Johnny Perez worked hard throughout his 13 year prison sentence. He sewed sheets and facilitated classes, met demanding quotas and helped other men prepare for life on the outside. The highest wage he was ever paid was 34 cents an hour. Meanwhile, prison labor generated $14 billion last year.  So why do so many people like Johnny leave prison empty handed? In this Season Two finale, we're going back to 1865, to understand how a key exception written into the 13th Amendment paved the way for the modern prison industry. From convict leasing to prison plantations, exploited labor is part of the DNA of this country, and more than two-thirds of people behind bars in America labor throughout their incarceration. Their average day wage? Just 86 cents.  But: there's a growing movement to end the exception, and end slavery once and for all in this country.     Slam the Gavel welcomes Tanawah M. Downing to the podcast. Tanawah is a Chief Legal Strategist and Civil Rights Advocate. Being aware of people suffering and in need of help, Tanawah, after going through a divorce himself, recognized the need for laws to change. It has been eight years since he as seen or spoken to his children.   We talked about the deprivation of rights under the color of law of parents.  The 13th Amendment explains very much what is wrong with the law in that the terms "slavery" and "prisoner" is synonymous with each other.  Parents are deprived of their rights every day by not only CPS but Judges as well.      The We Shall Be Free Tour will begin once the case is docketed. However, the clerk of court at the U.S. Supreme Court is refusing to docket. This is obstruction of justice and a crime. The people in the U.S. need to hear the truth and understand that these are rights that are guaranteed and the moment you take a right from one, you take it from all and no longer a freedom. But only an illusion of freedom.     Tanawah explained how this will be handled. When people are silent, they give their consent. People must speak up and speak out. When government is silent that is an indication of guilt. Once the clerk steps aside, this will be handed to the justices, the tour will be started. There will be press conferences  and rallies in every state Capitol and the tour will circle the whole country. This is the opportunity for people to tell their story.  People need to speak out on the egregious acts that were done to them and this gives them the opportunity to be heard. To Reach Tanawah M. The 13th Amendment of the US Constitution makes an exception to the abolition of slavery in order to permit the use of "involuntary servitude" as punishment for a crime. The modern system of mass incarceration depends on this exception to justify paying millions of incarcerated people subminimum wages that many advocates say is virtually indistinguishable from forms of slavery. Various US states also have their own constitutional "exception clauses" that mirror the language of the 13th Amendment, providing an additional layer of legal justification for the exploitation of prisoners. We address the myths being perpetrated that in any way, shape, or form, that slavery was beneficial to black people, that there was such a creature as a good enslaver, or that slaves were happy and content with their oppressive conditions. It's a shame we even need to explain this in 2023 but who better than us right? As always, we'll share amazing music, poetry, and bring the voices of the abolitionist ancestors back to life for a new generation in our Bridging The gap Segment.

This week on Political Breakfast, a group of Democratic lawmakers including Georgia Congresswoman Nikema Williams are pushing a joint resolution to negate a clause in the 13th Amendment of the U.S. Constitution -- that permits the use of slavery and involuntary servitude as a punishment for a crime. Currently the 13th Amendment says, "Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction."Plus, court records released recently have caused questions to swirl about just how secure the Dominion Voting machines are here in Georgia. At issue is the software that has been deemed by cybersecurity experts as being "vulnerable." Georgia Secretary of State officials say any updates will have to wait until after the 2024 presidential election. EPISODE 128: COUNTDOWN WITH KEITH OLBERMANN A-Block (1:43) SPECIAL COMMENT: Before he begins tonight's State of the Union Address, President Biden should pull his aviators out of his pocket and slap them on, reach under the lectern and pull out a shredded Chinese balloon and drape it in front of himself, and reach under again and produce an AIM-9X Sidewinder Missile and rest it on his shoulder. It's ridiculous hyperbole of course. But how much MORE ridiculous than Bush's Flight Suit and Mission Accomplished speech? Democrats have no clue how stupid half the country (or more) really is, and how easily that half can be manipulated by stunts, theater, shiny objects, crotch bulges in flight suits, braggadocio, nonsense, outright lies, and other tactics Republicans mastered decades ago. How stupid are they? When Karine Jean-Pierre reminded reporters they'd been given "Tick Tocks" (journalistic jargon for minute-by-minute timelines), The Daily Caller and Fox News both jumped to the asinine conclusion that the secrets of the nation were being distributed on TIK-TOK. This is how dumb they are, and they are not getting less so. Bring a Sidewinder with you, Mr. President. B-Block (18:50) POSTSCRIPTS TO THE NEWS: Did a Federal Judge just notice a flaw in the SCOTUS overturn of Roe-V-Wade that might reinstate it? Samuel Alito's Mom's Abortion Clinic? And Flaco seems about to check back in to his old home. (21:48) THE WORST PERSONS IN THE WORLD: Elon Musk, joke plagiarist, fake news spreader, safety disaster; Confirmation that NewsMax wanted to raise its price to DirecTV from $0 to $13,000,000. And the Bill Maher numbers are in and - guess what - he did not make the slightest difference in CNN's implosion. C-Block (28:34) EVERY DOG HAS ITS DAY: Pandora, in Philadelphia (29:47) THINGS I PROMISED NOT TO TELL: It's basically the anniversary of the day the geniuses at MSNBC would've lost Maddow to CNN because Larry King offered her $250 and unbeknownst to me we weren't paying her anything.See omnystudio.com/listener for privacy information.

The American Civil War wasn't just a military conflict. There was also a major political and legal conflict struggle that took place alongside the military campaigns.  In the last months of the war, President Abraham Lincoln knew that if the war was to truly be the end of the conflict, it was necessary to ban slavery once and for all.  That would require changing the constitution. The first attempt in history to include anti-slavery, free-soil provisions into a national constitutional instrument was written by Thomas Jefferson. Most historians teach us about the slave-owning of Jefferson - which is important history, but they ignore this fact, and fact that his text of 1784 was copied almost verbatim as Section 1 of the 13th Amendment.
