The Judicial Conduct Tribunal has reserved its decision in relation to complaints lodged by ten judges of the Western Cape High Court and the Cape Bar Council against Judge Mushtak Parker. Judge Parker is facing allegations of lying under oath and lying by deposing to an affidavit which stated that he was physically assaulted allegedly by the then Judge President John Hlophe - who has since been impeached. The tribunal earlier noted that Judge Parker has failed by participate in the tribunal and has offered no apology nor has he disputed the allegations levelled against him. A Clarecastle councillor insists there's "no apology to be given" for comments he made in relation to fellow councillors' alleged conflicts of interest. It follows a discussion at yesterday's meeting of Ennis representatives, which centred on funding given by councillors to community and voluntary organisations. A seemingly trivial matter snowballed into a war of words between councillors at this week's Ennis Municipal District meeting, after Councillor Tom O'Callaghan suggested several members present should have withdrawn from a previous meeting due to undeclared conflicts of interest. The comments were in relation to General Municipal Allocation funding which some councillors had given to organisations in which they are personally involved. Each of the seven councillors in the Ennis area has this year been granted €49,000 in GMA funding which can be given to local charities, sports clubs, festivals or other organisations of their choosing. Since 2014, almost €2.5 million has been doled out by Ennis's elected representatives. As per SIPO guidelines, all councillors must disclose all potential conflicts of interest and must withdraw from a meeting concerning the interest if it benefits them financially or otherwise. Former Mayor of Ennis Ann Norton, who manages the Clare Crusaders Children's Clinic in a voluntary capacity and has given GMA funding to the organisation in the past, took particular offence to the comments and demanded an apology from Councillor O'Callaghan. The Barefield Independent councillor says she "can't understand" why Councillor O'Callaghan felt the need to make the comments. Ennis Municipal District Senior Engineer Sean Lenihan confirmed at the meeting that Councillor Norton doesn't have an undeclared conflict of interest as she doesn't benefit financially from her role at Clare Crusaders. She received the support of Ennis Fine Gael Councillor Mary Howard who claimed that by Councillor O'Callaghan's logic, all local representatives have conflicts of interest due to their active roles in their communities. Councillor Howard says she feels that she and Councillor Norton have been unfairly "targetted" by their Clarecastle-based colleague. All local representatives nationwide are required to comply with the Code of Conduct for Councillors under the Local Government Act 2001. Councillor Tom O'Callaghan says his only goal in raising the issue of conflicts of interest was to ensure all councillors are in compliance with the law.

As we began to practice vulnerably sharing our hearts with each other, we found that we often ran into trouble when the listener would get defensive. So we started asking ourselves, what is it about the way I'm sharing my feelings that puts them on the defense?We found defensiveness shows up strongest for these reasons:Sometimes our "feelings" (read: emotions), are really disguised opinions, judgments or blame. For example, "I feel disrespected" is first of all, not an emotion at all, but a passive way of saying, "You disrespected me." Disrespecting someone is not as much as action as it is an intention of the heart. Of course someone would get defensive hearing that.Even when we managed to perfectly Connection Code our way through the vulnerable share and use one of the 8 core emotions, we as the listener had to train ourselves with the new belief that, "I can connect with their 'sad' and it doesn't mean I'm bad." Basically that my spouse can be hurt by me or be in emotional pain because of me and it doesn't actually mean that I've done something wrong. Necessarily paired with this is the belief that we began training ourselves to take on as the speaker, which is, "I can be sad and it doesn't mean they are bad." My pain does not equal the guilt of another.Finally, the heart of this episode. Because I'm feeling pain (read: sad, hurt, anger, fear, lonely, guilt or shame) that was triggered by my spouse, I'm going to share it with them, as I've learned holding it in breeds disconnection. However, I am not going to share this with them with the expectation/requirement that they apologize for causing me pain, nor am I going to expect/require they change their behavior.This is where it's easy to lose people. "What do you mean they don't need to apologize?" I'm not actually suggesting there isn't something to apologize for. What I'm suggesting is that our attempts at vulnerability turn into subtle attempts at control when we follow our emotions with the expectation or requirement that the listener admit their guilt by saying, "I was wrong, forgive me." Furthermore, to require that someone change their behavior in order for me to be okay (read: not sad anymore, not alone anymore, not fearful anymore), is classically called co-dependence. The good news is that hearing our spouse show up in true vulnerability inspires us to action. True vulnerability is the expression of our emotions that invites another to simply be with us in it. It's the act of getting known, not making demands. That place is one where we invite others to show up as the best version of themselves. It's from that place that the heart of our spouse gets to become their most authentic, creative, curious, compassionate and intentional selves. Quite the opposite when they are on the defensive. Are you the kind of person who is always apologizing for every little thing, even just for taking up space? The truth is that apologizing is typically not the most effective way to communicate with others and can actually cause you to be out of alignment with your own values. Today, co-hosts Ben and Paige talk about the concept of forgiveness, how to properly apologize when it is warranted, and how to stop apologizing when it is not necessary. Every interaction you have with another person teaches them something about who you are. By always apologizing for things like simply taking up space, you are teaching people that you are a burden to be around. Most apologies are not genuine or made with intention, but instead are about overcoming guilt or shame. Instead of being a person who feels guilty simply for being yourself, try to behave as a person who is comfortable taking up space in the world. The most effective apology is the one you make to yourself. If you do something that you later realize was not in alignment with how you want to show up in the world, then go ahead and apologize! But that apology is for your benefit, not the benefit of others.
