooh my friend thinks he's really cute!" the woman responded.Greenberg then replied that Gaetz was "down here only for the day," adding "we work hard and play hard," before asking, "Have you ever tried molly," referring to the drug MDMA, or Ecstasy. As Greenberg was discussing payment for the get-together, the woman asked if Gaetz used the same website Greenberg had used to meet her. Greenberg replied, in part, "He knows the deal :)," referring to the Florida congressman. The former tax collector then said he would book a "suite Downtown" for the gathering.Sugar Baby websites are built on the idea that wealthy people connect with attractive people. The implication of money or expensive gifts being exchanged is inherent to the concept. But… are the women legally w****s? Specifically, women who are charging money for the act of sex? This is a very important question. Flying a friend you eventually have sex with across state lines on your dime is a nice thing to do. Flying a w***e across state lines to pay for intercourse is sex trafficking. We do not have an answer for this. Although Greenberg plead guilty to sex trafficking so he seemingly admitted it.In general it is a moral and legal question that I am sure many rich men, including possibly some in congress, likely don't want answered. However, it gets even more serious when one of those women is 17 years old. Which leads us to our second question. Is it illegal to sleep with a minor who misrepresents their age? Can the sex be proven beyond a reasonable doubt?A lawyer for two women interviewed by the House Ethics Committee has said the following:Leppard told POLITICO on Sunday that his clients had attended between five to 10 "sex parties" with the former Florida Representative between 2017 and 2018. Gaetz was already in Congress at the time.Leppard also said one of his clients witnessed Gaetz having sex with another woman who was then 17 years old. They were at a house party in Florida."She testified [that] in July of 2017, at this house party, she was walking out to the pool area, and she looked to her right, and she saw Rep. Gaetz having sex with her friend, who was 17," Leppard said.A report from The Daily Beast identified two Venmo transactions Gaetz had in 2018 with Joe Greenberg, an accused sex trafficker, for a total of $900. Greenberg then sent the money to three teen girls in transactions labeled "tuition" and "school."The woman, now in her 20s, reportedly confirmed this during interviews with the House Ethics committee. In Florida, engaging in sexual activity with a minor is illegal, regardless of whether the minor misrepresents their age. The state enforces strict liability in such cases, meaning that a defendant's belief about the minor's age, even if based on the minor's false representation, is not a valid defense. Florida Statute 794.021 explicitly states that ignorance or a reasonable mistake regarding the victim's age is not a defense to prosecution under sexual offense laws. And yet… the woman in question also testified about this to criminal investigators and no charges were filed against Gaetz. This might suggest that the case against him is less than air tight. Or that proof beyond personal testimony would not stand up at trial. So no… you cannot claim ignorance on having sex with a 17-year-old in Florida. But also, there might not be evidence to prove it happened beyond a he said/she said.Again: this has all been known for years after Greenberg's arrest and the Department of Justice investigation. Will there be new information? We have to wait and see.But it also might not matter, because Gaetz' higher hurdle to clear has nothing to do with what he did or didn't do as a military-grade horny Florida Man bachelor… but rather his conduct as a rhetorical bomb thrower who has personally torched members of the Senate whose vote he now needs to court.-That and more on the show! This Day in Legal History: US DOJ Files Suit Against AT&TOn November 20, 1974, the United States Department of Justice initiated one of the most significant antitrust actions in American history by filing a lawsuit against telecommunications giant AT&T. The case, United States v. AT&T, aimed to dismantle the company's monopoly over telephone services. AT&T, through its Bell System, controlled virtually all local and long-distance phone services in the United States, stifling competition and innovation in the rapidly evolving communications sector. The Justice Department argued that AT&T's dominance violated antitrust laws, particularly the Sherman Act, which prohibits monopolistic practices that harm consumers and market fairness. The case did not proceed to trial. Instead, after nearly a decade of legal maneuvering and negotiations, AT&T reached a landmark settlement in 1982. The agreement mandated the breakup of AT&T into several regional companies, known as the Baby Bells, while AT&T retained its long-distance service and equipment manufacturing businesses. This divestiture marked the end of AT&T's century-long monopoly and transformed the telecommunications industry, creating opportunities for competition and technological advancements. The breakup of AT&T paved the way for the rise of new players in the market and innovations like wireless communications and the internet. It also became a model for how antitrust law could address monopolistic practices in other industries. The case remains a pivotal moment in legal and business history, demonstrating the government's ability to take on corporate behemoths in the interest of fostering competition and protecting consumers. The House Ethics Committee is set to convene as the controversy surrounding Matt