Mark Lundy has divided our workplace out there. Some of my colleagues think that it's really gross that the Herald, who we work with, have taken photos of Mark Lundy today after he got out of jail yesterday. Now, the photos aren't anything particularly special - he's sitting in the passenger seat of a car, all you can really see is his face, that funny little beard he's got, some sunglasses and his latte coloured hoodie. It tells you nothing and it shows you almost nothing. And I suspect the reason it shows you almost nothing is because there are very heavy suppression orders about where he lives at the moment. So anything that identifies the town outside of the car, I would imagine, cannot be published. So they're a little bit limited in what they can show you. But even though there's almost nothing to see in these photos, boy, are we clicking on this particular story. It was, when I last checked, the most read and most viewed story on the Herald - so people are interested. And shouldn't the media be reporting and taking photos of things that we're interested in? I would say yes. Now, I can understand why people are grossed out by this. I suspect a lot of that comes down to the fact that there is significant doubt amongst some people as to Lundy's guilt - just as there was doubt with David Bain, just as there was doubt with Scott Watson. And so the feeling is, if you think he hasn't done it, then you feel gross about the fact that he keeps on being harassed after serving his time. But remember, until he proves otherwise, he is a man who was convicted of murdering his wife and daughter, and his trial and his behaviour around that gripped the nation and frankly turned him into one of the most famous - or infamous - people in the country. So he is a legitimate news story And it's not really a question of whether the Herald should have taken those photos, it's actually just a question of where you were going to see that photo first. Because you were going to see it somewhere. If it wasn't on the Herald, it would be on some other news outlet, or just someone popping down to the local coffee shop, seeing Mark Lundy there, taking a photo of him, and putting it on social media. Big old day for the survivors of abuse in state care today because the government through the Prime Minister finally apologised for this. That is important. I know you know what they want is redress as well, a whole bunch of them, and fair enough... that will come. But, an apology also is very important. Especially when you consider how long it has officially not been a big deal that kids went through what they did while they were in the state of care - for it to now be acknowledged as, “yep, absolutely, actually a big deal” and for the state to admit it did wrong. I think that's really important Slightly unfortunately, the day has been overshadowed by anger directed at the Solicitor General. I think this is going to be the thing that everybody remembers about today. Una Jagose tried to apologise herself today as the solicitor general, she was booed by survivors. She was heckled by survivors. One woman walked out another, turned her back to the Solicitor General while she was talking in a move of protest. The reason they're so angry is because they want to strip her from her job. They accuse her of covering up what really happened to them. Now, I'm not going to tell these people that they're not entitled to feel angry because of course they are. But, what we have to remember when we're discussing the Solicitor General's role in this and even in a lower role previously as a Crown lawyer before she became the Solicitor General, is that Crown lawyers, Crown law, the Solicitor General, they are the Government's lawyers, right? They act in the best interests of the Crown. And it's pretty much the same as David Bain's lawyer or even Brenton Tarrant's lawyer or should you or I be accused of something significant, our lawyers - that our lawyers are not there to look after everybody else. They are there to look after us. They're working in the best interests of their clients. And the same is true of Crown law. It's really important context when we feel angry at somebody like the Solicitor General or Crown law for what they did. I understand why Una Jagose is copping it the worst today. It's much easier to pin the blame on one person, isn't it? Than to pin the blame on a giant system like Government. And especially when you consider that governments change every few years - one person is much easier to hold accountable than potentially thousands of people for little bits that they did over decades. Maybe it will make a lot of people feel a lot better if she loses her job. But remember this, it's not actually going to fix anything. Not in the past. And not for kids who are in state care in the future. Beware the quick solution, because the quick solution may create a false sense that things have been fixed when they really haven't. The most important thing is that things are actually fixed. Isn't it more important than anything she actually fronted up today? And so did the Prime Minister and I say that's got to be a good start. What I would like out of the Philip Polkinghorne trial is access to the jury. This country has an archaic and sheltered view of certain aspects of justice. If you believe justice has to be seen to be done, it behoves us to fully understand the process. I have had virtually no interest in the trial. I have no real overarching interest in crime generally. I got fascinated by the David Bain business, but Polkinghorne has passed me by. He either did it or he didn't. The jury is working that out as we speak. I have noticed a change this time and it confirms that my lack of interest in matters makes me part of a very, very small minority. It's the blogging that has gone on from court from the digital media. A criticism I have always had about media coverage of court is mainly they are cherry pickers and mainly formats, particularly in news bulletins, never gives fair insight into the day's proceedings. This time it has been no different. TV seems to have come and gone. On a slow day it's covered, on a busy one it's not. Having been in court enough times over the years, the tricky part is how slowly it all moves and therefore it is easy for media to miss a lot of detail, not to mention subtlety and nuance. If you can't cover it properly, don't. The digital operators have been able to give you all the blow-by-blow detail you could ever want and from my inquires, it has been absorbed vociferously by most of the population. But back to the jury. In America you get to talk to them. Why not here? Surely in a trial of this detail and interest, knowing what they thought or didn't think and what they made out as critical or of no consequence is not only fascinating, but vital to understanding as to how we got to where we are about to get. Seeing open justice work and getting the detail from those closest to it is good. Surely you can't argue that wouldn't improve the process, therefore our understanding? 