The history of abortion in the United States since 1970 has been marked by legal, political, and cultural shifts that have continually influenced the debate over reproductive rights. Here is a brief overview of the key events and turning points during this period: Roe v. Wade (1973): This landmark Supreme Court decision ruled that a woman's right to have an abortion is protected by the Constitution under the right to privacy. It established a legal framework in which states could regulate abortion but could not ban it outright before fetal viability (approximately 24 weeks of pregnancy). Roe v. Wade significantly expanded access to abortion throughout the United States. Planned Parenthood v. Casey (1992): This Supreme Court decision upheld the essential holding of Roe v. Wade but allowed states to impose certain restrictions on abortion as long as they did not place an "undue burden" on a woman's ability to access the procedure. This led to the implementation of various restrictions by states, such as waiting periods, parental consent laws, and mandatory counseling. Partial-Birth Abortion Ban Act (2003): This federal law, signed by President George W. Bush, banned a specific late-term abortion procedure known as intact dilation and extraction. The law was challenged but ultimately upheld by the Supreme Court in the 2007 case, Gonzales v. Carhart. Affordable Care Act (2010): Also known as Obamacare, this law required most insurance plans to cover women's preventive health services, including contraception, without co-pays or deductibles. However, it also allowed states to restrict or prohibit insurance coverage for abortion services. Whole Woman's Health v. Hellerstedt (2016): This Supreme Court decision struck down two Texas laws that imposed strict regulations on abortion providers, such as requiring doctors performing abortions to have admitting privileges at nearby hospitals and requiring clinics to meet surgical-center standards. The Court ruled that these restrictions placed an undue burden on women seeking abortions and were thus unconstitutional. Heartbeat Bills (2018-2021): In this period, several states passed so-called "heartbeat bills," which banned abortions once a fetal heartbeat could be detected, as early as six weeks into pregnancy. Many of these laws were challenged in court, leading to injunctions and legal battles that continue today. Texas Senate Bill 8 (2021): This law bans abortions after approximately six weeks of pregnancy and allows private citizens to sue anyone who aids, abets, or performs an abortion in violation of the law. The Supreme Court declined to block the law in September 2021, leading to concerns about its potential implications for Roe v. Wade and other state-level abortion restrictions. In today's episode, as much as I would like to move to a different subject, it's hard to not get sucked into the continued imbroglio surrounding Roe v. Wade. Initially, a few days ago, I approached the news cycle solely as it related to the leak. This is still the most important element and I am hoping they find the perpetrator and throw the book at him or her. The following show, I wondered if the leak was designed to help Democrats with the upcoming midterms. While I am sure the leaker and other extremists believe it will, it doesn't seem likely, especially this far out from November. Today, I decided to tackle what would repealing Roe v. Wade really mean for our country? Did you know, that of all the nations of the world, the United States is only 1 of 7 that allows abortion (in some states) past 20 months? With Roe in place, it paints the entirety of the US as a pariah to the world with such barbaric practices. The former Director of Planned Parenthood, Abby Johnson, weighed into the discussion and believes in a truly democratic-republic, this issue should have always been a state-by-state issue. She realizes the leaker is bent on creating turmoil and trying to threaten justices to change their minds. In other words, instead of allowing the third branch of government to carry out its Constitutional duty, unmolested by politics, they have now been highly politicized in an effort for the Left to exert it's will. As a pro-life realist (I do think there is room for some reasonable abortion laws), I have not been happy about the invention of a “right” to terminate the life of an unborn child. And before anyone gets upset at me, I am just using the exact terminology used by President Biden and Whoopi Goldberg over the past few days. Overturning Roe v. Wade would remove some of the stigma that the US is ghastly and barbaric in it's abortion views, at least for a large portion of the country. Yes, there will still be states who will want to grant one up to birth or maybe even within a few days, as California seems to be headed. But, at least there will not be a one-size-fits-all approach to a country of over 330 million people. Getting rid of Roe also removes the pretzel-logic invention of a right that does not exist anywhere in the Constitution. That confusion has likely been at the heart of so much debate and consternation over the last five decades. Finally, when looking at an AP poll from 2021, 80% of Americans do not think abortion should happen anywhere in the 3rd trimester, or after 24 weeks. 