Episode Info Scott A. White was appointed Commissioner of the Virginia State Corporation Commission's Bureau of Insurance in 2018. He was elected NAIC President in December 2025. White joined the Bureau as a research analyst in 1998. From 1999 until 2011, he worked as an attorney advising the Bureau on all major insurance regulatory and compliance matters. In 2011 he became head of the Commission's financial services legal division, expanding his practice areas to include securities and banking. At the NAIC, White has chaired the Financial Condition (E) Committee, the Long-Term Care Insurance (EX) Task Force, and the Southeast Zone. He is a member of the International Association of Insurance Supervisors (IAIS) Executive Committee, Macroprudential Committee, and Insurance Capital Standard Task Force. White earned a Bachelor of Arts degree from the University of Virginia and a law degree from the University of Missouri. He and his wife, Jodi, have two grown daughters. Episode Overview: Key Issues in Virginia: Affordability and Availability: While Virginia generally has good market availability, the state is addressing rising premiums and legislative interest in healthcare and property insurance. Natural Catastrophes: The discussion touches on the impact of weather-related events, with a focus on windstorms, hurricanes, and the often-overlooked risk of flooding. Risk Mitigation Programs: Virginia is exploring programs to incentivize hardening homes against perils like severe convective storms, including hail and wind. Litigation and Tort Reform: The conversation addresses the impact of litigation activity on insurance rates and the legislative considerations surrounding tort reform. The National Conversation on AI: Industry Adoption: Commissioner White observes that the insurance industry often lags in adopting new technologies like AI, partly due to its inherent risk aversion and the paramount importance of trust. Consumer Concerns: A significant concern is the potential for AI to be perceived as making critical decisions about healthcare authorization, leading to a growing distrust among consumers. NAIC's Approach: The NAIC has adopted an iterative approach, starting with principles and moving to guidance through an AI bulletin. Their focus is on compliance, transparency, accountability, and safe systems. AI Systems Evaluation Tool: The NAIC is piloting a tool to help state insurance departments assess how companies are using AI, focusing on governance and risk management. This aims to identify potential gaps in current laws. Bias in AI: The discussion highlights the concerns around algorithmic bias and proxy discrimination, while also acknowledging that bias exists in current, non-AI-driven processes. The importance of data protection and operational resiliency against cyber threats is also emphasized. The Future of Market Regulation: Modernization Efforts: The NAIC is undertaking an ambitious "Future of Market Regulation" initiative to modernize its approach, recognizing that market regulation has not progressed as rapidly as financial solvency regulation. Real-Time Surveillance: The goal is to move towards more real-time surveillance of companies, leveraging enhanced data and analysis, rather than relying solely on lengthy, complaint-driven examinations. Training and Resources: There is a recognized need for regulators to develop new skills and obtain adequate training to effectively oversee AI and other emerging technologies. Every time you check a stock price on your phone or watch a ticker scroll across a screen, you are seeing the result of a complex reporting system most investors never think about. Behind that number is a vast infrastructure capturing and consolidating trades from exchanges and over-the-counter markets in milliseconds—and that system is undergoing major enhancements. On this episode, Chris Stone, FINRA Vice President, Transparency Services, takes us inside the systems that make market transparency possible. Stone explains how FINRA recently extended trade reporting hours to 4 a.m. ET, why the industry is preparing for 23-hour, 5-day-a-week trading by December 2026, and how FINRA's recently implemented fractional share reporting is eliminating what researchers called "phantom volume." Regulators and experts in China have warned of "artificial intelligence data poisoning" after the annual 315 consumer rights gala, which was held on Sunday, exposed the fabrication of promotional content to influence AI-generated response. The findings of an investigation conducted by China Media Group, which were revealed during the live broadcast of the gala, showed the gross abuse of an online marketing tool called generative engine optimization, or GEO, that aims to enhance content visibility. The probe revealed that companies have been using GEO to mass-feed promotional articles in an attempt to manipulate the information AI retrieves when answering user queries. China Media Group reporters created a fake product — a smart wristband named "Apollo-9" — and claimed it had features such as quantum-entanglement sensors, a noninvasive blood glucose monitor and an ultra-long battery life. Within hours of more than a dozen promotional articles about the nonexistent wristband being uploaded to a platform called Liqing GEO, two mainstream AI models began recommending the product in response to queries about smart wearable devices. Li Fumin, a researcher of intelligent social governance at Shandong University of Finance and Economics in Jinan, the capital of Shandong province, said