Gaetz, Donald Trump's bafflingly stupid pick for attorney general, intensifies. Gaetz, who recently resigned from the House of Representatives, faces unresolved allegations of sexual misconduct, including accusations of sex with a minor. While the Justice Department's prior investigation into sex trafficking claims against Gaetz concluded without charges, the lingering ethical questions make his nomination a stunningly reckless choice.Gaetz, a hardline Republican notorious for orchestrating Kevin McCarthy's ouster as House Speaker, has no prosecutorial experience and has openly clashed with traditional Republican leadership. His nomination has drawn skepticism, even among Senate Republicans, some of whom demand that the Ethics Committee release findings from its probe. Critics argue that Gaetz's checkered history and lack of qualifications disqualify him from leading the nation's top law enforcement agency.Trump, undeterred by the backlash the way a dog eating a diaper ignores its screaming owner, has reportedly pressured Republican senators to confirm Gaetz, underscoring his pattern of appointing ideologically extreme figures with dubious credentials to key roles. Democrats, such as Representative Dean Phillips, emphasize the need for transparency, citing the importance of vetting someone poised to wield significant power. Despite these concerns, hardliners like Lauren Boebert dismiss the ethical questions, showcasing the deep divisions in the GOP over this chaotic appointment.Matt Gaetz probe in focus as House Ethics panel expected to meet | ReutersApple will ask a federal judge in New Jersey to dismiss a U.S. Department of Justice lawsuit accusing the company of monopolistic practices in the smartphone market. Prosecutors claim Apple's restrictions on third-party app developers and devices create barriers to competition, locking users into its ecosystem. Apple argues that these restrictions are reasonable, protect innovation, and should not be considered anticompetitive. This case follows a broader bipartisan push to curb Big Tech's market power. Similar lawsuits target Google for monopolizing online search, Meta for stifling competition through acquisitions, and Amazon for restrictive policies against sellers. However, some claims, like those alleging anticompetitive restrictions by Meta and Google, have been dismissed in court. Apple has cited these rulings to bolster its argument for dismissal. The DOJ and several states filed the lawsuit in March, focusing on Apple's fees and technical obstacles to competing devices, such as digital wallets and messaging services. If the judge finds the claims credible, the case could proceed, adding to the growing antitrust scrutiny of major tech firms.Apple to urge judge to end US smartphone monopoly case | ReutersU.S. prosecutors are set to outline potential remedies for Google's online search monopoly, following a landmark ruling in August that deemed Alphabet's practices illegal under antitrust laws. Options floated include terminating Google's exclusive agreements with companies like Apple, divesting business segments such as the Android operating system, or even requiring the sale of its Chrome browser. Prosecutors are expected to pursue several of these measures, despite Google's objections that such actions would harm consumers, businesses, and U.S. competitiveness in AI.The case, initiated during Donald Trump's presidency, faces uncertainty with his return to office. Trump has voiced both criticism of Google for perceived political bias and hesitancy about breaking up the company. His upcoming appointment of a new DOJ antitrust chief could shift the strategy, potentially altering the case's trajectory. A trial to consider these proposals is scheduled for April 2025, though final rulings by U.S. District Judge Amit Mehta are expected in August 2025. Google, which plans to appeal, will also present its own remedies in December.Google prosecutors to propose cure for search monopoly | ReutersAlex Jones, his depravity seemingly having no limit, has filed a lawsuit against Sandy Hook victims' families, The Onion's parent company, and a bankruptcy trustee, alleging collusion in the auction of his Infowars media company. The lawsuit follows a bankruptcy court's decision to award the majority of Infowars' assets to Global Tetrahedron LLC, whose bid of $1.75 million was deemed the best value. This winning bid included an agreement from some Sandy Hook families to waive their claims, boosting The Onion's affiliated bid.Jones, a grotesquerie facing $1.5 billion in defamation judgments for calling the Sandy Hook shooting a hoax, argues that the auction process was unfair and is seeking to disqualify the winning bid. First United America Companies, the backup bidder with a $3.5 million cash offer, also claims collusion and seeks to overturn the auction results. The bankruptcy trustee has defended the auction process as fair and transparent, emphasizing that Global Tetrahedron's bid was valued at over $7 million and was the clear choice. Sandy Hook families' attorneys reaffirmed their commitment to holding Jones accountable and rejected his intimidation tactics. Meanwhile, The Onion has dismissed Jones' claims as baseless, citing his history of conspiracy theories.Alex Jones Sues Sandy Hook Parents, Onion Over Infowars Bid (1)Former billionaire Bill Hwang, founder of Archegos Capital Management, is set to be sentenced for orchestrating a financial collapse that cost Wall Street over $10 billion. Convicted on charges of wire fraud, securities fraud, and market manipulation, Hwang faces a potential 21-year prison term, along with demands for $12.35 billion in forfeitures