Está nas mãos dos senadores a análise de uma série de medidas antiambientais que a bancada ruralista acaba de aprovar, a toque de caixa, na Câmara dos Deputados. Os projetos de lei visam enfraquecer os mecanismos de controle do desmatamento, amputam em 40% a área protegida de uma floresta na Amazônia e até transferem para o Ministério da Agricultura e Pecuária o poder de designar quais são os animais com risco de extinção no Brasil. O novo “pacote da destruição”, denunciado por entidades ambientalistas, começou a ser apresentado no chamado “Dia do Agro” na Casa, em 19 de maio. Com apoio do presidente da Câmara, Hugo Motta (Republicanos-PB), sem debate público nem aprofundamento técnico sobre as propostas, as votações ocorreram em ritmo acelerado, sem que houvesse margem de manobra para obstrução. A coordenadora de Políticas Públicas do Observatório do Clima, Suely Araújo, vê um governo de mãos amarradas diante da bancada ruralista. “O Congresso tem se mostrado uma arena muito complexa, e o executivo, que não tem mais o controle do Orçamento, principalmente, não tem armas para fazer impor a sua vontade. É muito preocupante o que está acontecendo”, afirma. O ministro do Meio Ambiente e Mudança do Clima, João Paulo Capobianco, advertiu que a ofensiva representa “um esforço concentrado dos Deputados para aprovar projetos que interferem diretamente na gestão ambiental do país”. “É um movimento extremamente grave, porque opera em várias frentes simultâneas, com poder de impacto sobre a gestão ambiental no Brasil, de proporções nunca vistas”, disse ele, em coletiva de imprensa na semana passada. “É uma ação coordenada: diferentes projetos que atacam diferentes áreas e competências e, portanto, é um retrocesso inimaginável. São projetos que vão exigir um trabalho grande do governo federal nas próximas semanas.” Proteção de áreas não-florestais Quatro textos são particularmente preocupantes: o PL 2.564/2025, que altera a Lei de Crimes Ambientais; o PL 5.900/2025, que amplia os poderes do Ministério da Agricultura na agenda ambiental; o PL 2.486/2026, ao diminuir os limites da Floresta Nacional do Jamanxim, uma das mais ameaçadas do Pará; e o PL 364/2019, destinado a reduzir o escopo da Lei de Proteção da Vegetação Nativa. Este último impacta zonas preservadas em todos os seis biomas brasileiros, adverte Suely Araújo. “Tudo o que não for floresta tecnicamente passa a ser considerado área consolidada. Isso significa que não vai ter qualquer proteção ambiental, e ninguém está nem falando. Você vai estar atingindo grande parte do cerrado, da caatinga, do pantanal”, lamenta a ex-presidente do Ibama. “Isso dá mais ou menos 48 milhões de hectares, uma boa parte do território brasileiro.” A aceleração da tramitação das pautas ocorre a cinco meses das eleições no Brasil, em um contexto de incerteza quanto ao futuro das políticas de proteção do meio ambiente no país. Organizações de proteção do meio ambiente já se preparam para uma nova derrota do governo no Senado e esperam que, na sequência, o presidente Luiz Inácio Lula da Silva vete o pacote. Entretanto, neste caso, é esperado que o Congresso barre os vetos, como ocorreu com a Lei Geral do Licenciamento Ambiental, em 2025. “A partir da aprovação no Congresso, vêm os vetos, depois o Congresso derruba tudo. Nós temos apoiado ações judiciais, principalmente movidas por partidos políticos, diretamente no Supremo Tribunal Federal e outras ações também na Justiça Federal de primeiro grau, o que não é uma boa saída”, indica Araújo. “A ação judicial deveria ser a última alternativa, mas elas têm se tornado cada vez mais frequentes.” Prejuízos para o próprio agronegócio Os projetos de lei enfraquecem o arcabouço brasileiro de combate às ilegalidades ambientais num momento em que as exigências para a compra de commodities brasileiras aumentam na Europa, um dos principais parceiros comerciais do Brasil. A aprovação do pacote pode acabar acarretando prejuízos para as exportações do agronegócio, frisou o ministro Capobianco. “Isso tem relação direta com a própria credibilidade do setor frente a contextos muito desafiadores, como as diretivas da União Europeia, que exigem a comprovação de não desmatamento nas exportações de um conjunto importante de produtos brasileiros. A sociedade internacional vem cobrando”, enfatizou. “Nós estamos fragilizando um sistema de controle ambiental que não vai beneficiar o conjunto do agro. Vai beneficiar uma parcela reduzida que segue desconsiderando a legislação.”