businesses that use GEO services to deliberately train AI models to promote specific products are essentially fabricating facts and engaging in bogus marketing. On the one hand, the practice leverages AI and algorithms to make false advertising, which results in unfair competition. On the other hand, this kind of behavior allows people to receive implanted marketing content without knowing it, which violates their consumer rights," Li said. Generative engine optimization is widely considered the AI-era evolution of search engine optimization, or SEO. China's search engine companies, such as Baidu Inc, have previously faced scrutiny over paid ranking practices that blur the line between advertising and organic search results. Several Chinese AI developers have responded cautiously to the investigation. ByteDance said that its chatbot, Doubao, was unaffected by such systems, while Alibaba said the core reasoning capability of its Qwen model was not affected by similar technologies. Industry experts said the issue reflects a broader structural challenge rather than a flaw in any single model. They said that most AI systems rely heavily on accessible internet content, which can be mass-produced or manipulated. Song Xiangqing, vice-president of the Commerce Economy Association of China, said that regulators should accelerate the formulation of new legislation to make deliberate pollution of AI data sources illegal. China currently has no specific regulations governing GEO services. According to a work priority guideline on advertising recently released by the State Administration for Market Regulation, the nation will step up efforts to streamline digital advertising market strategies, including AI-generated content. Song suggested drawing up a "white list" to identify trusted information sources and building a coordinated governance framework involving government oversight, corporate self-regulation and public supervision. "Without these safeguards, GEO services could evolve into a widespread source of information pollution, enabling data poisoning to spread throughout the AI ecosystem," he said. generative engine optimization(GEO)/ˈdʒenərətɪv ˈendʒɪn ˌɒptɪmaɪˈzeɪʃən/生成式引擎优化retrieve /rɪˈtriːv/检索quantum-entanglement /ˈkwɒntəm ɪnˈtæŋɡlmənt/量子纠缠noninvasive /ˌnɒnɪnˈveɪsɪv/无创的ultra-long /ˈʌltrə ˈlɒŋ/超长的bogus marketing /ˈbəʊɡəs ˈmɑːkɪtɪŋ/虚假营销expedite /ˈekspədaɪt/加快

A regulator has accused NVIDIA of violating China's antitrust laws over its acquisition of chipmaker Mellanox. In its preliminary findings of an investigation it commenced in December, the State Administration for Market Regulation claimed that the company breached both national regulations and the conditional terms China outlined when it rubber-stamped the $6.9 billion takeover. Also, on Monday, the state's Attorney General Letitia James released more specifics about what the SAFE for Kids Act will entail in practice. A recent controversy has drawn widespread public attention to pre-made dishes in China, prompting calls for greater standardization and transparency in the industry. Central to the discussion are concerns over food safety and consumers' right to be fully informed. The debate began when celebrity entrepreneur Luo Yonghao, known for his outspoken views and livestreaming influence, took to social media site Sina Weibo on Wednesday to criticize the popular Xibei restaurant chain. Luo wrote that after a recent meal with colleagues, he found most dishes were pre-made and costly, calling the experience "disgusting" and urging the government to require restaurants to clearly indicate whenever pre-made dishes are used. The post quickly went viral, garnering millions of comments and sparking industry discussion. Xibei founder Jia Guolong responded by emphasizing that the chain uses pre-preparation techniques but does not serve pre-made meals. "Not a single dish in Xibei outlets is a pre-made dish," Jia said. 。The chain opened its kitchens to media for a firsthand look at operations, but the distinction between pre-made dishes and pre-preparation processes remained unclear, fueling further debate. Jia described the controversy as "the biggest external crisis" in Xibei's history, noting a sharp decline in daily revenue across nearly 400 outlets over several days. Despite widespread adoption in large chain restaurants, pre-made dishes remain controversial for several reasons: small-scale producers may fail to meet food safety standards; consumers lack clarity on what constitutes a pre-made dish; and some businesses mislead patrons by charging for "freshly made" dishes that are actually reheated pre-made products. Regulatory notices encourage restaurants to clearly indicate their use of pre-made dishes to ensure consumer rights to information and choice. According to a 2024 notice issued by the State Administration for Market Regulation and other authorities, pre-made dishes are pre-packaged food products made from one or more edible agricultural ingredients, with or without seasonings and without added preservatives. They undergo industrial pre-processing — such as mixing, marinating, forming, frying, baking, boiling or steaming — and may include seasoning packets. These products are intended to be consumed after heating or cooking and must be produced, stored, transported and sold according to the conditions specified on their labels. Fresh vegetables or ingredients that have only undergone simple processing, including washing, peeling or cutting, as well as ready-to-eat foods — such as salads, convenience meals, steamed