Not On Record REWIND | Can a Judge Truly Be Impartial? Sponsored by EasyDNS Move your domain or web hosting to EasyDNS and support Not On Record: https://easydns.com/NotOnRecord Use promo code: notonrecord In this Not On Record REWIND, criminal defence lawyer Joseph Neuberger and Diana Davison dig into a fascinating Canadian court decision asking a deceptively simple question: can a judge ever truly be impartial? Using R. v. Fraser, 2023 NSSC 45, they examine a Crown appeal of an acquittal based on alleged judicial bias, reasonable apprehension of bias, judicial impartiality, recusal motions, and public confidence in the justice system. The discussion breaks down how Canadian courts assess whether a judge crossed the line, why proving actual bias is so difficult, and how courtroom case management can sometimes look alarming to outsiders while still falling short of legal bias. The episode also explores the difference between actual bias and reasonable apprehension of bias, the presumption of judicial impartiality, why appellate courts give deference to trial judges, and how courtroom demeanour, witness credibility, and live evidence can never be fully captured by a transcript alone. Joseph and Diana also widen the lens to discuss whether true impartiality is even possible, referencing Bertha Wilson, R. v. Lavallee, battered woman syndrome, judicial philosophy, and the tension between human experience and the duty to decide cases fairly. Along the way, they reflect on old-school courtroom culture, judicial civility, criminal harassment trials, wrongful conviction concerns, sexual assault and domestic violence prosecutions, and the importance of maintaining public confidence in the Canadian criminal justice system. This episode is essential viewing for anyone interested in Canadian law, criminal trials, judicial conduct, Crown appeals, recusal applications, courtroom fairness, wrongful convictions, legal ethics, and how judges actually make decisions.

In this episode of Commercial Construction Coffee Talk (CCCT), we sit down with Paul Lavallee, Global Market Manager for Arkema's Kynar® Coatings, to explore why PVDF-based coatings remain the gold standard for durability, performance and long-term sustainability in architectural and commercial construction.Paul shares insight into how Kynar® PVDF coatings protect buildings from UV exposure, harsh climates and environmental wear, while supporting sustainable urban development and iconic architectural design around the world.Paints formulated with Kynar 500® PVDF are recognized worldwide as some of the most durable architectural coatings available. This advanced fluoropolymer delivers exceptional resistance to sunlight, UV exposure and harsh environmental conditions, allowing buildings to maintain their appearance and performance for decades without noticeable paint degradation or the need for frequent maintenance or recoating.Manufactured exclusively by licensed producers of Kynar 500®, these coatings are factory-applied using spray or coil coating processes to protect metal substrates in high-performance architectural applications. They are trusted for use on skyscrapers, airports, hotels, shopping centers and landmark structures around the globe, including iconic projects such as the Empire State Building, Grande Arche de la Défense, and Singapore's Esplanade. In addition to factory-applied solutions, Arkema has developed complementary waterborne PVDF technologies for field application and restoration. Kynar Aquatec® PVDF emulsion, used in advanced cool roof coatings, has been recognized by the Solar Impulse Foundation as one of its “1,000 Solutions” for a more sustainable planet. These coatings can reduce exterior surface temperatures by as much as 32°C, significantly mitigating the urban heat island effect in densely populated cities.Enjoy the conversation.linkedin.com/in/paul-lavallee123456https://kynar500.arkema.com/https://kynaraquatec.arkema.com/en/Sharing some weblinks…CC&R Article: Why Smart Upfront Decisions Save Millions Over Building's Life Cycle - CCR-Mag.comSharing some weblinks for the Case Studies we discussed:Empire State Building | Arkema Kynar 500: https://kynar500.arkema.com/en/media/case-studies/empire-state-building/Plaza at Black Mountain | Arkema Kynaraquatec®: https://kynaraquatec.arkema.com/en/case-studies-1/cave-creek/Sanibel Island House | Arkema Kynaraquatec®: https://kynaraquatec.arkema.com/en/case-studies-1/sanibel-island-house/ Our specification languageSpecifying Kynar 500® by Arkema: https://kynar500.arkema.com/en/product-information/specifications/Specifying Kynar Aquatec® by Arkema: https://kynaraquatec.arkema.com/en/products/specifying-kynar-aquatec/

This week we shrank ourselves down to Dennis-Quaid-in-Inner-Space micro proportions to catch Spencer LaVallee and Graham Douglas, the co-founders of mega-successful micro creative agency Gus. Spencer and Graham lead a creative crew leaner than a wildebeest that got banished from its herd last Tuesday for repeatedly messing around. But size means little when you have big ideas, and the agency regularly rubs shoulders with the behemoths of the ad and marketing world when it comes to gongs and glory. From Gus being named Ad Age Small Agency of the Year, to their campaigns winning top honours at the likes of Cannes, Forbes and the New York Film Festival, Spencer and Graham are a testament that brains can beat brawn in this industry. Especially when those brains are inside the heads of a couple of fellas who've had such an interesting journey through it. This episode is dedicated to all the small but mighty creative agencies out there proving that size doesn't limit impact. ///// Follow GUS on LinkedIn Visit their website here. The episode features an enlightening conversation between the host and Sierra Lavallee, who has rapidly transformed from a freelancer into a dynamic entrepreneur over the past year. As the conversation unfolds, Sierra shares her experience of launching her agency in October 2023, reflecting on a chaotic yet exciting beginning. She was knowledgeable in social media but uncertain about her specific niche, so she initially juggled various clients and projects, as it allowed her to identify her ideal clients and refine her service offerings.Sierra discusses the turning point in her professional life when she sought mentorship from Megan in early 2024. Feeling overwhelmed and at risk of burnout, she recognized the need for structure and guidance as well as offering not just accountability, but also crucial insight into establishing a successful business. The conversation shifts to the work-life balance, emphasizing the necessity of self-care, which Sierra initially neglected due to her work ethic. Simple changes, such as taking walks, profoundly impacted her productivity and mindset, highlighting the intersection between personal well-being and business success.A pivotal breakthrough Sierra discusses is her realization of personal and professional values, which deeply influenced her decision-making process. By pinpointing values like family, friends, and financial security, she learned how to structure her business around what mattered most to her, leading to more fulfilling work life and personal satisfaction. Armed with this clarity, she embarked on hiring team members to delegate tasks, alleviating her overwhelming workload and fostering a collaborative environment conducive to growth. This step was not just a strategy but a transformation, as it cultivated efficiency and allowed Sierra to focus on her strategic role.If you believe this isn't possible for you, take a listen.HIGHLIGHTS:2:58 Starting the Business Journey7:28 Finding the Right Client8:58 Niche Discovery14:16 Balancing Work and Life18:32 The Power of Values21:49 Taking the Leap to Hire24:55 Shifting Business StrategiesFollow Megan Huber's Socials:LinkedIn | Instagram | Facebook | Book a Call | Consulting
