IS IT AN 8TH AMENDMENT VIOLATION TO BAN SLEEPING ON THE STREETS? That is the question that was just heard by the US Supreme Court in a case called City of Grants Pass, Oregon v. Johnson. The city of Grants Pass in Oregon banned sleeping on the streets with so much as a blanket in an effort to get homeless people to move along. The people sued, and the 9th Circuit agreed with them. Grants Pass has appealed, and now the Supremes will make a huge ruling that will hopefully clarify what the responsibilities of cities trying to get homelessness under control can and can't do. This case is EXTREMELY important and I've got Mark Miller, Senior Attorney from the Pacific Legal Foundation on to discuss it at 1.

Slam the Gavel welcomes back Patriot Parents to discuss their update to their case. They were last on the podcast October 25th, 2022 Season 3, Episode 140. They discussed the march against CPS corruption. Patriot Mom discussed the retaliation they both have endured after filing a Mass Tort Federal Lawsuit on the County, but went into default, as well as discussing how the Governor terminated the Commissioner. There have been 3 false allegations placed on Patriot Dad. We discussed the fear tactics used in Texas against Patriot Dad, as he was driving to the gym and police pulled him over as he was surrounded by 16 US Marshalls, taken to Jail. Patriot Dad asserted his 8th Amendment Rights as they kept him in Suicide Watch for 24 hours and had to beg for his phone call. Bond was set at $50,000.00 and was able to go home the next day. This is just is just a taste of Texas justice system. Patriot Mom and Dad explained that CPS is a 53 billion dollar a year business as they separate children from their parents as well as dividing spouses. Patriot Mom gave excellent advice, "be strong for your spouse undergoing false allegations and be strong for your children." Patriot Mom and Dad discussed the help they have received from the NLPA (National League Professional Association). HB 19 is very damming to the Veterans, discrimination noted to Veterans. Patriot Dad recommends that you do no "consent to waive your right to a SPEEDY trial, and if the attorney motions for an extension he is waiving your right." New trial date June 12th. There is a limitation when you can hold a "speedy" trial from the time of indictment to trial is 3 years. May be able to move to vacate the case on June 13th 2023, as it is unconstitutional. Guys, we made it a whole year! Today’s topics include a case that was just heard for oral arguments at SCOTUS about the constitutionality of a Delaware law requiring judges to be member of a particular party. The other is about a circuit split across the country involving sex change surgery and 8th Amendment cruel and unusual punishment.
After showing beyond a reasonable doubt that the 6th amendment is a myth which does not exist in reality, we move on toreviewing the primary tool used by prosecutors forcing the minorities and the poor to take plea deals at a 95% rate. The 8th amendment. Another constitutional protection and right that has become so perverted it no longer has any meaning. In this episode, Ms. Rosensweig discusses the landmark ruling in Martin v. Boise, a 9th Circuit Court of Appeals case which determined that it is an unconstitutional violation of one's 8th amendment right to be free from cruel and unusual punishment when a homeless person is charged with a crime for sleeping outside. Ms. Rosensweig will discuss the case itself, the cases that the 9th circuit relied upon in coming to its decision and what the real-life consequences are of such a decision on cities that are dealing with significant homelessness issues. Ms. Rosensweig will also explain the arguments that are made by the City of Boise in its recent petition to the Supreme Court to have it overrule the 9th Circuit Court's decision. Is arresting a homeless person for sleeping outside when they have nowhere to go reasonable or is it cruel and unusual? What if certain people are homeless by choice and do have somewhere to seek shelter? What about the health and safety concerns that arise when large amounts of people are sleeping outside? And, what about the residential neighborhoods and businesses that are affected? Ms. Rosensweig discusses these delicate issues and more in this episode.
In one of three bitterly-fought denials for rehearing en banc, the 9th Circuit let stand a ruling protecting homeless individuals from prosecution for sleeping in public spaces, when no shelter is available. But six dissenters called the decision 'badly misguided,' and another order 'absurd.' Professor Arthur Hellman visits first to discuss the use of 'dissentals' in this context, which one judge says is a lamentable 9th Circuit innovation that creates 'distorted presentations' of cases. Then, Public Counsel's Mark Rosenbaum discusses the legal and policy points of the public sleeping ruling, and its impact on LA's approach to its homelessness crisis.