buns, pastries, hamburgers, sandwiches, pizzas and central kitchen-prepared dishes delivered to chain outlets — are not considered pre-made dishes. Heating refers to simple reheating before consumption, while cooking indicates thorough preparation of partially processed ingredients. The notice outlined measures to strengthen food safety supervision. These include enforcing producer responsibility, verifying raw materials, regulating food additives, revising production licensing, enhancing inspections and promoting clear labeling in restaurants. Earlier, officials from the State Administration for Market Regulation said pre-made dishes do not require preservatives because cold storage, freezing and sterilization ensure safety, while aligning with consumer expectations and risk control requirements. Tan Guijun, director of the Nutrition Department at Tianjin First Central Hospital, told Xinhua News Agency that while fresh ingredients retain nutrients more fully and are generally more aligned with the body's needs, this does not mean pre-made dishes should be dismissed entirely. As long as production, transportation, storage and cooking processes comply with relevant food safety standards, pre-made dishes can adequately meet the body's requirements for calories and nutrition. According to previous media reports, consumers and industry insiders said the controversy reflects broader concerns and underscores the need to balance industry efficiency with consumer protection, with transparency, regulation and innovation shaping the sector's future. sterilizationn.灭菌/ˌster.ɪ.laɪˈzeɪ.ʃən/pre-madeadj.预制的/ˌpriːˈmeɪd/

China's cyberspace and health regulators have announced heightened supervision of online health science content as more medical professionals turn to social media to share educational materials — a trend that has also spurred profit-driven abuse and misinformation risks. Efforts will focus on verifying the medical credentials of content creators, requiring source attribution and banning advertisements for medical or healthcare products, according to a notice jointly released on Friday by the Cyberspace Administration of China, the National Health Commission, the State Administration for Market Regulation and the National Administration of Traditional Chinese Medicine. The notice highlighted how measures aim to "promote the production and dissemination of scientifically accurate health knowledge while curbing the spread of false and misleading information". Under the new rules, internet platforms must verify medical licenses or employment certificates of content creators, who are required to be affiliated with medical institutions, schools or pharmaceutical research institutes. Existing social media accounts must verify their credentials within two months of notification, while newly registered accounts will be barred from posting health-related content until certified. Creators are also required to cite sources related to health education content and disclose whether AI-generated material or dramatizations of historical medical cases are included. Platforms must inform influencers that they are responsible for ensuring the scientific accuracy and authenticity of their content. In addition, all forms of advertisements — including contact information or purchase links — for medical services, pharmaceuticals, medical devices or health foods will be prohibited. The notice also calls for a crackdown on misconduct such as illegal online consultations, sexually suggestive content disguised as health education, fabricated narratives promoting products and the impersonation of licensed physicians. Local authorities have been instructed to guide platforms in improving oversight and to direct hospitals to monitor the conduct of medical workers while online, with penalties for violations. Market regulators will investigate illegal advertising activities. At a recent news conference, Hu Qiangqiang, a spokesman for the National Health Commission, said common violations by doctors who are also influencers include directing followers to offline services, offering illegal online consultations, selling products via livestreams and prescribing overpriced medications. Patients must first undergo offline diagnosis and receive a clear medical assessment before pursuing follow-ups through qualified online hospitals," Hu said, urging the public to remain cautious. Among China's 1.07 billion internet audio and video users, 92 percent have viewed health education content on short-video platforms, and 63 percent consume it regularly, according to a report analyzing 150,000 health science videos posted by 14,700 social media accounts between 2023 and 2024. Produced by researchers from Fudan University and Tianjin Normal University, the report found that surgery is the most frequently featured medical specialty online. Respiratory diseases — particularly lung nodules and lung cancer — as well as thyroid and breast nodules, tend to draw high traffic. While some doctors have employed entertaining approaches to engage audiences, the report warns of rising homogeneity and content that stokes fear about certain diseases. It also highlights growing concerns about AI-generated medical content, citing risks to patient privacy and public trust. Wang Fan, a professor at the Fudan Development Institute and a co-author of the report, said online health science communication has reached a stage where regulatory intervention is needed to curb malpractice and ensure sustainable development. licensed physiciansn.