30 years ago, five members of the Bain family in Dunedin were found dead in their family home. The one surviving family member, David, was later convicted of murdering his parents and three siblings. He served 13 years in prison before the Privy Council quashed his convictions, and he was subsequently found not guilty on all charges at a retrial in 2009. Despite this, for three decades, this case has joined a gallery of notorious murders that have fascinated New Zealanders across the years. To mark the 30 year anniversary of the mass killing A Moment In Crime presents The House of Bain, a two-part telling of the case. On June 20 1994 Margaret and Robin Bain, their teenage daughters Arawa and Laniet and son Stephen were all shot dead in the family home at 65 Every Street, Dunedin. Just after 7am David Bain - Margaret and Robin's oldest child - called emergency services to report the ghastly scene. He said he had come home from his morning paper run and found them all dead. Days later Bain was charged with five counts of murder and after a high-profile trial a jury found him guilty. He maintained his innocence and fought for decades for a retrial, which finally went ahead in 2007. A second jury acquitted Bain, finding him not guilty of the five murders. The case is arguably New Zealand's most talked about massacre and over the years has become morbidly iconic. In the second part of House of Bain, you will hear more from Bain in his own words on his legal battle. The lawyer who represented him most recently also speaks about the case and its aftermath. Today's guest is a highly decorated police officer - and although Ross Pinkham retired from the force eleven years ago, he was one of the most experienced and high-profile provincial detectives. A massive 42 years dedicated to New Zealand Police - which included David Bain's retrial, NZ police investigator during the Bali Bombings, and arresting one of the country's most wanted criminals and prison escapee Bryan Curtis in the Philippines in 2002 (that's a yarn right out of the movies). Although retired from police work - he's an advisor and the water truck driver at Rhythm and Vines - the festival his son Hamish runs. A big one for New Zealand... Andi takes Ayla on a two part-er. The Bain family consisted of two parents, Robin and Margaret, and four children, Arawa, Laniet, Stephen and David. David had just arrived home from his early morning paper run to find the bodies of his five family members who had been shot using a .22 rifle and silencer. A note was left on the computer saying that David was the only person who deserved to live. David was convicted of the murders of his family and released on bail 12 years later due to a retrial of justice and was compensated $925,000. There are two theories – David was the killer, or it was the father, Robin. We cover some of the evidence... At the time, Robin and Margaret were separated with Robin staying in a caravan on the family property. A third party, a psychologist, had seen Robin and noticed he was not in a good mental state. There were blood-stained clothes in the washing machine which police hung out to dry. David's bloody fingerprints were found on the gun, although this was later found to be animal blood. Bloody sock prints were also found around the house, although there was some confusion around if they belonged to David or Robin. The computer was originally thought to have been switched on at 6.44am, just after David had supposedly arrived home, although there was no valid confirmation for this. There was hearsay evidence that Laniet had accused Robin of having a sexual relationship with her. David heard Laniet gurgling as she lay dying. A glasses lens was found in Stephen's room with the frame found in David's, although they belonged to Margaret. David Bain spent 13 years in prison after being found guilty of killing his family in 1994 – however he always maintained his innocence and he was acquitted in a retrial in 2009.

Finding our life's work can seem a daunting task. In this episode of Hope Helps, Charly Burridge-Jones and her guests explore tips that can help guide us on our own journey to find direction. Charly begins by expressing how individual our journeys can be and how important it is to approach the work we do positively. Her first guests are Hannah and David Bain. Hannah works as an acupuncturist who, from an early age, was surrounded by alternative health practices. She emphasises the importance of finding your spark and following the passions that ignite it. On the episode, I talk to David Bain, a long time and very prolific podcaster, the one I remember most being Digital Marketing Radio. David is also the author of Marketing Now (available very soon on Amazon!), which is a book which had it's genesis in a podcast. David is in good company with this type of repurposing, one of the biggest examples being Tim Ferriss and the Tools of Titans book. Tim created that book based on the hundreds of hours of content he's produced as part of his interview-based podcast. David Bain with Jason Barnard at Digital Elite Day 2019 David Bain talks with Jason Barnard (The Brand SERP Guy) about the 5 steps of podcasting. We kick off with a singing duet. David Bain then suggests that I am not so good at preliminaries. We then quickly get onto the five steps. Step 1 is prerecorded audio – make sure that is really good or you will hit problems later on. He gives some great tips on recording sound and getting the audio to sound great. I go off topic by jamming ‘All about the Bass', then we get sidetracked by iPhone theft and motorbikes falling on us before getting back on track (which is a very appropriate turn of phrase). Step 2 is live audio and David Bain gives practical tips about how to prepare, editing and what is annoying for listeners tuts, for example. Step 3 is using as-live video. He gives super tips and tricks, and we have fun describing what we are doing for people who are just listening to the audio and cannot see what we are doing. Step 4 is live video – by this time, you can really concentrate on getting the live-chatting part right since you will have mastered the audio and getting the video right. He talks about platforms he uses – Vmix, Google Hangouts, LinkedIn, Periscope, Facebook, Blab.im. Step 5 is a live event such as David's rather ambitious 120-guest 5-day live digital marketing marathon on Facebook. We end up agreeing with Mark Askwith that Digital Marketing is just marketing now. In 2012 Canadian judge Justice Binnie said David Bain was innocent on the balance of probabilities. Why? Hear what Binnie says and what Martin van Beynen makes of his arguments. And why does Binnie compare van Beynen to Inspector Javert, a fictitious fanatical police inspector?
The shootings appalled the country and deeply shocked the community and wider Bain family. Yet sole survivor David Bain's unusual reaction surprised many. Loyalties were tested. Suspicions were raised. And then an arrest is made.
Although police initially regarded the shootings as a murder/suicide, evidence began to mount against David Bain. His fingerprints were on the rifle, he had blood on his T-shirt, a lens from glasses in his bedroom were found in his dead brother's room and he had injuries that were consistent with a fight.
Despite giving evidence in court only once, David Bain has said a lot about the shootings in various contexts. He has steadfastly maintained his innocence but the details of his story have changed. How plausible is it?