and restitution. Prosecutors described Hwang as a repeat offender who has shown no remorse, arguing for a severe sentence to deter others from similar actions.Archegos' collapse in March 2021 exposed Hwang's aggressive borrowing and speculative bets on media and tech stocks, which at its height created $160 billion in market exposure. When stock prices fell, Hwang failed to meet margin calls, triggering massive sell-offs and erasing over $100 billion in market value. Major banks, including Credit Suisse and Nomura Holdings, suffered significant losses.Hwang's defense argues for leniency, citing his Christian faith, philanthropic efforts, and lack of flight risk. They claim his actions didn't directly cause the losses and that his age and health reduce his risk of reoffending. However, prosecutors maintain that Hwang's reckless conduct and refusal to accept responsibility warrant harsh punishment. The 21-year sentence sought by prosecutors would be among the longest for white-collar crime in the U.S.Archegos' Bill Hwang to be sentenced for massive US fraud | Reuters This is a public episode. Whole lot of 'ugly' coming out folks after Donald Trump's election win. Locally, people have been getting racist text messages. Then there's two of his Cabinet picks - both with prior sexual assault claims dogging them. The anti-woke Pentagon pick is pretty noteworthy, no? Then, no big deal, but the nation's future top attorney is sweating a House Ethics panel report. Totally fine. Birds of a feather, right? Hey, whatever became of Billy Bush, anyway? Here in Atlanta, two suburban (and blue!) counties rejected transit initiatives. Why? Bill Tory says voters didn't see immediate gratification. I believe we've lost our appetite for 'vision.' Meanwhile, Transportation Secretary Pete Buttigieg - who I believe Democrats should rally behind for messaging, going forward - spent time at Harvard talking with students there offering his party a route to 'salvation' - local action. He also addressed the steady stream of disinformation ruining political discourse and believes it'll take Sen Z tackling it to help solve it.

Jim Jordan has been piggy-backing off of Matt Gaetz for years, and now that Gaetz is no longer in the House, Jordan is still trying to protect his buddy. Jordan has been on a media blitz begging for the House Ethics report into Matt Gaetz to remain secret so that Gaetz still has a shot at becoming the Attorney General. Donald Trump is waiting until he gets back into office to seek retribution, as he's already going after media outlets that hurt his feelings over the past few years. Trump's lawyers have filed off several "demand letters" to media outlets claiming that they have to pay him $10 BILLION for their alleged "false" coverage of him during the campaign. This might be one of the most insane things Trump has ever tried to do.Donald Trump is attempting to bypass the standard FBI background check process for his cabinet picks, and is instead trying to use a private contractor to perform the "checks" for them. This is what will be turned over to the Senate when these people come before them for their confirmations, and there's a very obvious reason why Trump has decided to go this route. Farron Cousins explains what's happening.Donald Trump's cabinet picks are getting worse by the day, but there's a chance that he's picks are so bad that they can't cause any real, lasting damage to this country. That's not to say that they won't try and that they won't have success, but by packing his cabinet with extremists who have no regard for the rule of law, he could end up running right into the buzzsaw and instantly regret it. And that's assuming these people even pass their confirmation hearings. THIS IS NOT WHAT RECESS APPOINTMENTS ARE FOR When I heard yesterday that Trump wanted the Senate to come to order and then recess so he could make recess appointments for his Cabinet, especially with Matt Gaetz, I got mad. This is NOT what recess appointment power is supposed to be used for. Obama got his hand slapped by the Supreme Court when he appointed a bunch of people to the National Labor Relations Board in this fashion and the more conservative justices all joined an opinion by the late great Antonin Scalia in which he said: As Scalia explained in a lengthy statement from the bench that followed Breyer's summary of the Court's decision, he and his three colleagues would have held that the president's recess appointments power is substantially more limited than the Court ruled today. For example, they would have ruled that the president can only make recess appointments during inter-session recesses, and only then to fill vacancies that are created during that recess. And the majority did not escape Scalia's trademark incisive remarks, as he criticized it for relying on an “adverse-possession theory of executive authority: “Presidents have long claimed the powers in question, and the Senate has not disputed those claims with sufficient vigor, so the Court should not ‘upset the compromises and working arrangements that the elected branches of Government themselves have reached.'”Three of the justices who joined this opinion are still on the bench and have been joined by even more conservative justices so I would expect Trump to have his nominations invalidated too. By the way, Gaetz already resigned from Congress. None of the other appointees have. You know why he resigned? Because the House Ethics investigation was due to release their findings, which now won't happen because he isn't a member of Congress. How convenient. I've got Daily Caller News Foundation reporter Katelynn Richardson on at 2:30 to discuss.