China has released its first national standards aimed at regulating school meal providers, part of a broader effort to improve food safety for the country's more than 230 million schoolchildren following a series of incidents that have sparkedpublic concern. The "Guidelines for the Management of School Meal Service Providers", issuedby the State Administration for Market Regulation, will take effect on Dec 1 and apply to companies that prepare and deliver meals to primary and secondary schools as well as kindergartens. The guidelines are designed to address food safety risks across the entire supplychain, from menu planning and ingredient procurement to food preparation, delivery and emergency response, officials said. School meal provision involves wide coverage and multiple steps and has become a key area of supervision," said Qu Hao, an official with the administration,in an interview with China Central Television. "The guidelines offer clear, standardized instructions for schools and meal providers to follow." The new rules require providers to appoint food safety directors and dedicated inspection staff, conduct daily safety checks and analyze risks monthly. Staple ingredients such as rice, flour and cooking oil must be purchased from designatedsuppliers, and all batches of ingredients must undergo testing, including checks for pesticide residue. Food preparation processes will be monitored through "smart kitchen" systems that allow parents and schools to view operations in real time, while samples from each meal must be retained for at least 48 hours for safety checks. Delivery vehicles must be sealed, registered with authorities and equipped with GPS tracking. If food safety issues are detected, providers must immediately initiate recall procedures and report incidents to local regulators. The guidelines come as Chinese authorities move to strengthen oversight of school meals following recent incidents. In one case, more than 200 children at a kindergarten in Tianshui, Gansu province, were found to have elevated blood lead levels after kitchen staff used diluted industrial pigments in meals. Six people have been arrested and an investigation is ongoing. The Ministry of Education has urged local education departments to use the summer break to conduct safety inspections and train school administrators and canteen staff in food safety management before the new semester begins. Authorities are also encouraging schools to offer affordable day care services during the summer using public facilities while reminding parents to remain vigilant when choosing summer camps and after-school programs to protect children'swell-being. The ministry has stressed that schools are not allowed to conduct classes duringthe summer vacation, delay the break or start the fall semester early, and should limit homework assigned over the summer. China's efforts to tighten oversight of school meal services aim to ensure "safety on the tip of the tongue" for millions of students, regulators said, as the government works to address public concerns over food safety and child welfare. school meal providersn.

Lina Khan recently concluded her term as one of the Biden administration's most controversial leaders. Her tenure as chair of the Federal Trade Commission raised the profile of the relatively obscure antitrust agency charged with protecting competition. Her anti-monopoly outlook and more aggressive enforcement strategies, particularly toward Big Tech market power and protecting workers, earned the ire of the business community and the dedicated vitriol of the Wall Street Journal editorial board.Khan began her term as the youngest-ever appointee of the FTC. She initially rose to prominence for her 2017 Yale Law Journal article, “Amazon's Antitrust Paradox,” which went viral among the antitrust community for its argument that scholars and regulators must look beyond prices to understand what constitutes a harm from a lack of competition, especially in today's digital economy where many services are nominally provided for free to consumers. Fresh out of law school, Khan appeared on a Capitalisn't episode in our first season and wrote for our sister publication at the Stigler Center, ProMarket, as far back as 2018. She also delivered two keynote addresses at the Stigler Center's annual Antitrust and Competition Conferences while FTC chair. On this episode, Khan returns to Capitalisn't to reflect on her tenure, her vision of capitalism, and how her approach to enforcing existing laws with new thinking may have impacted the everyday lives of Americans. How does she respond to her critics, who include major Democratic business leaders? How does she view the new Trump administration, which is continuing many of her transformative policies, including revised merger guidelines and major lawsuits? As a senator, Vice President JD Vance said she was “one of the few people in the Biden administration actually doing a pretty good job.” Reflecting on her work, Khan also touches upon how conflicts of interest among corporate lawyers and consultants, former bureaucrats, and academics distort policymaking, court rulings, and market outcomes. Finally, she highlights the antitrust issues to pay attention to moving forward, such as algorithmic collusion.Show Notes: Also, check out ProMarket's series on the future of the Neo-Brandesian movement, of which Lina Khan is an emblematic figure.