65% of Americans think it should be illegal starting with the 2nd trimester, or at around 12 weeks. What we see is the vast majority feel this is something that should be decided within the 1st trimester, which is where many of the more “conservative” states have been trending and where the Heartbeat Bills derive. It's not perfect for all pro-life people, but nothing ever is. But, returning the discussion back to the people might be one of the most democratic things to have happened in a long time in our country. Last Thursday, the Heartbeat Bill passed the South Carolina Senate 40-13 and the House by a vote of 78-35. The passage follows Arkansas, North Dakota, Iowa, Kentucky, Mississippi, Georgia, Missouri, Louisiana, Tennessee, and Ohio in passing Heartbeat laws. Heartbeat Bills have now been introduced in 29 states. On today’s show, Mark shares a powerful floor speech from Rep. Melissa Oremus that will bring tears to your eyes. Also, Mark will reference a recent independent study that demonstrates how hearts and minds are being changed despite these laws not being enforced. Abortion advocates even make the case that these laws lead to women concluding that abortion is illegal. Rather than the HB Bill teaching ageism, as some wrongly believe (with no imperial evidence to back it up), it has changed hearts resulting in saved lives and we now have independent confirmation of that fact. Abortion has been decriminalized from conception to birth for decades before these HB Bills were passed. HB Bills don’t legalize any abortions. A law that limits evil (which all laws do) isn’t evil. The civil government is meant to be a restrainer of evil. Even abortion bans don’t zero out the behavior; they build fences around the evil and set criminal sanctions for the behavior. From the study: "Many women in Ohio were unsure whether abortion is illegal in the state (26.2%); a smaller subset (9.8%) believed it to be illegal. The prevalence of believing that abortion in Ohio is illegal increased during the study interval, which corresponded to the interval marked by legislative and judicial activity surrounding the six-week ban in Ohio." HB Bills teach that abortion is illegal to a good percentage of the female population, which inevitably leads to saved lives. This is good news! “The Abortion Divide” PBS Documentary Review | The Mark Harrington Show | 4-25-19 To watch the documentary, go here: https://to.pbs.org/2G8JI45 In 1983, a decade after the Roe v. Wade decision, FRONTLINE went inside an abortion clinic on the outskirts of Chester, Pennsylvania and filmed Abortion Clinic.  Almost four decades later, FRONTLINE returned to Pennsylvania to film FRONTLINE’s latest documentary, The Abortion Divide, which aired on April 23rd.   Here are my takeaways from the film: Transition to medical abortions: The key difference explored in the film is the availability of a non-surgical method of killing babies:  RU-486, often called “the abortion pill.” In the film two women — Taryn and Megan — begin the process of a chemical abortion. They take one pill in the clinic and will take another at home. Of course, unlike in the movie unPlanned, the film doesn’t show what happened when the cramping and bleeding began! Abortion reality: The film shows the aftermath of a 6-week surgical abortion in the pathology room but covers over the flask containing an aborted baby killed in the procedure room. Oddly, the film tries to have it both ways by showing abortion but not really showing abortion since 6 features of week aborted babies are generally not recognizable due to be torn up through high powered suction catheter. Abortion pill lies: The complications and process of medical abortions are minimized in the documentary. One of the abortionists, Dr. Rebecca Mercier, says, “A medical abortion procedure is very similar to inducing a miscarriage. It is safe for women to do up to ten weeks of their pregnancy.” However, Dr. Anthony Levatino, a former abortionist, begs to differ. In a Live Action video, Dr. Levatino discusses the failure rates, risks, and adverse effects (i.e. abdominal pain, vomiting, heavy bleeding, and maternal death) from medical abortions. Utrasounds matter: Despite some criticism of the Heartbeat Bills and other legislation requiring an ultrasound before an abortion, the film demonstrates how requiring an ultrasound affects the decision to abort. Pill reversals work: Monique Ruberu, an obstetrician-gynecologist who opposes abortion and counsels outside the abortion center, tells women who are exiting, “If you took the abortion pill, we can reverse it.” Restrictions on abortion facilities close clinics: Laws that require abortion facilities to meet the same requirements as ambulatory surgical centers closed eight abortion facilities in Pennsylvania. Authentic sidewalk advocates: Counselors are depicted as thoughtful, law abiding, and sacrificial. One such counselor, Geoarge Asajiw, M.D., is shown taking at-risk families into his home. Pregnancy Resource Centers and homes for pregnant mothers are shown in a favorable light. Pro-lifers are vigilant: Now, with an abortion process that can begin by swallowing a pill, the film shows pro-lifers becoming more vigilant. Dr. Ruberu says, “The RU-486 pill has completely changed the landscape of abortion, and it really necessitates that somebody is present outside of these abortion centers every single day, every hour that they’re open,” she says. Finally, one of the most disturbing parts of the film is when Taryn, a mother of two who became pregnant with twins, says: “What I hope I feel is a sense of peace, not only with myself and the decision that I’ve made, but also a sense of peace with these two beings that I’ve chosen not to bring into the world.  Thank you for choosing me. And I’m honored to be given this gift of life. I can’t do it right now. I can’t accept that mantle in terms of the other lives that I’m taking care of and I’m responsible for.” One thing is clear in the film, there is not getting away from the fact that abortion is sad and tragic despite the attempts of some abortion advocates to destigmatize it.