A mock trial based upon Arkham Asylum: A Serious House on a Serious Earth featuring law students from Golden Gate University, California Western School of Law, and the University of Kentucky. Recorded live at San Diego Comic Fest on March 9, 2019. Overview of Facts: Harvey Dent had his silver dollar taken away as part of his treatment at Arkham Asylum. Psychotherapist Ruth Adams claimed Dent was being “cured” of his obsession with duality. Dent's treatment was replacing his coin with a six-sided die and then Tarot cards. Dr. Adams next stage of treatment was to introduce Dent to I-Ching. Dr. Adams believed Dent would have a completely functional judgment facility that did not result in black and white absolutes.Result of Treatment: Dent was unable to make basic decisions, such as when to go to the bathroom. The treatment left Dent hollow and sitting under a table the day the inmates took over asylum. The Lawsuit: Attorneys retained by the Wayne Foundation have brought 42 U.S.C.S. 1983 lawsuit against Arkham Asylum, the late Arkham Administrator Charles Cavendish, Dr. Ruth Adams, and DOES 1-50, claiming that Harvey Dent's treatment violated the 8th and 14th Amendments. Dent's attorneys have claimed Dr. Cavendish and Dr. Adams demonstrated a “deliberate indifference to a prisoner's serious illness” and subjected Dent to "the unnecessary and wanton infliction of pain" by taking away his coin. Attorneys for the state have brought a summary judgment motion on the grounds that Dent's coin was not taken away as a form of punishment, but a form of treatment.Attorneys retained by the Wayne Foundation on Dent's behalf have brought suit against Arkham Asylum, the late Arkham Administrator Charles Cavendish, Dr. Ruth Adams, and DOES 1-50, claiming that Dent's treatment violated the 8th Amendment prohibition against cruel and unusual punishment. The Defendants have argued that Dent's coin was not taken away as a form of punishment, but a form of treatment.Arguments by Parties The Plaintiffs are seeking a preliminary instruction against Arkham Asylum to cease any treatments on Harvey Dent that deprive him of his coin. The Plaintiff will argue that Arkham Asylum, the late Arkham Administrator Charles Cavendish, and Dr. Ruth Adams, were all deliberately indifferent to Harvey Dent's medical condition, that the treatment amounted to cruel and unusual punishment, and that a preliminary injunction is needed in order to prevent further cruelty to Harvey Dent. Earlier in the week, we took the temperature of the electorate and found a five point surge in support for Fine Gael, while yesterday's poll focused on Brexit. The poll showed greater support for a limited revision of abortion restrictions than their outright removal. But some pro-choice activists have criticised how the question was framed - Hugh puts their position to Pat. And there's time at the end to look at the other major finding: Taoiseach Leo Varadkar is the most popular party leader with an impressive 49% approval rating. Excessive bail shall not be required, nor excessive fines imposed... 8th Amendment In recent days, members of the California State Senate and Assembly have made the reformation of the Bail system a "Legislative Priority" in the State. Their reasoning is that on any given day, 63% of the people held in the States Jails have not been convicted of any crime. They are simply awaiting trial and cannot - for a variety of reasons - make bail. The Legislative argument goes that the main reason that people cannot make bail is twofold. First that bail levels are set far too high in the State. Second is that the Bail system discriminates against those who are "poor," in favor of those who have money. So the solution that at least two other States have elected to employ is to eliminate Bail requirements for some "low level" crimes. The history of Bail in The United States traces its origins to 1689 and the Glorious Revolution. And, with just a single word change since, has been a cornerstone of those rights which we have held dear, both as Englishmen and as Americans. So is Bail really discriminatory? Or is there a bigger problem? Or any problem at all? And why hasn't the Supreme Court addressed it? Today we look at Bail on Constitution Thursday.