China fired off a sweeping package of robust countermeasures on Friday—including a 34 percent tariff hike and rare earth export controls—in response to the latest round of sweeping tariffs adopted by the administration of United States President Donald Trump. More forceful and precise counterstrikes are still in Beijing's pocket if Washington persists with its unilateral trade bullying, several sources confirmed to China Daily. As approved by the State Council, the country's Cabinet, China will impose an additional 34 percent tariff on all US-origin imports starting on April 10. Simultaneously, the Ministry of Commerce and the General Administration of Customs announced immediate export restrictions on seven key medium to heavy rare earth elements, as China Daily first reported on Thursday. These elements—samarium, gadolinium, terbium, dysprosium, lutetium, scandium and yttrium—are crucial elements for manufacturing key products used in semiconductor, defense, aerospace and green energy. Citing their dual-use nature in both military and civilian industries, a spokesman for the Commerce Ministry said: "Imposing export controls on them is a common international practice. As a responsible major country, China's decision to regulate these items reflects its consistent position of firmly safeguarding world peace and regional stability." Other measures include filing a lawsuit with the World Trade Organization over the US' "reciprocal tariffs", launching an industry competitiveness investigation and an anti-dumping investigation regarding imported medical CT tubes from the US and India, adding 16 US entities to the export control list and 11 US companies to the unreliable entity list, and canceling import qualifications for certain US companies. Tu Xinquan, dean of the China Institute for WTO Studies at the University of International Business and Economics in Beijing, said that such rapid, intensive and multi-pronged countermeasures are unprecedented in the world's history, proving that China will not sit back amid unilateral bullying tariffs. This isn't just tit-for-tat. These countermeasures, including both tariff and nontariff measures, aim to directly hit the weak spots of the US to make it feel the real pain," said Tu.“这不仅仅是针锋相对,这些包括关税和非关税措施的反制措施,都是要直击美国的薄弱环节,让其真正感受到痛点。” Bai Ming, a researcher at the Chinese Academy of International Trade and Economic Cooperation, said that China, as the world's second-largest economy, has taken the lead in resisting US trade protectionism. These countermeasures are not only to protect China's own interests, but also to safeguard the stable operation of the global trading system," he emphasized.“这些反制措施不仅是为了维护中国自身的利益,也是为了维护全球贸易体系的稳定运行。” The State Administration for Market Regulation, China's top market regulator, also announced on Friday night that it has launched an investigation into DuPont China, a subsidiary of the US company DuPont, for suspected monopolisticpractices in violation of China's Anti-Monopoly Law. All of the moves came after China, a major trading partner of the US, was hit with a 34 percent so-called reciprocal tariff by the Trump administration on Wednesday, in addition to a 20 percent tariff imposed earlier this year. Further counterstrikes could include tightening export controls on more critical raw materials vital for US high-tech manufacturing, new energy transformation and defense projects, and further escalating the blocking of key technologies used in extracting and processing strategic minerals, said two sources close to the matter, who asked for anonymity. China accounts for at least 85 percent of rare earth refining, 77 percent of cobalt refining, 82 percent of tungsten production, 80 percent of antimony processing capacity, and 90 percent of the world's synthetic graphite production. These are all critical materials for defense, new energy batteries, semiconductors and advanced manufacturing. Beyond nontariff measures, China could still adopt additional tariffs on certain US products, particularly agricultural goods. Having already imposed tariffs on key US farm products, China is weighing further increases, another source added. Chen Wenling, former chief economist at the China Center for International Economic Exchanges, said, "China could follow the cases of countries like Canada and levy tariffs on US products in a high range of 250 percent to 390 percent according to different situations." The latest tariff from the Trump administration is provoking a strong global reaction. International Monetary Fund Managing Director Kristalina Georgieva warned that the sweeping tariffs presented "a significant risk to the global outlook at a time of sluggish growth". Ngozi Okonjo-Iweala, director-general of the World Trade Organization, expressed deep concern on Thursday over the decline in global trade and the potential for an escalating tariff war sparked by US tariff measures. Iweala said in a statement that the US tariff measures will have "substantial implications for global trade and economic growth prospects". Michael Hart, president of the American Chamber of Commerce in China, has said that AmCham China is not in favor of widespread tariffs, and it advocates constructive dialogue and policy predictability to reduce volatility in trade relations. Quoting a report from the chamber that more than half of its member companies said they plan to increase investments in China this year, he said that ensuring that businesses can operate competitively and with greater certainty benefits both countries' economies and supports global economic stability. Oliver Zipse, board chairman of BMW, said: "Economic growth thrives through opening, not closing. The increase of protectionist behavior will not create winners, but will result in a situation where everyone is going to lose prosperity. At BMW, we strongly oppose tariffs or other trade barriers." unilateraladj.