Today's Headlines: Election Day is just 42 days away, but early voting has already started in Minnesota, South Dakota, and Virginia. Most states offer early voting, except for Alabama, New Hampshire, and Mississippi (which has some exceptions). Meanwhile, Georgia's Board of Elections has sparked controversy with a rule requiring counties to hand-count millions of ballots—raising concerns about delays and errors. Other red states, like Texas and Oklahoma, continue voter suppression efforts, purging hundreds of thousands of voters and closing polling locations in minority areas. In Texas, the maternal mortality rate jumped 56% after its abortion bans, hitting Black and Hispanic women the hardest. And in North Carolina, Republican candidate for governor Mark Robinson is facing backlash over racist and offensive comments, leading key campaign staff to resign. Finally, Congressman Matt Gaetz is once again under fire—this time, with fresh allegations involving a minor at a sex party, adding to his ongoing House Ethics investigation. How will the insurance bills that passed in the recently completed 2024 Florida legislative session compliment past marketplace reforms? Is a property insurance market marred by carrier insolvencies in recent years and ongoing double-digit rate increases starting to stabilize? Former Florida Deputy Insurance Commissioner Lisa Miller talks with two legislators about the new laws expected to impact Florida's property insurance and real estate markets, reinsurance prices, condominium affordability, and their joint belief in bipartisanship for finding workable policy solutions. Show Notes Florida State Representative Tom Fabricio (R-Miami Lakes) sits on the House Insurance & Banking Subcommittee and Chairs the House Ethics, Elections & Open Government Subcommittee. He is a former insurance defense attorney whose practice now focuses on commercial and real estate litigation, including real estate transactions. Florida State Senator Nick DiCeglie (R-St. Petersburg) is Vice Chair of the Senate Banking and Insurance Committee, Chair of the Senate Transportation Committee, and a former Chair of the House Insurance & Banking Subcommittee. He is President and CEO of Hope Villages of America, a Tampa Bay area nonprofit organization addressing hunger, homelessness, and domestic violence. Both lawmakers discussed their motivation for entering the Florida Legislature and their vision for Florida's homeowners insurance marketplace and by extension, the state economy. Topics included the admitted insurance market (those companies whose rates and policy forms are approved by state regulators) and the surplus lines companies (those whose rates and forms are largely unregulated, and who often insure risks admitted companies don't), along with reinsurance companies, who provide catastrophe insurance for insurance companies. Among the bills and issues discussed on the podcast with host Lisa Miller: HB 1503 authorizes surplus lines insurance companies to take out policies (“takeouts”) from the legislatively-created and state-backed Citizens Property Insurance Corporation's non-homesteaded residential properties, such as second homes, among other risks. “I think surplus lines are important (for) it allows other free market competition,” said Rep. Fabricio. “Because ultimately, with Citizens having a population of over 1.2 million to close to 1.3 million policies, we need to depopulate Citizens. We need to bring Citizens down to a number under a million policies, where Citizens will be truly our carrier of last resort,” he said. HB 1029 applies the popular My Safe Florida Home homeowners program to condominium complexes and individual condo unit owners in an initial pilot program. The program offers a $2 to $1 match to incentivize homeowners to harden their homes from future hurricanes. “Anytime that we can mitigate losses in the state, it's going to go a long way in contributing to that healthy insurance market,” said Sen. DiCeglie, who sponsored the Senate companion bill. “In my district alone, we have thousands of condominium associations and those folks are looking for relief as well. Recent condominium reforms requiring them to put more money in reserves, so that they're making the necessary repairs and upkeep of the condominiums (together with)....
